Paradise Way (Seven Eleven Ranch Subdivision) approximately 338 feet from its intersection with State Highway 6. b. Westward Ho (Seven Eleven Ranch Subdivision) approximately 1,493 feet from its intersection with State Highway 6. c. Greens Prairie Road approximately 9,018 feet west of State Highway 6. d. Arrington Road approximately 10,405 feet south of Greens Prairie Road. 42. The Replat of Lot 82 of Woodlake Subdivision, Section One, 15.22 acres. Site is located in Precinct 1. 43. To make arrangements, call (409) 361-4102. g ACIn C2 COMMISSIONERS' COURT REGULAR MEETING OCTOBER 26, 1999 t r A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, October 26, 1996, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. The attached sheet contains the names of the citizens and officials that were in attendance. Commissioner Thornton gave the invocation and led the pledge of allegiance. The Court heard a presentation by Don Gray, the County's consultant on Health Insurance. Mr. Gray made the following recommendations: *Stop-Loss Insurance Sun Life*(Plumhoff) *Third Party Administrators Employee Benefit Services *Provider Networks Alliance The Court next considered Budget Amendment #98/99-42.1 which would reallocate funds for the County Records Management Fund. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered Budget Amendment #99/00-3.1 through 3.6, which would transfer funds to Personnel from Commissioners Office, and reallocated funds for Sheriff's Office (2), Risk Management, County Attorney and Capital Improvement Fund. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. wo - r J • • Commissioners Court meeting October 26, 1999 s , F I } 2 The Court next considered a request by the Sheriff's office to reclassify a receptionist /clerk position. In a memo to the Court it was stated that the responsibilities of the position had changed and that it had become more of a receptionist/clerk position. It was requested to reclassify the position from a Group 12 to a Group 9. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the reclassification of the position. The Court proceeded to consider the change of status of employees as submitted on the attached Personnel Action Requests. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the changes as submitted. The Court next considered authorizing the Auditor's office to process recurring payment requests for the following: a) Mike Hensarling for lease of property located at 14821 FM 2154 offices of Justice of the Peace and Constable, Precinct 2 $5,520 b) Bryan/College Station Chamber of Commerce for lease of property for the Metropolitan Planning Organization $6,284.88 c) Fred Keller for lease of property located at 8991 East Highway 21, East, Bryan Texas $750.00 for Justice of the Peace, Precinct 3. d) Brazos County Appraisal District, $50,318.75 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Auditor's office to process all the previously noted recurring payments. The Court next considered the following Claims as submitted by the County Treasurer for payment: 200000448 through 20000814 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. VOL. / FAQ. , 2301 r i Commissioners Court meeting October 26, 1999 3 The Court next considered RFP No. 99-042, Health Insurance for County Employees. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve Sun Life for Stop-Loss Insurance with 15/12 specific, "Paid" aggregate, $50,000 SIR and $50,000 corridor deductible. Commissioner Sims moved to approve Employee Benefit Services as Third Party Administrators and that Employee Benefit Services takeover the "repricing" duties that are now provided by Alliance and that Express Scripts continue to provide the RX plan and that administration of COBRA remain with the County. Commissioner Cauley seconded the motion. Commissioners Jones, Sims and Cauley voted "Aye". Commissioner Thornton voted "No". The motion carried. On motion by Commissioner Sims, seconded by Commissioner Cauley the Court voted unanimously to approve Alliance as the Provider Network and recommended the option in which College Station Medical Center is not in the network and in which Alliance is not the TPA. Commissioner Sims moved to approve Canada Life (Corp. Health Plans) for the Fully Insured Life coverage and leaving the Basic Life limit at $10,000. Commissioner Thornton seconded the motion. After some discussion, Commissioners Sims and Thornton withdrew their motion and second. Then, on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve Canada Life and recommended increasing the Basic Life limit from $10,000 to $20,000 and attempting to meet the minimum participation level for optional Employee and Dependent Life coverage. The next matter before the Court was adoption of an Order Amending the Annually Determined Contribution Rate Plan and making plan selections for the county retirement program. On motion by commissioner Sims, seconded by commissioner Cauley, the Court voted unanimously to adopt the Order for an increase in existing annuities under Sec. 844.209 at the rate of 3% plus the county shall make contributions to the System at the 01 11 t~.esrcil f 1 • 01 6 - Commissioners Court meeting October 26, 1999 4 total employer contribution rate of 10.98$. A copy of the Order is attached hereto. The next matter for consideration by the Court was a request submitted by the Judge of the 3615` District Court requesting approval for out of state travel for himself. Judge Smith would be traveling to New Orleans, Louisiana to attend a judicial education presentation by the American Institute of Certified Public Accountants October 27 through the 29, 1999. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to grant the request from Judge Smith and approved payment of out of state travel expense for him. The next matter for consideration by the Court was a request submitted by Michael A. Parks, Transportation Planning Director of the Bryan-College Station Metropolitan Planning organization approval for out of state travel for himself. Mr. Parks would be traveling to Wilmington, Delaware, to attend the Association of Metropolitan Planing Organization's 8`" Annual Conference the second week of November 1999. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to grant the request from Mr. Parks and approved payment of out of state travel expense for him. The Court next considered the selection of a firm for legal services to prepare a county redistricting plan. The County Judge told the Court. that he respected the firm of Allison, Bass & Associates but that the County had worked previously with the firm of Bickerstaff, Heath and Smiley. He then moved to select the firm of Bickerstaff, Heath and Smiley to prepare the county redistricting plan. Commissioner Sims, seconded motion. Commissioner Jones, Thornton and Sims and the County Judge voted "Aye". Commissioner Cauley abstained. The motion carried. Commissioner Sims asked that the services include writing boundary lines of election precincts. ti ~i Commissioners Court meeting October 26, 1999 S The next matter before the Court was the approval of Official Bond for Charles H. Ellis, Jr., Justice of the Peace, Precinct 2. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Official Bond for Charles H. Ellis, Jr. The court next considered the addition of one day to the 1999 County Holiday Schedule. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to add New Year's Eve (December 31, 1999) to the holiday schedule. On motion by the County Judge, seconded by Commissioner Thornton, the Court voted unanimously to table consideration of rescinding the outdoor burning ban. The current dryness index is 683 and the Emergency Coordinator could not recommend rescinding the order. The next matter for consideration was approval of the amended Application for Federal Assistance for participation in the SLA/50 Emergency Management Agency program by Brazos County Interjurisdictional Emergency Management. This is for additional personnel for the cities of Bryan and College Station. On motion by the County Judge, seconded by Commissioner Thornton, the Court voted unanimously to approve the amended Application. A copy of the Application is attached. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Family Practice Residency of the Brazos Valley. The Family Practice will provide good medical care for the County's poor and indigent. The County will reimburse the Family Practice for actual costs up to a maximum of Fifty-Five Thousand and No/100 I dollars ($55,000). The term of the contract will commence on the 1"t day of October, 1999 and terminating on the 30th day of September, 2000. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to enter j into contractual agreement with the Family Practice Presidency r i i Commissioners Court meeting October 26, 1999 6 of the Brazos Valley. A copy of the contractual agreement is attached hereto. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos County Rape Crisis Center, Inc. The Center will provide support services to the victims of sexual assault. The cost to Brazos County will be $13,000.00 annually. The term of the contract will commence on the 1" day of October, 1999 and terminate on the 30`n day of September, 2000. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to enter into contractual agreement with the Brazos County Rape Crisis Center, Inc. A copy of the contractual agreement is attached hereto. The Court next considered approving a GTE Service Agreement for the Juvenile Services Department telephone system. Cost for the Agreement will be $2,479.92 and will provide around the clock coverage. This is a twelve (12) • month contract commencing November 13, 1999. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve a GTE Service Agreement for the Juvenile Services Department telephone system. A copy of the Agreement is attached. , The Court next considered Tax Resale Deeds and authorization for the County Judge to execute the tax resale deeds for the following properties: a. Part of Block 17,-Original Town of Bryan, described by metes and bounds in Volume 134, Page 218, Deed Records, to George Lopez Trevino. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously -MU Commissioners Court meeting October 26, 1999 7 to authorize the County Judge to execute a Tax Resale Deed. The next matter for the Court's consideration was allocation of funds to three (30) eligible EMS providers and revocation of funds to Texas A&M University EMS in compliance with the 1999 SB 102/EMS contract with the Texas Department of Health. On motion by the County Judge, seconded by Commissioner Thornton, the Court voted unanimously to allocated funds to the three (3) eligible EMS providers who are: r i 1. Bryan Fire Department 801 N. Bryan Bryan, Texas 77803 2. College Station Fire Department P.O. Box 9960 College Station, Texas 77842 3. St. Joseph Regional Health center 2801 Franciscan Drive Bryan, Texas 77802 and revoke funds to Texas A&M University. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to appoint the following persons as alternate judges for the current voting year at the following voting precincts: Pct # Election Judge Alternate Judge 7 Robert Wilson (D) 11 Teresa Ramirez (D) Changes to previously approved Judges and Alternate Judges: 7 Gladys Dominik (R) 23 Kristy Hardy (R) The next matter before the Court was reclassification of parking spaces on the East 26t° Street side of the courthouse. Parking will be limited to thirty (30) minutes and the city will install the signs. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to reclassify the parking spaces on the East 261h Street side of the Courthouse and limit parking to thirty (30) minutes. The Court next considered a request from Constable Precinct 2, James Marrow, to appoint Michael Ross Bewley as unpaid Reserve Deputy Constable. on motion by Commissioner i kI • • • Commissioners Court meeting October 26, 1999 8 Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the request from Constable Marrow to appoint Michael Ross Bewley as unpaid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. The Court next considered a request from Constable Precinct 6, Phil Sikes, to appoint Troy Walden, Kevin McCullough and Lance Platt as unpaid Reserve Deputy Constables. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court.voted unanimously to approve the request from Constable Sikes to appoint Troy Walden, Kevin McCullough and Lance Platt as unpaid Reserve Deputy Constables subject to appointment being within the allotted number of deputies. The next matter before the Court was approval of a Contractual Agreement between Brazos County and Patterson Architects. Patterson Architects will provide design services for the Justice of the Peace buildings to be constructed. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to enter into contractual agreement with Patterson Architects subject to Patterson Architects charging the same rate as the former Architect, Rick Ravey. A copy of the contractual agreement is attached hereto. The Court next heard a request by the District Clerk to purchase one computer with monitor each for the Collections Division and Jury Services Division. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to take no action on this request. The Court next considered entering into Agreement with Hewlett Packard for system support. This is for Hardware support. Coverage period is from October 1, 1999 to September 30, 2000 at a total cost of $467.64. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court Commissioners Court meeting October 26, 1999 9 voted unanimously to enter into Agreement with Hewlett Packard for hardware support. The Court next considered approval of requisitions from the Capital Projects Fund for the following purchases: a) 2 Filing cabinets for the Sheriff's Office Investigators $770.00 b) 2 Intensive use dispatch chairs $1,550.00 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisitions to be paid from Capital Projects Fund. The next matter for consideration was approval for the Purchasing Agent to advertise for the following bids: 1. Bid 2000-015, Cellular Phone Service 2. Bid 2000-016, Long Distance Telephone Service for Brazos County Offices. r - 'f• 1 • • 91 i I C Commissioners Court meeting October 26, 1999 10 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for cellular phone service and long distance telephone service. The Court next considered awarding the following bid: Bid No. 2000-12,Vehicles for Sheriffs Office John Hachmann, Purchasing Agent, recommended acceptance of the bid submitted by Phillpott Ford. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Phillpott Ford. There were two bidders, A.R. Mortuary in Franklin and Daniel and Sons in Bryan. This action was requested because the low bidder, A.R. Mortuary, would not be able to respond within 15 minutes and there was a drastic price difference in professional services between the two bidders. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to reject all bids submitted for Bid #20b0-013. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Melvin Allen on Rock Prairie Road in Precinct 1, to clear out an existing channel. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the work. i t f V Commissioners Court meeting October 26, 1999 12 The Court next considered the request from Williams Communications, Inc. to construct road bores for fiber optic cable installation in the rights-of-way of the following locations which are in Precinct 1: • a) Paradise Way (Seven Eleven Ranch Subdivision)approximately 338 feet from it intersection with State Highway 6. b) Westward Ho (Seven Eleven Ranch Subdivision) 1,493 feet from its intersection with State Highway 6. c) Greens Prairie Road approximately 9,018 feet of State Highway 6. d) Arrington Road approximately 10,405 feet south of Greens Prairie Road. 401 The County Engineer stated that all appeared to be in order and recommended approval of all requests. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve all the requests from Williams Communications, Inc. and authorized all the installations. A copy of each request is attached hereto. The Court next considered approval of the Re-Plat of Lot 83 of Woodlake Subdivision in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1) A 20 ft. utility easement shall be shown along the property line between lots 82A and 82B (10 ft. on either side of the lot line) 2) In General Note #3, the minimum set back line for side and rear will be 10 ft. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approved the final plat of Re-Plat of Lot 83 of Woodlake Subdivision subject to the developer complying with the exceptions noted by the County Engineer. Covered expenses in excess of the $50,000 level are reimbursed to the County by the stop-loss carrier. This $50,000 deductible is known as the "SIR'. The "Corridor" deductible provides a guaranteed premium reduction in exchange for the employers willingness to assume a greater, but limited, portion of the risk. The County can save a maximum of $40,285 or loose as much as $9,715 through purchasing a corridor deductible. If the corridor deductible is selected, Sun Life will reduce the premiums by $40,285. The County would continue to be responsible for $50,000 SIR. However, the County would increase its' "risk exposure" by agreeing to assume responsibility for the first $50,000 of covered expenses that are in excess of the $50,000 SIR's. The County's exposure is limited to $50,000 of loss beyond the $50,000 SIR (but not for each person), in exchange for a premium reduction of $40,285. Therefore, the most that the County can 'loose" through the corridor deductible is $9,715 ($50,0000 maximum corridor deductible less the $40,285 premium reduction). The trade-off is the guaranteed premium savings versus having to return all or a portion of the savings plus the possibility of having to pay an additional $9,715 to the insurer. EMPLOYER CONTRIBUTION RATE The County hereby undertakes to make monthly normal contributions and prior service contributions to the System at an employer contribution rate that equals or exceeds the total calculated employer contribution rate (i.e., the calculated employer contribution rate plus the rates for any optional rights, benefits and credits elected in Section IV) determined from year to year by the actuary of the System, and approved by the Board of Trustees as provided by Subchapter H of Chapter 844 of the TCDRS Act. Such employer contribution rate (which does not Include the rate for 'picked-up' contributions under Section 845.403(i) and the rate, if any, for contributions to the Supplemental Death Benefits Fund under Section 845.406) shall not exceed the statutory maximum employer contribution rate prescribed by Section 844.703(c) (currently 11 percent) unless this Court elects to waive that statu- tory limit. Any waiver of the statutory maximum rate made in accordance with Section 844.703(c) shall remain in effect until January 1 of the year following the year in which the waiver is repealed by the Court. The Committee reviewed the present plan, selected options for the County and makes the following recommendation for consideration. A three per cent (3%) "Flat-Rate COLA" be given to all current retirees. Mr. Froh. Deputy Director Membership Communications, with TCDRS advised that this would affect only those retirees who have been retired for one (1) full calendar year as of midnight, December 31, 1999. This increase would be a one-time-only increase, and would be effective for the remainder of the life of the retiree. It would not increase again without further action of the Commissioners Court. For example, a retiree's monthly income of $100.00 would increase to 5103.00, and would remain at that amount for his/her lifetime. Mr. Froh stated that this increase could be put into place without affecting the county's current match 10.98%. We anticipate the census will be released in the first few months of 2001, thereafter Counties statewide will need to redistrict their commissioner, justice and constable precincts. It has been our pleasure serving Brazos County in prior redistrictings of Commissioner precincts, as well as the more recent reduction of Justice and Constable precincts. I hope that, in practice, these efforts have resulted in positive results for the County. The legal landscape has changed dramatically since the 1991 redistricting round. Under Shaw v. Reno and related cases, there is a new cause of action in redistricting cases for "racial gerrymandering." In this next round of redistricting, the County can be sued not only by minority groups claiming a redistricting plan is discriminatory, but also by Anglo groups claiming a plan is based primarily on race. Safe middle ground will be harder to identify and stay on than in 191. Uninformed early decisions may provide evidence of impermissible motive for subsequent lawsuits, but a carefully planned process can provide favorable evidence and may even deter suits. The 2000 Census will be taken on April 1, 2000. Population data will be released early in 2001. Brazos County will then need to determine if you precincts are out of population balance so that redistricting is required. As in 1991, the Voting Rights Act mandates that the County submit its redistricting plan to the Department of Justice (DOJ) and obtain preclearance before it can be used in an election. The County's redistricting will have special importance since it will dictate the election precinct lines used for other jurisdictions. First, I believe the Commissioner precincts likely will have to be redrawn due to the increase in population in the County since 1991. Second, following the redistricting of Commissioner and Justice and Constable precincts in 1991, the County had an extremely difficult time redrawing its voting precincts, due to the fact that the Tfxas Legislative Council redrew the boundaries for state and feder officeholders in a manner which split the County into numerous segments. I recall this problem was compounded by the redrawing of City ward lines by the City of College Station in a manner which did not follow existing County voting precinct boundaries. Unfortunately, the applicable provisions of the Election Code generally require a voting precinct not to contain territory from more than one federal, state, county and municipal territorial unit. While the County should be able to agree with the City regarding the City's redrawing of its ward lines, there is always the possibility that the Legislative Council will draw state and federal districts in a manner which causes a need for the County to create additional voting precincts. In 1991, these efforts resulted in substantial fees incurred by the County, and it_is difficult to predict what amount of fees should be budgeted for this portion of the redistricting work. All this being said, I anticipate the cost of redistricting services for Brazos County following the release of the 2000 Census should run in the neighborhood of $18,000 - $22,000. This estimate is based upon our firm's experience in representing numerous other County clients of a similar size in redistricting matters following the release of the 1980 and 1990 census. While I believe the estimate to be accurate, the actual cost to the County could increase substantially in the event of 1) unforeseen local opposition; 2) the number of redistricting plans drawn and considered; • 3) intensive inquiries from the Department of Justice during the preclearance review; 4) lack of consensus by members of the Commissioners Court; and 5) potential redrawing of voting precincts as a result of redistricting by other governmental units. The good news is that the redistricting technology has advanced substantially since the 1990 round of redistricting. The firm has purchased the latest redistricting software which is extremely powerful, allowing a much more detailed analysis of each plan. Sherri McCall, our redistricting specialist, has the depth of experience to draft a plan taking numerous individual factors into account. This is in contrast to other redistricting specialists who historically have produced a "one size fits all" recipe approach toward redistricting. We are presently preparing our staffing projections to ensure that we can be responsive to each client's particular needs. Fee Arrangement: The firm typically bills by the hour. The most time-consuming element of the task is generally the creation of the plan. Most of those hours typically will be billed by the redistricting specialist at $90 per hour. This work is performed on computer, which greatly reduces the time required and increases the accuracy. In addition, the firm submits expenses to the client for reimbursement. These include items such as travel, photocopying, courier service, postage, and long distance telephone. It is the policy of our firm to adjust its rates each year, therefore, our rates may be different in 2001, but I do not expect any such rate changes to be substantially different from those set forth above. THIS CONTRACT IS ENTERED INTO BY AND BETWEEN BRAZOS COUNTY, TEXAS, acting by and through its duly elected County Commissioners (hereinafter "County'), and the FAMILY PRACTICE RESIDENCY OF THE BRAZOS VALLEY (hereinafter "Provider"), located at 1301 Memorial Drive, Suite 200, Bryan, Texas 77802, RECITALS: WHEREAS, the medical care of the County's poor and indigent has become a growing problem; and WHEREAS, the County recognizes that good medical care of individuals and families that emphasizes prevention, care management, and appropriate acute care results in less costly medical expenses for the Community and in a more productive work force; and WHEREAS, the County is interested in promoting such care through the Provider, NOW THEREFORE the parties above stated agree to the following terms and conditions to provide such indigent health care. TERM The contract shall continue in force and effect for a term of twelve (12) months commencing on the 1st day of October, 1999 and terminating 30th day of September, 2000. CANCELLATION This contract may be canceled by any of the parties hereto upon sixty (60) days written notice as provided herein. SERVICES TO BE PERFORMED BY PROVIDER Provider shall provide the following services through trained, salaried staff to qualified county residents pursuant to the guidelines currently implemented for making such determination: physical exams, educational information, information on sources of prescription medication and/or access to "sample" or subsidized medications, coordination of physician care during hospitalization (herein "services"). COUNTY'S LIABILITY FOR PAYMENT The County agrees to reimburse the Provider for actual cost of the parts of the salaries as stated on Enclosure 1 up to a maximum of Fifty-Five Thousand and No/100 Dollars ($55,000.00) for the term of this Contract. This sum shall be paid quarterly as in the previous year. RESPONSIBILITIES OF PROVIDER Provider will be responsible for providing the following Services pursuant to this Contract: I. All necessary application forms to potentially eligible individuals. 2. Obtaining and compiling information on each applicant for Provider's Services with regard to residency and financial qualifications. 3. Maintaining this Contract. 4. Providing of the Provider's Services. • 5. Maintaining data files on clientstpatients and the Services provided thereto. 6. Respond to all and any inquires by the County regarding the Clinic and its Services. 7. Assist the County with information needed for audit purposes. 8. Provide the County with quarterly financial statements. 9. Provide the County with any and all certified audits of Provider and the management letter prepared in connection therewith. 10. Provide financial statements evidencing how County funds are spent. Such statements to be submitted to County one week prior to the funding dates set form herein above. 11. Provide the County with statistics evidencing the number of Brazos County ; residents using the Provider's Services and the percentage Brazos County residents comprise of the total population using Provider's Services. RESPONSIBILITY OF COUNTY The County shall be responsible for the following duties and requirements. 1. Provide County funds for the payment of the consideration stated herein. 2. Conduct a review of the Provider's performance in providing the Services to be provided hereunder in order to assess County's continued participation in the funding of the Provider. RECORD RETENTION The Provider shall be responsible for record keeping on all Services provided to those individuals using its services and all financial records of the Clinic. The Provider agrees to maintain and make available for inspection by the County upon request consistent with personal privacy and subject to the limitation of state law, any and all records the County determines, in its sole discretion, to be necessary for the County to justify its continued participation in supporting the provider with funding. Such records shall be retained for at least four (4) years from the date the service was provided. These records shall be made available for inspection and audit by the County, if it so desires. DISCRIMINATION The Provider shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin. The Provider shall take affirmative action to ensure that applicants who are employed are treated during employment, without regard to their race, color, religion, sex, or national origin. INSURANCE The parties hereto agree that the Provider shall be an independent contractor and not any employee or agent of the County and that each shall maintain at its own expense, adequate liability insurance to insure against damages and liabilities which may arise due to the duties and obligations contracted for herein.
