VOL.L • • • f COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 28, 1999 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, September 28, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Cauley gave the invocation and led the pledge of allegiance. The. County Judge read aloud a Proclamation designating October 1, 1999 as a day of celebration for the Brazos County Health Department in honor of its 60`n year anniversary. The Court joins with the citizens of Brazos County in recognizing the efforts of the Health Department to assure the health and future of our community. On motion by the County Judge, seconded by Commissioner Sims, the Court moved to designate October 1, 1999 as a day of celebration for the Brazos County. The Court next considered Budget Amendment #98/99-40.1 through 40.6, which would reallocate funds for the County Attorney Kids and Cops Grant, Metropolitan Planning Organization, Sheriff's Office, Constable Precinct 2, District Attorney and Constable, Precinct 6. On motion by t Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of employees as submitted by the attached personnel action requests. Commissioner Cauley moved to approve all but the 5 9 YAGR r ti Commissioner Court meeting September 28, 1999 change for Linda Stoddard. Commissioner Jones seconded the motion. The Court voted unanimously to approve the changes with the exception of the one for Linda Stoddard. Commissioner Jones then moved to table consideration on Linda Stoddard's change of status. Commissioner Thornton seconded the motion and it carried unanimously. Commissioner Sims asked about giving salary increases to other department heads. This will be done by memo to all Court members. The Court next considered the following Claims as submitted by the County Treasurer for payment: 99-010800 through 99-011087 On motion by Commissioner Jones seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter for consideration was a request for a waiver of the burn ban to permit the burning of dead livestock. On motion by the County Judge, seconded by Commissioner Thornton, the Court voted unanimously to deny the request for a waiver. The County Judge said that he did not think the Court has the authority to issue a waiver. Commissioner Sims suggested that the County assist with the burial. The Court next considered approval of an Engagement Letter with Orrick, Herrington Sutcliffe LLP to provide arbitrage rebate compliance, services concerning the Certificates of Obligation, Series 1998. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the Engagement Letter with Orrick, Herrington & Sutcliffe LLP. A copy of the letter is attached. The next matter before the Court was approval for payment of an invoice to Lange Micrographics incurred by the Sheriff's Office. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted VOL... 16 K r l , Commissioner Court meeting September 28, 1999 r~ unanimously to authorize payment of the invoice in the amount of $5,000.00. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos County Community Council. The Council will provide coordination of existing agencies, telephone reassurance, utility assistance, dental program screening, and rent assistance benefitting very low income residents of Brazos County. The cost to Brazos County will be $2,500.00 annually. The term of the contract will be fiscal year 1999- 2000. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with the Brazos County Community Council. A copy of the contractual agreement is attached hereto. The Court next considered renewal of a lease agreement between the Brazos Valley Art League and Brazos County for rental of office space within the Brazos Center located 3232 Briarcrest Drive, in Bryan, Texas. Term of the lease is for the period of one year commencing on October 1, 1999 and ending on September 30, 2000. The Art League agrees to pay Brazos County four hundred eighty dollars ($480.00) per month. On motion by Commissioner Thornton, seconded by Commissioner Sims, the Court voted unanimously to renew the lease agreement between Brazos County and Brazos Valley Art League for the period stated above. A copy of the lease agreement is attached. i I t s VOL. . AQ a s The Court next considered authorizing work outside of county right-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Stephen J. Lehr on Nunn Jones Road in Precinct 3 to haul dirt donated for county use from an excavation site on the property. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to Commissioner Court meeting September 28, 1999 authorize the work. The Court next considered a Construction and Maintenance Agreement between Brazos County and the Texas Department of Transportation for bridges on the off-system Federal Aid Bridge Rehabilitation and Replacement Program. The Department of Transportation will fund 80 percent of the project with the County funding 20 percent. On motion by Commissioner Jones, seconded by Commissioner Sims, the court voted unanimously to enter into Agreement with the Texas Department of Transportation for bridges on the off-system Federal Aid Bridge Rehabilitation and Replacement Program. A copy of the project list is attached. The Court next considered renewal-of bid #99-010, Rental of ` Equipment with Operator. In a letter to the Purchasing VOL., i 0 p Commissioner Court meeting September 28, 1999 Agent, the President of Texcon.proposed a continuance of the existing contract to be renewed at the same prices without any escalation for the period beginning November 15, 1999 through November 15, 2000. On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to renew Bid #99-010, Rental of Equipment with operator. The Court next considered awarding the following bid: Bid No. 2000-006, Uniforms for Sheriff's Office John Hachmann, Purchasing agent recommended acceptance of the bid submitted by Skaggs Uniforms. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Skaggs Uniforms. A copy of the bid tabulation is attached. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's Report for August • 1999. A copy of which is attached to and made a part of these minutes. Commissioner Thornton made the following comment: 1) The Law Library has not been moved because of a misunderstanding over the cost of moving and storage. The County Judge made the following comments: 1) Acknowledged the employees and community for all their help in making the Jasper Trial run so smoothly. 2) He acknowledged the services of the committee that worked on the distribution of the tobacco funds. There was no citizen input and/or concerns. The calculations are to be performed with respect to the bond issue(s) listed on Exhibit A hereto (the "Bonds") applying applicable federal tax rules. • • Orrick will calculate the amount of rebate liability with respect to the Bonds once per year as of the end of each bond year (unless specifically directed in writing otherwise by the Obligor) and as of the final maturity or redemption of the Bonds (each such date on which a rebate calculation is performed is referred to herein as a "Rebate Calculation Date") applying regulations of the United States Department of the Treasury ("Treasury") in effect on such Rebate Calculation Date. In addition, if a "penalty in lieu of rebate" election under Code Section 148(f)(4XCXvii) has been made by the Obligor with respect to the Bonds, Orrick will calculate, every six months, the amount of such "penalty" as of the end of each six- month period beginning on the date of issue of the Bonds (each such date on which a penalty calculation is performed is referred to herein as a "Penalty Calculation Date"). (The term "Calculation Date" as used herein shall refer to a Rebate Calculation Date or a Penalty Calculation Date, as appropriate.) In addition, if required or requested by the Obligor, Orrick will include in each report delivered to the Obligor an analysis of compliance with applicable arbitrage yield restrictions. With respect to each Calculation Date, Orrick will prepare or cause to be prepared schedules reflecting the relevant calculations and the assumptions involved and will deliver a rebate or penalty liability report and opinion addressed to the Obligor as to the amount of the rebate or penalty liability as of such Calculation Date. The Obligor undertakes to provide or cause to be provided to Orrick all such relevant data, as specified by Orrick from time to time, and shall cooperate with all reasonable requests of Orrick in connection therewith. Lessee shall be exclusively entitled to the space allocated to it by the Director of the Center for a term beginning October 1, 1999 and ending September 30, 2000. The space allocated to Lessee as described in Attachment "A" hereto, which have been signed by the Director of the Center. (room 106 and closet) A. Lessee shall have access to this space during those hours in which the Brazos Center is open for normal business. Lessee will not have a key to the exterior door of the facility. B. Lessee shall use the leased premises solely for the use and purposes for which it is let, that being the conduct of the Brazos Valley Art League meetings, classes, exhibits and workshops. C. Lessee shall provide the Director of the Center with a monthly schedule of activities by the 15th of the preceding month. Lessor is responsible for verifying that the Center is scheduled to be open prior too scheduling activities. 2. A. In consideration therefore, Lessee agrees to pay the Lessor on the first working day of each calendar month during the term hereof, in advance, the sum of $480 representing the agreed monthly rental for use of such space as herein set forth. B. In addition, Lessee has permission to use Concourse and assembly 111 for three art shows per year. The term for each not being longer than seven days. W%O t • w • C. Lessor will make staff and chairs available to set the room three times per month, auditorium style for up to 40 persons, at the request of Lessee. Lessee will request this service at least 30 days to advance for each set-up. 3. Lessee agrees to arrange and hang work of local artists on a continual basis in Showcase III. Artist's works chosen too be spotlighted are the sole responsibility of Lessee. At least six artists per year will be featured. The Brazos Center has the right to deny exhibition of any work that the director deems to be of questionable appropriateness. 4. Lessor shall furnish all utilities, including gas, water and electricity. Excluding telephone service. 5. Lessee will pay the regular User fees for space used by it, other than space allocated to it under this agreement. 6. Lessor does not provide and will not provide furnishings, custodial care, or maintenance of the space allocated to Lessee under this agreement. Lessor will replace light bulbs, only. 7. Lessee shall take good care of the space allocated to it, reasonable wear and tear only excepted, and shall surrender the premises at the termination of this agreement. 8. Lessee agrees that no improvements to or alterations to the space shall be made without the consent of Lessor in writing. 9. Risk of loss of all property owned by Lessee shall remain with Lessee, it being understood that Lessor will maintain no insurance on such property. Any insurance desired by Lessee on Lessee's property shall be purchased by Lessee at its expense. 10. Lessor shall not be liable to Lessee or the Lessee's employees for any damage to person or property caused by the negligent act of Lessor, its agent, servants, or employees or due to the act of any other tenant in the building, or due to any defect of want of repair in any part of the building of which the allocated space forms a part. 11.
