To make arrangements, call (409) 361-4102. 0 uVOL.15-2.~PAGE, - 20~dftrl- COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 21, 1999 s ~I 1 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, September 21, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Sims gave the invocation and led the pledge of allegiance. The Court next considered Budget Amendment #98/99-39.1 through 39.11, which would create budget for the BVCOG Workforce; increase revenue for Justices of the Peace Precincts 3 & 6, and Constable Precinct 5, Indigent Health Care, Environmental Protection; and reallocate funds for the TNCP Training Grant, County Attorney, Juvenile Services, Constable, Precinct 4, Constable, Precinct 5 Community Supervision, County Support Costs. There were questions on amendments 3, 5 & 7 that were answered by the County Auditor. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted. A copy of which is attached hereto. The Court proceeded to consider the change of status of the employees on the attached requests for personnel changes. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the changes as submitted. 'r I i 4 t e Commissioners Court meeting September 21, 1999 2 • On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The next matter for consideration by the Court was approval of the recommendations made by the Brazos County Community Healthcare Endowment Fund Review Committee concerning the distribution of the tobacco settlement funds. The committee made the following recommendations: 1. Hospice of Brazos Valley $72,000 2. American Lung Association of Texas $34,000 3. Brazos Valley Council on Alcohol and Substance Abuse (BVCASA) Coalition $46,214 On motion by Commissioner Sims, seconded by Commissioners Thornton and Cauley, the Court voted unanimously to accept the recommendations of the committee and approved payment of the funds to the recipients. The next matter before the Court was consideration of Initiative #2 with Vertex for services concerning the Juvenile Services Department's Title IV-E Administrative Claims. Vertex recognized that the Brazos County Juvenile Probation Department's Administrative Claims for Title IV-E, reimbursement could be greatly increased by defining and documenting reimbursable activities of the Juvenile Probation staff. Vertex will train Juvenile staff, implement a time keeping system, and prepare an "Enhanced" Title IV-E Administrative Claim for the Department. Increased • reimbursements are expected to be between $20,000 to $30,000 quarterly. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to proceed with the baseline. The Court next considered a Clinical Psychology Services Agreement with the Psychology Clinic at Texas A&M University for services for the Juvenile Services Department. The Psychology clinic will provide clinical psychology services to Juvenile Services inmates. Cost to Brazos County will be a VOL- -1 • 5 Commissioners Court meeting September 21, 1999 3 $10,900.00 to be paid in twelve (12) monthly installments of $908.33. Term of the agreement is for a period of twelve months, beginning September 1, 1999 and ending August 31, 2000. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to enter into Agreement with to Psychology Clinic at Texas A&M University. A copy of the Agreement is attached. The next matter before the Court was to raise the qualification limit of indigents to 25* of the poverty level. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to raise the qualification limit of indigents to 25% of the poverty level. This is so more people can receive benefits. The Court next considered the appointment of a member and an alternate member to serve on the Technical Advisory Committee of the Bryan/College Station Metropolitan Planning Organization. On motion by the County Judge, seconded by Commissioner Jones, the Court voted unanimously to appoint Richard Vance, County Engineer, as a member to serve on the committee and Ray Crow as an alternate member. The Court next considered Change Order No. 3 for the Courthouse Renovations Contract with R. M. Dudley, Construction Company. The Change Order would make the following changes: 1. Provide and install hardware for door 43 $488.00 2. Provide and install new door/frame/hardware between room 210 and corridor 220 $733.93 3. Weld new door stop to existing door in room 314 $62.46 4. Finish out west wall of room 201 to deck $200.00 5. Delete VCT requirements from Rooms 252, 260 & 280 [$300.00] 6. Repairs to existing smoke stop $245.00 7 Add 5 inch storefront section at vestibule 101 $396.00 s' . I . ~.-..ter r . _ I I . • Commissioners Court meeting September 21, 1999 4 Total for Change Order Number Three is $1,925.38. This amount is to be subtracted from the remaining $12,897.50 contingency allowance. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve Change Order Number Three. A copy of the change order is attached. The Court next considered a request by the Bryan Independent School District for transportation of material to the Special Opportunity School Community Garden. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize the use of County vehicles to transport materials to the school site. The next matter for consideration by the Court was a • request submitted by the Sheriff seeking approval for out of state travel for the Jail Administrator, Wayne Dicky. Mr. Dicky would be traveling to Quantico, Virginia to attend the F.B.I. National Academy October 3 through December 17, 1999. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to grant the request from the Sheriff and approved payment of out of state travel expense for Wayne Dicky. The next matter to be considered was a Resolution providing for the sale of property acquired by the County of Brazos at Delinquent Tax Sale and Tax Resale Deed and authorization for the County Judge to execute the tax resale deed for 30 feet by 50 feet out of the South End of Lot 10, Block 66, City of Bryan, to Eunice M. Williams. The Texas Property Tax Code provides that the County may accept a sufficient bid. The County received a bid of Nine hundred Ninety and no Hundredths Dollars ($990.00) from Eunice M. Cj Williams On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to accept the bid of $990.00 from Eunice M. Williams, approve the sale of the property and authorized the County Judge to execute the tax resale deed. Vj% W4W -7 tfr Commissioners Court meeting September 21, 1999 5 The Court next considered payment of an invoice from the City of College Station for one third (1/3) of the expenses for the Chancellor's reception. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to authorize payment of the invoice in the amount of $487.56. f ; 4 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to adopt a Resolution authorizing county officials or county employees, including county sheriff, deputy sheriffs or juvenile probation officers to participate in the program established by the General Services Commission to gain access to the State's contract airline fares. The Court also authorized the payment of an invoice in the amount of $1,751.40 to the General Services Commission for the program administrative costs as provided by Senate Bill 204. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos County Soil and Water Conservation District #450. The District will provide soil and water conservation services to the residents of Brazos County and to the County proper such as erosion control, water management and rural development. The cost to Brazos County will be $5,500.00 for fiscal year 2000. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with the Brazos County Soil and Water Conservation District #450. A copy of the contractual agreement is attached hereto. The Court next considered a funding agreement with Mental Health Mental Retardation Authority of Brazos Valley (MHMR). On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to enter into a funding agreement with MHMR in the amount of $75,000.00. ' t The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos '1\ r~ Commissioners Court meeting September 21, 1999 • • k 6 Maternal & Child Health Clinic, Inc. The Clinic will provide medical care for pregnant indigent women. The cost to Brazos County will be $60,OA0.00 annually. The term of the contract will be from October 1, 1999 through September 30, 2000. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to enter into contractual agreement with the Brazos Maternal & Child Health Clinic, Inc. subject to a correction to the contract referring to the quarterly payments. The correct amount should be $15,000.00 quarterly rather than $17,500.00 as written in the contract. A copy of the contractual agreement is attached hereto. The Court next considered entering into agreement with the Arts Council of Brazos Valley. The Arts Council will provide funding to assist local performing arts groups. Cost to Brazos County will be $20,000.00 for the year beginning October 1, 1999 and ending September 30, 2000. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to enter into agreement with the Arts Council of Brazos Valley authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached. The next matter for consideration was the renewal of a contract between the Retired Senior Volunteer Program (RSVP) and Brazos County. Brazos County will pay $2,500.00 to RSVP and in exchange, RSVP will provide volunteers to help the citizens of Brazos County. Term of the contract will be from October 1, 1999 to September 30, 2000. On motion by Commissioner Sims seconded by Commissioner Cauley, the Court voted unanimously to approve the contract with the Retired Senior Volunteer Program. A copy of which is attached. The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos County Community Council. The cost to Brazos County will be $4,400.00 annually. The term of the contract will be fiscal Commissioners Court meeting September 21, 1999 7 year 2000. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with the Brazos County Community Council. A copy of the contractual agreement is attached hereto. The Court next considered awarding the following annual contracts: 1. Vehicle Rental John Hachmann, Purchasing Agent, recommended acceptance of the bid submitted by Advantage. 2. Armored Car Service John Hachmann, Purchasing Agent, recommended acceptance of the bid submitted by Star Armored. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to accept the recommendations of the Purchasing Agent and award the contracts to Advantage Car Rental and Star Armored Car Services. A copy of each bid tabulation is attached. The next matter before the Court was the renewal of a Contractual Agreement between Brazos County and the Greenery for grounds maintenance. The cost to Brazos County will not change from the 1998-1999 contract. The term of the contract will be fiscal year 1999/2000. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with the Greenery. A copy of the contractual agreement is attached hereto. The next matter for consideration was approval for the Purchasing Agent to advertise Bid 2000-012, Vehicles for the Sheriff's Office. Commissioner Cauley praised the department heads for participating in this effort. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to grant permission to to the Purchasing Department to enter into negotiations. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and, Bridge Department requested permission to enter the private property of Clarence Cobb on Long Trussel Road in Precinct 3 to obtain water for road improvements. The property entrance will be repaired as needed. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Sammy Catalena on Democrat Road in Precinct 3 to clean out Sand Creek in order to stop erosion on the road. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Cooter Kenney on Democrat Road in Precinct 3 to route water from Sand Creek back to the original channel across the south corner of the property, parallel to Democrat Road to prevent the water from crossing the roadway. The site will be maintained as necessary to ensure adequate drainage and prevent erosion. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Road and Bridge Department requested permission to enter the private property of Larry West on Democrat Road in Precinct 3 to reclaim gravel washed off the roadway. The area will be cleared of brush and trees to allow access to road material. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered the request from Texas A&M University to construct a road bore in the right-of-way of Luza Lane to install a corrosion protection system for water system improvements. The site is located in Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Cauley, i f seconded by Commissioner Sims, the Court voted unanimously to approve the request from Texas A&M University and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Re-Plat of Lot 3, Block 2 of Old Spanish Trail Estates in Precinct 4. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1) Add 10 feet utility easement on both sides of new lot line. 2) Remove "Road" from old Spanish Trail road name. 3) On note #5 of General Notes, FEMA map number should be 48041C0075C. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approved the Re-Plat of Lot 3, Block 2 of Old Spanish Trail Estates, subject to the developer complying with the exceptions noted by the County Engineer. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the minutes as submitted. Under announcement of interest items and possible future agenda topics, Commissioner Thornton made the following announcement: 1) The County law Library was being moved on September 22, 1999 and would be put in storage. The County Judge made the following comments: 1) There has been a. great deal of frustration with the Houston Cellular phone service. He has asked the Purchasing Agent to develop a new RFP. 2) Four or five months ago, there was discussion about hiring a consultant for re-districting. The Court needs to proceed with this matter. 3) He spoke with a representative of a company that is willing to take on the responsibility for collecting all fines. There was no citizen input and/or concerns. There being no further business to come before the Court, the meeting was adjourned. Purpose of Agreement This contract outlines an agreement between the Brazos County Department of Juvenile Services (henceforth referred to as Juvenile Services) and the clinical psychology program in the Department of Psychology at Texas A&M University (henceforth referred to as TAHU) regarding a clinical assistantship program between the two institutions. The purpose of this agreement is to provide the terms whereby (a) students enrolled in the Doctoral Clinical Psychology Program shall receive on-site educational experiences from Juvenile Services, and (b) Juvenile Services shall receive clinical psychology services provided by students enrolled in the Doctoral Clinical Psychology Program. • II. Respective Responsibilities A. TAMU agrees to: 1. Provide a masters-level graduate student in clinical psychology to Juvenile Services for 10 hours/week for 50 weeks during a 12-month period (500 hours per year). 2. Provide one hour per week of doctoral-level supervision for this graduate student. 3. Bill Juvenile Services monthly for services provided. B. The student agrees to: 1. Provide clinical psychology services to Juvenile Services for 10 hours/week. Scheduling of these 10 hours is to be negotiated on an individual basis between the student and Juvenile Services. 2. Include within the 10 hours/week the following on-site activities: Direct clinical services, staff meetings and consultations, and all administrative responsibilities including preparation of written reports and maintenance of clinical records. 3. Comply with policies established by Juvenile Services regarding code of ethics, confidentiality, and other issues relevant to provision of clinical services in a multidisciplinary setting. The student will supply appropriate certification of credentials and complete agreements regarding confidentiality and other professional issues as required by Juvenile Services of its staff and consultants. tWOOL.1 ~~AIGP l Juvenile Services / TAMU Psychology Proposal 4 C. Juvenile Services agrees to: 1. Submit a check payable to Texas AM University 10 days following receipt of the bill for services. 2. Provide case-by-case consultation to the student on an as-needed basis by Juvenile Services staff. 3. Provide written evaluation of the student to the director of clinical psychology training at TAMU at the end of the term of this agreement. 4. Identify two weeks during the 12-month period, in consultation with the student, during which no clinical services will be provided by the graduate student. D. TAMU and Juvenile Services both agree to: 1. Selection of the graduate student for this clinical assistantship by the Director of Clinical Psychology Training at TAMU in consultation with program faculty and with appropriate Juvenile Services administrative personnel. 2. Mutual evaluation of the graduate student throughout the term of this agreement. In the event that difficulties arise with any component of the assistantship program, the following steps will be undertaken: a. Either Juvenile Services or TAMU may initiate a joint meeting with representatives from both institutions, including the student assigned to the assistantship, to identify relevant issues and plan appropriate interventions to remediate these difficulties. b. In the event that appropriate interventions cannot be identified or upon implementation and modification prove unsuccessful, reasonable efforts will be made to continue the student's clinical assistantship at Juvenile Services through the last month of the current academic semester. c. Should continuation of the assistantship or a given student through the end of the current academic semester not prove possible, this agreement may be cancelled upon 30 days written notice by either Juvenile Services or TAMU. III. Professional Liability 1. The dispute resolution process provided for in Chapter 2260 of the Texas Government Code shall be used, as further described herein, by Texas A&M University, and JUVENILE SERVICES to attempt to resolve any claim for breach of contract made by JUVENILE SERVICES: (A) JUVENILE SERVICES's claim for breach of this contract that the parties cannot resolve in the ordinary course of business shall be submitted to the negotiation process provided in Chapter 2260, subchapter B, of the Texas Government Code. To initiate the process, JUVENILE SERVICES shall submit written notice, as required by subchapter B. to Dr. Richard L. Floyd, Associate Vice-President for Finance. Said notice shall specifically state that the provisions of Chapter 2260 of subchapter B, are being invoked. A copy of the nonce shall also be given to all other representatives of Texas A&M University and JUVENILE SERVICES otherwise entitled to notice under the parties' contract.. Compliance by JUVENILE SERVICES with subchapter B is a condition precedent to the filing of a contested case proceeding under Chapter 2260, subchapter C. of the Texas Government Code. (B) The contested case process provided in Chapter 2260, subchapter C, of the Texas Government Code is JUVENILE SERVICES's sole and exclusive process for seeking a remedy for any and all alleged breaches of contract by Texas A&M University if the parties are unable to resolve their disputes under subparagraph (A) of this paragraph. (C) Compliance with the contested case process provided in subchapter C is a condition precedent to seeking consent to sue from the Legislature under Ch. 107 of the Civil Practices and Remedies Code. Neither the execution of this contract by Texas A&M University nor any conduct of any representative of Texas A&M University hereafter shall be considered a waiver of sovereign immunity to suit 2. The submission, processing, and resolution of JUVENILE SERVICES's claim is governed by the published rules as adopted by Texas A&M University pursuant to Chapter 2260 as currently effective, hereafter enacted or subsequently amended. 3. Neither the occurrence of an event nor the pendency of a claim constitutes grounds for the suspension of performance by JUVENILE SERVICES, in whole or in part 4. Senate Bill 204 was a direct result of House Bill 255 being successful in saving the counties money when a Texas County Sheriff or juvenile Probation Officer was transporting a state prisoner under a felony warrant and was participating in the State's program. The average discount for Fiscal Year 1999 (Sept. 1, 1998 - Aug. 31, 1999) was approximately 60% off the normal coach fare for the Texas County Sheriff and juvenile Probation Officer Departments. t Your county may participate in this program by filing an approved resolution with the GSC's State Travel Management Program (STMP) and designating an individual as a contact person (POC) for STMP. The resolution will authorize the county officer and employees to participate in our program, and recognizes the county's obligation to pay the participation fee. Senate Bill 204 authorizes the STMP to charge a fee for participating in the program. The annual participation fee is to cover administrative costs incurred by the STMP and an invoice has been included in your application package. Payment along with the resolution and POC form must be in our office prior to applying for your Business Travel Account (BTA). County Commissioner's Court: 1. The County Commissioner's Court, of a county wishing to participate in the program, must submit an approved resolution to the STMP. The resolution: a. authorizes a Texas county officer or employee including a county sheriff, deputy sheriff or juvenile probation officer to enter the program; b. acknowledges the County's obligation to pay the participation fee; and c. selects an individual as the Point-of-Contact (POC). 2. The resolution, participation fee, and the POC form must be submitted to: General Services Commission State Travel Management Program P O Box 13047 Austin TX 78711-3047 State Travel Management Program (STMP): 1. Upon receipt of the approved resolution, annual participation fee and POC form the STMP will approve the County for the Business Travel Account (BTA) to be opened. The BTA is the only form of payment accepted by the airlines to use the State's contract airline fares. 2. The County may begin using the contract airfares as soon as they receive their BTA number. 3. Each County is responsible for reconciling and paying the BTA on a monthly basis. 4. The STMP will be available to assist the counties by answering questions. These contracts are valid from September 1, 1999, through August 31, 2000. In accordance with GSC rules, these contracts may be used by a Texas county officer or employee, including a county sheriff, deputy sheriff, or a juvenile probation officer, who Is traveling on official county business, provided that the county has elected to participate In the program that provides this service. Airlines contract with the State of Texas in order to obtain a greater percentage of the State's business. When travelers do not use the contract aldine, the contract carrier does not receive an increase in business and may refuse to contract with the State In the future. Use of the airline contracts can save Texas counties an average of 60% off normal coach fares. Attachment A lists all of the contract city-pairs in alphabetical order along with the contract airline and contract base fare. The base fare does not include the Federal Excise Ticket Tax (including segment fees) or any other mandatory fees assessed by the airlines, airports and/or local govemments. The airlines may round the fares to the nearest dollar amount. However, the base fare must not be higher than the amount listed on Attachment A. Contract airline fares cannot be used for personal travel. ~J Payment Contract airfares can only be purchased when charged to the American Express Business Travel Account (BTA). The American Express BTA begins with a specific prefix that allows the contract airlines to determine if the caller is eligible to receive the contract airline fares. Tickets Tickets may be purchased from travel agencies who have been approved by the Airlines Reporting Corporation, contract airlines, all member airlines of the Airlines Reporting Corporation (where allowed by interline agreement), and all travel agencies who have been appointed by the Airlines Reporting Corporation. Reservations To make reservations, contact your travel agency, or the airline direct. Be sure to identify yourself as a State of Texas county officer/employee and ask for the YCATX fare basis code to ensure you receive the State of Texas contract rate. Airlines have contracts with other governmental entities, so please do not just say you need the government rate. When your reservation is made, simply give the travel agency or the airline the BTA number and the ticket will automatically be charged to the BTA. Class of Service The fare basis codes of 'YCATX' and 'OCATX' have been established to identify the State of Texas contract fare on the contract airline. Reservations for YCATX can be made in the regular unrestricted Y or coach class of service. Reservations for OCATX must be made in the 0 seat inventory. The forms of identification accepted by the contract airlines are: county officer or employee ID; sheriff deputy or juvenile probation officer ID and felony warrant of prisoner being transported; or a letter, on county letterhead, signed by an executive officer of that county department, identifying the bearer as traveling on official county business and authorized to use state contract fares. Penalties and Restrictions State of Texas contract airfares are not subject to any restrictions or penalties. There are no time limitations for advance purchase of tickets, day or time of departure, length of stay, ticket cancellation or change charges, or other special purchase requirements. Additional Charges Fares DO NOT include Federal Excise Ticket Taxes (which also includes segment fees), Passenger Facility Charges (PFCs) - taxes and fees imposed by airports and/or local governments - or any fees for special services such as prepaid ticket charges (PTAs). Exception: AirTran Airways, America West, Austin Express, Frontier, Southwest, and United do not assess a charge for PTAs issued at the contract rate. Matched Fares Airlines who did not receive the State's contract award in a specific city-pair may offer matched or lower 'state rates'. A matched fare or lower 'state rate' is a fare that is only offered to a state or county traveler, not the general public. Use of these matched airfares is not recommended. Thoso services will include, but not be limited to. erosion control, water management, and rural development. This will be carried out by planning and application through informal agreements with land users, or, as required by Federal or State law. An information and recognition program will be used to inform the public. Technical assistance is utilized through a Memo of Understanding between the District and the USDA - Natural Resources Conservation Service. Erosion control will keep the laud productive for its various uses for many generations. Sediment resulting from erosion clogs our local streams reducing water carrying capacity and resulting in local flooding. Excessive siltation ruins our local wetlands, and; therefore. reduces a dwindling wildlife habitat. Silt from erosion carries many pollutants directly into our local streams and rivers. Conservation practices consist of erosion control structures. erosion control ponds. gully shaping. diversions. vegetating old fields, proper management of grazing resources. Water management includes recommendations for proper irrigation, flood control, and water quality. Irrigated crops account for 75% of all water used. Proper irrigation saves that resource for tomorrow's uses including domestic oonsurnption. Proper irrigation helps to keep agriculture pollutants from entering underground water supplies. Conservation practices include total evaluation of irrigation systems and application procedures. precision land leveling, and underground pipeline. Water management includes floodplain management. The District's role in Rural Development in Brazos County is in providing fire protection utilizing dry hydrants. Insurance rata outside the city limits can be lowered a great deal, as well as provide a reliable source of water to fight rural fires. Farm ponds provide the water and we plan the dry hydrant system. The District is evaluating the use of artificial wetlands to replace septic tank filter fields. The prospects are very promising, but, much work mains to be done before this tochnology can be implementod. Water quality in nail Brazos County will be greatly inhanoed if this method can be used. • VW y v i The District and the County have interacted ever since the inception of the District in 1942. (hereinafter "Provider"), located in 1720 Barak Lane, Bryan, Texas 77802, RECITALS: • WHEREAS, the medical care of the County's poor and indigent has become a growing problem; and WHEREAS, the County recognizes that good medical care of pregnant women results in healthier babies and less costly medical expenses incurred for the child in the future by the parents and the Community; and WHEREAS, the Court is interested in promoting such care through the Provider, NOW THEREFORE the parties above stated agree to the following terms and conditions to provide such indigent health care. TERM This contract shall continue in force and effect for a term of twelve (12) months commencing on the 1 st day of October, 1999 and terminating 30th day of September, 2000. CANCELLATION This contract may be canceled by any of the parties hereto upon sixty (60) days written notice as provided herein. SERVICES TO BE PERFORMED BY PROVIDER Provider shall provide the following services through trained, salaried staff to pregnant women who qualify for such services pursuant to the guidelines currently implemented for making such determination: interviews, lab work, physical exams, educational information and medicine as needed (herein "Services"). USE OF COUNTY FUNDS Funds to be furnished to Provider as stated herein below shall be used to pay the partial salary of the Director of Provider and the salaries of other staff as described in Enclosure (1) attached hereto and made a part hereof for all purposes. The County and Provider acknowledge that the County's purpose in providing funds hereunder is to provide medical assistance to qualified 1 • ,K . . a r 'r f~ r, applicants and that the funding of salaries for the trained personnel of Provider is designed to accomplish that goal. COUNTY'S LIABILITY FOR PAYMENT The County agrees to reimburse the Provider for actual cost of the salaries as stated on Exhibit "A" up to a maximum of Sixty Thousand and No/100 Dollars ($60,000.00) for the term of this Contract. This sum shall be paid upon the following dates and in the following amounts: December 15, 1999 $15,000.00 March 15, 2000 $15,000.00 June 15, 2000 $15,000.00 September 15, 2000 $15,000.00 RESPONSIBILITIES OF PROVIDER Provider will be responsible for providing the following Services pursuant to this Contract: I. All necessary application foams to potentially eligible individuals. 2. Obtaining and compiling information on each applicant for Providers Services with regard to residency and financial qualifications. 3. Maintaining this Contract. 4. Providing of the Provider's Services. 5. Maintaining data files on clients and the Services provided thereto. 6. Respond to all and any inquiries by the County regarding the Clinic and its Services. 7. Assist the County with information needed for audit purposes. 8. Provide the County with quarterly financial statements. 9. Provide financial statements evidencing how County funds are spent. Such statements to be submitted to County one week prior to the funding dates set forth herein above. 11. Provide the Court with statistics evidencing the number of Brazos County residents using the Provider's Services and the percentage Brazos County residents comprise of the total population using Provider's Services. RESPONSIBILITY OF COUNTY The County shall be responsible for the following duties and requirements: 1. Provide County funds for the payment of the consideration stated herein. 2. Conduct a review of the Provider's performance in providing the Services to be provided hereunder in order to assess County's continued participation in the funding of the Provider. RECORD RETENTION • The Provider shall be responsible for record keeping on all Services provided to those individuals using its services and all financial records of the Clinic. The Provider agrees to maintain and make available for inspection by the County upon request consistent with personal privacy and subject to the limitation of state law, any and all records the County determines, in its sole discretion, to be necessary for the Court to justify its continued participation in supporting the Provider with funding. Such records shall be retained for at least four (4) years from the date the service was provided. These records shall be made available for inspection and audit by the County, if it so desires. DISCRIMINATION The Provider shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin. The Provider shall take affirmative action to ensure that applicants who are employed are treated during employment, without regard to their race, color, religion, sex, or national origin. Such action shall include, but not be limited to, the following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rated of pay or other forms of compensation; and selection for training, including apprenticeship. The Provider agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this nondiscrimination clause. INDEMNITY The parties hereto agree to indemnify one another for and hold one another harmless from and against all suits, claims, demands, liabilities or actions resulting or alleged to result from the • 3 VU K -Jkp- -o ~ V6 breach, violation or non-performance of the Services stated herein and for any damage to any person resulting from any act or omission or negligence on the part of each party hereto. INSURANCE The parties hereto agree that the Provider shall be an independent contractor and not any employee or agent of the County and that each shall maintain at its own expense, adequate liability insurance to insure against damages and liabilities which may arise due to the duties and obligations contracted for herein. COUNTYINVOLVEMENT The County and Provider state that to the best of their knowledge, no officer, agent or employee of the County who exercises any function or responsibility in connection with the carrying out of this Contract or the Services to which it relates has personal interest direct or indirect, in this Contract. GOVERNING LAW This Agreement shall be executed in and shall be governed by the laws of the State of Texas. A WITNESSETH: WHEREAS, Article 3, Section 52-a of the Constitution, Section 381 of the Local Government Code of the State of Texas and V.A.T.S. §5190.6 provide for COUNTY to engage in economic development activities; and WHEREAS, a primary focus of economic development inquiries is the quality of arts programs in a community; and WHEREAS, ACBV provides assistance to local arts organizations ofthe COUNTY through funding and support for programs involving substance abuse prevention and education for Brazos County children through arts programs and continue to provide arts-related programs and scholarships for young people which foster positive self-image and thereby assists in prevention of drug and alcohol use and abuse; and WHEREAS, Article 152m, V.A.T.S. recognizes that the health, education, and general welfare of the citizens of the State of Texas require promotion and education about the preforming, dramatic, visual and literary arts; and VOL.j , t WHEREAS, said Article permits COUNTY to provide funding for cultural education facilities, and is to be liberally construed; and WHEREAS, ACBV provides funding to member organizations, in part, for facilities acquisition and upkeep, and WHEREAS, Article 5190.7, V.A.T.S. permits COUNTY to assist with urban enterprise zones; and WHEREAS, ACBV, through its funding programs, has provided benefit to Brazos County, Texas through programs attracting over 25,000 participants, and resulting in significant purchases of goods from Brazos County merchants; and WHEREAS, ACBV has provided funding to assist local performing arts groups; and WHEREAS, Chapter 318 of the Local Government Code of the State of Texas provides for historic preservation; and WHEREAS, other programs provided by COUNTY art directly benefited by ACBV and its member organizations. NOW, THEREFORE, COUNTY and ACBV hereby agree as follows: I. ACBV, through its funding and support of members organizations, agrees to provide the above enumerated services which it has provided and agrees to continue to engage in support of arts organizations. Any invention of literacy or artistic production arising out of an assignment shall be the exclusive property of the Volunteer Station and the Volunteer shall have the right to produce additional copies and distribute to the general public. The Volunteers will not receive any pay from a Volunteer Station for their services, they will not be considered an employee and this service will be considered as voluntary contribution to the betterment of the community and the public purpose of Brazos County. Since the Volunteer is not a party to this agreement, the Volunteer Station may require Volunteers who accept service to sign other instruments setting forth other terms and conditions between the Volunteer Station to amend or rescind this contract by mutual agreement.
