Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 24, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. The County Judge gave the invocation and led the pledge of allegiance. The Court next considered Budget Amendment #98/99-36.1 through 36.9, which would reduce the budget for Courthouse Security, increase the budget for Constable Precinct 2; set up a budget for the District Attorney's Child Protective Services activities; and reallocate funds for the District Clerk's office, Tax office, Constable Precinct 6, Agricultural Extension Service, Jail Administration, and County Court at Law #1. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 99-009750 through 99-009960 On motion by Commissioner Jones seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court next considered entering into agreement with Vertex Targeted Opportunities, Inc. for professional services and Initiative #1 in procuring federal financial participation. Commissioner Sims questioned Article II, item 2. He wanted to know if any information violated the privacy act. He was told that it did not. For compensation, Vertex Targeted Opportunities, Inc. will receive twenty-two percent (22%) of all revenue actually earned (prospectively or retroactively) by the County as a direct result of the work VTO completes for the County. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into agreement with Vertix Targeted Opportunities, Inc.. A copy of the Agreement is attached. The Court next considered the standardization of operating hours at all Citizen Trash and Refuse Collection sites. Friday 7:00 a.m. 4:00 p.m. Saturday 8:00 a.m. 4:00 p.m. Sunday Closed On motion by Commissioner Cauley, seconded •by Commissioner Sims, the Court voted unanimously to adopt the standardized operating hours for all the citizen collection sites. A copy of the hours is attached. The Court next considered entering into agreement with the law firm of Meece & Kohn for property located at 201 East Wm. J. Bryan Parkway for use as news media headquarters during the Brewer trial. There will be no cost to Brazos County. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to enter into agreement with Meece & Kohn and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached. The Court next considered establishing a salary for all constables in Brazos County at $32,000.00 per year in the FY 2001 budget which begins on October 1, 2000. Commissioner Sims moved to approve. Commissioner Cauley seconded the motion. After some discussion, Commissioner Sims asked to modify his motion to $36,000.00 annually. Commissioner Cauley modified his second saying that no elected official should make less than a hired employee. The Court voted unanimously to establish the Constables' salary at $36,000.00 annually beginning October 1, 2000. The next matter for consideration was a declaration of local disaster in Brazos County. On motion by the County Judge, seconded by Commissioner Jones, the Court voted unanimously to table consideration until a later date. The Court next considered adopting an order of the Commissioners Court prohibiting outdoor burning, if necessary. On motion by the County Judge, seconded by Commissioner Sims, Commissioners Court meeting 4 the Court voted unanimously to table consideration until Wednesday, August 25, 1999 at 1:340 p.m.. The Court next considered the clarification of costs to be paid from the Courthouse Security Fund. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to table consideration until September 7, 1999. The next matter before the Court was approval of a Disparate Agreement with the Cities of Bryan and College Station concerning to the Local Law Enforcement Block Grant for the Sheriff's office. Commissioner Sims moved to table consideration. Commissioner Cauley seconded the motion. The County Judge asked if the motion could be changed to postpone rather than table consideration. Sims and Cauley withdrew their motion and second. Then on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to postpone action until further word from the Sheriff. On motion by Commissioner Cauley, seconded by commissioner Sims, the Court received, approved and ordered filed as submitted the Treasurer's report for July 1999. A copy of which is attached to and made a part of these minutes. The Court next considered awarding the contract for elevator maintenance. The Purchasing Department published bids for maintenance but received none. The Purchasing Agent contacted Dover, Millar and Montgomery-Kone. Montgomery-Kone was the only interested party. The company offered to perform the maintenance on the four (4) elevators located in the Brazos County Courthouse for a one (1) year period for the amount of $275.00 per each elevator. The Purchasing Agent requested a two (2) year agreement with an option for a third year. The Court next considered awarding the following bid: Bid No. 99-053, Oil Changes, Annual Contract John Hachmann, Purchasing Agent, recommended acceptance of the bid submitted by The Align Guys. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to The Align Guys. A copy of the bid tabulation is attached. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Neil and Lorna Rowan on Lightsey Lane in Precinct 1 to dispose of a tree from the right-of-way of River Road. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. Under announcement of interest items and possible future •I agenda topics, Commissioner Jones made the following comments: 1) Attached to payroll checks will be a memo dealing with parking, ID badges, and security during the Brewer Trial. 2) There is now a new intersection with Gandy Road in Precinct 1. 3) We will need to address a name change for Gandy Road, Sherwood and Blue Ridge. These are now one road. The Sheriff made the following comment: 1) There will be a meeting at 10:00 a.m to inform employees and elected officials about Monday's Courthouse activities., Commissioner Thornton made the following comment: 1) The Law Library will be moved from the Bryan Library by•.September 15, 1999. He needs help in locating space for the books. Ron Schmidt, representing the Boys and Girls Clubs made a presentation to the Court. Ron Rowlett, 3909 Seminol Court, made a presentation to the Court. The County Judge then recessed the meeting until it Wednesday August 25, 1999 at 1:30 p.m.. The County Judge reconvened the meeting of the Commissioners' Court of Brazos County, Texas at 1:30 p.m. on I Commissioners Court meeting 8 August 25, 1999 in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas. The first item for consideration was a Declaration of Local Disaster. Fred Forsthoff, Emergency Manager, reported that the number of fires remained the same but that the drought index was increasing. It is currently at 633. On motion by Commissioner Sims. seconded by Commissioner Thornton, the Court voted unanimously to declare a local disaster. The next matter for consideration was the adoption of an Order Prohibiting Outdoor Burning. On motion by Commissioner i Sims, seconded by Commissioner Thornton, the Court voted unanimously to adopt an Order Prohibiting Outdoor Burning. (hereinafter referred to as "VTO"), located at 2010 Valley View Lane, Suite 300, Dallas, TX 75234. WITNESSETH WHEREAS, many of the services provided by the County are funded directly by local and state funds when, in fact, some of those services are eligible for Federal Financial Participation (FFP); and WHEREAS, VTO is willing and able to provide professional assistance to the County in I securing appropriate FFP; NOW, THEREFORE, for and in consideration of the mutual covenants and promises recorded I herein, the parties hereto agree as follows. ARTICLE I RESPONSIBILITIES OF VTO VTO agrees to perform the following two services: 1. VTO will review the policies and procedures used by the County in order to identify any additional Federal and other revenues sources that could be captured or enhanced by the County and to work with the County to secure those additional revenues. In accomplishing this service VTO will perform the following steps: a. Meet with County officials who represent the programs as agreed to by the County and VTO; b. Create a baseline report that distinguishes Federal reimbursements that are currently being received by the county, and defines the new and/or enhanced opportunities for reimbursement. c. Assist the County in its efforts to recover additional federal dollars that are due to the County, as they are identified by VTO; and r - C] • d. Assist the County in negotiations with Federal agencies to ensure that the County receives the additional revenues identified by VTO. 2. VTO will continually monitor for new opportunities of funding. a. On any new opportunity that arises, the County has sixty (60) days to act on its own. b. If sixty (60) days after an opportunity has become available the County has not acted to claim the new dollars, VTO then may notify the County of the opportunity, aid the county in claiming the new monies, and is due compensation per Article VI. ARTICLE U RESPONSIBILITIES OF THE COUNTY The County agrees to complete the following activities: 1. Designate a contract monitor who shall: A. Be the person responsible for monitoring VTO's performance under the terms and conditions of this agreement; and B. Authorize payment for services rendered based upon properly submitted invoices to the County in accordance with Article VI of this agreement (i.e. Compensation). 2. Provide VTO with copies of or access to documents and databases that are necessary for the successful completion of work required by this agreement. ARTICLE III NOTIFICATION Any notice, specifications. reports, or other written communications from VTO to the County shall be considered delivered when posted by certified mail. Any notice, delivered by certified mail to VTO at the address on the fuel paragraph of this Agreement shall be considered delivered when posted. e- • if U L'6- /7 . akiPwi L,- *76 ARTICLE IV EFFECTIVE TERM Both parties agree that the effective term of this Agreement shall be for a one. (1) year period beginning October 1, 1999 through September 30, 2000. Provided, however, that either party may cancel this Agreement by giving thirty (30) day's written notice prior to the beginning of the County's fiscal year. Upon receipt of such notice, VTO shall complete the federal reimbursement claims for the fiscal year in which the notice is given. VTO shall be compensated for these final federal claims in accordance with Article VI. ARTICLE V RENEWAL Both parties agree that upon conclusion, this Agreement will automatically be renewed on year-by-year basis, under the same terns and conditions as set forth herein, unless written notice is given at least thirty (30) days prior to the expiration of this Agreement. ARTICLE VI COMPENSATION Both parties agree as follows: 1. The intent of this agreement is to compensate VTO only for new revenues received by the County that are expressly deemed to be a result of VTO's efforts. The parties agree that VTO will be compensated for new or enhanced revenue sources that directly result from VTO's activities at the following rate: ev Twenty-two percent (22%) of all revenue actually earned (prospectively or retroactively) by the County as a direct result of the work VTO completes for the County. 2. VTO will be due its fees on new or enhanced federal reimbursements earned on each program area VTO identifies or enhances for a minimum two-year period. The initial start date for each program area will be the date the first new or enhanced claim is submitted for reimbursement. VTO's compensation period may be extended beyond the minimum two- year period, depending on renewals that occur with this contract. 3. Both parties recognize that there may be delays in reimbursement to the County by the Federal government. VTO will be reimbursed within three weeks after funds are actually received by the County and an accurate invoice is delivered to the County by VTO, even if those receipts occur beyond the term of contract. l 27 M • 4. VTO agrees that should any funds recovered by the County as a result of this agreement be subsequently disallowed, any related fees paid to VTO based on such disallowed reimbursements will be promptly repaid to the County should this agreement be terminated. VTO's liability is limited to funds paid to, or owed to. VTO as a result of this contract with the County. 5. VTO is not obligated to make the County aware of absolutely all funding opportunities and is without liability for failure to do so. 6. VTO has the right to review the County's claims, grant awards, and such books, records, and other documents as may be required to ensure that the payment of VTO's fees is in accordance with this Agreement. 7. VTO covenants and agrees to pay and be solely responsible for all its own staff and out-of- pocket expenses that it incurs in providing services hereunder. • ARTICLE VII REPORTS VTO shall furnish the County with periodic reports, at least annually, on the effectiveness of VTO's engagement. A final report shall be made forty-five (45) days after the termination of this agreement. ARTICLE VIII CONFIDENTIALITY The County and VTO mutually agree that the confidentiality of the information obtained by VTO shall be strictly observed, as permitted by law, in any reporting, auditing, invoicing and evaluation, provided however, that this provision shall be construed as a standard of conduct and not a limitation upon the right to conduct the foregoing activities. Lessor hereby leases to Lessee and Lessee hereby leases from Lessor that certain property located at 201 East William Joel Parkway, Bryan Brazos County, Texas, under and pursuant to the following terms and conditions. 1. TEXAS BRAZOS COUNTY COMMISSIONERS COURT DECLARATION OF LOCAL DISASTER THREAT OF WILDFIRES WHEREAS, Brazos County has not had rainfall for an extended period; and WHEREAS, weather forecasters offer little promise of a change in the hot, dry conditions in the near future; and WHEREAS, these hot, dry conditions pose the threat of large, dangerous and fast moving wildfires; and WHEREAS, such fires have the potential of endangering lives and damaging property on a large scale; and WHEREAS, the Texas Disaster Act of 1975 authorized the declaration of a state of disaster "if the threat of disaster is imminent"; and WHEREAS, the magnitude of the potential damage and the rapidity at which such a fire could escalate to major proportions constitute an imminent threat of disaster; and WHEREAS, declaration of such disaster authorized the imposition of controls on activities which tend to increase the likelihood of fires; and WHEREAS, such controls, once implemented, have the potential of protecting lives and property by mitigating the threat of dangerous fires; and WHEREAS, Sec. 418.108 of the Government Code authorizes the governing body of a political subdivision to declare a lorzl disaster; BE IT THEREFORE PROCLAIMED that the Commissioners Court of Brazos County does hereby declare a state of disaster based on the threat of large wildfires in Brazos County, Texas; and BE IT ALSO PROCLAIMED that this state of disaster will continue until rescinded in accordance with the above statute. BE IT ALSO PROCLAIMED that this state of disaster is being declared solely for the purpose of implementing controls aimed at mitigating the hazard posed by wildfires during the hot, dry weather; BE IT ALSO ORDERED THAT the purpose of this order is the mitigation of the hazard posed by wildfires by curtailing the practice of outdoor burning, which purpose is to be taken into account in any enforcement action based upon this order. BRAZOS COUNTY • BRYAN. TEXAS COMMISSIONERS COURT ORDER PROHIBITING OUTDOOR BURNING WHEREAS, in accordance with provisions of the Texas Disaster Act of 1975, Sec. 418.108 and Sec. 418.173 of the Government Code, a state of disaster has been declared based on the imminent threat of disaster from wildfire; and WHEREAS, the provisions of the Brazos County Intequrisdictional Emergency Management Plan have been implemented, and WHEREAS, declaration of such disaster authorized the imposition of controls on activities which tend to increase the likelihood of such fires; and NOW THEREFORE BE IT ORDERED that the following regulations are hereby established for all unincorporated areas of Brazos County, Texas through a period ending September 7,1999: (1) Actions Prohibited: A person violates this order if he/she burns any combustible material outside of an enclosure which serves to contain all flames and/or sparks, or orders such burning by others. (2) Enforcement: (a) Upon notification of suspected outdoor burning, the fire department assigned to the location of the fire shall respond to the scene and take immediate measures to contain and/or extinguish the fire. (b) As soon as possible, a duly-commissioned peace officer shall be sent to the t scene to investigate the nature of the fire. (c) If, in the opinion of the officer at the scene and/or the Fire Chief, the goal of the order can be attained by informing the responsible party about the prohibitions established by the order, the officer may, at his discretion, notify the party about the provisions of this order and request compliance with it. In such instances, an entry of the notification shall be made into the dispatcher's log containing the time, date, and place of the warning, and the name of the person receiving the warning. (3) At the discretion of the Peace Officer and/or Fire Chief, a second or flagrant violation of this order may be prosecuted in accordance with the statutes and procedures t governing misdemeanors. BE IT ALSO ORDERED that this order may be enforced by any duly-commissioned peace officer and that the venue for prosecution of this order will be Justice Court, Brazos County, Texas.
