To make arrangements, call (409) 361-4102. 1' COMMISSIONERS' COURT REGULAR MEETING JULY 27, 1999 • A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 27, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3, Absent; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. The County Judge gave the invocation and led the pledge of allegiance. The Court next heard a presentation by District Judge J. • D. Langley, concerning the following recommendations of the Courthouse Security Committee: 41Purchase pass through metal detector and small conveyor x-ray machine. •Limit public access to courthouse to main entrance only. *Task Sheriff of Brazos County with responsibility for maintaining courthouse security and staffing security vestibule by allowing him 3 additional employees to accomplish such (1 a $38,000/yr and 2 $31,000/yr). *Prohibit employee parking in the main parking lot (closest to main entrance). •Install magnetic card lock system throughout the courthouse Clyde Collins, Chief Deputy, read aloud a letter from the Sheriff. The Court next considered the presentation of a • Resolution of the Brazos County Bar Association concerning the County Law Library. Julie May Young, President of the local Bar Association was the presenter. The Court next considered a request by the County Clerk to create a temporary clerk position. The position is for -dUL f I I Commissioners Court meeting July 27, 1999 2 three days and is necessary for training purposes. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the creation of a temporary position in the County Clerk's office. The Court next considered Budget Amendment #98/99-32.1 . through 32.6, which would set up the budget and department for the TYC Parole Support in Juvenile Services Department; reallocate funds for Environmental Protection, Road & Bridge, and Constable Precinct 6; transfer funds from Contingency to the 85`h District Court; and increase the budget of Court Support Costs. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of the following employees. The Court next considered the following Claims as submitted by the County Treasurer for payment: 99-008875 through 99-009129 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The Court next considered adopting a Resolution authorizing condemnation of 7.25 acres of land owned by Oliver i F. Goen, et al, for county right-of-way for the proposed Greens Prairie Road Extension. On motion by Commissioner • L i Commissioners Court meeting July 27, 1999 3 Jones, seconded by Commissioner Cauley, the Court voted unanimously to adopt a Resolution authorizing the law firm of Bruchez, Goss, Thornton, Meronoff, & Hawthorne, P.C. to institute and prosecute to conclusion, proceedings in eminent domain on behalf of and in the name of Brazos County, Texas' against the owner of the property. A copy of the Resolution i is attached. The Court next considered a budget amendment request from the Brazos Animal Shelter in the amount of $5,313.00 for FY 1998-1999. This adjustment will reflect the final approved budget figure. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment. The Court next considered an amendment to the • Intergovernmental Agreement with the Brazos Animal Shelter. Paragraph 3 and paragraph 13 of the Intergovernmental Agreement dated October 22, 1991 are being amended. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to adopt the amendment. A copy of the amendment is attached. The next matter for consideration by the Court was a request from the City of Bryan for waiver of sixty (60) day notice requirement for the creation of a Reinvestment Zone for tax increment financing withing the zone. The project involves an 18-hole golf course, clubhouse, hotel, and mixed use residential estimated to be between 1000-4000 units. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the request for waiver of the sixty (60) day notice requirement. A copy of the Reinvestment Zone is attached. lei The next matter for consideration was the adoption of a policy for salaries for constapAes for the fiscal year beginning October 1, 2000. This will take place during the budget cycle for the fiscal year beginning October 1, 2000. The Commissioners Court may or will establish the salary for Pie y Commissioners Court meeting July 27► 1999 4 all constables for the county at the same level. The County Judge moved to adopt the policy. Commissioner Thornton seconded the motion. The County Judge, Commissioners Thornton and Cauley voted "Aye". Commissioner Jones voted "No". The motion carried. The Court next considered foregoing the collection and write-off debt of $39,012.67 owed by Bluebonnet Paving pursuant to Colorado Materials vs. Brazos County, Texas and Bluebonnet Paving, Inc., Cause Number 94-0514,207"' District Court, Hays County Texas. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to forego the collection and write-off debt of $39,012.67 on the advise of legal counsel. The next matter for consideration by the Court was a request submitted by the Director of the Computer & Network Services Department requesting approval of state travel for Patricia Fowler. Mrs. Fowler would be traveling to Los Angeles, California to attend the "Sixth National Court Technology Conference" September 14 through the 16, 1999. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to grant the request from the Director of the Computer & Network Services Department and approved payment of out of state travel expense for Mrs. Patricia Fowler. On motion by commissioner Cauley, seconded by commissioner Thornton, the Court voted unanimously to conduct a Public Hearing on August 10, 1999 at 10:30 a.m. to hear commentary for and against the posting of speed limits on Chick Lane in Precinct 4. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a .Tax Resale Deed to the following individual: Sonya Sauseda, M.A.M. Bid 99-059 Janitorial Supplies, Annual Contract on motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Purchasing Agent to advertise for the bids. The Court next considered awarding the following bids: Bid No. 99-034, Shop Supplies and Auto Parts, Annual Contract John Hachmann, Purchasing Agent, recommended acceptance of the bid submitted by Napa Auto Parts as Primary ,in Category A; O'Reilly Auto Parts as Secondary in Category A; Napa Auto Parts as Primary in Category B and Brazos Parts Warehouse as Secondary in Category B. Bid No. 99-046, Office Furniture-Annual Contract 101 John Hachmann, Purchasing Agent, recommended acceptance of the bid submitted by EOS on Sections I,II,III,IV;1-6b; Wiltons on Section IV: 7-8' Boise Cascade on Section IV:O; and to reject Section II: number 11, the item will be discontinued after 10-01-99. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendations of the Purchasing Agent and award the Y 3sioners Court meeting July 27, 1999 6 contracts as stipulated. A copy of each bid tabulation is attached. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Robert G. Garrett on Sand Creek Road in Precinct 2 to stock pile grade 4 rock for the Sand Creek Road. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered approval of the Preliminary Plat of Dawn's Meadows Subdivision in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approved the Preliminary Plat of Dawn's Meadows Subdivision as submitted. On motion by Commissioner Cauley, seconded by Commissioner Jones the Court received, approved and ordered filed as submitted the Treasurer's report for June 1999. Under announcement of interest items and possible future agenda topics, the County Judge made the following comments: 1) When Cellular Phone provider was changed a $10.00 gift certificate was issued for each department using cellular phones. We have a total of $560.00 in gift certificates at this time. We would like to get the gift certificates validated and then give the $560.00 to Child Protective Services for the purchase of clothing or school supplies for the children in their care. The Court then recessed the meeting so that the Court could convene into Executive Session pursuant to 551.071 of the Texas Government Code, consultation with attornev regarding possible litigation. The County Judge reconvened the meeting of the Commissioners' Court of Brazos County, Texas at 10:38 a.m. and announced that there would be no action taken on the Executive Session. There being no further business to come before the Court, the meeting was adjourned. This budget amendment also increases the buddpRett ffbb current ad valorem due to revenue realized in excess Pmpamd trr the AW*Ws Offim pProv y _ 0996WAM VOL f~1 County Commissioners Court, Brazos County, Texas Order No. AN ORDER ORDERING THE CONDEMNATION OF PROPERTY FOR COUNTY RIGHT-OF-WAY WHEREAS, the County Commissioners Court of Brazos County has determined that there exists a public necessity and convenience for the acquisition of a right-of-way, more particularly described on Exhibit "A" attached hereto and made a part hereof for all purposes (the "Property'l, for the public purpose of locating, constructing, maintaining and repairing a road way which shall be an extension of Greens Prairie Road; and WHEREAS, the County has made an offer to purchase the Property to the owner of the Property in writing and in verbal discussions; and WHEREAS, the County has been unable to negotiate with the owner an agreeable purchase price for the acquisition of such right-of-way. BE IT ORDERED BY THE COUNTY COMMISSIONERS COURT OF THE COUNTY OF BRAZOS, TEXAS: Section 1. That the findings and recitals in the preamble of this Order are hereby found and determined to be true and correct and are hereby approved and adopted. Section 2. That a public necessity and convenience exists and ; ty requires the acquisition by Brazos County, Texas, of a right-of-way in fee simple as described in Exhibit "A" for the public purpose and use of and for the location construction, operation, maintenance and repair of a road way, to be part of Greens Prairie Road. Section 3. That the law firm of Bruchez, Goss, Thornton, Meronoff & Hawthorne, P.C. be and is hereby authorized and directed to institute and prosecute to conclusion proceedings in eminent domain on the behalf of and in the name of Brazos County, Texas against the owner of the Property, the same being Oliver F. Goen, Individually, the Estate of Clyde F. Goen, Deceased, the Clyde F. Goen Trust Estate, the Grace Goen Trust Estate and Marcella R. Goen, Individually, and against all other interested owners, lien holders and other holders or claimants of any interest in the Property in order to acquire such right-of-way. Section 4.
