14. Request from Wickson Creek Special Utility District to construct a road bore for water
line installation in the right-of-way of Ferrill Creek Road approximately 0.75 mile from
its intersection with FM 2038. Site is located in Precinct 2.
15. Request from Wickson Creek Special Utility District to construct a road bore for water
line installation in the right-of-way of Lakefront Drive (Forest Lake Estates) near its
intersection with Forest Drive. Site is located in Precinct 3.
16. Presentation of the quarterly delinquent tax report.
17. Announcement of interest items and possible future agenda topics.
18. Call for citizens input and/or concerns.
19. Convene into Executive Session pursuant to 551.072 of the Texas Government Code
to discuss possible acquisition of real property.
20. Consider and take action on Executive Session.
21. Adjourn.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, July 20, 1999, with the following members of
JULY 20, 1999

the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.

The Court next considered Budget Amendment #98/99-31.1
through 31.2, which would set up funding for the County
Attorney Grant "Sale to Intoxicated Persons Program", and
reallocate funds for the office of Justice of the Peace,
Precinct 2. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

Thornton, the Court voted unanimously to approve the changes
as submitted.

The Court next considered the following Claims as
submitted by the County Treasurer for payment:
99-008621 through 99-008874
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to table
consideration of a Resolution concerning the Brazos County Law
Library.
The Court next considered Applications for Tax Refund
from the following:
A. Plantation Oaks, 1400 Plantation Oaks .(2
Applications). In a Court settlement it was agreed
that the appraised value for 1997 on account number
R37890 be fixed at $4,559,142.00 and on account
number R37892 be fixed $4,061,858.00.
B. The Court fixed the appraised value for property
as of January 1, 1998 at $4,576,025.00 on account
R37890 and $4,075,975.00 on account number R37892.
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to refund a total of
$4,087.15 in county taxes for the years 1997 and 1998 on
property number R37890 and to refund a total of $1,329.16 in
county taxes for the years 1997 and 1998 on property number
R37892 to P.O. Apartments LTD, 2602 McKinny Ave, Ste 115,
Dallas, Texas 75204.
On motion by Commissioner Thornton, seconded by
Commissioner Jones, the Court voted unanimously to appoint the
following persons as presiding judge and alternate judge for
the current voting year at the following voting precincts:

The Court next considered rescinding the resolution
adopted July 13, 1999 providing for the sale of property
acquired by the County of Brazos at Delinquent Tax Sale and
Tax Resale Deed for a 116 feet by 68 feet tract in the James
Gray Survey, Abstract 290, to John W. Vaughn.• This was
necessitated because of a clerical error in reporting the
incorrect Abstract number. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously
to rescind the resolution adopted July 13, 1999.
The • Court next considered approving a Resolution
providing for the sale of property acquired by the County of
Brazos at Delinquent Tax Sale and Tax Resale Deed and
authorization of the County Judge to execute tax resale deed
for a 116 feet by 68 feet tract/yin the James Gray Survey,
Abstract 250. The Texas Property Tax Code 534.05(a) provides
that the County may accept a sufficient bid and Mr. John W.

Vaughn bid $150.00 for the property. On motion by Commissioner
Thornton, seconded by Commissioner Cauley, the Court voted
unanimously to approve the Resolution providing for the sale
of property and the Tax Resale Deed and also authorizing the
County Judge to execute the tax resale deed.
The next matter for consideration was approval for the
Purchasing Agent to advertise Bid 98-057 Sale of Courthouse
Phone System. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the Purchasing Agent to advertise for-bids for the sale of the
Courthouse Phone System.
The Court next considered awarding the following bid:
Bid No. 99-006, Cleaning Supplies for County Jail
John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by Wade Supply on items 1 & 9;
Americlean on items 2 & 4; Acme Supply on
items 3 & 8; Southwest Auto-Chlor on item
7; and Eco-Lab on items 5 & 6. On motion
by Commissioner Cauley, seconded by
Commissioner Jones, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract as specified. A copy of the bid
tabulation is attached.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Jackie Robinson on
Macey Road in Precinct 2 to obtain water from the stock pond
for use on improvements to Old Bundick Road. On motion by
Commissioner Thornton, seconded by Commissioner Jones, the
Court voted unanimously to authorize the work subject to
compliance with requirements of the County Engineer. A copy
of the request is attached hereto.
The Court next considered the request from Wickson Creek
Special Utility District.to construct a road bore for water
line installation in the right-of-way of Ferrill Creek Road
approximately 0.75 mile from its intersection with FM2038.

Thornton, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request from Wickson Creek Special
• Utility District and authorized the installation subject to
compliance with requirements of the County Engineer. A copy
of the request is attached hereto.
The Court next heard Shelly Veselka, Representative of
McCreary, Veselka, Bragg & Allen, present a report on
Delinquent Property Tax Collection Activity for the last
quarter.
The County Judge announced the following interest items
and possible future agenda topics:
1) He received a memo from the Sheriff's
office concerning charges that he intends
to make to the Brazos County inmates for
dental and medical services that they are
afforded while they are in the facility.
Along with that the Legislature passed
legislation now allows counties to charge
inmates while they are in the facility.
• 2) The Legislature passed a bill to increase
the fees for the Law Library to $35.00
per filing.
3) In 1996, the Court established fees to be
charged for requested information from
the County. The Court should look at
those charges and make changes if
necessary.
4) He received a letter recognizing Sheriff
Chris Kirk and his department along with
Don Pauler for services in connection
with a mental case.
5) He asked if money had been set aside for
the new telephone system.
6) TxDOT has set aside $228,000.00 for the
Wellborn corridor study. The Federal
Government has set aside $25 million for
the rail road relocation as an 80%;/20%
match. The MPO estimates cost of the
study to be approximately &759,000.00.
Union Pacific has set aside $100,000 for
the study. Approximately $400,000 more
is needed. The MPO may be asking all
entities for an additional $25,000.00 for

! Commissioner Jones made the following comment:
1) He informed the Court of a fund raiser
for the Wellborn Community Center. Total
amount of funds needed for the center is
$150,000.00. So far they have raised
$3,500.00.

The County Auditor made the following comment:
1) He reminded the Court that it had tabled
the Blue Bonnet Paving issue and that it
was not on the current agenda.
Commissioner Cauley made the following comment:
1) Three vendors have been picked for
imaging and site visits have been
planned. It appears that someone is
trying to kill this issue but the County
is going forward with the project.
The County Judge continued with his comments:

1) The budget process is on schedule.
2) Commissioner Sims is absent due to his
attending the NaCO Conference in St.
Louis Missouri.

At 9:50 a.m., the County Judge closed the Commissioners
Court meeting so that the Court could convene in Executive
Session. At 10:15 a.m., the County Judge opened the
Commissioners Court meeting and announced that no action would
be required.
There was no citizen input and/or concerns.
There being no further business to come before the Court, ' `

Commissioners' Court, the following members were present:

THAT WHEREAS, on July 20, 1999 the Court heard and approved a
budget amendment for the 1998-1999 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 1,
1998 the following amendment(s) to the original are hereby

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be Installed 1) within 3.6 of and parallel to the right-of-way One and/or 2) in the
case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction Is necessary, It shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from County right-0f-way.
D) Duch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an Independent Geotechnlcal testing firm; copies of all test results shall
be fumished to the office of the Bravos County Engineer.
E) Construction shall be In strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

In Brazos County, Texas as follows:
The location or description of the proposed Installation Is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that
1. The County Engineer must by notified 72 hours prior to the beginning of
construction in order that he or his designated inspector may inspect the
actual installation.
2. That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or
lower any such Ilno at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines In the right-of-way.
5. That tho line will be constructed and maintained on the County right-of-way in
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
S. That the line or lines will be constructed no less than twenty-four inches (241
lower than the lowest part of the drainage or bar ditch and the drainage Is to
be considered at least two feet (2) below the center of the roadway.
7. That all sites will be barricaded during the construction period.
