IN THE COMMISSIONERS COURTROOM OF THE BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN, TEXAS. 1 1. Invocation - Commissioner Thornton. 2. To make arrangements, call (409) 3614102. •I •I COMMISSIONERS' COURT REGULAR MEETING MAY 24, 1999 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, May 24, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Thornton gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. The County Judge read aloud a Proclamation designating June 6, 1999 as "National Cancer Survivors Dayt. On motion•by Commissioner Sims, seconded by Commissioner Cauley the Court moved to proclaim June 6, 1999 as "Cancer Survivors Day" throughout Brazos County. The County Judge then presented the signed Proclamation to Mrs. Edwina Ramzyck. The Court next considered Budget Amendment #98/99-24.1 through 24.3, which would reallocate funds for Constable, Precinct 2, County Court at Law No. 2 and Juvenile Services. h On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of the following employees. The Court next considered the following Claims as submitted by the County Treasurer for payment: 99-006961 through 99-007209 On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The Court next considered a request by the District Clerk for petty cash funds for clerks. The District Clerk is requesting $400.00 cash be used in implementing new internal control procedures recommended by the Auditor's office. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the establishment of a petty cash fund for the District Clerk's office. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to change the Commissioners Court regular meeting day to Tuesdays. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to authorize the County Judge to execute Tax Resale Deeds to the following individuals: Katherine Diedre Smith - 12.17 acres, more or less, out of the Morgan Rector League, Brazos County, Texas Robert Durens - Tract #2, Lot 10, Block 6, McCullough Addition #3, City of Bryan, Brazos County, Texas The next matter before the Court was a request for a letter of support for an application for grant funding to increase and coordinate community response to child abuse. Bryan/College Station's Project Unity is wishing to expand its successful collaboration through the Office of Juvenile Justice and Delinquency Prevention's Safe Start Demonstration Project. On motion by Commissioner Cauley, seconded by PAGE---kiL I _ o I~ 01 61 01 Commissioners Court meeting May 24, 1999 3 Commissioner Thornton, the Court voted unanimously to write a letter of support for Project Unity. The Court next considered approval of the creation of 14 new jail staffing positions. This request is the result of a staffing analysis conducted by an inspector for the Texas Commission on Jail Standards. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the creation of 14 new jail staffing positions. The next matter before the Court was approval to freeze all salaries at current levels until October 1, 1999. Commissioner Thornton voiced concern about the need to write a policy to allow department heads more authority in increasing salaries. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to freeze all salaries at current levels until October 1, 1999. The Court next considered the creation of a Courthouse Security Planning Committee. The following names have been submitted: Ruth McLeod Bill Thornton John Hachmann Chris Kirk Ed Dobbins J. D. Langley Tony Jones Rick Ravey Ginger Lanehart on motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to appoint the previously named individuals to the Security Planning Committee. The first meeting will be held Wednesday, May 26, 1999. The next matter before the Court was approval of a Supplement to Independent Contractor Agreement between Brazos County and Junction Five- 0-Five to man the Citizen Collection Station in Millican on Kathy Fleming Road. Junction Five-0- Five currently provides man power for the other collection sites around the County. This merely adds and additional site to the original contract. The cost to Brazos County will be $1,186.50 monthly. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously '40L...~J Pht-..FA, 6 • , I I ! Commissioners Court meeting May 24, 1999 4 to approve the Supplement to Independent Contract Agreement with Junction Five-O-Five. A copy of the contractual agreement is attached hereto. The Court proceeded to consider the following blanket Purchase Orders: B/CS Eagle MPO $ 500 Scarmardo Produce Jail $4,000 Sysco Foods Jail $6,750 Alliant Food Jail $7,625 Performance Jail $3,025 US Food Service Jail $2,000 Ben E. Jail $ 750 Ray Criswell Dist Jail $ 750 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Orders as submitted. The Court next considered awarding the following bid and approval of the requisition from Capital Projects, Courthouse Improvements: Bid No. 99-052, Carpet and Cove Base John Hachmann, Purchasing Agent, recommended acceptance of the bid submitted by Aggieland Carpet. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Aggieland Carpet and approved the requisition from Capital Projects, Courthouse Improvements. A copy of the bid tabulation is attached. The next matter for consideration was approval for the Purchasing Agent to advertise for the following bids: Cleaning Supplies for the Jail Jail Commissary Oil Changes - Annual Contract Office Furniture - Annual Contract on motion by Commissioner Sims, seconded by commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for the previously noted items. The Court next considered variance requests of the previously reviewed Replat of Ravenwood Subdivision, lots a r•. I• i ti Commissioners Court meeting May 24, 1999 5 6,7,8,11,13 and 14 in Precinct 3. The Road & Bridge Department received a letter from Bryan Texas Utilities (BTU) stating that BTU will not require a utility easement to be located between Lots 11A and 14A and that there were no conflicts with the replat concerning easements on the other effected lot lines. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve the variances. The Court next considered approval of the Master Preliminary Plat of Lake Placid East in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approved the Master Preliminary Plat of Lake Placid East. The Court next considered approval of the Final Plat of Hefti Subdivision in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approved the Final Plat of the Hefti Subdivision. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for water line installation the right-of-way of Deer Run in Deerfield Estates. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, 401 seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next considered, the request from United Telephone Company for a parallel installation of 1,390.0 feet of cable in the right-of-way of Rusk and Pierce Streets in IVOL..~,yAwL., ~4'11ma Commissioners Court meeting May 24, 1999 6 Millican. The site is located in Precinct 1. The County Engineer noted the following exceptions: 1. This project is on Rusk Street and Pierce Street as noted. 2. This project 652 feet along Rusk Street and 738 feet along Pierce Street. 3. These two roads have very narrow road surface with at least an 80 ft. wide right-of-way; be sure the cable is on the back slope of the ditch and within 5 ft. of the right-of-way. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the request from United Telephone Company of Texas and authorized the installation subject to United Telephone complying with the exceptions noted by the Engineer. A copy of the request is attached hereto. The Court next considered approval of a Memorandum of Understanding with US Audiotex for an Interactive Voice Response service for credit card payment of fines, fees and/or taxes. This is at no cost to the County. The terms of the memorandum shall be valid for a period of thirty days and will continue on a month to month basis until either the County of Brazos or US Audiotex provides a 30 day written cancellation notice. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the Memorandum of understanding with US Audiotex. A copy of the Memorandum is attached. The Court received, approved and ordered filed as submitted the Treasurer's report for April 1999. A copy of which is attached to and made a part of these minutes. The Court next considered approval of the minutes of the Commissioners' Court meetings held in March, 1999 on the following dates: 1, 8, 22, 29; Public Hearing held March 1, and Workshops held on March 29 and 29. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the minutes as submitted. 01 Commissioners Court meeting May 24, 1999 7' The Court acknowledged receipt of the Extension Service reports for April 1999 and acknowledged receipt of reports from the following County and Precinct Offices showing revenues collected and remitted to the County Treasurer: County Clerk District Clerk Justice of the Peace Precinct 2 Justice of the Peace Precinct 3 Justice of the Peace Precinct 4 Justice of the Peace Precinct 5 Justice of the Peace Precinct 6 Constable Precinct 4 Constable Precinct 5 Constable Precinct 6 Brazos County Events Facilities County Attorney Road & Bridge Tax Assessor/Collector A copy of the Officials' reports can be viewed in the County Auditor's office. 401 The County Judge made the following announcements: 1) He received a document from the comptroller's office for uncollected utility money. 2) There will be a Work Shop at 10:00 a.m.. 3) He has received a letter from the retirement system on benefits. 4) He received a letter from Sheila Walker on revenue for the Brazos Center. 5) The Jasper case trial is coming to Brazos County. He has put together a small commit- tee for logistics. John Hachmann, Purchasing Agent, informed the Court that the Auction had gone well. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS that for and in consideration of the mutual conditions and covenants herein set forth the receipt and sufficiency is hereby acknowledged, lei the parties hereto agree as follows: 1. To add to the list of recycling center sites to be operated pursuant to the Agreement the site(s) described on Exhibit "A" attached hereto and made a part hereof for all purposes. 2. COUNTY agrees to payJUNCTION the sum of ONE THOUSAND ONE HUNDRED EIGHTY- SIX and 5L/100 Dollars (a 186.50 per month for the services to be rendered by JUNCTION at the site(s) described pursuant hereto and the Agreement. Key features of the service include: • Settlement of the County of Brazos's U S Audiotex transactions to the appropriate Card associations, Card networks and Card issuers. • Payment to the County of Brazos the total face net amount of its Card transactions. • Provision of processing services including all equipment and software for the purpose of accepting various Cards as agreed to by both parties. U S Audiotex shall provide for the acceptance of fines, fees, taxes and/or other obligations owed to the County of Brazos. • U S Audiotex shall provide storage and retrieval of Card transactions for a minimum of thirty-six (36) months from the transaction date. This responsibility shall survive the termination of the program. • Electronic transmission of all Card transactions to the designated processing center, in real time, as the transactions occur. The system will balance and reconcile each day's electronically captured transactions on a daily basis. The system will, when necessary as a result of such reconciliation, process all appropriate adjustments. • Clear disclosure of convenience fees to cardholders prior to completing the Card transaction. • Authorization code to be obtained on every Card transaction and to be provided to Brazos County to allow for confirmation (see attachment "B'). It is noted that during the program, the County of Brazos will: • Adhere fully to the rules and regulations of the various Card associations, Card networks, Card issuers, and the Local Government Code, Section 132 of Vernon's Texas Code Annotated. • Not impose any surcharges on Card transactions made under this proposal letter. Convenience fees, assessed by U S Audiotex, are permitted for those Card transactions that are processed via the system. ,_'1 I • • • Not require a cardholder, as a condition for honoring a Card, to agree in any way to waive the cardholder's rights to dispute the transaction with the Card issuer (see attachment "B"). • Prior to including any Card specific logos or marks in any signs or in any printed or broadcast materials, the County of Brazos will obtain written approval for such usage from U S Audiotex. • Establish and maintain a reasonable adjustment policy to accommodate adjustments that are required in the normal course of the County of the Brazos's daily operation. The County of Brazos may restrict its adjustment policy, provided that a proper disclosure of such restriction is made to the cardholder at the time that the Card transaction takes place. Proper disclosure may not include any statement that in any way waives a cardholder's right to dispute the transaction with the Card issuer. • Give U S Audiotex the right, at any time, to invoice the County of Brazos for all incoming charge backs, or other types of returned items, that are deemed valid and proper by any of the Card associations, Card networks, Card issuers or any other appropriate regulatory agency. U S Audiotex will only charge the County of Brazos the original amount of the Card transaction that was originally paid to the County of Brazos. U S Audiotex will be responsible for the convenience fees and any new service fees related to the charged back Card transaction, excluding the County of Brazos's bank fees, if any. The County of Brazos will pay such invoices without delay, and never longer than thirty (30) calendar days from the date of the invoice. This responsibility shall survive the termination of this program. • Be responsible for establishing an electronic deposit account for Audiotex's use. • Be responsible for all promotion and advertising of the Card payment program. The County of Brazos will print the system's telephone number on all citations and notices. • Agree that the U S Audiotex system shall be their exclusive Card acceptance service and agrees not to accept Card payments over the counter, through the mail, or through any other service. The terms of this memorandum shall be valid for a period of thirty days and will continue on a month to month basis until either the County of Brazos or U S Audiotex provide a 30 day written cancellation notice. • U S Audiotex retains ownership of all systems and software provided during the program. The program should run for a minimum of six months after advertising appears on the citations and or notice. The program will be extended as necessary until the County of Brazos or U S Audiotex provides a 30-day cancellation notice. The County of Brazos acknowledges that U S Audiotex will be charging a convenience fee to users of the system (see attachment "A").
