National School Lunch Program Application for Juvenile Services Department. b • N Y J COMMISSIONERS' COURT REGULAR MEETING MAY 10, 1999 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Monday, May 10, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct-2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk, Attached is a list of the citizens and officials in attendance. The County Judge gave the invocation and led the pledge of allegiance. There was no citizen input and/or concerns. The Court next considered Budget Amendment #98/99-22.1 , which would reallocate funds for the County Attorney's office. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered the following Claims as submitted by the County Treasurer for payment: 99-006483 through 99-006742 r t Is 61 01 Commissioners Court meeting May 10, 1999 2 On motion by Commissioner Cauley, seconded by Commissioner , Sims, the Court voted unanimously to approve the Claims as submitted. The next matter for consideration by the Court was the approval of members for the On-Site Sewage Facility Order Advisory Committee. The following have been recommended: 1. Builder Joe Courtney Homes 2. Homeowner at Large Doug Garrett 3. Installer Class I & II License James Heath 4. Installer Class I & II License Montel Rutledge 5. Realtor Curtis Cox 6. Road & Bridge Dept Richard Vance Ray Crow 7. Site/Soil Evaluator Jerry Monical on motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to appoint the above named individuals to the On-Site Sewage Facility Order Advisory Committee. Demetrios Basdekas asked what the committee was charged with where upon Julie Anderson, Interim Director of Environmental Health Services explained it to him. The Court next considered a request by Constable, Precinct 5, for installation of emergency lights on a vehicle. Commissioner Cauley moved to approve the request. Commissioner Jones seconded the motion. Commissioners Jones, Thornton and Cauley voted "Aye". Commissioner Sims and the County Judge voted "No". The motion carried. The next matter for consideration was a contract with the Brazos Valley Council on.. Alcohol & Substance Abuse for Juvenile Services. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to table consideration until a later date. The next matter before the Court was the renewal of a Contractual Agreement between Brazos County and the Brazos County Emergency Communications District for emergency communications services dispatching. Effective June 1, 1999, the District is appointed the emergency communications dispatching authority for Brazos•County for the period June 1, 1999 through and including May 31, 2000. On motion by :I V 7 AU h,!~ Commissioners Court meeting May 10, 1999 3 Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with the Brazos County Emergency Communications District for emergency communications services dispatching. A copy of the contractual agreement is attached hereto. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute a Tax Resale Deed to the following individuals: Otis Henry - Northeast % of Lot 2, Block 6, Austin Addition, City of Bryan, Brazos County, Texas Rosalinda E. Stevens - Tract #2, Lot 19, Whitehead Addition, City of Bryan The next matter before the Court was to consider adoption of an Order for Confirming the Creation of Rural Fire Prevention District No. 3. In an election held May 1, 1999 259 votes were cast in favor of formation of the district and 149 votes were cast against formation. On motion by the Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to adopt the Order Confirming the Creation of a Rural Fire Prevention District under the name of Brazos County Rural Fire Prevention District No. 3, under Article III, Section 48-d, of the Texas Constitution. A copy of the order is attached hereto. The Court proceeded to consider the appointment of Rural Fire Prevention District No. 3 Commissioners. The County Judge expressed a desire to wait. Commissioner Sims said he saw no problem with making the appointments now and then moved to appoint the following individuals: 1. Jerry Merker 2. Raymond Plagen 3. Bill Milberger 4. Rusty Lewis 5. Ray Haven on motion by Commissioner. Sims, seconded by Commissioner Thornton, the Court voted unanimously to appoint the previously named individuals to be Fire Commissioners for Rural Fire Prevention District No. 3. ifuL 1 I E Commissioners Court meeting May 10, 1999 4 The next matter for consideration was an application made by Joe E. Smith to receive Military Service Credit with the Texas County and District Retirement System. Submitted with the application is a check in the amount of Ninety Dollars and No Cents ($90.00). On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to forward the application of Joe E. Smith to the Texas County and District Retirement System along with the County's matching funds in the amount of Ninety Dollars and No Cents ($90.00). The Court proceeded to set a date and time for a public hearing for the purpose of establishing speed limits for White Creek Road in Precinct 1 and Lightsey Lane in Precinct 4. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to set the date and time for the lei hearing on Monday, June 7, 1999 at 10:30 a.m.. The Court proceeded to consider the following blanket Purchase Orders: B/CS Eagle MPO $1,600 Lilly Dairy Juvenile Services $1,600 Labatt Foods Juvenile Services $5,500 Talley Chemical Maintenance $2,800 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Orders as submitted. The Court next considered approval of a requisition from the Capital Projects Fund for the following purchase: a) Computer/Printer for Computer & Network Services new telephone system $3,613.00 On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approve the requisition to be paid from Capital Projects Fund. The Court next considered the following requisitions for purchases through sealed competitive bids for the Road and Bridge Department: Bid Amount 1) No. 99-001 - Flexible Base $2,325,750.00 :r .A Commissioners' Court meeting May 10, 1999 5 2) No. 99-028 - Material Hauling $ 200,000.00 On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to approve the above listed requisitions for the Road and Bridge Department. The Court next considered approval for items to be auctioned for sale on May 22, 1999. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the attached list of items to be auctioned. The Court next considered acceptance of a Warranty Deed for improvements on Hardy Weedon Road in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Hardy Lynn Weedon, Jr. for improvements to Hardy Weedon Road. The Court next considered approval of the Replat of Lots 6,7,8,11,13 and 14 of Ravenwood in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1) The Southeast corner of lot 14A has only 20.78 feet of road frontage, there must be a minimum of 70 feet (Article V, Paragraph C, Line 4) ; the frontage is not wide enough for a culvert to be installed. 2) Since there are several lot line revisions, we will need a statement from each utility company indicating they have no conflicts with this replat concerning utility easements. 3) Note #3 indicates there will be no utility easement along new lot line between 11A and 14A due to an existing structure being in the way, this is not acceptable and needs to be cleared up since the utility easement is also the building line. 4) The dimension along the northwest end of the new lot 6A shows to be 160.24 feet; should be 160.13 feet to make the totals correct. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approved the final plat of Ravenwood subject to the developer complying with the exceptions noted by the County Engineer. The Court next considered approval of the Preliminary Plat of Hefti Subdivision in Precinct 2. Richard Vance, c I Commissioners' Court meeting May 10, 1999 6 County Engineer, stated that he had reviewed the plat and offered the following comments: 1) Add note for further clarification to body of plat showing existing access easement and reference it to Note #15. 2) Incorporate requirements from the Health Department into plat notes. On motion by Commissioner Thornton, seconded by Commissioner Jones, the Court voted unanimously to approved the preliminary plat of Hefti Subdivision subject to the developer complying with the exceptions noted by the County Engineer. The Court next considered the request from GTE to construct a road bore and parallel cable installation in the right-of-way of Gandy Road and Old Wellborn Road. The site is located in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the request from GTE and authorized the installation. The Court next considered an Addendum to the Commissioners Court Agenda which was to consider and take action on the renewal of the National School Lunch Program Application for Juvenile Services. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted i- f k x Commissioners' Court meeting May 10, 1999 7 unanimously to once again participate in the program. A copy of the application is attached. Under interest items and possible future agenda topics: 1. Commissioner Sims informed the Court that the committee appointed to oversee the tobacco money met and they were very excited about what's going on and that they had picked a chairman. 2. Kay Hamilton, Treasurer asked if the Commissioners Court would be meeting on Memorial Day. There was no citizen input and/or concerns. If the Contractor fails to provide services in accordance with the provisions of this contract, TDHS may, upon written notice hereinafter referred to as the Contractor, do hereby make and enter into this contract, as required by the National School Lunch Act and the Child Nutrition Act, as arnendod, and the following program regulations: the National School Lunch Program (NSLP), 7 Code of Federal Regulations (CFR) Part 210; the Special Milk Program (SMP), 7 CFR Part 215; the School Breakfast Program (SBP), 7 CFR Part 220; the Summer Food Service Program (SFSP), 7 CFR Part 225; and the Child and Adult Cart Food Program (CACFP) 7 CFR Part 226. L MUTUAL AGREEMENTS The Parties mutually agree: of default to the Contractor, immediately terminate the whole or any part of this contract, including refusal to pay claims for munbursernent, and such termination shall not be an exclusive rrmody but shall be in addition to any other rights and remedies provided by law or under this contract. B. If federal or state laws or other requirements are amended or judicially interpreted so that the continued fulfillment of this 'contract, on the part of either party, is substantially unreasonable or impossible, or if the parties are unable to agree upon any amendment which would therefore be needed to enable the substantial continuation of the services contemplated by this contract then, the parties shall be discharged from any further obligations created under the tams of this contract, except for the equitable settlement of the respective accrued interest or obligations, including audit findings, inured up to the date of termination. C. This contract may be canceled by mmmlal consent. Nothing in this paragraph shall be construed to prohibit immediate cancellation pursuant to above paragraphs A and/or B. II. CONTRACTOR PROGRAM ADMINISTRATION AND FINANCIAL MANAGEMENT A. The Contractor will comply with the applicable regulations for its designated program, as will as 7 CFR Parts 245 and 250, as amended, the Uniform Federal Assistance Regulation (7 CFR, Part 3015, as amended). Audits of State, Local Governments, and Non-Profit Organiutions (7 CFR 3052, as amendod)wA state poIi ks and pmoodurts as issued and 'amended by TDHS. The Contractor further ag ees to perform as described in its application (including its Policy statement and supporting documents, and approved amendments to the application) for participation in the designated program. IL CONTRACTOR PROGRAM ADMIMSMATION AND FINANCIAL MANAGEMENT (Continued) B. The Contractor accepts final administrative and financial responsibility for food service operations in each school, surnmer feeding site, and child and/or adult care facility, hereinafter referred to as a site, operated or sponsored by the Contractor. The responsibility includes any audit exceptions or payment deficiency in the program covered by this contract, and all subcontracts hereunder, which are found after monitoring or auditing by TDHS or USDA and will be responsible for the collgetions and payback of any amount paid in excess of the proper claim amount C. The Contactor submits for TDHS approval only those applications for sites which have delegated the authority for the administration of food service operations to the CootracW or which have executed subegncemcnts with the Contractor for the administration of food services operatics. D. Contractors participating in the NSLP agree 1. that the official signing the Claim for Reimbursement will be responsible for reviewing and analyzing meal counts to ensure accuracy and compliance with federal regulations 2. to enter into an agiew t to ieccive donated foods as required by federal regulations, and 3. to price lunch as a unit E. M. RECORD KEEPING A. The Contractor will keep financial and supporting documents, statistical records, and any other records pertinent to the services for which a claim was submitted in the manner and detail prescribed by TDHS. The records and documents will be kept for a minimum of 3 years and 90 days after the termination of the federal fiscal year for the relevant program. If any litigation, claim, or audit involving these records begins before such period expires, the Contractor will keep the records and documents for not less than 3 years and 90 days and until all litigation, claims or audit findings are resolved. The case is considered resolved when there is a final order issued in liti cation, or a written agreement is entered into between TDHS and the Contractor. The Contractor will keep records of non-expendable property acquired under the contract for 3 years and 90 days after final disposition of the property. B. The Contractor and its subcontractors will allow TDHS and USDA officials and other appropriate officials determined by TDHS to inspect facilities and records and to audit, examine, and copy records at any reasonable time. This includes access to all records of costs paid, even in part, by TDHS. IV. CIVIL RIGHTS POLICY COMPLIANCE A. 'Ilse Contractor agrees to comply with Title VI of the Civil Rights Act of 1964 (Public Law 88-352) and all requirements imposed by the regulations of the Department of Agriculture (7 CFR Part 15), Department of Justice (28 CFR Parts 42 and 50) and FNS directives or regulations issued pursuant to that act and the regulations. Section 504 of the Rehabilitation Act of 1973 (Public Law 93-112), the Americans with Disabilities Act of 1990 (Public Law 101-336), Title IX of the Education Amendments of 1972 (7 CFR Part 15a). the Age Discrimination Act of 1975 (Public Law 94- 135), and all amendments to each, and all requirements imposed by the regulations issued pursuant to these acts. In addition the contractor agrees to comply with Title 40, Chapter 73, of the Texas Administrative Code. These provide in Part that no person in the United States shall, on the ground of race, color, national origin, sex, age, disability, political beliefs, or religion be excluded from participation in, or denied any aid, care, service or other benefits provided by federal and/or state funding, or otherwise be subjected to discrimination. The contractor also agrees to comply with Health and Safety Code Section 85.113 (relating to workplace and confidentiality guidelines regarding AIDS and HIV). The contractor hereby gives assurance that it will immediately take any measures necessary to effectuate this agreement. - • IV. CIVIL RIGHTS POLICY COMPLIANCE (Continued) B. This assurance is given in consideration of and for the purpose of obtaining any and all federal financial assistance, grants and loans of federal funds, reimbursable expenditures, grant or donation of federal property and interest in property, the detail of federal personnel, the sale and lease of, and the permission to use, federal property or interest in such property or the furnishing of services without consideration or at a nominal consideration. or at a consideration which is reduced for the purpose of assisting the recipient, or in recognition of the public interest to be served by such sale, lease or furnishing of services to the recipient, or any improvements made with federal financial assistance extended to the program applicant by the TDHS. This includes any federal agreement, arrangement, or other contract which has as one of its purposes the provision of cash assistance for the purchase of food, and cash assistance for purchase or rental of food service equipment or any other financial assistance extended in reliance Qn the representation and agreements made in this assurance. C. The Contractor agrees to compile data, maintain records, and submit reports as required, to permit eff'odive enforcement of the above Acts and permit authorized TDHS. USDA and FCS personnel during normal workirig hours to review such records, books, and accounts as needed to ascertain compliance with the above Acts. If there are any violations of this assurance, TDHS, USDA and FCS have the right to seek judicial enforcement of this assurance. This assurance is binding on the Contractor, its successors, trarufer es, and assignees as long as it receives assistance or retains possession of any assistance from the department The person whose signature appears on this contract is authorized to sign this assurance on the behalf of the Contractor. D. A religious or charitable organization is eligible to be a contractor on the same basis as any other private organization. The contractor retains its independence from State and local governments, including the contractor's control over the definition. development, practice, and expression of its charitable or religious beliefs. Except as provided by federal law. TDHS shall not interpret this contract to require a charitable or religious organization to alter its form of internal governance or remove religious art, icons, scripture, or other symbols. Furthermore, if a religious or charitable organization segregates the government funds provided under the contract, then only the financial assistance provided by these funds will be subject to audit However, neither TDHS's selection of a charitable or faith-based contractor of services nor the expenditure of funds under this contract is an endorsement of the contractor's charitable or religious character, practices, or expression. The purpose of this contract is the provision of services; no State expenditures have as their objective the funding of sectarian worship, instructions, or proselytization. • A charitable or faith-based provider of services under this contract shall reasonably apprise all assisted individuals of the following: "Neither THDS's selection of a charitable or faith-based provider of services nor the expenditure of funds under this contract is an endorsement of the provider's charitable or religious character. practices, or expression. Section 104 of The Personal Responsibility and Work Opportunity Reconciliation Act of 1996.42 U.S.C. § 604x, sets forth certain additional rights and responsibilities for charitable and faith-based providers of services, certain additional rights of assisted individuals, and certain additional responsibilities of TDHS to these providers and assisted individuals. This contract is subject to those additional rights and responsibilities. V. TDHS CLAIMS PAYMENT TDHS will, subject to the federal appropriation and availability to TDHS of sufficient funds for the applicable program. make program payment to the Contractor in accordance with the terms of this agreement No reimbursement shall be made for performance under this agreement occurring prior to (a) the beginning effective date of this agreanent or (b) a later date established by TDHS based on the date of receipt of a fully executed copy of this agreement. VI. CERTIFICATION A. Regarding Debarment, Suspension. Ineligibility, or Voluntary Exclusion For Covered Contracts - The contractor certifies, by execution of this agreement, that neither it nor its principals is presently debarred, anspendod, proposed for debarment, declared ineligible, or voluntarily excluded from participating in this contract by any federal department or agency or by the State of Texas. By making this certification the contractor agrees to the following terms: 1. The above certificatiea is a material representation of fact upon which reliance was based when this contract was entered into. If it is later determined that the contractor knowingly rendered an erroneous certification, in addition to other remedies available to the federal government, the Department of Health and Human Services, United State Department of Agriculture or other federal department of agency, or, the Texas Department of Human Saviors may pursue available remedies, including suspension and/or debarment. 2. The contractor shall provide immediate written notice to the person to which this certification is submitted if at any time the contractor learns that the certification was erroneous when submitted or has become erroneous by reason of changed circumstances. 3. The words "covered contract," "debarred," suspended," ".ineligible," "participant," "person," "principal," "proposal," and voluntarily excluded," as used in this certification have meanings based upon materials in the Definitions and Coverage sections of federal rules implementing Executive Order 12549. A contractor may rely upon a certification of a subcontractor that it is not debarred, suspended, ineligible, or voluntarily excluded from the covered contract, unless it knows that the certification is erroneous. A contractor must, at a minimum, obtain ccrtificatcs from its covered subcontractor upon each subcontractor's initiation and upon each renewal. 7. Nothing contained in all the foregoing shall be construed to require establishment of a system of records in order.to render in good faith the ratification required by this certification document. Thu knowledge and information of a contractor is not required to exceed that which is normally possessed by a prudcnt person in the ordinary course of business dealings. 8. Except for contracts authorized under paragraph 4 of these terms, if a contractor in a covered contract knowingly enters into a covered subcontract with a person who is suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition to other remedies available to the federal government, Department of Health and Human Services, United States Department of Agriculture, or other federal department or agency, as applicable, and/or the Texas Department of Human Services may pursue available remedies, including suspension and/or dcbarment. B. Regarding Federal Lobbying - This certification applies only to this contract and is a material representation of fact upon which reliance was placed when this transaction was made or entered into.
