THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
APRIL S, 1999 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

COMMISSIONERS' COURT
REGULAR MEETING
APRIL 5, 1999
A regular meeting of 4he Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, April 5, 1999, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The County Judge read aloud a Proclamation designating
the month of April, 1999 as "Sexual Assault Awareness Month".
The Court joins with the local Rape Crisis Center to promote
public understanding of sexual violence and victims of sexual
violence and the need for citizen involvement in efforts to
reduce sexual assault. The County Judge then presented the
signed Proclamation to Ms Heather Mundt, representing the
local Rape Crisis Center.
The County Judge read aloud a Proclamation designating
the week of April 5th to 11th as "National Public Health Week".
The Court joins with Texas A&M University and the Brazos
County Health Department to promote medical health care for
their fellow citizens. On motion by the County Judge,
seconded by Commissioner Jones, the Court moved to proclaim
the week of April 5th to 11th as "National Public Health Week"
throughout Brazos County. The Proclamation was presented to
Robin Johnson and Marcie McDonald representing the Brazos
County Health Department.

The Court next considered Budget Amendment #98/99-16.1
and #98/99-17. 1 through 17.4. Commissioner Cauley moved for
approval of both budget amendments. The motion was seconded
by Commissioner Jones. Commissioner Sims asked Constable,
Precinct 5, how many radios his department had. The County
Judge proposed to amend the motion and second to include
delaying action on amendment 17.2. There was no second to the
amended motion. Commissioners Jones, Thornton, Sims and
Cauley voted "Aye". The County Judge voted "No". The motion
carried. A copy of which is attached hereto.
The Court proceeded to consider the change of status of
the following employees.

on motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered entering into an Interlocal
Governmental Agreement with the City of Bryan for a special
election for a Rural Fire Prevention District #3. The City of
Bryan will conduct a Municipal Election and a School District
Election on Saturday, May 1, 1999. Brazos County has ordered
a special election to be held Saturday, May 1, 1999 for the
purpose of creating a Rural Fire Prevention District. It is
proposed that the City of Bryan and Brazos County hold a joint
election because it would be cost effective and convenient to

the citizens of Brazos County. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to conduct a joint election with the City of Bryan
for the convenience of Brazos County voters on Election day,
May 1, 1999. A copy of the Agreement is attached.
The Court next considered the purchase of two (2) TV/VCR
combinations for the County Attorney's office. On motion by

Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to approve the purchase of two (2) TV/VCR

combinations and authorized payment of the requisition in the

amount of $419.98.
The next matter before the Court was the appointment of

a member to the Brazos County Historical Commission. On
motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to appoint Mrs. Regina
Opersteny to the Brazos County Historical Commission as a
representative of the Czech and Polish citizens of the county.
On motion by Commissioner Thornton, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to the following
individual:
The Truth and the Life Church - Lot 3, Block 1,
Higgs Addition, City of Bryan, Brazos County,
Texas.
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to authorize

the County Judge to execute a Tax Resale Deed to the following
individual:
Oscar Caranza - 50 feet by 100 feet, being Lot 19,
Edward V. Hrdlick's Subdivision, City of Bryan,
Brazos County, Texas.
The Court next considered a request by the Emergency
Management Coordinator to accept donated property. A
computer, monitor, keyboard and mouse have been donated to the
Emergency Management office. On motion by Commissioner
Cauley, seconded by Commissioner Sims, the Court voted

unanimously to accept the donation of the computer, monitor,
keyboard and mouse at a value of $500.00.
The next matter before the Court was consideration of a
request submitted by Constable, Precinct 2, to obtain a used
vehicle from the Sheriff's office. Commissioner Sims voiced
concern over the Deputy Constable running radar on state
highways. Commissioner Jones moved to approve the request.
Commissioner Thornton seconded the motion. Commissioners
Jones, Thornton and Cauley voted "Aye". Commissioner Sims and
the County Judge voted "No". The motion carried.
The Court next heard a request from Constable, Precinct
5 to retain the current two (2) vehicles assigned to that
department after receiving a new vehicle. Commissioner Jones
asked what the car would be used for. The Constable replied
that it would be used for transporting prisoners, serving
papers, running traffic. Commissioner Sims asked when they
patrolled county roads. Constable Butler replied that he had
specific times when he patrolled. Commissioner Cauley voiced
concern over the reduction of law enforcement for a growing
population. Commissioner Jones moved to approve the request.
Commissioner Cauley, seconded the motion. Commissioners Jones
and Cauley voted "Aye". Commissioners Thornton, Sims and the
County Judge voted "No". The motion failed to pass.
The Court next considered the' replacement or repair of
overhead light bars for two cars for Constable, Precinct 6.
Constable Sikes explained the request. Commissioner Jones
moved to approve the request. Commissioner Sims seconded the
motion. Commissioners Jones, Thornton and Cauley voted "Aye".
Commissioner Sims and the County Judge voted "No". The motion
carried.
The Court proceeded to consider the following blanket

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of a requisition from
the Capital Projects Fund for the following purchase:
a) Motorola handheld radio for Constable,
Pct. 5, $570.00
Commissioner Jones moved to approve. Commissioner Cauley
seconded the motion. Commissioners Jones, Thornton, Sims and
Cauley voted "Aye". The County Judge voted "No". The
requisition is to be paid from the Capital Projects Fund.
The Court next considered approval of a requisition from
the DA Crime Fund for the purchase of a Communicator Trial
Package and audio/visual table for the 272nd District
Courtroom. On motion by Commissioner Jones, seconded by
Commissioner Sims, the Court voted unanimously to approve the
requisition to be paid from the DA Crime Fund.
The Court next considered acceptance of a Warranty Deed
for the proposed Greens Prairie Road project located in
Precinct 1. On motion by Commissioner Jones, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the County Judge to accept on behalf of Brazos County a
Warranty Deed from Jean M. Stephen and Carol M. Anderson for
the proposed Greens Prairie Road Project.
The next matter before the Court was the acceptance of a
portion of Timbercreek at Steep Hollow Phase Two being
Planters Loop and Phillips Drive for county maintenance. The
site is located in Precinct 3. Richard Vance, County Engineer
stated that he had reviewed the request and offered the
following exception:
1) Developer will assure that all road name signs are
of design and in place as specified in the Brazos
• County Subdivision and Development Regulations.
On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to accept Planters Loop and
Phillips Drive for county maintenance subject to the developer
complying with the exception noted by the County Engineer.
The Court next considered approval of the re-submission
of the Preliminary Plat of The Oaks At OSR in Precinct 4.

Commissioners Court meeting

Richard Vance, County Engineer, stated that he had reviewed
the plat and offered the following comments:
2) Block 2, Lot 3 does not meet the minimum 70'
frontage on road (Brazos County Subdivision
and Development Regulations, Article V,
Paragraph C. Line 4).
3) The utility easements along OSR and Minh
Street must be 20' rather than the 16, as
shown (Article V, Paragraph C, Line 16)
4) The sharp 900 curve in Colwell Court is not
acceptable - the minimum radius is 300 feet
per Article V, Paragraph C, Line 9 (Engineer
has determined they can not do this;
therefore, they will need to request a
variance stating a satisfactory reason).
5) At the intersection of Matthews Way and Trace
Bend, the intersection must be 900 or the side
of the acute angle must be cut back at a
minimum 50, radius on Block 1, Lot 5 (Article
V, Paragraph C, Line 7).
6) There must be 10' utility easements along the
property lines between Block 1, Lots 6&7 and
Lots 4 & 5.
7) There must be 10, utility easements around the
perimeter of the subdivision along the backs
of all perimeter lots.
7) When developer does his fill for the roadbeds
lying in the flood plain (Trace Bend and Minh
Street), the fill material must come from
within the flood plain on his property and
cannot be imported, unless an adverse impact
study is performed and approved Dy the County
Engineer.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approved the re-
submission of the Preliminary Plat of The Oaks at OSR subject
to the developer complying with the exceptions noted by the
County Engineer.
The County Judge made the following announcements:
1) The budget preparation has begun.
Sometime in mid May, budget requests will
be delivered to department heads.
2) There will be an important meeting for the CUC
concerning the revision of the Texas
Constitution.
y 3) MS funding grant monies need to be disbursed.
4) He received a phone call from a Mr. Ross asking
TXDot about installing boat lamps on the Brazos
River.

This agreement, made this _Mday of 1999 by and between the CITY OF
BRYAN and BRAZOS COUNTY.
WHEREAS, the City of Bryan will conduct a Municipal Election and a School District
Eletion on Saturday, May 1,1999; and,
WHEREAS, Brazos County has ordered a special election to be held Saturday, May 1,
1999 for the purpose of creating a Rural Fire Prevention District; and,
WHEREAS, Section 271.002(b) of the Texas Election Code authorizes more than one
political subdivision to enter into an agreement to hold elections jointly; and,
WHEREAS, the CITY OF BRYAN and BRAZOS COUNTY will hold elections on the
same day; and
WHEREAS, the parties to this agreement desire that a joint election be held that is cost
effective and convenient to the citizens of Brazos County.
NOW THEREFORE BE IT RESOLVED that a joint election be held by the CITY OF
BRYAN and BRAZOS COUNTY, TEXAS under the following terms and conditions, and the
parties herewith agree with said conditions:
1. That there shall be one ballot that contains the appropriate proposition available
for qualified voters of the Rural Fire Prevention District area.
II. That there shall be one set of ballot boxes to be used at the common polling
places.
111. That election forms used and records maintained be combined in a manner
convenient and adequate to record and report the results of the election for
the CITY OF BRYAN and BRAZOS COUNTY.
IV. That the tabulation of the precinct results shall be in a manner to facilitate the
canvass of the returns by the City of Bryan and the Brazos County Commissioners
Court, independently.
V. That Brazos County shall be responsible for the Spanish translation of
all propositions.
VI. That the implementation and actual management of the joint election shall be with
the CITY OF BRYAN with assistance from the Brazos County Clerk's Office
and staff. The implementation and management of the election shall include the
VMRLOCAL GOVERNMENT AGREEMENT

following:
A. The securing of qualified individuals to serve as election judges for each
polling place within the voting precinct.
B. The securing of the location and facilities where election is to be located.
C. The securing of the official ballots, election materials and supplies
requisite to the proper administration of elections under the Texas Election
Code.
D. Securing of a contract for election services and supplies which included
counting of ballots with Texas Voting Systems, Inc.
E. The CITY OF BRYAN to be responsible for conducting joint early voting
at the City of Bryan Municipal Building.
VII. The amount to be paid by BRAZOS COUNTY to the CITY OF BRYAN for
services rendered by said City in the General Election to be held on Saturday,
May 1, 1999 is:
A. CITY OF BRYAN will pay all cost in total.
B. BRAZOS COUNTY will reimburse the CITY OF BRYAN for certain
costs in accordance with the following schedule.
1. 100 percent of all costs incurred for polling places and election
workers located in the proposed Rural Fire Prevention District
area..
2. One-Third (1/3) of the cost of Early Voting.
3. One-Third (1/3) of the cost of publication of all required notices,
with the exception of the Notice of Election, which will be
published by each individual entity.
4. One-Third (113) of costs of the Early Ballot Board and Central
Counting Station.
C. BRAZOS COUNTY shall be responsible for the submission of appropriate
documents to the Attorney General, Civil Rights Division. Voting Section,
Department of Justice, in Washington, D.C. to pursue preclearance of the
election.
