THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON MONDAY,
MARCH 8, 1999 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26"' STREET, SUITE 115, BRYAN,

MARCH 8, 1999
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Monday, March 8, 1999, with the following members of
the Court present: V
Alvin W. Jones, County Judge, Absent;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #98/99-14.1
through 14.4, which would reallocate funds for the Road and
Bride Department, Community Supervision Department and County
Clerk; and increase a line item for Road and Bridge
Improvements. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
budget amendment as submitted, a copy of which is attached
hereto.

The Court next considered the following Claims as

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered the cancellation of the March

15, 1999 Commissioners Court meeting. On motion by
Commissioner Thornton, seconded by Commissioner Sims, Court
voted unanimously to cancel the March 15, 1999 Commissioners
Court meeting.
The Court then considered a request from the Judge of
County Court at Law No. 2 for an increase to the budget. In
a memo, Judge Davis informed the Court that none of the
printed material in his court's library is current nor are
there any active subscriptions for soft bound law books that
are customarily kept on the bench. Commissioner Jones voiced
puzzlement over why Judge Davis didn't have his books updated
and asked if the other Judges had requested these books. On
motion by Commissioner Thornton seconded by Commissioner
Cauley, the Court voted unanimously to approve the budget
increase.
The next matter before the Court was the posting of speed
limits in Enchanted Oaks Subdivision located in Precinct 3.
At a Public Hearing held March 1, 1999 it was recommended that
the speed limit be set at 35 miles per hour throughout the
subdivision. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to set the
speed limit at 35 miles per hour in Enchanted Oaks
Subdivision.

The Court next considered appointing a member to the
Brazos County Historical Commission. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to appoint Mr. Thomas F. Lynch to the
Commissioners Court meeting 3
The next matter for consideration by the Court was a
request submitted by the County Judge seeking approval for
out of state travel for himself. Judge Jones would be
traveling to Philadelphia, Pennsylvania with the Economic
Development Corporation on March 8, 1999. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to approve the request.
On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to adopt a
resolution urging the 76`" Texas Legislature to enact
legislation allowing the creation of a county planning
commissions authorized by the county commissioners to regulate
county subdivision platting and development through a review,
evaluation and approval process.
The next matter before the Court was authorization for
the payment of two invoices incurred by the Brazos Center.
One invoice was to Bossier Chrysler-Dodge, Inc. and the other
was to the American Red Cross - Brazos Valley. On motion by
Commissioner Cauley, seconded by Commissioner Jones, the Court
voted unanimously to authorize the payment of both invoices.
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to set Thursday, April
1, 1999 at 5:30 p.m. as the date and time for the Public
Hearing to consider the petition for the establishment of a
rural fire prevention district.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and R. M. Dudley
for the additions and renovations to the former Juvenile
Probation offices in the Brazos County Courthouse. The cost
to Brazos County will be $496,940.00. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to enter into contractual agreement with R.
M. Dudley. A copy of the contractual agreement is attached
hereto.

The next matter before the Court was the renewal of the

Hewlett-Packard System Support Agreement. Cost to Brazos
County is $6,204.80 for hardware, software and network support
for the period of February 17, 1999 to September 30, 1999. On
motion by Commissioner Cauley, seconded by Commissioner Jones,
the Court voted unanimously to renew the Hewlett-Packard
System Support Agreement. A copy of the Agreement is
attached.
The Court proceeded to consider the following blanket
Purchase Orders:
Office Express District Clerk $2,500
Copy Corner Emergency Management $ 800
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of requisitions from j'
the Capital Projects Fund for the following purchases:
a) Desk and filing cabinet for Auditor's
Office $737.20
b) Office Furniture for Community
Supervision Department $2,558.30
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisitions to be paid from Capital Projects Fund.
The Court next considered approval of a requisition from

On motion by Commissioner Jones, seconded by Commissioner

Cauley, the Court voted unanimously to approve the requisition
to be paid from the General Fund. i
The Court next considered entering into Interlocal
Agreements in order to conduct an auction by the Purchasing
Department with the following entities:

On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to enter into Interlocal
Agreements with the entities noted above in order to conduct
an auction.
The next matter for consideration was the acceptance of
Headwater Lane in Willow Run Phase II Subdivision in Precinct
1, for Brazos County maintenance. The County Engineer stated
that all appeared to be in order and recommended approval. On

motion by Commissioner Jones, seconded by Commissioner Cauley
the Court voted unanimously to accept Headwater Lane for
county maintenance.
The Court next considered approval of the Final Plat of
Oates Acres, being 2 lots out of 8.420 acre tract belonging to
Johnny Oats and wife, Hazel Oates, in Precinct 3. Richard
Vance, County Engineer, stated that he had reviewed the plat
and all appeared to be in order. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to approve the final plat of the Oates Acres
Subdivision.
The Court next considered approval of the Preliminary
Plat of Hicks Lane Estates, in Precinct 3. Richard Vance,
County Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approved the preliminary plat of Hicks Lane Estates as
submitted.
The Court next considered approval of the Final Plat of
High Country Subdivision in Precinct 2. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Thornton,

to approved the final plat of High Country Subdivision.
The Court next considered approval of the Final Plat of

Commissioners Court meeting 6
County Engineer, stated that he had reviewed the plat and
offered the following comments:
•
1) All lots are required to have a minimum 70 ft.
of road frontage (Subdivision Regulations, Article
V, paragraph C, Line 4).
2) Shall be 20 feet utility easements rather than
16 feet along OSR and Minh Street.
3) Shall be 10 feet utility easements around the
perimeter of the subdivision along the backs of all
perimeter lots.
Commissioner Cauley voiced concern over the sewage problems in
the area and asked that soil samples be taken on the lots to
determine the kind of septic system that will be allowed to be
installed. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
preliminary plat of The Oaks at OSR Subdivision subject to the
developer complying with the exceptions noted by the County
Engineer and Commissioner Cauley's requests.

The Court next considered acceptance of Warranty Deeds
from the following on improvements to Smith Lane in Precinct
4. On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to authorize the County
Judge to accept on behalf of Brazos County Warranty Deeds
from:
a. Barbara P. Brown
b. Teuthus Morrow
c. Larry Gilbert

On this the 8th of March 1999 at a regular meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on March 8, 1999 the Court heard and approved a
budget amendment for the 1998-1999 budget year for Brazos County,
Texas.

meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 1,
1998 the following amendment(s) to the original are hereby

To increase the expenditure line item to reflect the actual Reserve Funds for the FYE 9/30/98
which was estimated at $525,000 at the time the budget was being prepared. It was the intent
Commissioners Court to budget all available funds. Per the audit, the final fund balance for the year
ended September 30, 1998 was $720,333. The Certificate of Obligation Series 1996 funds are
required to be spent or under contract by 6/30/1999.

Drawings, Specifications, addenda issued prior to execution of this Agreement, other documents listed in this Agreement and
Modificauons Issued afar execution of this Agreement; these form the Contract, and are as fully a part of the Contract as if attached
to this Agreement or repeated herein. The Contract represents the entire and integrated agreement between the parties hereto

each and every calendar day that Substantial Conpletion is delayed after the date

ARTICLE 5
PROGRESS PAYMENTS
5.1 Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for Payment issued by the
Architect. the Owner shall make progress payments on account of the Contract Sum to the Contractor as provided below and
elsewhere in the Contract Documents.
5.2 The period covered by each Application for Payment shall be one calendar month ending on the last day of the month, or as
follows:

5.3 Provided an Application for Payment is received by the Architect not later than the last
day of a month, the Owner shall snake payment to the Contractor not later than
the Fifteenth (15th) day of the following month. if an Application for Payment is received by the
Architect after the application date fixed above, payment shall be made by the Owner not later than rty (30)

5.4 Each Application for Payment shall be based upon the schedule of values submitted by the Contractor in accordance with
the Contact Documents The schedule of values shall allocate the entire Contract Sum among the various portions of the Work
and be prepared in such form and supported by such data to substantiate Its accuracy as the Architect may require. This schedule,
unless objected to by the Archuec). s rah 11 berused as a basis for reviewing the Contractor's Applications for Payment.

5.5 Applicltions, for Payment shall indicate the percentage of completion of each portion of the Work as of the end of the period
covered by the Application for Payment.
5.6 Subject to the provisions of the Contract Documents, the amount of each progress payment shall be computed as follows:
5.6.1. Take that portion of the Contact Sum properly allocable to completed Work as determined by multiplying the percentage
completion of each pon ton of the Rbrk by the share of the total Contact Sum allocated to that portion of the Wbrk in the schedule
of values, less retainage of five percent
( 5 Pending final determination of cost to the Owner of changes in the Rork, amounts not in the dispute may be
included as provided in Subparagraph 7.3.7 of the General Conditions even though the Contract Sum has not yet been adjusted
by Change Order;
5.6.2 Add that portion of the Contract Sum properly allocable to materials and equipment delivered and suitably stored 21 the
site for subsequent Incorporation in the completed construction (or, if approved in advance by the Owner, suitably stored oft the
,ire at a location agreed upon in writing), kss retainage of five

5.6.3 Subtract the aggregate of previous payments made by the Owner; and
5.6.4 Subtract amounts, If any, for which the Architect has withheld or nullified a Certificate for Payment as provided in Pan-
graph 9.5 of the General Conditions
5.7 The pr ol;rcw payment amount determined in accordance with Paragraph 5.6 shall be further modified under the following
CLrcumstulces.
5.7.1 Add, upon Substantial Completion of the Work, a sum sufficient to Increase the total payments to
Ninety-Five percent ( 95 of the Contract
Sum, less such amounts as the Architect shall determine for incomplete Work and unsettled claims; and
5.7.2 Add, if final complctnon of the Work is thereafter materially delayed through no fault of the Contraaor. any additional
amounvi payahk: in accordance with Subparagraph 9 10.3 of the General Conditions.

ADDENDUM TO AIA DOCUMENT
A101(1987 EDITION)
Article 7.3.1 Contractor to Provide Performance and Payment Bonds.
WITHIN FIVE (5) DAYS AFTER EXECUTION OF THE CONTRACT
DOCUMENTS AND PRIOR TO THE COMMENCEMENT OF ANY OF THE
WORK, Contractor shall furnish to Owner and keep in force throughout the
effectiveness of this Contract a statutory performance bond and a statutory
payment bond in the amount of the Contract Sum set forth in Article 4
hereof, covering faithful performance of this Contract and the payment of all
obligations arising in connection therewith The bonds shall name Owner as
obligee and shall be in such form and with such sureties as Owner may
reasonably approve. Should the surety on such bonds become insolvent or be
put into receivership during the term of this Contract, Contractor shall
promptly notify Owner thereof and shall be obligated to obtain replacement
bonds within ten (10) days after receiving notice of such event, at Contractor's
cost, provided that Contractor shall be entitled to receive any rebate in
premium from the prior surety, if any, and Owner shall not receive credit
therefor, unless and to the extent such rebate exceeds the cost of the
replacement bonds.
Article 7.3.2. Notices. Any notice provided or permitted to be given under
the Contract Documents must be in writing and may be served by depositing
same in the United States postage prepaid, registered or certified, return
receipt requested, or by delivering the same in person to such party, or by
private receipted courier guaranteeing same-day or next-day delivery. Notice
given by mail as herein provided shall de deemed given and received on the
earlier to occur of (i) actual delivery at the address of the named addressee,
whether or not refused or receipted for, or (ii) the third (3rd) day following
deposit with the United States Postal Service, postage prepaid, packaged and
properly addressed as herein provided.
Article 7.3.3. Texas Law. This Agreement shall be governed by the laws of the
State of Texas.
Article 7.3.4. Performance and Enforcement, This agreement is performable
and enforceable in Brazos County, Texas.

contracts and agreements for the performance of governmental functions and services
including administrative functions normally associated with the operation of government
such as purchasing of necessary materials and supplies, and the sale of goods and
equipment in a public auction;
WHEREAS, it is the desire of the aforesaid participating governments to comply
with and further the policies and purposes of the Interlocal Cooperation Act;

possible purchase price for materials and supplies acting individually and without
cooperation; and
