To make arrangements, call (409) 361-4102. i I 1 COMMISSIONERS' COURT JANUARY 26, 1999 ~J REGULAR MEETING A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, January 26, 1999, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Reverend Dr. G. H. Jones gave the invocation and led the pledge of allegiance. • There was no citizen input and/or concerns. The Judge deviated from the agenda and considered item 31, the approval and presentation of a proclamation to the Lions Club of Bryan. The County Judge read aloud a Proclamation congratulating the Bryan Lions Club for its 75 years of outstanding service to the community. On motion by the County Judge, seconded by Commissioner Thornton, the Court moved to approve the proclamation. The County Judge then presented the signed Proclamation to Mr. Charles Ellis, representing the Lions Club of Bryan. The Court next considered Budget Amendment #98/99-05.1 through 09.8, which would increase the fund balance of the Capital Improvement Fund; transfer funds from Contingency to is Justice of the Peace, Precinct 2, Constable, Precinct 2, 361st District Court Administration, Capital Improvement fund for 361" District court, Road & Bridge; and reallocate funds for the 85th District Court, County Court at Law #1, Road & Bridge and County Attorney. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously tint 15 Pimp- i 2 to approve the budget amendment as submitted,- a copy of which is attached hereto. The County Judge voiced displeasure with promoting a person from Clerk 1 position to a Clerk 3 position in three weeks time. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approve the changes as submitted. The Court next considered the following Claims as submitted by the County Treasurer for payment: 99-003059 through 99-003437 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. % The Court next considered a request by Randy Michele, Judge, County Court ht Law #1 for a laptop computer for his office. Five computers were ordered but due to an oversight, only four computers arrived On motion by commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the request of Judge Michele and authorize the purchase of a laptop computer for his use. The next matter before the Court was the appointment of two (2) fire commissioners to the Brazos County Fire V~ to 1 Commissioners Court meeting January 26, 1999 Prevention District #4 Fire Commissioners Board. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the • Court voted unanimously to appoint Betty Putz and Dorothy Dlabay to the Brazos County Fire Prevention District #4 Fire Commissioners Board. Brazos County Community Action Association The Court next considered renewal of a lease agreement between Brazos County and Fred Keller of Brazos County for rental of office space in the building located on 8991 East Highway 21, in Bryan, Texas, for the use of the Justice of the Peace for Precinct 3. Term of the lease is for the period of nine (9) months commencing on January 1, 1999 and ending on September 30, 1999. The County agrees to pay to Mr. Fred Keller the amount of seven hundred fifty dollars ($750.00) per month. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to renew the lease agreement between Brazos County and Mr. Keller for the period stated above. The County Judge stated that he wanted a termination clause in the lease agreement. Commissioner Jones stated that the new Justice of the Peace/Constable building would not be ready until the end of summer when the lease is about to expire. A copy of the lease agreement is attached. The Court next considered a request by the County Attorney for permission to apply for a grant entitled "Sale to Intoxicated Persons" through the Texas Department of Transportation. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to adopt a resolution authorizing the County Judge to make application to the Texas Department of Transportation, for grant funds to participate in the "Sale to Intoxicated Persons" program conducted in coordination with the Texas Alcoholic Beverage Commission and to authorize the County Judge to accept such grant funds should they be tendered. -VC) 76)~. 7 14 1 I 5 Commissioners Court meeting January 26, 1999 The next matter for consideration was a request by the • Personnel Department for Internet access. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize Internet access for the Personnel Department. The Court next considered the selection of a general contractor for the Brazos County Courthouse Juvenile Area Renovation. Commissioner Jones read aloud the total base bid plus alternate no. 1 and alternate no. 2 of each of the following bidders: • R. M. Dudley Matrix Builders Orion Construction Marek Brothers Madison Construction Quad-Tex S1C Construction Jimco Builders He then recommended awarding the base bid to R.M. Dudley along with alternate no. 1 and alternate no. 2. This will be the former juvenile services area along with an entry vestibule at the front of the Courthouse and locking mechanisms. A copy of the bid tabulation is attached. The next matter before the Court was approval of a Contractual Agreement between Brazos County and Buchanan Soil Mechanics for materials engineering and related construction inspection and materials testing services. The cost to Brazos County will be based on the fee schedule that is a part of the contract. The term of the contract will be for calendar year 1999. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to enter into contractual agreement with Buchanan Soil Mechanics. The next matter for consideration was approval for the Purchasing Agent to advertise Request for Proposals (RFP 99- 039), Telecommunication System. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Purchasing Agent to advertise for proposals for a telecommunication system. The Court next considered approval of requisitions from the Capital Projects Fund for the following purchases: a) Body armor for County Attorney 1,810.00 b) Conference table for Justice of the Peace, Precinct 4 $319.95 c) Radios for Road & Bridge $1,327.50 On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the requisitions to be paid from Capital Projects Fund. The Court next considered approval of a requisition from the Capital Projects Account, Replacement Account for the following purchase: a) Printer for the Brazos Center $1,376.09 On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the requisition to be paid from Capital Projects, Replacement Account. The Court next considered approval of requisitions from Non Departmental Fund for the annual copier maintenance agreement with Ikon. On motion by Commissioner Cauley, --1 •1 7 Commissioners Court meeting January 26, 1999 seconded by Commissioner Jones, the Court voted unanimously to ~J approve the requisition in the amount of $22,500.00 to be paid from the Capital Projects Fund. The Court next considered approval of a requisition in the amount of $1,112.00 for the purchase of Office Pro 97 software for the Computer and Network Services Department. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approve the requisition to be paid from Computer Supplies. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Sadie Mahaffey on Deer Park Drive in Precinct 1 to obtain water for use on roadway improvement projects. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Randy Britten on Britten Road in Precinct 4 to obtain water for use on roadway improvement projects. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested • permission to enter the private property of Wade Ross on Hensarling Lane in Precinct 3 to stock pile cover stone for construction on Elmo Weedon Road. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Road and Bridge Department requested permission to enter the private property of Gay Favor on Favor Road in Precinct 1 to make a turnaround for trucks hauling material to an oil field location. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for water line installation in the right-of-way of Steep Hollow Road approximately 0.6 of a mile southeast of FM 1179. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the -installation. A copy of the request is attached hereto. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to receive, approve and order filed as submitted the Treasurer's report for December 1998 and the Quarter Ending December 31, 1998 Treasurer's Report. A copy of which is attached to and made a part of these minutes. The Court next considered approval of the minutes of the Commissioners' Court meetings held on the following dates: October 6, 13, 20, and 27, 1998; Workshops held on September 29 and October 6, 1998 and,a Public Hearing held October 20, 1998. On motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the minutes as submitted. Shelly Veselka, Representative of McCreary, Veselka, Bragg & Allen, presented a report on Delinquent Property Tax Collection Activity. Under announcement of interest items and possible future agenda topics, the County Judge made the following comments: 1) The County Judges and County Commissioners Association will increase its dues. 2) He attended a Conference of Urban Counties (CUC) conference in Austin and the CUC had decided to assess fees to help defray some costs. Brazos County's fee will be $1,000. 3) The new cellular phone supplier is AT&T. Unless someone uses over 325 minutes per month there is no reason to change from analogue to digital. 4) Each Tuesday during the legislative session, there is a breakfast meeting at TAC. We might consider moving the Commissioners Court meeting to Monday during the legislative session. 5) There will be a Workshop February 4, 1999 dealing with Y2K and how if affects Brazos County. Fred Forsthoff, Emergency Manager and Ed Mackenzie, Assistant Manager, will make a presentation. 6) The Expo committee has met and made a recommendation on an architect. 7) Bill McLeod is having surgery to replace a knee. • 8) He had been really excited about the numbers in jail but unfortunately the numbers jumped up over the weekend. There being no further business to come before the Court, the meeting was adjourned. INDEMNITY AGREEMENT • Lessee agrees to indemnify and hold Lessor and the property of Lessor, including the leased premises, fee and harmless, from any and all liability for injury to, or death of, any person, including employees of Lessee or for damage to property arising from the use and occupancy of the leased premises by Lessee or from the act or omission of any person, or persons, including employees of Lessee, in or about the leased premises with the express or implied consent of lessee; provided that nothing in this agreement shall expand or enlarge the liability of lessee greater than that of Lessee under the Texas Tort Claims Act. ALTERATIONS AND II~RONEMENTS Lessee shall make no alterations to the building on the leased premises not construct any buildings or other improvements on the leased premises without first having obtained the written consent of Lessor. LESSOR REPAIRS Lessor shall, at his expense, be responsible for fresh water lines to the building. Unless otherwise herein provided, all 2 VO AU&44 L normal repairs, painting and replacements to the inside of buildings shall be made at the expense of Lessee which shall surrender the same at the end of the Lease term dr any extension thereof in substantially as good condition as when received, ordinary wear and tear, damage by fire or the elements and unavoidable casualties excepted. Lessee shall keep the grass mowed and trimmed around the building. DESTRUCTION OF PREMISES Should any building or improvements on the leased premises be damaged or destroyed by fire, the elements, acts of God, or other causes not the fault of Lessee or any person in or about the leased premises with the express or implied consent of Lessee, they shall be repaired or replaced by Lessor at his own cost and expense and the rent payable by Lessee pursuant to this lease shall be abated to the extent such damage or destruction renders the leased premises uninhabitable by Lessee. Provided however, should the cost of repairing or restoring any buildings or improvements so damaged or destroyed exceed twenty-five percent (25%) of the replacement cost of all buildings and improvements now located on the leased premises, or if more than fifty percent (50%) of the total floor space of the leased premises shall be rendered unfit for Lessee's occupancy this lease may be terminated by either party by ten (10) days written notice. CONDITION OF PREMISES Lessee stipulates that the leased premises, as well as all building and improvements located thereon, are at the date of this lease in good order, repair and a safe and clean condition. UTILITIES All charges for electricity, water and other utility services shall be paid by Lessee. IMPROVEMENTS PROPERTY OF LESSOR All alterations, changes, and improvements built constructed, or placed in the leased premises by Lessee, other than movable personal property shall, unless otherwise provided by written agreement between Lessor and Lessee, be the property of Lessor and remain in the leased premises at the expiration or sooner termination of this lease. Lessee at the termination of the lease shall not be required to restore the improvements to their original condition. Nothing contained in this paragraph, however, shall authorize Lessee to make or place any such alteration, change, or improvements on the leased premises without having first obtained the written consent of Lessor. ASSIGNMENT AND SUBLETTING Lessee shall not assign this lease nor sublet the leased premises or any interest therein without first obtaining the written consent of Lessor, which consent shall not be unreasonably withheld. A consent by Lessor to one assignment or subletting a 109,1 shall not be deemed to be a consent to any subsequent assignment or subletting. An assignment or subletting without the written consent of Lessor, shall be void and shall, at the option of the Lessor, terminate the lease. LESSER'S RIGHT TO PERFORM[ In the event Lessor violates or fails to perform any provisions or agreements of the lease to be performed or complies with by Lessor, and such violation or failure continues for fifteen (15) days after written notice thereof to Lessor, Lessee may, in addition to all remedies available to it, be entitled to perform on behalf of Lessor and deduct all such payments from the rent. DEFAULT BY LESSEE Should Lessee be in default for a period of more than ten (10) days in the payment of any rent payable under this lease or in the performance of any other provision of this lease and such default continues for thirty (30) days after written notice, Lessor may terminate this lease and regain possession of the leased premises in the manner provided by the laws of the State of Texas in effect at the date of such default. HOLD OVER At the expiration of this lease, should Lessee hold over for any reason whatsoever, it is hereby agreed that in the absence of a written agreement to the contrary, such tenancy shall be from month to month only under the same conditions and at the same monthly rental as provided herein. 5 1 r P • • • • i SUBORDINATION OF LEASE This lease and Lessee's leasehold interest under this lease are and shall be subject, subordinate, and inferior to any lien or encumbrance now on the leased premises by Lessor. RIGHT OF INSPECTION Lessor and his agents have the right at all reasonable times during the terms of this lease to enter the leased premises for the purpose of inspecting them and all building and improvements thereon; provided however that the right of inspection shall not extend to any record, the disclosure of which is prohibited by law. NOTICES Any and all notices or other communication required or permitted by this lease to be served on or given to either party to this lease by the other party hereto shall be in writing and shall be deemed duly served and given when personally delivered to the party to whom it is directed, or in lieu of such personal service, when deposited in the United States Mail, postage prepaid, addressed to Lessor, Fred Keller, at 8032 East State Highway 21, Bryan, Texas 77803, addressed to Lessee, Brazos County, 300 East 26th Street, Bryan, Texas 77803-5317 until otherwise notified.
