THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, January 12, 1999, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Judge Jones gave the invocation and led the pledge of
allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #98/99-08.1
through 08.2, which would increase funds budgeted for Justice
of the Peace, Precinct 6, and reallocate funds for Building
Maintenance. On motion by Commissioner Cauley, seconded by
Commissioner Jones, the Court voted unanimously to approve the
budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of

On motion by Commissioner Cauley, seconded' by Commissioner
Jones, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered a request for a budget increase

from the Judge of the 361st District Court. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to approve the request for a budget
increase.
The next matter for consideration was the approval of the
bonds of the following newly elected officials who took office
on January 1, 1999:

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the bonds of
the newly elected officials.
The next matter before the Court was an Interagency
Agreement between Brazos County and the City of College
Station concerning the filing of a joint.grant application

with the criminal Justice Division of the Governor's Office
for funding for the Brazos Valley Narcotics Task Force. On
motion by Commissioner Jones, seconded by Commissioner Cauley,
the Court voted unanimously to enter into an Interagency
Agreement with the City of College Station subject to an
investigation into the Task Force's liability. A copy of the
Agreement is attached hereto.
The Court next considered the appointment of the
following persons to be members of the Brazos County
Historical Commission:

on motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the appointment
of the previously named individuals to the Historical
Commission.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to appoint former County
Judge Richard (Dick) Holmgreen to the Board of Managers of the
Brazos County Emergency Communications District 9-1-1.
The Court proceeded to the selection of the Salary
Grievance Committee for 1999 in accordance with the law. On
motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to select nine (9)
members from the Grand Jury Pool to serve on the Grievance
Committee. The following names were drawn from the list of
persons who served on the Grand Jury during the previous
-twelve months:

on motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to appoint those persons
as their names were drawn.
The next matter for consideration by the Court was the
release and/or retention of bonds rendered by the Justices of
the Peace who left office on December 31, 1998. The County
Auditor stated that he had received certificates from both
Tommy Lyons, Justice of the Peace, Precinct 1 and Wesley Hall,
Justice of the Peace, Precinct 7-2, concerning the surrender
of documents. He then recommended release of all bonds of the
Justices of the Peace. On motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously
-to release all the bonds of the outgoing Justices of the
Peace.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to cancel the January 19,
1999 Commissioners Court meeting.
The next matter for consideration was an application made
by George H. Boyett for military service credit with the Texas
County & District Retirement System. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to forward the application of George
H. Boyett to the Texas County and District Retirement System
along with his check for Five Hundred Forty Dollars ($540.00)
which represents his contribution for the months of military
service for which he seeks credit.
The Court next considered approval of requisitions from
the Capital Projects Fund for the following purchases:
a) 2 Okidata Microline Printers for stock

b) HP Printer replacement for 361st District

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the

requisitions to be paid from Capital Projects Fund.
The Court next considered awarding the following bids and
approving the requisitions for payment:

explained that due to human error the bid
was awarded to the wrong vendor. He then
recommended awarding the bid to Brazos
Bottom Crop Care. A copy of the bid
tabulation is attached hereto.
Bid No. 99-026, Hydrated Lime, Annual Contract

recommended acceptance of the bid
submitted by Austin White Lime. A copy
of the bid tabulation is attached hereto.
Bid No. 99-027, Concrete, Annual Contract

recommended acceptance of the bid
submitted by Transit Mix Concrete. A

hereto.
Bid No. 99-028, Materials Hauling Annual Contract

recommended on 58,42011 acceptance as
primary, of the bid submitted by D & J
Dozer, as secondary Con Agg Transpor-
tation and alternate Young Contractors;
on 80,00011 Primary, Reece Transport,
secondary, J&J Transport and alternate,
Brazos Dozer. A copy of the bid
tabulation is attached hereto.
Bid No. 99-030, Cellular Phones Service, Annual
Contract
John Hachmann, Purchasing Agent,
recommended acceptance of the analog bid
submitted by AT&T Wireless, Option Two,
Government Rate and the digital bid
submitted by AT&T Wireless. A copy of
the bid tabulation is attached hereto.
Bid No. 99-032, Portland Cement, Annual Contract
John Hachmann, Purchasing Agent,
recommended acceptance of the bid
submitted by Young Materials. A copy of
the bid tabulation is attached hereto.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to accept the

recommendation of the Purchasing Agent and award the contracts
as stated and approve the requisitions for payment.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(27). This is for the purchase of cellular phone
service for the Brazos Valley Narcotics Trafficking Task Force
because using Brazos County Bid Number 99-030 Cellular Phone
Service would be cost prohibitive due to the roaming charges.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Exemption
of Competitive Bidding Requirements and approved payment for
said costs for the fiscal year 1998-1999.
The Court proceeded to consider the following blanket
Purchase Order:

On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The Court next considered a requisition for surveying
services from Strong Survey for work on Rabbit Lane located in
Precinct 2. On October 6, 1998, the Court voted unanimously
to grant an exemption from the competitive bidding
requirements and approved payment for all professional
services from Strong Survey. On motion by Commissioner
Cauley, seconded by Commissioner Jones, the Court voted
unanimously to approve payment of the requisition in the
amount of $22,300.00
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Helen Jean
Monteilh's on Long Trussel Road in Precinct 3 to clean out -in
existing drainage ditch to allow water to drain off of Long
Trussel Road. On motion by Commissioner Jones, seconded by

Commissioner Thornton, the Court voted unanimously to
authorize the work.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Gandy Road in Precinct 1. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to authorize the County Judge to
accept on behalf of Brazos County a Warranty Deed from Andrew
Ray White, Lover D. White Woods, Euridell White Clark, Mary E.
White McNeal, Abner White, Jr., Joseph Eli White, Wilbart
Bledsoe, Lula B. White Holiman, Shirley White, Ruthell White
Henderson, Robert D. White and Edna White Goodman for the
expansion and improvements to Fickey Road.
The Court next considered approval of the Final Plat of

Nantucket Cove, a resubdivision of 30.178 acres out of Deer
Park Subdivision in Precinct 1. Richard Vance, County
Engineer, stated that he had reviewed the plat and all
appeared to be in order. Commissioner Jones moved to approve
the final plat of Nantucket Cove, Commissioner Cauley seconded
the motion. Commissioners Jones and Cauley and the County
Judge voted "Aye". Commissioner Thornton abstained. The
motion carried.
The Court next considered acceptance of a Warranty Deed
for right-of-way on Old Bundick Road in Precinct 2. On motion
by Commissioner Thornton, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the County Judge to
accept on behalf of Brazos County a Warranty Deed from Frances
Lynn Truelove for the expansion and improvements to old
Bundick Road.
Under announcement of interest item and possible future

agenda topics:
1. Commissioner Cauley voiced concern over
the County not being a worksite for the
Texas Workforce Commission. Bill Jeanes,
Risk Manager stated that the Workforce
Commission does not cover insurance on an
employee.

The County Judge made the following comments:
1) He received a letter from Ron Steelie, an
employee of the EDC, commending Ray Crow
and Bret Blankner of the Road s Bridge
Department on their mapping knowledge and
skills.
2) He received a letter from Larry Craig,
President of TAC, concerning a symposium
on legislative items.
3) One or two Court members have asked about
a consent agenda. We may have to look
into it.
4) He received a letter and a packet from
the Secretary of State's office
concerning an inspection on election day
and the results of the inspection.
5) Resolutions adopted by the Brazos Valley
COG will be placed on future agendas.
6) The CUC will be meeting tomorrow in
Austin. He will be attending.
7) 5:00 workshop in the 85th District
Courtroom there will be a hearing on
tobacco money disbursement.
8) There will be a Commissioners Court
meeting on Thursday, January 14, 1999 at
5:30 p.m. to hear presentations from
architects for the expo center.
9) Jail reports show that the population in
the jail is down.
10) There will be a workshop at 10:00 to
discuss bids on jail expansion.

Under citizen input and/or concerns, Demetrios Basdekas
asked the procedure on the workshop for the Expo Center and if
there will be citizen input.
At 9:52 the County Judge declared the meeting closed so
that the Court could meet in executive session to discuss
personnel. At 10:25 a.m. the County Judge opened the meeting
to the public and announced that there would be no action
taken on the executive session.
The Court next considered awarding Bid No. 99-033,
Minimum Security Jail Expansion. On motion by the County
Judge, seconded by Commissioner Cauley, the Court voted
unanimously to table consideration until a later time.
The County Judge recessed the meeting until 4:00 p.m.

consider awarding Bid No. 99-033, Minimum Security Jail
Expansion.
The County Judge reconvened the meeting of the
Commissioners' Court of Brazos County, Texas at 4:10 p.m. on
January 12, 1999 in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas. Commissioner Sims
was present for this recoveened session. Commissioner
Thornton asked Rick Ravey, Architect, to make a recommenda-
tion. Ed Dobbins, Maintenance Director, recommended that
Alternate X13 be deleted. On motion by Commissioner Jones,
seconded by Commissioner Thornton, the Court voted unanimously
to delete Alternate N3 from consideration. Commissioner Sims
asked why Alternate $3 was even included in the bid. Mr.
Dobbins explained that the annex needed a roof but the cost
could not be recouped since it would only be used 2 days a
week. The County Judge asked Mr. Ravey for his recommenda-
tion. Mr. Ravey recommended acceptance of the lowest base bid
+ alternates which was submitted by W. M. Klunkert, Inc.. The
other bidders were R. M. Dudley Construction and Bryan
Construction. On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to accept
the Klunkert bid for the addition to the Brazos County
Detention Center. A copy of the bid tabulation is attached.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 12th day of January 1999 at a regular meeting of the
Commissioners' Court, the following members were present:

INTERAGENCY AGREEMENT REVIEW AND APPROVAL
STATE OF TEXAS
County of Brazos
•
This Agreement is entered into by and between the County of Brazos, a political subdivision of
the state of Texas, hereinafter called "County", and the City of College Station a municipal
corporation situated in Brazos County, Texas, hereinafter called "City", pursuant to Chapter 791
of the Texas Government Code, concerning interlocal cooperation contracts.
WITNESSETH
WHEREAS, the County and City wish to file a joint grant application with the Criminal Justice
Division of the Governor's Office, State of Texas, for funding in the amount of $772,025.00 for
the Brazos Valley Narcotics Task Force and
WHEREAS, the County and City along with other political subdivisions of the State of Texas
have agreed to contribute the total of $193,006.00 in matching funds of the total Grant Funding
Request of $772,025.00 as detailed in the budget of attached Grant Application if said joint
application is approved; and
WHEREAS, the source of funds would not normally be used for this purpose; and
WHEREAS, the County and City believe it to be in the in best interests to join in the application
to develop a Narcotic Task Force; and
WHEREAS, the county and City agree to each accept the responsibility to adhere to all pertinent
federal, state and local laws or regulations.

NOW THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
ARTICLE I
PURPOSE
1.01 The purpose of this Agreement is to allow the County and City to file a joint
application for a Grant with the Criminal Justice Division, which creates The Brazos
Valley Narcotics Task Force, which application is attached hereto as Exhibit "A" and
made a part hereof for all purposes.
ARTICLE lI
TERM
2.01 The term of this Agreement is to commence on the execution of this Agreement and
to end May 31, 2000.
ARTICLE III
CONSIDERATION
3.01 As consideration for this agreement, The County and City agree to contribute a total
of $84,671.00 in matching funds for the enhancement of the Task Force in the
amounts as follows:
County: S 41.610.00
City: S 43 -061 .99:
ARTICLE IV
ALLOCATION OF FUNDS
4.01 The specific allocation of the County and City fund is set out in the attached Grant
Application marked as Exhibit "A" and made a part hereof for all purposes.
ARTICLE V
OWNERSHIP OF EQUIPMENT
5.01 Upon termination of this Agreement, ownership of equipment, hardware, and other
nonexpendable items will revert to the applicant for which it was acquired, subject to
the approval of the Criminal Justice Division of the Governor's Office.
ARTICLE VI
AMENDMENTS
6.01 This agreement may be amended by the mutual agreement of the parties hereto in writing
to the attached to and incorporated into this agreement.

LEGAL CONSTRUCTION
7.01 In case any one or more of the provisions contained in this agreement shall be held to
be invalid, illegal, or unenforceable in any respect such an invalidity, illegality,
unenforccability shall not affect any other provision thereof and this agreement shall
be construed as if such invalid, illegal, or unenforceable provision had never been
contained herein.
ARTICLE VIII
ENTIRE AGREEMENT
8.01. This Agreement supersedes any and all other agreements, either oral or in writing,
between the parties hereto with respect to the subject matter hereof, and no other
agreement, statement, or promise relating to the subject matter of this agreement which
is not contained herein shall be valid or binding.

service for the Brazos Valley Narcotics Trafficking Task Force and hereby grants an
exemption from using Brazos County Bid Number 99-030 Cellular Phone Service. The
service would be cost prohibitive due to the area that is not included in the roam free
region of the contract. The Court considers these services necessary to preserve and
protect the public health of the residents of the County, as provided in the Local
Government Code, Section 262.024(a)(2~ The Court hereby approves payment for said
costs for the fiscal year 1998-1999.
