Va ~~Y COMMISSIONERS' COURT REGULAR MEETING OCTOBER 6, 1998 • A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, October 6, 1998, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Thornton gave the invocation and led the • • pledge of allegiance. There was no citizen input and/or concerns. The County Judge welcomed new employee, C. Jack Hunter. Mr. Hunter is the County Extension Agent replacing Dr. Jim Mazurkiewicz. The County Judge then deviated from the agenda and considered agenda item number 6 which was the approval and presentation of a Proclamation concerning Breast Cancer Awareness Month. He then read aloud a Proclamation proclaiming October as "Breast Cancer Awareness Month" and October 16, 1998 as "National Mammography Day". The Court joins with the nation in urging all women and their families 3 in Brazos County get the facts about breast cancer and mammography. On motion by the County Judge, seconded by i Commissioner Jones, Thornton, Sims and Cauley the Court voted to proclaim October as "Breast Cancer Awareness Month" and October 16, 1998 as "National Mammography Day" throughout Brazos County. The County Judge then presented the signed Proclamation to Ms Marcie McDonald, representing the Brazos County Health Department. Commissioners Court meeting October 6, 1998 The County Judge read aloud a Proclamation designating the month of October as "National Arts and Humanities Month". The Court joins with the local Arts Council to participate in and celebrate the cultural riches our community has to offer. On motion by the County Judge, seconded by Commissioners Jones, Thornton, Sims and Cauley the Court moved to proclaim the month of October 1998 as "National Arts and Humanities Month" throughout Brazos County. The County Judge then presented the signed Proclamation to Ms Julie Angelo, representing the local Arts Council who introduced Diane Stropp and Jeanine Wood. The Court next considered the following Claims as submitted by the County Treasurer for payment: 99-000001 through 99-000220 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The Court next considered entering into agreement with the Arts Council of Brazos Valley. The Arts Council will provide assistance to local arts organizations of the County through funding and support which improves the quality of life in the County and.in turn assists in attracting industry and business to the County. Term of the Agreement is for October 1, 1998 and ending September 30, 1999. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to enter into agreement with the Arts Council of Brazos Valley and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached hereto. - The next matter before the Court was approval of a Contractual Agreement between Brazos County and the Brazos County Soil and Water Conservation District #450. The District will provided soil and water conservation services to the residents of Brazos County and to the County proper such as erosion control, water management and rural development. The cost to Brazos County will be $4,400.00 annually. The term of the contract will be fiscal year 1999. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with the Brazos County Soil and Water Conservation District #450. A copy of the contractual agreement is attached hereto. The next matter before the Court was approval of a Contractual Agreement between Brazos County and Brazos Beautiful, Inc.. Brazos Beautiful strives to improve waste handling practices and improve litter control. The cost to Brazos County will be $12,000.00 annually. The term of the contract will be fiscal year 1999. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with Brazos Beautiful, Inc.. (T.V.S.). T.V.S. will provide election services and supplies to conduct the General Election and a College Station Bond Election to be held on November 3, 1998, in Brazos County, Texas.. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with Texas Voting Systems, Inc.. A copy of the contractual agreement is attached hereto. The Court next considered renewal of a lease agreement between Brazos County and Fred Keller of Brazos County for rental of office space in the building located on 8991 East Highway 21, in Bryan, Texas, for the use of the Justice of the Peace for Precinct 3. Term of the lease is for three months commencing on October 1, 1998 and ending on December 31, 1998. The County agrees to pay to Mr. Fred Keller the amount of seven hundred fifty dollars ($750.00) per month. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to renew the lease agreement between Brazos County and Mr. Keller for the period stated above. A copy of the lease agreement is attached. The court next considered a request from Constable Precinct 6, Phil Sikes, to appoint Daniel Martinez as a Non- paid Reserve Deputy Constable. on motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Constable Sikes to appoint Daniel Martinez as a Non-paid Reserve Deputy Constable subject to appointment being within the allotted number of deputies. The Court next considered the approval of a modification to the contract with Ravey & Associates for additional architectural services for the Adult Detention Center Addition. In a letter to the court Rick Ravey, Architect, indicated that Sheriff Kirk had request changes to the layout of the isolation cell area. This will constitute additional services and will have to have approval from the Court. The estimated cost for the work is $5,000.00 to $6,000.00. The Court next considered authorizing the Auditor's office to process recurring payment requests for the following: a) Fred Keller, for lease of building for Justice of the Peace 3 office, $9,000.00 b) Dr. Rany Cherian for health care of inmates both adult and juvenile, $36,000.00 c) Brazos Maternal & Child Health Clinic, Inc., for prenatal care of poor and indigent $60,000.00 d) Star Armored, Inc., for transport of currency, coin, negotiable instruments and other documents for Treasurer's office, JP, Precinct 6 & Juvenile Services $7,200.00 e) Montgomery Kone, for elevator maintenance $3,878.00 f) Becky Segrest for serving on Juvenile Board $600.00 g) City of Bryan housing and maintaining County Law Library $10,956.00 h) Mike Hensarling, office space for Justice of the Peace and Constable, Precinct 2 $7,200.00 i) College Station ISD for office space for Justice of the Peace and Constable, Precinct 6 $12,000.00 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Auditor's office to process all the previously noted recurring payments. The Court next considered establishing a speed limit for Sweetwater Drive in Precinct 1. The Court held a Public Hearing to consider the posting of speed limits on Tuesday, September 29, 1998 at 10:00 a.m.. The Engineer's office stated that the 85% was 41 mph. It was then recommended that the speed limit be set at 40 mph. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to set the speed limit on Sweetwater Drive at 40 mph. 3 t c2 x' ti f`r f r l , Commissioners Court meeting October 6, 1998 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to hold a Public Hearing on Tuesday, October 20, 1998 at 10:00 a.m. to consider establishing a speed limit on North Dowling Road from Quail Run Drive to Hoppes Creek Road in Precinct 1. The Court next considered terms for right-of-way acquisition for a specific tract of land for the proposed Greens Prairie Road Extension located in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the terms for right-of- way acquisition. A copy of those terms is attached hereto. The Court next considered acceptance of a Warranty Deed for right-of-way on Greens Prairie Road in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from C.M. Anderson Properties, Ltd., Carol Anderson, General Partner for the expansion and improvements to Greens Prairie Road. The total cost is $40,000.00 and they are asking the County to fund 1/3 of the cost. 4) He reminded the Court of when it declined $1800 for EMS Trauma Service. A new offer has been received increasing the amount to $3392. Texas through programs attracting over 25,000 participants, and resulting in significant purchases of goods from Brazos County merchants; and WHEREAS, ACBV has provided funding to assist local performing arts groups; and WHEREAS. Chapter 318 of the Local Government Code of the State of Texas provides for historic preservation; and WHEREAS, other programs provided by COUNTY art directly benefited by ACBV and its member organizations. NOW, THEREFORE, COUNTY and ACBV hereby agree as follows: 1. Educate the community on the need for buying recycled products through the use of displays in the local schools, libraries, shopping malls, and wherever else requested. Organize and train area teachers on the importance of litter abatement, recycling, buying of recycled products, maintain recycling boxes in area schools used as teaching aids and maintain a lending library to assist area teachers in teaching litter control and reuse practices. If less than fifty percent (60%) of the total floor space of leased premises shall be uninhabitable and repair and restoration can be accomplished within ninety (90) days. Lessor may, at his option, either repair and restore the damaged buildings and improvements or cancel this lease and retmu any unearned rent previously paid by Lessee under this lease. CONDITION OF PREMISES Lessee stipulates that the leased premises, as well as all building and improvements located thereon, are at the date of this lease in good order, repair and a safe and clean condition. All charges for electricity, water and other utility services shall be paid by Lessee. It has been determined that 29.52 acres of your property will be required for the construction of this project. Brazos County agrees to the following terms and conditions in exchange for your conveying this 29.52 acres- 1. Based on an appraisal, made by a qualified appraiser, the County is authorized to offer you $35,04100 for 29.52 acres of your property required for right-of-way. Commissioner's Court will mail the $35,041.00 to you within 15 days of acceptance of the Warranty Deed. 2. Build approximately 15,000 feet of new 5-strand barbed wire fence using 12-1/2 ga. American made barbed wire with cedar comer posts in concrete. Cedar line posts will be placed every 50' with metal t posts in-between on 10' centers. Cedar posts will be used for the horizontal bracing. Wire will be placed on property owner's side of the fence. 3. Install six (6), more or less, 16' x 2" heavy duty galvanized tubular gates at locations designated by property owner. These gates will be installed flush with the new fence line. Brazos County will install any other gates in the right-of-way perimeter fence provided and located by the property owner (property owner to furnish materials only) Any gates placed at utility crossings will not count against the six to be installed for property owner. 4. Construction of seal coated access roads, with installation of culverts; from the proposed Greens Prairie Road to the perimeter gates will be built and maintained by Brazos County. 5. Clear an additional 12' swath along the new fence line on your property for a firebreak and to allow the fence builders room to work. The County will also push -the trees and brush from this 12' swath into County right-of-way for disposal. 7. Install cattle guards furnished by property owner at initial time of construction. 8. Install one (1) 8' culvert with concrete bottom at a location to be designated by property owner. This site will coincide with the Station No. as shown on Profile Map prepared by Strong Surveying Company where the old hunting road meets the north side of the new right-of-way. A funnel fence using same materials as perimeter fence will be installed around this area. 9. Damages in the amount of $4,000.00 will be paid to property owner to allow for his securing of the additional clearing of brush to facilitate his cattle reaching pastures from the cattle crossing provided by Brazos County. This item was not addressed in the appraisal prepared by Steven Trent Lovett dated August 6, 1998. 10. Brazos County will make reasonable efforts to control erosion. This will include the design of all culverts on a 100-year storm frequency. Installation of erosion control measures on the downstream side that reduces velocity to that which existed prior to installation of the culverts. Those measures may include, but not be limited to, grassed channels (using TP-61, or more current, design criteria), concrete aprons, energy dissipators, filter cloth with/without block paving, rock rip-rap. It is understood and natural that a blowhole below the pipe discharge will occur. Measures installed on the Anderson property will be able to be maintained by Anderson or, in the case of major practices that involve concrete, by Brazos County. All culverts will be designed so that temporary storage of water will not be long enough (one-week) for the area to be considered a man-made wetland as would be determined today by U.S. Corps of Engineers. 11. timber recovery fee to be paid to property owner. 12. Property owner shall have access to his south pasture at both Tonkaway Lake Road and the existing TMPA easement locations from the County right-of-way before and during construction of the proposed Greens Prairie Road.
