A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, September 15, 1998, with the following
members of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Jones gave the invocation and led the pledge

of allegiance.
Under citizen input and/or concerns, Demetrios Basdekas
announced that the Sheriff's Citizen Academy would be holding
a fund raiser at the Kurten Community Center on September 19,
1998 and invited all to attend.
The Court next considered Budget Amendment #97/98-45.1
through 45.5, which would increase funds budgeted for General
Obligation Debt Service, and reallocate funds for County Court
at Law #1, Treasurer, Juvenile Detention Services and Road and
Bridge. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered adoption of an order Dividing
Election Precinct 28. The Commissioners Court, the Democratic
Party and the Republican Party have all received complaints
about the location of the polling place for Election Precinct
28. The northern part of the precinct is the most populated
but the polling place is in the far southern area. It is
proposed that Election Precinct 28 be divided into two (2)
election precincts at the right-of-way line for the extension
of Greens Prairie Road and that the northern area be numbered
Election Precinct 28A and the southern area be numbered
Election Precinct 28B. The polling place for Election
Precinct 28A can be combined with the polling place for
Election Precinct 59 which is located in the Holy Cross
Lutheran Church on Fox Fire Drive, in College Station, Texas
for the November 3, 1998 election. on motion by Commissioner
Jones, seconded by Commissioner Cauley, the Court voted

unanimously to adopt the Order for the Division of Election
Precinct 28. A copy of the order is attached hereto.
On motion by Commissioner Cauley, seconded by
Precinct 1.
The next matter for consideration was the renewal of a
contract between the Retired Senior Volunteer Program (RSVP)
and Brazos County. Brazos County will pay $2,500.00 to RSVP
and in exchange, RSVP will provide volunteers to help the

Cauley, the Court voted unanimously to table consideration of
Commissioner Sims, the Court voted unanimously to hold a
Public Hearing on Tuesday, September 29, 1998 at 10:00 a.m. to
consider the posting of speed limits on Sweetwater Drive in
citizens of Brazos County. Term of the contract will be from
October 1, 1998 to September 30,- 1999. On motion by the
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to approve the contract with the Retired

The next matter before the Court was the appointment of
a representative to the Economic Development Corporation's
Board of Directors. On motion by Commissioner Jones, seconded
by Commissioner Cauley, the Court voted unanimously to appoint
Lynn Stuart to the Economic Development Corporation's Board of
Directors.
Senior Volunteer Program. A copy of which is attached.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to table consideration of
the Agreement with the Mental Health Mental Retardation
Authority of Brazos Valley. There was a discrepancy between
the contract amount and the budgeted amount.

The Court next considered renewing the Contract with the
Brazos Valley Council of Governments (BVCOG).' The BVCOG will
administer the Brazos County Indigent health Care Program.
Commissioners Court meeting September 15, 1998
The cost to Brazos County will be $54,000.00. The term of the
contract will be from October 1, 1998 to September 30, 1999.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to enter into contractual
agreement with the Brazos Valley Council of Governments. A
copy of the contractual agreement is attached hereto.
The next matter for consideration by the Court was a
request submitted by the Director of Computer & Network
Services seeking approval for out of state travel for Ernie
Laney. Mr. Laney would be traveling to Nashville, Tennessee
to attend a Zortec User's Conference September 21 through the
23, 1998. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to grant
the request from the Director of Computer & Network Services
and approved payment of out of state travel expense for Ernie
Laney.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following:
Brookshire Brothers, LTD., a Texas Limited
Partnership - Lot 8, Block 46, City of Bryan,
Brazos County, Texas
The Court next considered a request from Constable
Precinct 5, Isaac Butler, to appoint Cheryl Denise Daniels as
a non paid Reserve Deputy Constable. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the court
voted unanimously to approve the request from Constable Butler
to appoint Cheryl Denise Daniels as a non paid Reserve Deputy
Constable subject to appointment being within the allotted
number of deputies.
The Court next considered the request from Wickson Creek
Special Utility District to construct a road bore 35 feet long
for water line installation in the right-of-way of old
Reliance Road approximately 1600 feet from its intersection
with Carrabba Road. The site is located in Precinct 2. The
County Engineer stated that all appeared to be in order and

recommended approval. on motion by Commissioner Thornton,
seconded by Commissioner Cauley, the Court voted unanimously

The Court next considered approval of the Final Plat of
Robin Hudson Subdivision in Precinct 1. Richard Vance, County
Engineer, stated that he had reviewed the plat and offered the
following comment:
1) Add "Private or PVT" to Clayton Lane for
clarification.
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approved the final
plat of the Robin Hudson Subdivision subject to the developer
complying with the exception noted by the County Engineer.
r The Court next considered approval of requisitions from
the Capital Projects Fund for the following purchases:
a) 20 Ton Air/Hydraulic Jack and 1 Ton
Hydraulic Transmission Jack for Road &
Bridge $2,158.00
b) Six (6) four drawer lateral file cabinets

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the requisitions
! to be paid from the Capital Projects Fund.
The Court proceeded to consider the following blanket

Sims, the Court voted unanimously to approve the Blanket
Purchase order as submitted.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Daniel & Son

Funeral Home for transportation to and from Bexar County to
the Medical Examiner's Office. Cost to Brazos County will be
$125.00 for staff and professional services plus $1.25 per
loaded mile to the Medical Examiner's Office in San Antonio.

{ For round trip to Medical Examiner's Office in Bexar County a
total amount of $520.00 will be paid. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to enter into contractual agreement
with the Daniel & Son Funeral Home. A copy of the contractual

agreement is attached hereto.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in August, 1998 on the
following dates: 4, 11, 18, 25 and for Public Hearings held
on August 18 and 25, 1998. on motion by Commissioner Cauley,
seconded by Commissioner Thornton, the Court voted unanimously

i to approve the minutes as submitted.
f The next matter before the Court was rescinding the
outdoor burning ban in Brazos County. Commissioner Sims
explained that the Court once again contacted the Forest

Service and were informed that the drought index for Brazos
I
( County was 8. Being that the safety factor is below 500 KBDI,
E Commissioner Thornton moved to rescind the outdoor burning
t
ban. Commissioners Jones, Sims and Cauley seconded the motion
and it carried unanimously.
Commissioner Sims made the following comment:
1) He noted that the Rural Fire Departments
voiced appreciation for the cooperation
of the rural citizens in observing the
burning ban.
The County Judge made the following comment:
1) He reminded the Court that there would be
no Commissioners Court meeting on
September 22, 1998.
Commissioner Jones made the following comment:
1) The Regional Water Committee is
developing grant applications.
There was no citizen input and/or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

THAT WHEREAS, on September 15, 1998 the Court heard and
approved a budget amendment for the 1997-1998 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 23,
1997 the following amendment(s) to the original are hereby

WHEREAS, the Brazos County Commissioners Court has received numerous calls and
i complaints from the voters about the location of the polling place for Election Precinct 28; and
WHEREAS, the Republican Party of Brazos County has advised the Commissioners
Court that they have heard from voters complaining about the location of the polling place and the
c
distance the voter has to travel to vote; and
WHEREAS, Neeley Lewis, County Chairman of the Democratic Party of Brazos County
has notified the Commissioners Court that he has had numerous complaints from voters about the
distance they have to travael to vote and the accessibility of the polling place located on Peach
i
Creek Road; and
WHEREAS, the polling place for Election Precinct 28 is located at the south end of the
precinct on Peach Creek Road; and
WHEREAS, the majority of the voters of Election Precinct 28 are located in the northern
part of the precinct; and
WHEREAS, Brazos County owns the right-of-way for the extension of the existing
Greens Prairie Road, which could be used as a dividing line for Election Precinct 28; and
WHEREAS, dividing Election Precinct 28 into Precinct 28A and Precinct 28B would
benefit all voters in the precinct by allowing the voters in the northern most populated area to be
placed in Election Precinct 28A and the voters in the southern area to be placed in Election
Precinct 28B:
NOW, THEREFORE BE IT ORDERED BY THE COMMSSIONERS COURT OF

BRAZOS COUNTY, TEXAS THAT:
Pursuant to Chapter 42 of the Texas Election Code, Election Precinct 28 be divided to
wit:
(1) Election Precinct 28 be divided into two (2) election precincts at the right-of-way
line for the extension of Greens Prairie Road; and
(2) That the northern area be numbered Election Precinct 28A and the polling place be
combined with Election Precinct 59, located in the Holy Cross Lutheran Church on Fox Fire
4 Drive, College Station, Texas for the November 3, 1998 election; and

the Peach Creek Community Center on Peach Creels Road, College Station, Texas; and
(4) . That submission be made to the Assistant Attorney Cenral, Civil Rights Division,
Voting Section. Department of Justice, Washington D.C. requesting preclearance of this Order

Retired and Senior Volunteer Program
of the Brazos Valley
CONTRACT SOR SUPPORT BY BRAZOS COUNTY, TEXAS
Brazos County, Texas and the Retired Senior Volunteer Program, under the
sponsorship of the Brazos County Community Council and hereinafter referred to as
RSVP for the covenants and consideration herein expressed, mutually agree to the
following terms and conditions:

Brazos County, Texas agrees to pay the total sum of n1,560 to RSVP in a single
payment on or before March 31, 1999. All payments will be payable to the Retired
Senior Volunteer Program and mailed to their current address: 305 S. Main Suite
100; Bryan, Texas 77803.
II.
RSVP agrees to provide the service of its program to the citizens of Brazos County.
There is not established any definite program of assignments; but, the number of
volunteers and assignments can be changed throughout the term of this contract by
agreement of all parties. RSVP does agree to address the mutual goals of RSVP and
Brazos County, Texas by assisting with volunteer recruitment for:
A.
Volunteer tax preparation for residents of Brazos County.
B.
Volunteer service
in public
schools.
C.
Senior
volunteers
with the County Extension Quality of Life Committee.
D.
Senior
volunteers
assisting
with library programs.
E.
Senior
volunteers
assisting
with area youth activities.
F.
Senior
volunteers
assisting
with county health department and clinics.
G.
Senior
volunteers
providing
clerical support to county and city offices.
The terms of this contract will be October 1, 1998 to September 30, 1999.
III.
Volunteer placements will be made as appropriate at volunteer workstations
throughout the community. All workstations will have a signed Memorandum of
Understanding on file with RSVP.
IV.
Any invention of literacy or artistic production arising out of an assignment shall
be the exclusive property of the Volunteer Station and the Volunteer shall have the
right to produce additional copies and distribute to the general public. Volunteer
Station my consent to other uses by the Volunteer.

Volunteers shall comply with all the rules and standards exercised by the employees
in the department to which she or he is assigned.

The County Judge or his delegate shall have the authority to represent Brazos
County and make whatever further agreements necessary to administer and effectuate
the terms and conditions not forth herein.
VII.
The Volunteers will not receive any pay from a Volunteer Station for their
services, they will not be considered an employee ahd this service will be
considered as voluntary contribution to the betterment of the community and the
public purpose of Brazos County.
VIII.
Since the Volunteer is not a party to this agreement, the Volunteer Station may
require Volunteers who accept service to sign other instruments setting forth other
terms and conditions between the Volunteer Station to amend or rescind this
contract by mutual agreement.
IN WITNESS WHEREOF, the parties to this agreement have set their hands for the

i The contract between the Brazos Valley Council of Governments (formerly Brazos
Valley Development Council) and Brazos County for the administration of the Brazos
County Indigent Health Care Program, will expire on September 30, 1998.
This contract originated on October 1, 1996 and Included three, one-year renewal
options. The upcoming fiscal year will be the last renewal option, and if mutually agreed
upon, this contract will be extended to cover the period October 1, 1998 through
September 30, 1999. The Brazos Valley Council of Governments will invoice you on a
c quarterly basis for the total annual contract amount of $54,400.

C) If clearing of brush, trees and other obstruction Is necessary, It shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from County right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an Independent Geotechnlcal testing firm; copies of all test results shall
be furnished to the office of the Bravos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

The location or description of the proposed installation Is more fully shown by 3
copies of the drawings attached to this notice.
I understand and agree that
1. The County Engineer must by notified 72 hours prior to the beginning of
construction in order that he or his designated inspector may inspect the
actual Installation.
2 That all damage to the roadways and rights-of-way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the
roadway or right-of-way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any wdsting utility lines in the right-of-way.
S. That the line will be constructed and maintained on the County right-of-way In
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
8. That the line or lines will be constructed no less than twenty-four inches (241
lower than the lowest part of the drainage or bar ditch and the drainage Is to
be considered at least two feet (2') below the center of the roadway.
7. That all sites will be barricaded during the construction period.

It is agreed that in consideration of the Contractor fully and faithfully complying with all
the terms, provisions, and stipulations contained herein or attached and made part of this
contract, the County undertakes, covenants and agrees to pay to the contractor for the
I furnishing of all material and labor, and the performance of the work herein contracted
for the following sum which is evidenced by the attached proposal or bid of the
Contractor. The said sum shall be the full compensation to be received by the said
Contractor under the terms of this contract, which is performable and enforceable in
Brazos County, Texas.

It is agreed by both parties that the Contractor is not an employee of the County for the
purposes of this contract, nor Is the Contractor to be construed to be an employee of the
County. The Contractor is independent and therefore responsible for all federal taxes that
may accrue as a result of this contract, responsible for payroll related costs that may
accrue as a result of this contract, is responsible for carrying all workman's compensation
insurance, and is responsible for carrying a minimum of 100/300/100 autoliability
insurance. It is agreed that the Contractor is responsible for all work related to this
contract until it has been accepted by the County.
4.
WITNESSETH: In testimony thereof, Brazos County has caused this instrument to be
signed in its corporate name, and on its behalf, by the County Judge of Brazos County
acting at the direction of the Commissioners Court of Brazos County, and herein stated
Contractor, therein binding themselves, their heirs, successors, assigns, and
representatives for the faithful and full performance of the terms and provisions of this
contra in ividua y, jointly, and severally. Executed this the IS day of
