a parallel cable installation (1,209 feet) along the right-of-way of River Road Site is located
in Precinct 1.
18. Permission for Road & Bridge to enter Stan Stephen's property located off Tonkaway Lake
Road for the purpose of leveling off the existing cleared fence line in conjunction with the
re-shaping of the ditches along same fence line. Site is located in Precinct 3.

REGULAR MEETING
SEPTEMBER 8, 1998
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, September 8, 1998, with the following members
of the Court present:
Alvin W. Jones, County Judge, Absent;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.

Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
Commissioner Sims read aloud a Proclamation designating
the month of September as "Prostate Cancer Awareness Month".
The Court urges all men over the age of fifty years and those

in high risk groups to undergo screenings and get the facts
about prostate cancer. On motion by Commissioner Cauley,
seconded by Commissioner Thornton the Court moved to proclaim
September as "Brazos County Prostate Cancer Awareness Month"

f throughout Brazos County. Commissioner Sims then presented
the signed Proclamation to Ms. Marcie McDonald, Preventive
Health Services Coordinator for the Brazos County Health

Department.
The Court next considered Budget Amendment #97/98-44.1
through 44.4, which would transfer funds from Contingency to
j Jail Administration, and reallocated funds for Road & Bridge,
Environmental Protection and County Clerk Election. On motion
by Commissioner Cauley, seconded by Commissioner Jones, the
Court voted unanimously to approve the budget amendment as

submitted, a copy of which is attached hereto.

The Court next considered the following claims as
submitted by the County Treasurer for payments

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court then considered rescinding the outdoor burning
ban. Once again the Court contacted the Texas Forest Service
and were informed that the drought index was at 599. Being
that the safety factor is 500 KBDI or below, Commissioner Sims
moved to continue the ban on outdoor burning. Commissioner
Cauley seconded the motion and carried unanimously.
The Court next considered a longevity pay policy for
elected officials. During the budget preparations a proposal
was made to implement longevity pay for all elected officials,
appointed officials, department heads and employees. An issue
arose regarding the statutory authority of the Commissioners
Court to apply this policy to elected officials; specifically
whether basing the policy on the anniversary date for elected
officials would violate Section 152.03 of the Local Government
Code. On motion by Commissioner Cauley, seconded by
Commissioner Jones, the Court voted unanimously to base
longevity pay for elected officials on the number of years of

The Court next considered a request from the District
Attorney's office for Internet access. In a memo to the Court
the District Attorney asked that the following individuals

Government Agreement with the City of College Station for
conducting a joint election to be held Tuesday, November 3,
1998. This is authorized under Texas Election Code Section
271.002(b). on motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to enter
into an Interlocal Government Agreement with the City of
College Station for conducting a joint election to be held
Tuesday, November 3, 1998. A copy of the agreement is
attached.
The next matter for consideration was a contract between
the Community Supervision Department and the Sheriff's office
for services of jailers to transport and monitor jail
inmates/probationers for video conference interviews. This
will benefit both departments by streamlining the process. on
motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the contract
between the Community Supervision Department and the Sheriff's
office for the transport and monitor of jail
inmates/probationers for video conference interviews. A copy
of the contract is attached hereto.

Commissioners Court meeting September 8, 1998
The Court next considered entering into a lease agreement
between Brazos County and the Brazos Valley Art League for
rental of space in the Brazos Center located at 3232
Briarcrest Drive in Bryan, Texas. Term of the lease is for
the period of one year commencing on September 15, 1998 and
ending on September 15, 1999. The Art League agrees to pay to
the County the amount of four hundred eighty dollars ($480. 00)
per month. On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to enter into
a lease agreement with the Brazos Valley Art League. A copy
of the lease agreement is attached.
The Court next considered an Agreement with the Bryan
Independent School District to provide the hauling of
materials for the Special Opportunity School gardening
program. This is the fourth year the school has requested the
County to help them haul donated material for the gardening
program. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to
authorize the use of county equipment to haul donated material
to the special opportunity campus.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Ralph Piper on Old
Reliance Road in Precinct 3 to construct a 60 feet long outlet
channel to divert water from Old Reliance Road to a creek
channel on private property. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the work.
The Court next considered acceptance of the roads and
drainage structures in Estates at River Run, Phase I and Phase
II for Brazos County maintenance. The roads are in Precinct

1. The County Engineer stated that all appeared to be in
order and recommended approval. On motion by Commissioner
Jones, seconded by commissioner Thornton, the Court voted
unanimously to approve the request from GTE and authorized the
installation. A copy of the request is attached hereto.
The Court next considered authorizing work outside of

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the

of the Purchasing Agent and award the
contract to Garrett Mechanical. A copy

motion by Commissioner Thornton, seconded

unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to wolf Creek Oil & Lube. A
copy of the bid tabulation is attached
hereto.
Commissioner Cauley made the following comment:
1) Two weeks ago several people looked at a
software package for the Courthouse. The
response was favorable so there is a
meeting planned for a demonstration of
the equipment here at the Courthouse.

' INTERLOCAL GOVERNMENT AGREEMENT
i
This agreement, made this 3rd day of September. 1998 by and between the
CITY OF COLLEGE STATION and BRAZOS COUNTY.
i
WHEREAS, the County will conduct a general election on Tuesday,
November 3,1998; and,
c
WHEREAS, the City of College Station has ordered a special election to
be held Tuesday, November 3, 1998 for the purpose of issuing bonds on various
capital improvement projects; and
WHEREAS, Section 271.002(b) of the Texas Election Code authorizes
more than one political subdivision to enter Into an agreement to hold elections
jointly; and
WHEREAS, BRAZOS COUNTY and the CITY OF COLLEGE STATION
will hold elections on the same day; and
WHEREAS, the parties to this agreement desire that a joint election be
held that is cost effective and convenient to the citizens of Brazos County and
College Station;
NOW THEREFORE BE IT RESOLVED that a joint election be held by
BRAZOS COUNTY, TEXAS and the CITY OF COLLEGE STATION under the
following terms and conditions, and the parties herewith agree with said
i conditions:
1. That there shall be one ballot that contains all appropriate offices
and bond propositions.
f II. That there shall be one set of ballot boxes to be used at the
common polling places.
III. That election forms used and records maintained be combined in a
E' manner convenient and adequate to record and report the results
d of the election for BRAZOS COUNTY, and the CITY OF COLLEGE

IV. That the tabulation of the precinct results shall be in a manner to
facilitate the canvass of the returns by the Brazos County
Commissioners Court and the City of College Station,
Independently.
V. That the City of College Station shall be responsible for the
Spanish translation of all city related propositions.
V1. That the implementation and actual management of the joint
election shall be with BRAZOS COUNTY with assistance from
the College Station City Secretary and staff. The implementation
and management of the election shall include the following:
A. The securing of qualified individuals to serve as election judges
for each polling place within the voting precinct.
B. The securing of the location and facilities where election is to
be located.
C. The securing of the official ballots, election materials and
supplies requisite to the proper administration of elections under
the Texas Election Code.
D. Securing of a contract for election services and supplies which
includes assistance at central counting.
E. COUNTY to be responsible for conducting early voting at the
Brazos County Courthouse, Galilee Baptist Church, Arena Hall,
College Station Independent School Administration Building and
Memorial Student Center on Texas A&M Campus.
VII. The amount to be paid by the CITY OF COLLEGE STATION to
BRAZOS COUNTY for services rendered by said County in the
General Election to be held on Tuesday, November 3, 1998 is:
A. BRAZOS COUNTY will pay all cost in total.

B. The CITY OF COLLEGE STATION will reimburse BRAZOS
COUNTY for certain costs in accordance with the following schedule.
1. 30 percent of all costs Incurred for polling places located in
the City of College Station.
2. 30 percent of compensation paid to Judges, Clerks, services,
and supplies at all polling places in the City of College
Station, including all five early voting locations.
3. 30 percent of the cost of publication of all required notices.
4. 30 percent of costs of Early Ballot Board and Central
Counting Station.
C. The CITY OF COLLEGE STATION shall be responsible for the

CONTRACT FOR SERVICES
The Braws County Community Supervision and Corrections Department, a political entity of the 85th,
272nd, and 361st Judicial Districts, hereinafter known as the "Department," and the Brazos County
Sheriff's Department, hereinafter referred to as the "Service Provider." by this agreement and in
consideration of the mutual promises set forth below, have agreed as follows: .
A. The Service Provider will provide a jail officer in each of the jails a maximum of two days per week,
three hours per day. These officers will be responsible for moving offenders from their cells to the
video conference system area, positioning and operating the equipment, witnessing the offenders signing
documents, communicating with the community supervision officer, returning the offenders to their
cells, and sending signed documents through inter-office mail. The Service Provider will designate one
or multiple contact persons who will receive a weekly or daily faxed list of offenders who need to be
seen. The contact person will monitor forms. and will notify the Department contact person when
forms are running low.
B. The Department will provide a contact person or persons who will fax a list or otherwise communicate
with the Service Provider contact person(s) about offenders needing to be seen. The Department will
tape the visits from the Department conference site.
C. The Department will provide a fax machine for each of the Service Provider's conference sites, but will
not assume costs associated with phone lines, calls, or supplies for the fax.
D. For services specified in Paragraph A, the Department will pay the Service Provider $ 12.00 per hour.
These wages will be limited to 12 hours weekly, unless in an emergency situation, when both parties
may agree to a temporary increase in hours. Payment will be made within 30 days following receipt
of an itemized invoice that lists inmates served and date and time of service.
E. The services provided for in this contract will not exceed $15,000 per year. In addition. the services
provided are from a sole source, the Brazos County Sheriff's Department, which operates both Brazos
County Jails.
F. The Service Provider agrees to adopt and implement workplace guidelines concerning persons with
AIDS and HIV infection and to develop and implement guidelines regarding confidentiality of AIDS
and HIV related medical information for employees of said Service Provider and for inmates served by
the Service Provider, in accordance with the provisions found in Acts 1989, 71st Legislature. Ch. 1195,
Sections 5.03 and 5.04.
G. The Service Provider agrees to furnish to the Department and/or the Texas Department of Criminal
Justice - Community Justice Assistance Division (rDCJ-CJAD) such information as may be requested
which relates to the services described in this contract. The Service Provider shall permit the
Department and TDCJ-CJAD to audit/inspect records and reports, review services, and/or evaluate
the performance of these services at any time. The Service Provider shall provide reasonable access
to all [lie records, books, reports and other necessary data and information needed to accomplish
reviews of program activities, services and expenditures.
If. It is understood that the employees of the Department or individuals acting as agents of the Department
arc not authorized to receive any type of personal payment, reimbursement, compensation, commission,

employee or agent of the Department has been retained to solicit or secure this contract and that the
Service Provider has not paid or agreed to pay any employee of the Department any fee, commission,

or as an inducement for entering into this agreement. The unauthorized offering or receipt of such
payments may result in the immediate termination of this agreement.

I. The Service Provider agrees to comply with all applicable standards and guidelines, including those
contained in the Contract Administration Manual, promulgated by the Texas Department of Criminal
Justice-Community Justice Assistance Division.
J. The venue of this contract is Brazos County, Texas, and this contract shall be governed by and in
accordance with the laws of the State of Texas.
K. This contract will be voided in the event of a reduction of State funding to the Department.

In consideration of the mutual covenants and agreements herein set forth and other good and
valuable consideretlon, Lessor does hereby demise and lease to Lessee and Lessee does
hereby lease from Lessor the premises situated in Brazos County, Texas, and being a part of
the property commonly referred to as the Brazos Center, and more particularly described and
shown in Exhibit A attached hereto and made a part hereof for all purposes, with such property
hereinafter called the "leased premises".

TERM
The tern of this lease shall be one year commencing on September 15, 1998 and
ending on September 15, 1999.

RENT AND USE OF THE LEASED PREMISES
A. Lessee agrees to pay to Lessor without any prior demand therefor and without any
deduction or setoff as a fixed minimum rent the sum of one hundred dollars (=100.00) per
month during the entire tern of this lease, such amount to be referred to herein as the 'Base
Rent' Unless otherwise expressly set forth herein, Lessee shall have the use of the leased
premises as described below In consideration for the payment of the Base Rent and no
other amount
B. In consideration for the payment of the Base Rent, the lessee shall have access to and use
of the leased premises as follows:
1. During those hours which the Brazos Center Is open for normal business, the
exclusive use of the space described and designated at Exhibit W attached hereto
commonly known as the triangular office and nonexclusive use of public access
areas such as hallways and resbwms.
2. Lessee shall use the leased premises solely for the use and purposes for which it is
let, that being the conduct of the Brazos Valley Art League.
3. Lessee will not have a key to the Brazos Center's exterior doors.
4. Lessor is not responsible for providing or controlling access to the leased space.
C. Lessor shall furnish all utilities, Including gas, water and electricity, excluding telephone
service. Lessee understands that air temperature control Is adjusted to meet the needs of
the persons using room 102.

Lessor shall maintain the roof, foundation, underground and otherwise concealed
plumbing, the structural soundness of the exterior walls, and all other parts of the building and
responsible and keep in a good state of repair all Interior plumbing, windows, window glass,
plate glass, doors, heating system, air conditioning equipment, fire protection, sprinkler system
and the interior of the building In general including the reasonable care of the entrance and exit
of the premises. Lessor will replace light bulbs.
Lessee shall provide all furniture for the based premises. Lessee shall provide all
custodial services for the leased premises as well as minor maintenance of the leased
premises. Lessee shall throughout the lease term maintain the leased premises free from
waste or nuisance, and shall deliver up the premises In a dean and sanitary condition at the
termination of this lease, reasonable wear and tear and damage from fire, tornado and other
casualties excepted.
IV.
CONSTRUCTION AND ACCEPTANCE OF PREMISES
Lessor will provide the Lessee exclusive use of all property described In Exhibit `K
attached hereto. Lessee accepts the property in Its present condition, and lessee shall not
construct any improvements on or In such property without the express written consent of the
Lessor. Lessor retains the right to control the operating status of the air conditioning and
heating units as well as the thermostat setting.. Lessee agrees to abide by all facility rubs as
stated In Exhibit 0130 attached hereto and made a part hereof for all purposes.
VI.
TAXES AND ASSESSMENTS
Lessor shall pay and fully discharge all taxes, special assessments and governmental
charges, y any, assessed against the real estate herein leased, and Losses shall pay and fully
discharge all taxes, spedal assessments and governmental charges, r any levied an all
personal property located on the leased premises.

Lessee bears the risk of loss of all property owned by or under the care of Losses, and
Losses holds Lessor harmless from any claims or causes of action for the loss of or damage to
the property owned by or under the care of the Losses.
IX.
SIGNS
Lessee may not Bred signs on any portion of the leased premises, with the exception of
one small sign Identifying the leased premises, which must be approved by Lessor In advance.
X.
INDEMNITY
Lessee agrees to indemnify and hold Lessor harmless against any and all
claims, demands, damages, costs and expenses, including reasonable attorney's
fees for the defense thereof, arising from the conduct or management of Lessee's
business in the leased premises or from any breach on the part of Lessee of any
conditions of this lease, or from any act of negligence of Lessee, its agents, '
contractors, employees, subtenants, concessionaires or licensees in or about the
leased premises. In case of any action or proceeding brought against Lessor by
reason of any such claim, Lessee, upon notice from Lessor, covenants to defend
such action or proceeding by counsel acceptable to Lessor.

DEFAULT
N Lessee shall allow the rent to be in arrears more than ten (10) days after written notice
by U.S. mail, return receipt requested, of such delinquency, or shall remain In default under any
other conditions of this lease for a period of ten (10) days after written notice by U.S. mail, return
receipt requested, from Lessor, or should any other person than Lessee secure possession of
the premises, or any part thereof, by reason of receivership bankruptcy proceedings, or other
operation of law in any manner whatsoever, Lessor may at Its option following, upon (10) days
written notice by U.S. mail, return receipt requested to Lessee, terminate this lease or in the
alternative, Lessor may reenter and take possession of said premises and remove all persons
and property therefrom, without being deemed guilty of any manner of trespass and relet the

premises or any part thereof, for all or any part of the remainder of said term, to a party
satisfactory to Lessor, and at such monthly rental as Lessor may with reasonable diligence be
able to secure. Should Lessor be unable to relet after reasonable efforts to do so, or should
such monthly rental be less than the rental Lessee was obligated to pay under this lease, or any
removal thereof, plus the expense of reletting, then Lessee shall pay the amount of such
deficiency to Lessor.
XII.
ASSIGNMENT AND SUBLEASE
Lessee shall not assign this lease, and any Interest therein, or sublet the leased
premises, or any part thereof, or any right or privilege pertinent thereto.

supersedes any prior understandings or written or oral agreements between the parties

FORCE MAJEURE
Neither Lessor or Lessee shall be required to perform any term, condition or covenant In
this lease so long as such performance Is delayed or prevented by force majoure, which shall
mean ads of God, material or labor restrictions by any governmental authority, civil riot, floods
and any other cause not reasonably within the control of the Lessor or Lessee and which by the
exercise of due diligence Lessor or Lessee is unable, wholly or in part, to prevent or overcome

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be Installed 1) within 3-5' of and parallel to the right-of-way line and/or 2) in the
case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction Is necessary, It shall be the Appiicanre
responsibility to do so and to remove all cleared brush, trees etc. from County right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-898; test
shall be conducted by an Independent Geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
E) Construction shall be In strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Hiahwavs, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.
