To make arrangements. call (409) 361-4102. r x ~ i t En Y COMMISSIONERS' COURT REGULAR MEETING AUGUST 25, 1998 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 25, 1998, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner-Thornton gave the invocation and led the pledge of allegiance. • The County Judge deviated from the agenda and considered the emergency addendum item on the cessation of outdoor burning. Commissioner Thornton suggested contacting the Texas Forest Service before taking action on lifting the ban. The County Judge asked his secretary to contact the Forest Service and then stated that the Court would consider this later in the meeting. There was no citizen input and/or concerns. The Court next considered Budget Amendment #97/98-42.1 through 42.5, which create budgets for CO funds for the Minimum Security Jail Expansion, Capital Improvements, Right- of-way Acquisition and Roads Capital and reverse some entries associated with the issuance of the 1998 Certificates of Obligation. The Court next considered the following Claims as submitted by the County Treasurer for payment: 98-009181 through 98-009405 On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was the reimbursement to the General Fund from available Certificate of obligation funds. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to reimburse the General Fund from available Certificate of obligation funds. The Court next heard a request to move interest earned from the Certificate of Obligation Series 1996 which had been designated for the Juvenile Detention Facility to the Road & Bridge Certificate of Obligation Series 1996. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to move the interest earned. The next matter before the Court was a request for Internet connection for the training coordinator in the Sheriff's department. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve Internet connection for the training coordinator. Commissioners Court meeting August 25, 1998 The next matter before the Court was to consider adoption • of an Order relocating Polling Place for Election Precinct 12, Combined Election Precincts 18A, 18B, 18C and Election Precinct 32. The polling place for Election Precinct 12 is located in Manor East Mall Shopping Center. A state candidate's campaign headquarters has been established in the mall which violates Section 61.003 of the Texas Election Code. Bryan Independent School District has agreed to allow the. polling place for Election Precinct 12 to be located at Sul Ross School located at 3300 Parkway Terrace. The polling • place for combined Election Precincts 18A, 18B, 18C was located in the Bryan Central Fire Station. It will no longer be available for the conduction of elections. The City of Bryan has constructed a new fire station and has agreed to allow the polling place for Combined Election Precincts 18A, 18B, and 18C to be located in the new fire station. The polling place for Election Precinct 32 is located in the Southwood Valley Elementary School. It will no longer be available for the conduction of elections, but the Friends Congregational Church has offered their building as a polling place. On motion by the Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to adopt the Order Relocating Polling Place for Election Precinct 12, Election Precincts 18A, 18B, 18C and Election Precinct 32. A copy of the order is attached hereto. The next matter for consideration was a Contractual Agreement with the State of Texas for Brazos County to contribute funds for the acquisition of right-of-way for FM 158. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to accept responsibility for ten (10) percent of the cost of said right-of-way which, is currently estimated at $16,000.00 for the improvement of FM 158. A copy of the Agreement is attached hereto. The Court next considered the establishment of speed limits on Bird Pond Road in precincts 1 and 3. In a Public H #JUL 1 _ Commissioners Court meeting August 25, 1998 Hearing held Tuesday, August 18, 1998, it was the recommenda- tion of the Road and Bridge Department to set the speed limit along the entire length of the road at 55 mph. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to accept the recommendation of the Road & Bridge department and set the speed limit along the entire length of the road at 55 mph. The Court next considered approval of the Preliminary Plat of Robin Hudson Subdivision in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comment: 1) Add note: All private wells shall be located and shall have a sanitary zone of 100 feet radius in all directions. No On Site Sewage Facility on this property or any other property shall encroach in any sanitary zone. If public water is to be used, an appropriate note must be added. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approved the preliminary plat of the Robin Hudson Subdivision subject to the developer complying with the exception noted by the County Engineer. The Court next considered the request from Wickson Creek Special Utility District to construct a road bore for water line installation in the right of way of Dick Elliott Road approximately 0.4 mile from its intersection with FM 974. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Jones, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. The Court next considered approval of requisitions from Computer Replacement for the following purchases: a) Printer replacement for County Clerk's office $200.00 b) Printer replacement for County Clerk's office $309.00 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the requisitions to be paid from Computer Replacement. The Court next considered a requisition from Furniture - Major account for a computer desk with hutch for Emergency Management. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve payment of the requisition for a computer desk. The Court next considered a request to enter into contract negotiations with Ben Sanford & Associates, Inc. for a Telecommunication System Consultant. The Purchasing Agent informed the Court that after screening the proposals this was the recommendation of the telecommunications committee. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request to enter into contract negotiations with Ben Sanford & Associates, Inc.. The Court next considered approval of the minutes of the Commissioners' Court meetings held June 2,9,23,and 30, 1998; VOL- t Commissioners Court meeting August 25, 1998 Special Meetings held June 4 and June 14, 1998= Workshops held on June 9, 1998 and Emergency Meeting held June 9, 1998. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court .voted unanimously to approve the minutes as submitted. The Court next considered approval of the minutes of the Commissioners' Court meetings held in July, 1998. on the following dates: 7, 14, 21, 27 and Workshop held on July 21, 1998. on motion by Commissioner A Sims, seconded by Commissioner Cauley,•the Court voted unanimously to approve the minutes as submitted. The Court received, approved and ordered filed as submitted the Treasurer's report for July 1998. A copy of which is attached to and made a part of these minutes. The Court acknowledged receipt of the Extension Service reports for July 1998 and acknowledged receipt of reports from the following County and Precinct Offices showing revenues collected and remitted to the County Treasurer: County Clerk District Clerk Justice of the Peace Precinct 2 Justice of the Peace Precinct 3 Justice of the Peace Precinct 4 Justice of the Peace Precinct 5 Justice of the Peace Precinct 6 Constable Precinct 4 Constable Precinct 5 Constable Precinct 6 Brazos County Events Facilities County Attorney Road & Bridge Tax Assessor/Collector A copy of the officials' reports can be viewed in the County Auditor's office. Commissioner Sims suggested that Court members go to old keliance Road to look at the bridge the contractor is building. The County Judge made the following comments: 1) There will be a hearing at 1:00 p.m on the proposal to increase taxes. 2) There will be a budget hearing at 2:00 p.m.. If the hearing is not concluded at 5:00 p.m. it will be irecessed. 1~_~ • • ~J Commissioners Court meeting August 25, 1998 Commissioner Cauley reminded the Court that on Thursday a group from the county will be going to Dallas to view equipment for imaging. The County Judge stated that the current Brazos Valley Council of Governments Board of Directors has 39 members. The new Board will be reduced to 32 members having eight (8) minorities and 3 members being Brazos County Court members. The County Judge recessed the meeting at 9:28 a.m.. The meeting of the Commissioners Court was reconvened at 1:00 p.m. to consider the emergency addendum item on the cessation of outdoor burning. The Texas Forest Service was contacted and they could not recommend lifting the ban. on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to continue the burning ban. It will be put on the agenda for each Commissioners Court meeting. There was no citizen input and/or concerns. There being no further business to come before the Court, the meeting was adjourned. Resolution RESOLUTION NO. !LS~lt WHEREAS, the Texas Department of Transportation has previously requested Brazos County (County) to enter into a contractual agreement and acquire Right of Way for the highway project on FH 158 from FM 1179 to SH 30; and WHEREAS, the County desires to voluntarily contribute to the State funds equal to ten (10) percent of the cost of the said Right of Way for the proper development and construction of the project; and WHEREAS, the completion of the improvement to FM 158 is crucial to the enhancement of circulation and safety; and NOW, THEREFORE, BE IT RESOLVED by the Commissioner's Court of Brazos County, Texas, that Brazos County, Texas, accepts responsibility for ten (10) percent of the cost of said Right of Way which is currently estimated at $16,000.00 for the improvement of FM 158 from FM 1179 to SH 30. The Department of Transportation will be responsible for acquiring all property required for the project. Acquisition procedures will be in accordance with policies of the Texas Department of Transportation and with applicable Federal and State laws governing the acquisition policies for acquiring real property. WHEREAS, the State is requesting the County to enter into a contractual agreement and acquire right of way for a highway project on Highway No. FM 158 with the following project limits: From: FM 1179 To: SH 30 :and WHEREAS, the County has now requested that the State assume responsibility for acquisition of all necessary right of way for said highway project; and WHEREAS, the County desires to voluntarily contribute to the State funds equal to ten (10) percent of the cost of the said right of way for the proper development and construction of the State Highway System; NOW, THEREFORE, in consideration of the foregoing premises and the mutual benefits to be derived therefrom, the County shall contribute to the State an amount equal to ten (10) percent of the cost of the right of way to be acquired by the State and shall transmit to the State with the return of this agreement, duly executed by the County, a warrant or check payable to the Texas Department of Transportation in the amount of _Sixteen Thousand and 00/100 Dollars (S 16.000.00 which represents ten (10) percent of the estimated cost of the right of way. However, if it is found that this amount is insufficient to pay the County's obligation, then the County, upon request of the State, will forthwith supplement this amount in such amount as is re- quested by the State. Upon completion of the highway project and in the event the total amount as paid by the County is more than ten (10) percent of the actual cost of the right of way, any excess amount will be returned to the County by the State. Cost of the right of way acquired by the State shall mean the total value of compensation paid to owners, including but not limited to utility owners, for their property interests either through negotiations'or eminent domain proceedings. C) If clearing of brush, trees and other obstruction is necessary, it shall be the Applicants responsibility to do so and to remove all cleared brush, trees etc. from County right-of-way. D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Bravos County Engineer.
