THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
JULY 28, 1998 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

right-of-way of Westward Ho Road in Seven-Eleven Ranch Subdivision. Site is located
in Precinct 1.
23. Acceptance and approval of Treasurer's Reports for June, 1998 and for the Quarter

REGULAR MEETING
JULY 28, 1998
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, July 28, 1998, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2, absent;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #97/98-38.1
through 38.5, which would transfer funds from Contingency to
various departments, and reallocate funds for the Task Force,
Brazos Center, Capital Improvements and Personnel. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.

Commissioner Cauley, seconded by Commissioner Sims, the court
voted unanimously to approve the request from Constable Sikes
to appoint Hector M. Camarillo as Reserve (Non Paid) Deputy
Constable subject to appointment being within the allotted
number of deputies.

Cauley, the Court voted unanimously to appoint the following

The next matter before the Court was the establishment of
a date and time for the Public Hearing concerning the posting
of a speed limit for Bird Pond Road in Precincts 1 and 3. On
motion by Commissioner Jones, seconded by Commissioner Sims,
the Court voted unanimously to set the Public Hearing for
Tuesday, August 18, 1998 at 10:00 a.m..
The Court next considered approval of an Amendment to the
Intergovernmental Agreement with Wixon Valley for road
maintenance. In a memo to the Court the County Engineer
proposed a cost of 16f per square yard for dust control and
said that the Mayor of Wickson Valley had agreed to the cost
and requested that the Road and Bridge Department proceed on
all roads with the exception of Creek Shadows Drive. on
motion by Commissioner Sims, seconded by Commissioner Cauley,

the Court voted unanimously to approve the Amendment to the
Intergovernmental Agreement with wixon Valley.
The next matter for consideration was the authorization
for the Sheriff to apply for a Bureau of Justice Assistance
Grant through the State Criminal Alien Assistance Program.
This grant will seek partial reimbursement for the
incarceration expense of keeping illegal aliens in our jail.
The Sheriff asked that this be removed from consideration at
this time.
The next matter for consideration by the Court was a
written request submitted by Steve Smith, Judge County Court
at Law No. 1 seeking approval for out of state travel for
himself. Judge Smith would be traveling to Toronto, Canada to
attend the National Conference of Special Court Judges July 30
through August 3, 1998. Once again he would be paying for his
airfare. The lodging cost should be approximately $600.00 and
the per diem $100.00. The County Judge moved to limit the per
diem to $25.00. Commissioner Sims seconded the motion. The
County Judge and Commissioner Sims then withdrew their motion
and second. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to grant the
request from the Judge Smith and approved payment of out of
state travel expense.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individuals:
Eddie Rodriguez and Nickie Rodriguez - 50 feet off
the South end of Lots 4 and 5, Block 190, City of
Bryan, Brazos County, Texas
on motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individual:

Cauley, the Court voted unanimously to accept the
recommendation of the Purchasing Agent and reject all bids and
rebid the contract.
The next matter for consideration was approval for the
Buyer to advertise Bid 98-058 Janitorial Supplies Annual

Contract. on motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the Purchasing Agent to advertise for bids for janitorial
supplies.
The Court next considered approval of a requisition from
General Funds for the following purchase:
a) Typewriter for Personnel, $260.49
on motion by commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the requisition
to be paid from General Funds.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of R. M. Dudley on SH
30 in Precinct 3 to stockpile Grade 4 rock for road

seconded by Commissioner Jones, the Court voted unanimously to
authorize the work.

The Court acknowledged receipt of the Extension Service
reports for June 1998 and acknowledged receipt of reports from

There was no citizen input and/or concerns.
The County Judge made the following comments:
1) He received a letter from Jim Allison
concerning the tobacco settlement. The
final settlement will be $2,152,214 and
it will be paid on January 10, 1999.
Demetrios Basdekas asked if the money had any
restrictions. He was informed that it did not. He
then suggested using the funds to make an inventory
of septic systems and that part of the money should
go to upgrading those systems that are
malfunctioning.
2) There will be a change in licensing fees.
3) The Budget, the Auditor has the figures
for posting. They are preparing the
narrative to be distributed to the
departments. This will be done by next
Tuesday.

ITEM: Request from United Telephone Companj to construct parallel cable installation
in the right of way of Westward Ho Road in Seven-Eleven Ranch Subdivision. Site Is
SOURCE OF FUNDS: N/A
1. PRESENTATION:
A) No work will be perrnitted between front slope and/or back slope.
B) The line shall be installed 1) within 3-5 of and parallel to the dol of-way One and/or 2) in the
case of a road bore, perpendicular to the right-of-way line.
C) If clearing of brush, trees and other obstruction is necessary. It shall be the Applicanrs
responsibility to do so and to remove all cleared brush, trees etc. from County right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing fine; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.

Brazos County will not be held liable at any future
date for accidental damages to the buried cable plant by road working
equipment such as maintainers, hole diggers, etc. In the event of
such damages the Telephone Comapany will be notified Immediately.
The County Commissioners Court may require the owners to relocate this`
line. for valid reasons under the law, by giving thirty (30) days
written notice.
a. Where communication facilities are located on county
road ROW the Telephone Company will relocate said
facilities at no expense to the County.
b. Where communication facilities are located on private
property the county will reimburse the Telephone Company
for the relocation of said facilities.
At any place where a communications line crosses over a county road. it
shall be constructed and maintained at least eighteen (18) feet above
the surface of the traffic lane.
Please notify forty-eight (48)
hours prior to starting construction of the line. In order that a
representative may be present.
The locations of the proposed lines are more fully shown by the Copies
attached to this notice.
Construction of this line will begin on or after the 21 st day of
