THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
JUNE 30, 1998 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

21. Permission for Road & Bridge to enter Robert Murphy's property located off Elmo

COMMISSIONERS' COURT
REGULAR MEETING
JUNE 30, 1998
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, June 30, 1998, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and /or concerns.
The Court next considered Budget Amendment #97/98 -34.1
through 34.5, which would transfer funds to Indigent Health
from Contingency, and reallocate funds for District Attorney,
361st District Court, County Judge and Agricultural Extension.
Commissioner Sims moved to approve as submitted. Commissioner
Cauley seconded the motion. The Auditor reported that Judge
Ruffino, asked that the 361st District Court budget amendment
be withdrawn. Commissioners Sims and Cauley withdrew their
motion and second. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the budget amendment with the exception of the amendment
submitted by the 361st District Court. A copy of which is
attached hereto.

Commissioners Court meeting June 30, 1998
The Court proceeded to consider the change of status of
the following employees.

The District Clerk asked that changes be made to his request.
He withdrew the request for Dana Pomykal, requested a Clerk
position for O'Riley who is a VOE student and requested a
Clerk 2 Position 4 for Reyes. On motion by Commissioner
Jones, seconded by Commissioner Cauley, the Court voted
unanimously to approve the changes along with the District
Clerk's requested changes.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
98- 007371 through 98- 007635
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered a request to change the payday
for County Employees from Thursday to Friday. The County
Auditor explained that time sheets are due in the Treasurer's
office by noon on Friday. This is before the day is over and
there is the possibility that an employee may not complete the
day. On motion by Commissioner Cauley, seconded by Commis-
sioner Sims, the Court voted unanimously to change the payday
for County Employees from Thursday to Friday beginning the
month of July.
The Court next considered a request from the District
Clerk for internet access for two (2) computers in the
Collections Department. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the request from the District Clerk and approve,
internet access for the Collections Department.

The next matter before the Court was consideration of a
Letter Agreement with Bruchez, Goss, Thornton, Meronoff,
Michel & Hawthorne for legal services. Commissioner Cauley
moved to approve the Letter Agreement. Commissioner Sims
seconded the motion. Commissioners Jones Sims and Cauley and
the County Judge voted "Aye ". Commissioner Thornton
abstained. The motion carried.
The Court next considered Exemptions from Competitive
Bidding Requirements of Local Government Code:
Section 262.024(a)(2)
This is for the purchase of Indigent Health Care
Services both medical and pharmaceutical through
the County Indigent Health Care Program. The Court
considers these services necessary to preserve and
protect the public health of the residents of the
County.
Section 262.024(a)(4)
1. This is for the purchase of professional
service in the form of counseling and assessments
of juvenile detainees, from various vendors.
2. This is for the purchase of professional
services from various vendors as authorized by the
Brazos County Court at Law Number One, Brazos
County Court at Law Number Two, 85h District Court,
272nd District Court and the 361st District Court
in a properly authorized Court Order, for the 1997-
1998 fiscal year
As provided in the Local Government Code, Section
113.901(c) the County Judge waives the requirement of the
County Judge's signature on requisitions that have previously
been exempted from competitive bids for the following services
1. Indigent Health Care Services, as
authorized by the Brazos Valley Council
of Governments with contracted vendors
[LGC262.024(a)(2)].
2. Counseling and assessments of juvenile
detainees, as authorized by the Brazos
County Juvenile Services Department with
contracted vendors [LGC262.024(a)(4)].
3. Professional services as authorized by
Brazos County Court at Law Number One,
Brazos County Court at Law Number Two,
85h District Court, 272nd District Court
and the 361st District Court in a
properly authorized Ccurt Order, for the
1997 -1998 fiscal year [LGC262.024(a)(4)1.

On motion 'by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Exemption
of Competitive Bidding Requirements and the waiver of
signature.
The Court next considered a request by the Sheriff's
office for a VISA card to be issued to Investigator Gerald B.
Kinard. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the request to issue a VISA card to Gerald B. Kinard.
The next matter for consideration was a request submitted
by an employee for medical leave of absence. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to approve the request for a medical leave
of absence.
The next matter for consideration by the Court was a
request submitted by the Director of the Computer & Network
Services Department seeking approval for out of state travel
for Allen Campbell. Mr. Campbell would be traveling to
Bethlehem, Pennsylvania to attend the annual Pentamation
Client Conference and Training symposium September 13 through
the 16, 1998. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to grant the
request from the Director of the Computer & Network Services
Department and approved payment of out of state travel expense
for Mr. Allen Campbell.
The Court next considered the payment of invoices for
additional architectural services for renovation of the
Courthouse. Commissioner Cauley moved to approve the
invoices. Commissioner Sims seconded he motion.
Commissioners Cauley and Sims then withdrew their motion and
second. Then on motion by Commissioner Jones, seconded by

Commissioner Cauley, the Court voted unanimously to table
consideration until a later date.

The next matter for consideration was the selection of
Liability and Casualty Insurance (RFP 98 -049) for Brazos
County. Don Gray, consultant, made the following
recommendations:
1) Workers Compensation
Texas Association of Counties ($97,479)
2) Automobile Liability & Physical Damage,
General Liability, Public Officials, Law

Enforcement
Hartford ($176,436)
With respect to the Property and Boiler & Machinery coverage,

he claimed there were two "best" options to select from.
Depending on the choices, the County could save close to
$100,000.00 on premiums. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to accept the recommendation of the Consultant and accept the
quote of $176,436 on Automobile Liability & Physical Damage

submitted by Hartford Insurance. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to accept the recommendation of the Consultant and
accept the quote of $97,479.00 on Workers Compensation
coverage submitted by the Texas Association of Counties.
Commissioner Sims then moved to accept the recommendation of

and Boiler coverage submitted by Hartford Insurance.
Commissioner Jones seconded the motion. Commissioners Sims
and Jones voted "Aye ". Commissioner Thornton and the County

Hartford on General Liability, Law Enforcement and Public
Officials. Bill Jeanes, Risk Manager, thanked the elected
officials and employees for their help in reporting accidents.
The Court proceeded to consider the following blanket
Purchase Orders:
Ray Criswell Jail $800
Americlean Jail $800
Brazos Wholesale Jail $600
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of requisitions from
Capital Expenditures for the following purchases:
a) Replacement Monitor for Road & Bridge
$1,230.00
b) Replacement Computer for JP 2 $993.00
c) Replacement Computer for the County
Attorney's Office $1,036.74
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve all
requisitions to be paid from Capital Expenditures
The Court next considered the following Supplement
Requisitions for the Road & Bridge Department:
a. Additional $200,000.00 on bid No. 98 -004,
Asphalt Oil
b. Additional $20,000.00 on bid No. 98 -005, Culverts

The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Don Chandler on
Old Reliance Road in Precinct 3 to clear brush at the curve

to authorize the work.
The Court next considered approval of the Final Plat of
Forestridge Subdivision in Precinct 1. Richard Vance, County
Engineer, stated that he had reviewed the plat and offered the
following comments:
1) This property is part of a previously recorded
final plat, Plantation Meadow, recorded in Volume
1113, Page 361. Said plat was vacated by the
owners and the Commissioners Court of Brazos
County, by instrument recorded in Volume 1214, Page
804.
On motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to approved the final
plat of Forestridge Subdivision subject to the developer
complying with the exception noted by the County Engineer.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Robert Murphy on
Elmo Weedon Road in Precinct 3 to clean out a drainage channel
to allow water to drain from the roadway. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to authorize the work.
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to receive,
approve and order filed as submitted the Treasurer's report of
May 1997 through Quarter ending March 31, 1998. A copy of
which is attached to and made a part of these minutes.
The Court acknowledged receipt of the Extension Service
reports for May 1998 and acknowledged receipt of reports from
the following County and Precinct Offices showing revenues
collected and remitted to the County Treasurer:

A copy of the Officials' reports can be viewed in the County
Auditor's office.
There was no citizen input and /or concerns.
The County Judge made the following comments:
1) In 1996 -1997, a company provided 2000
maps for Brazos County. They have asked
to be allowed to bring maps up to date
and provide the County a supply at no
cost to the County.
2) Budget Hearings will begin next week.
3) He received a letter from Representative
Dan Kubiak indicating that due to the
drought, he has asked the Governor to
designate Brazos County as a disaster
area.
Commissioner Sims made the following comment:
1) He asked the Judge if he had informed the
news media on the use of fireworks in the
County.
Commissioner Thornton made the following comment:
1) He asked if it would be possible to
inform the public that the speed limit on
a County road is 60 mph unless signed
otherwise.
Sarah Wirt, representative of the Texas Association of
Counties, thanked the Court for their relationship in
representing the County for Auto Liability. She indicated
that she would try again the next time the coverage was bid.
She also said that the Texas Association of Counties would
provide workers compensation coverage.
There being no further business to come before the Court,
the meeting was adjourned.

This letter will confirm our agreement wherein Bruchez, Goss, Thornton, Meronoff, Michel
& Hawthorne, P.C. ( "BGTMM &H ") has agreed to represent Brazos County, Texas (the "County ")
in a variety of matters.
SCOPE OF SERVICES: It is understood that BGTMM &H will represent the County in a
variety of matters including, but not limited to, economic development issues, County depository
issues, roadway acquisition matters, subdivision regulation issues, construction contracts, general
law issues, commercial contracts and bidding issues, general contracts and real estate purchases.

FEES: We have agreed to represent the County on a hourly fee basis whereby our fee will
be based on actual time spent in connection with the file. The hourly rates of attorneys and others
likely to work on your file arc:
Patricia E. Meronoff $150.00/hour
Kyle Hawthorne $150.00/hour
William S. Thornton, Jr. $150.00/hour
We review these hourly rates in January of cacti year, and in the event of any increase in
such rates by the firm, the increased rates will apply to this agreement.
BGTM,M &H reserves the right to designate which attorney shall perform the various
aspects of the representation. It is our policy to have the necessary work performed in the most cost
effective way consistent with a satisfactory resolution.
EXPENSES: The County agrees to be responsible for all actual expenses incurred by the
firm in handling its matters. "Actual expenses" means expenses for which the firm actually

advances funds. It includes such things as court costs, Clerk's fees, fees expended for obtaining
reports and other information, actual travel expense, and other expenses which are necessary to our
representation of the County in a diligent manner. Sometimes expenses may be billed by the
provider directly to the County. The County should then make direct payment to the provider.
BILLINO: Statements will be rendered on a regular basis, usually monthly. Time will be
recorded for conferences with County employees and others, legal research, factual investigation,
preparation of correspondence and legal documents, reading and analyzing correspondence and
legal documents, preparation for and appearances in court and other meetings, travel to and from
court and other meetings, and telephone conversations with County employees and others. Bills are
due and payable upon receipt unless otherwise agreed in writing.
TERMINATION of this Contract may be at any time by written notice by or to the County.
DISPUTES or questions as to the amount of a statement shall be brought to the attention of
the firm in writing within fifteen (15) days of the date of the bill.
Please review this letter and, if it sets forth correctly the terms of our understanding and
agreement, sign the enclosed copy and return it to me in the envelope provided.

The Commissioners' Court has determined that there is a need to purchase professional medical
f and pharmacutical services for indigents qualifying for benefits through the County Indigent
' Health Care Program, and hereby grants an exemption from the competitive bidding requirement
for the necessary and approved services provided by various vendors. The Court considers these
services necessary to preserve and protect the public health of the residents of the County, as
provided in the Local Government Code, Section 262.024(x)(2). The Court hereby approves all
such payments to vendors designated by the Brazos Valley Council of Governments during the
1997.1 998 fiscal year.
