THE COMMISSIONERS COURT WILL MEET ON SUNDAY, JUNE 14, 1998 AT 4:30
P.M. IN THE COMMISSIONERS' COURTROOM OF THE BRAZOS COUNTY
COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN, TEXAS TO CONSIDER
AND TAKE ACTION ON ESTABLISHMENT OF A BAN ON THE SALE AND USE OF
AERIAL FIREWORKS.
The Courthouse is wheelchair accessible. Handicap parking spaces are available. Any request
for sign interpretive services must be made 48 hours before the meeting. To make arrangements,

COMMISSIONERS' COURT
SPECIAL MEETING
JUNE 14, 1998
A special meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 4:30
p.m. on Sunday, June 14, 1998, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Absent;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
The Court met to consider the establishment of a ban on
the use of aerial fireworks in Brazos County. The County
Judge explained that the Court has the authority to impose the
ban. He then read aloud the Order and a letter from the Texas
Forest Service recommending the ban. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to Adopt the Order Banning the Use of
Aerial Fireworks in the unincorporated areas of Brazos County.
A copy of the Order is attached hereto.
Elaine Thomas, owner of a fireworks stand, asked the
Court to describe aerial fireworks. She stated that she
abided by the Order in 1996 and planned to do so this year.
There was no citizen input and /or concerns.
There being no further business to come before the Court,
the meeting was adjourned.

ORDER PROHIBITING THE USE OF AERIAL FIREWORKS
WHEREAS, Lhe Texas Forest Service has determined that drought
conditions exist within this county; and
WHEREAS, the use of aerial fireworks during these drought
conditions would constitute an unreasonable risk to life and
property;
THEREFORE, It is hereby ordered by the Commissioners Court of
Brazos County that the use of aerial fireworks within the
unincorporated areas of this county is prohibited. All persons
selling fireworks within this county shall provide reasonable
notice of this Order. This Order is adopted pursuant to Section
240.904, Local Government Code, and other applicable statutes.
violation of this Order is a Class C Misdemeanor, punishable by
fine not to exceed $500.00
Adopted this /4 day of June, 1998 by a vote of _� ayes
