To make arrangements, call (409) 361 -4102. i a I • • • i 1 a i i i 1 COMMISSIONERS' COURT REGULAR MEETING APRIL 14, 1998 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning.at 9:00 a.m. on Tuesday, March 31, 1998, with the following members of the Court present: Alvin W. Jones, County Judge, Absent; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3, Presiding; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Jones gave the invocation and led the pledge of allegiance. There was no citizen input and /or concerns. The Court next considered Budget Amendment #97/98 -24.1, which would reallocate funds for Constable, Precinct No. 4. on motion by Commissioner Cauley, seconded by Commissioner Thornton, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The next matter for the Court's consideration was allowing additional rain days for Chappell Hill Construction Company for the Juvenile Justice Center. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to allow the additional rain days for Chappell Hill Construction Company for the Juvenile Justice Center. The next matter before the Court was a request by the Big 8 RC &D for travel expenses for the county representative to attend the annual meeting in Midland, Texas, April 21 -23, 1998. Estimated expenditures are $389.00. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approve the payment of travel expenses for the county representative to attend the annual meeting in Midland, Texas. The Court next considered the payment of an invoice in the amount of $2,862.80 from Ravey, Patterson & Associates for Architectural Services and Reimbursable Items related to the renovations to the County Courthouse. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the payment of $2,862.80 to Ravey, Patterson & Associates. The next matter for consideration was an amendment to the County Attorney's "Sell to Minor Sting Grant Agreement" with the Texas Department of Transportation. This is a matching grant with the State funding 75% or $45,000.00 and the County funding 25% or $3.5,000.00. Amendment No. 1 includes the Approved Project Description for the project and Approved Project Budget for the project. A copy of the amendment is attached hereto. The Court next considered acceptance of a Warranty Deed for right -of -way on Elmo Weedon Road in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Elizabeth Maret- Havens for the expansion and improvements to Elmo Weedon Road. The Court next considered the request from GTE to construct a road bore for cable installation in the right -of- way of Dilly Shaw Tap Road approximately 300 feet from its intersection with J. M. Moore School House Road. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from GTE and authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights -of -way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Ronnie W. Treat on Straub Road in Precinct 1 to install a 36 inch by 20 feet pipe arch in the driveway. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to authorize the work. The Court next considered the request from Aquila Southwest Pipeline Corporation to construct a natural gas tap on an existing pipeline in the right -of -way of Bird Pond Road. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Aquila Southwest Pipeline Corporation and authorized the installation. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to the Greenery. A copy of the bid tabulation is attached hereto. ' Under citizen input and /or concerns, the following comments were heard: Sheila Walker - Brazos Beautiful has announced that the County will be the recipient of 3 trees. Ms. Walker stated that the trees will be planted in the park. Susan Gandy - asked the members of the Court for vacation schedules in order to arrive at a budget calendar. Randy Sims - reminded the Court that the County Judges and Commissioners Conference will be held in June and he would like to have some topics for discussion at that time. t ' Tony Jones - asked for a list of the committees that each commissioner serves on and suggested rotating committee assignments. Constable Precinct 4 has retained Express Personnel to provide temporary assistance for his office. NOTE: Constable 4 in March retained Express Personnel to provide the office with temporary assistance. Constable 4 did not get a purchase order. The invoices as they arrived (weekly) were charged to the personnel line item. The account coding and the use of a "payment authorization" were incorrect. The error was not caught until last Monday. At that time the auditor's office was reviewing the payroll costs for the last quarter. The error should have been caught six weeks ago. The charges to the personnel line item need to be reclassified properly as of March 31, 1998. The Auditor's office is taking steps to make that reclassification. Approval of the budget amendment is respectfully requested. It is after the fact. It does not follow current policy adopted by the Commissioners' Court. General Provisions: 1.5 Scope of Work The Contractor shall provide all materials, equipment, tabor, and supervision to perform all the specified services throughout the year. All applicable laws and regulations shall be adhered to at all times. Our staff includes Irrigators licensed by the Texas Board of Irrigators, and Commercial Pesticide Applicators licensed by the Texas Department of Agriculture. 1.5 Workforce The Contractor's supervisory personnel shall be experienced in landscape management. All landscapers shall be trained and supervised. The Immigration Reform and Control Act of 1986 (IRCA) requires all individuals hired after November 6, 1986 provide their employers with proof of their authorization to work in the United States. IRCA may severely penalize any employer for knowingly hiring undocumented workers or for the failure to verify the legal status of workers already employed. The Greenery is committed to complying with this law. 1.5 Insurance The Contractor will at all times maintain the legally required amounts of Worker's Compensation insurance, Unemployment Compensation, General Liability and Property Damage coverage for the protection of the Client and The Greenery. A Certificate of Insurance will be presented. 1.4 Landscape Improvements Plant replacements or additions or any other additional landscaping beyond the scope of this proposal can be accomplished by a separate agreement. 1.5 Equipment Damage Prevention: Equipment used weekly to cost- effectively maintain the landscape can over a period of time unavoidably damage tender plants in spite of proper training, operation, and supervision. May use chemicals where not unsightly. 5. Clean up debris caused by our work. Cut grasi will be bagged immediately around swimming pools. In all other PRIMARY areas cut grass will not be bagged or picked up unless it is detrimental to the lawn or unsightly. 2.3 The SECONDARY lawn areas will be cut 0 times per year. The greatest control can be achieved by separate warm and cool season applications over the coming twelve months. It should be understood that this weed control program must be accompanied with proper turf management practices (water, fertilizing, insect control, mowing) to deliver the best results.. 2.5.2 Dallis grass control in St. Augustine turf will be difficult and may result in temporary spot discoloration of St. Augustine Turf. 2.5.3 The Landscape Management Contractor must be notified upon acceptance of this program if any of the turf areas will be over - seeded with cool season grass. 2.5.4 PRIMARY areas only; unless specified here, the SECONDARY lawn will not be treated. 3. Color Beds Management: 3.1 The Contractor shall plant annual flowers in well defyted beds _ times per year. 3.2 The Contractor shall fertilize the flowers as needed. 3.3 If there is no automatic irrigation system the client agrees to hand water the flowers. It must be understood that the color beds may need to be watered daily during the hot months. Shrub/Groundcover Management: NONE INCLUDED 4.1 Shearing: 4. 1.1 Shrubs shall be sheared monthly: March through November. 4.1.2 Groundcover shall be edged to keep in bounds and trimmed as necessary to achieve an overall even appearance. 4.1.3 Growth regulators may be used where appropriate. 4.2 Fertilization: A spring application of one (1) lb. of nitrogen per 1000 sq.R. of bed area. 4.3 Weed Control: Weeds in well - defined shrub /groundcover beds and in pavement cracks will be controlled with selective pre - emergent systemic herbicides. Where herbicides can not be effectively used, the weeds will be manually removed. 4.4 Definition/Turning of Ornamental Beds: 4.4.1 Unbordered ornamental beds will be manually defined with hand tools -- times per year. 4.4.2 Unless specified here the beds will not be turned because of potential damage to shallow plant roots and because this practice breaks the seal of pre - emergent herbicides. 5. Tree Management: NONE INCLUDED 5.1 Pruning: Trees shall be pruned 0 times a year, only from ground level to a height of six (6) feet above ground. The purpose shall be to eliminate; narrow v- shaped branch forks that are structurally weak, diseased or broken branches, water sprouts or sucker growth. Automatic Irrigation System Monitoring: NONE INCLUDED 6.1 The automatic irrigation system will be monitored 00. times. Each visit will include the following activities. 6. 1.1 Activate all sections where there is evidence of a possible problem. 6.1.2 Check each sprinkler head for proper operation and coverage. 6.1.3 Monitor the controller for optimum response to the landscape's water needs. 6.1.4 All needed repairs will be invoiced separately from the monthly maintenance billing except any damages caused by our operations will be repaired at no cost. This irrigation system monitoring program does not address system design problems, i.e, poor coverage and low pressure, etc. 7.2 All irrigation which can not be done by an automatic system will be done on a negotiated basis. 7.2 Important irrigation factors that should be understood: 6.3.1 This area experiences frequent hot and dry periods virtually every year that are very injurious to the landscape. 6.3.2 Our heavy clay soils drain poorly resulting in standing water for long periods of time in low areas and quick run off of available water on slopes and tops of berms. Under these conditions most effective irrigation is achieved by watering slowly with low volume sprinkler headstor multiple cycles of short duration. 6.3.3 Proper irrigation is critical to the development of the landscape. All other landscape tasks be effectively managed and still result in failure without the effective management of water. 7. Special Provisions: 8.1 The Greenery cannot accept responsibility for damage or death of flowers, groundcovers, shrubs, trees, lawn or damage to other landscape and property improvements due to circumstances beyond our control: 8.1.1 Extreme weather conditions (storms, flooding, temperature extremes, etc). 8.1.2 Curtailment of water supplies by government entities, owners, or managers. 8.1.3 Poor drainage and/or erosion. 8.1.4 Vandalism; vehicular or pedestrian traffic; animal damage. 8.1.5 Oak wilt, Oak decline, or other disease. 8.1.6 Damage caused by other contractors or workmen. 8. 1.7 Plants transplanted from one location to another. 8.2 The landscape irrigation system will be activated, checked for proper design and operation and a status report submitted upon acceptance of this proposal. 8.3 Work Not Included In This Proposal 8.3.1 Maintenance of large trees, removal or extensive pruning from above ground level. 8.3.2 Insect and disease infestations are not included, but can be treated on a separate "as needed" agreement. 8.3.3 Pickup of fall/winter fallen leaves and debris (except plant clippings caused by our work) in parking areas, street, driveways, tennis court, etc. 9. Landscape Observations: 9.1 The landscape is not automatically irrigated. Effective water management is critical to good landscape management. Landscape Management Agreement The foregoing Landscape Management Proposal constitutes a part of this contract by and between THE GREENERY and BRAZOS COUNTY ARENA in BRAZOS COUNTY. If the Client uses his own purchase order or contract form, the provisions, terms, and conditions set forth herein must be incorporated verbatim or by reference to this contract as " Addendum A". The services specified in this contract will be completed in a workmanlike manner as nearly as possible on the scheduled day. However, The Greenery shall not be held responsible or liable for, nor shall this contract be voided by interruptions and delays caused by so called "Acts of God ", strikes, lockouts, or any other event beyond the control of The Greenery. This does not relieve The Greenery of performing the delayed services as soon as conditions permit, nor does it relieve the Client of prompt payment of regular monthly installments as billed. The Client also agrees that should any payment not be made before the next billing date The Greenery may at its option declare this contract terminated and without further notice cease all services and immediately invoice for "settlement for work actually done ". Failure to exercise said option at any given time does not void this contract nor does it prevent the right to do so at a later date. This contract shall continue on an annual basis unless canceled on a thirty (30) days written notice with "settlement for work actually done ". "Settlement for work actually done ": shall be a cash payment representing the difference between the work actually done as specified in the contract and the amount paid in monthly ins all is in�, ' relation to the stated annual cost. Shrub /Groundcover Management: NONE INCLUDED ' 4.1 Shearing: • 4. 1.1 Shrubs shall be sheared monthly: March through November. 4,1.2 Groundcover shall be edged to keep in bounds and trimmed as necessary to achieve an overall even appearance. 4.1.3 Growth regulators may be used where appropriate. 4.2 Fertilization: A spring application of one (1) lb. of nitrogen per 1000 sq.ft. of bed area. 4.3 Weed Control: Weeds in well- defined shrub /groundcover beds and in pavement cracks will be controlled with selective pre - emergent systemic herbicides. Where herbicides can not be effectively used, the weeds will be manually removed. 4.4 Definition/Turning of Ornamental Beds: 4.4.1 Unbordered ornamental beds will be manually defined with hand tools = times per year. 4.4.2 Unless specified here the beds will not be turned because of potential damage to shallow plant roots and because this practice breaks the seal of pre - emergent herbicides. 5. Tree Management: NONE INCLUDED 5.1 Pruning: Trees shall be pruned _-L times a year, only from ground level to a height of six (6) feet above ground. The purpose shall be to eliminate; narrow v- shaped branch forks that are structurally weak, diseased or broken branches, water sprouts or sucker growth. Each visit will include the following activities. 6.1. l Activate all sections where there is evidence of a possible problem. 6.1.2 Check each sprinkler head for proper operation and coverage. 6.1.3 Monitor the controller for optimum response to the landscape's water needs. 6.1.4 All needed repairs will be invoiced separately from the monthly maintenance billing except any damages caused by our operations will be repaired at no cost. This irrigation system monitoring program does not address system design problems, i.e. poor coverage and low pressure, etc. 7.2 All irrigation which can not be done by an automatic system will be done on a negotiated basis. 7.2 Important irrigation factors that should be understood: 6.3.1 This area experiences frequent hot and dry periods virtually every year that are very injurious to the landscape. 6.3.2 Our heavy clay soils drain poorly resulting in standing water for long periods of time in low areas and quick run off of available water on slopes and tops of berms. Under these conditions most effective irrigation is achieved by watering slowly with low volume sprinkler headstor multiple cycles of short duration. 6.3.3 Proper irrigation is critical to the development of the landscape. Landscape Management Agreement The foregoing Landscape Management Proposal constitutes a part of this contract by and between THE GREENERY and BRAZOS COUNTY. JUVENILE JUSTICE CENTER in BRYAN, TX. If the Client uses his own purchase order or contract form, the provisions, terms, and conditions set forth herein must be incorporated verbatim or by reference to this contract as " Addendum A ". The services specified in this contract will be completed in a workmanlike manner as nearly as possible on the scheduled day. However, The Greenery shall not be held responsible or liable for, . nor shall this contract be voided by interruptions and delays caused by so called "Acts of God ", strikes, lockouts, or any other event beyond the control of The Greenery. This does not relieve The Greenery of performing the delayed services as soon as conditions permit, nor does it relieve the Client of prompt payment of regular monthly installments as billed.. A payment not postmarked by the due date will be considered late, and a payment not received before the next billing date will incur service ordinance charges at the maximum rate allowed by law. The Client also agrees that should any payment not be made before the next billing date The Greenery may at its option declare this contract terminated and without further notice cease all services and immediately invoice for "settlement for work actually done ". Failure to exercise said option at any given time does not void this contract nor does it prevent the right to do so at a later date. This contract shall continue on an annual basis unless canceled on a thirty (30) days written notice with "settlement for work actually done ". "Settlement for work actually done ": shall be a cash payment representing the difference between the work actually done as specified in the contract and the amount paid in monthly install ents in relation to the stated annual cost. LANDSCAPE MANAGEMENT PROPOSAL BRAZOS COUNTY ARENA MARCH 27, 1998 1. General Provisions: 1.5 Scope of Work The Contractor shall provide all materials, equipment, tabor, and supervision to perform all the specified services throughout the year. All applicable laws and regulations shall be adhered to at all times. Our staff includes Irrigators licensed by the Texas Board of Irrigators, and Commercial Pesticide Applicators licensed by the Texas Department of Agriculture. 1.5 Workforce The Contractor's supervisory personnel shall be experienced in landscape management. All landscapers shall be trained and supervised. The Immigration Reform and Control Act of 1986 (IRCA) requires all individuals hired after November 6, 1986 provide their employers with proof of their authorization to work in the United States. IRCA may severely penalize any employer for knowingly hiring undocumented workers or for the failure to verify the legal status of workers already employed. The Greenery is committed to complying with this law. 1.5 Insurance The Contractor will at all times maintain the legally required amounts of Worker's Compensation insurance, Unemployment Compensation, General Liability and Property Damage coverage for the protection of the Client and The Greenery. A Certificate of Insurance will be presented. 1.4 Landscape Improvements Plant replacements or additions or any other additional landscaping beyond the scope of this proposal can be accomplished by a separate agreement. 1.5 Equipment Damage Prevention: Equipment used weekly to cost - effectively maintain the landscape can over a period of time unavoidably damage tender plants in spite of proper training, operation, and supervision. Failure to exercise said option at any given time does not void this contract nor does it prevent the right to do so at a later date. This irrigation system monitoring program does not address system design problems, i.e. poor coverage and low pressure, etc. 6.2 All irrigation which can not be done by an automatic system wi(1 be done on a negotiated basis. 6.3 Important irrigation factors that should be understood: 6.3.1 This area experiences frequent hot and dry periods virtually every year that are very injurious to the landscape. 6.3.2 Our heavy clay soils drain poorly resulting in standing water for long periods of time in low areas and quick run off of available water on slopes and tops of berms. Under these conditions most effective irrigation is achieved by watering slowly with low volume sprinkler heads/or multiple cycles of short duration. 6.3.3 Proper irrigation is critical to the development of the landscape. All other landscape tasks be effectively managed and still result in failure without the effective management of water. 7. Quality Control: 7.1 The entire landscape site shall be inspected on the same schedule as the PRIMARY cutting trips by a qualified management person. • 7.2 The Contractor's recommendation is that the property's 4uthorized representative walk the property with the Contractor's supervisor after each cutting trip and sign a duplicate form indicating the evaluation of the maintenance job. Special Provisions: 8.1 The Greenery cannot accept responsibility for damage or death of flowers, groundcovers, shrubs, trees, lawn or damage to other landscape and property improvements due to circumstances beyond our control: 8.1.1 Extreme weather conditions (storms, flooding, temperature extremes, etc). 8.1.2 Curtailment of water supplies by government entities, owners, or managers. 8.1.3 Poor drainage and/or erosion. 8. 1.4 Vandalism; vehicular or pedestrian traffic; animal damage. 8. l .5 Oak wilt, Oak decline, or other disease. 8.1.6 Damage caused by other contractors or workmen. S. 1.7 Plants transplanted from one location to another. 8.2 The landscape irrigation system will be activated, checked for proper design and operation and a status report submitted upon acceptance of this proposal. 8.3 Work Not Included In This Proposal 8.3.1 Maintenance of large trees, removal or extensive pruning from above ground level. 8.3.2 Insect and disease infestations are not included, but can be treated on a separate "as needed" agreement. 8.3.3 Pickup of fall/winter fallen leaves and debris (except plant clippings caused by our work) in parking areas, street, driveways, tennis court, etc. 9. Landscape Observations: 9.1 The landscape is not automatically irrigated. Effective water management is critical to good landscape management. 9.2 There is a very poor stand of grass over most of the property (bare areas, weeds, uneven finished grade, drainage problems, rocks, etc.). 9.3 There appears to be equipment impact evidence on some of the property improvements. 9.4 It is very difficult to clearly determine the location of all the graves. Many head stones are damaged and laying down on the ground. 9.5 There are several dead, non - vigorous or missing ornamental plants. Landscape Management Agreement The foregoing Landscape Management Proposal constitutes a part of this contract by and between THE GREENERY and BOONVILLE CEMETERY — BRAZOS COUNTY. If the Client uses his own purchase order or contract form, the provisions, terms, and conditions set forth herein must be incorporated verbatim or by reference to this contract as" Addendum A". The services specified in this contract will be completed in a workmanlike manner as nearly as possible on the scheduled day. However, The Greenery shall not be held responsible or liable for, ' nor shall this contract be voided by interruptions and delays caused by so called "Acts of God ", strikes, lockouts, or any other event beyond the control of The Greenery. A payment not postmarked by the due date will be considered late, and a payment not received before the next billing date will incur service ordinance charges at the maximum rate allowed by law. The Client also agrees that should any payment not be made before the next billing date The Greenery may at its option declare this contract terminated and without further notice cease all services and immediately invoice for "settlement for work actually done ". Failure to exercise said option at any given time does not void this contract nor does it prevent the right to do so at a later date. This contract shall continue on an annual basis unless canceled on a thirty (30) days written notice with "settlement for work actually done ". "Settlement for work actually done ": shall be a cash payment representing the difference between the work actually done as specified in the contract and the amount paid in monthl ioAstat nts i n relation to the stated annual cost.
