THE COMMISSIONERS WILL MEET IN REGULAR SESSION ON TUESDAY,
APRIL 7, 1998 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,

COMMISSIONERS' COURT
REGULAR MEETING
APRIL 7, 1998
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, April 7, 1998, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding]
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and /or concerns.
The County Judge read aloud a Proclamation designating
,
the month of April as Sexual Assault Awareness Month" The
Court joins with 'the local Rape Crisis Center to help promote
citizen involvement in efforts to reduce sexual assault
through public education and changing public attitudes. On
motion by the County Judge, seconded by Commissioner Cauley
the Court moved to proclaim the month of April as "Sexual
Assault Awareness Month" throughout Brazos County. The County
Judge then presented the signed Proclamation to Ms Sherry
Hostetter representing the local Rape Crisis Center.
The Court next considered Budget Amendment #97/98 -23.1
through 23.5, which would transfer funds to Non Departmental
from Contingency, and reallocated funds for Risk Management,
Narcotic Trafficking Task Force, Extension Service and Justice
of the Peace Precinct No. 6. On motion by Commissioner
Cauley, seconded by Commissioner Sims, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to adopt a Resolution
approving the County's participation in the Child Protective
Services Cluster Court - Texas Court Improvement Project. The
Court could provide the children involved with faster access
to a judicial determination that affects the children's future
and assist the District Courts and County Courts at Law in
managing ever increasing caseloads.
The Court next considered a request from the Special
Opportunity School of the Bryan Independent School District
for the Road & Bridge Department to provide dump trucks for
the transport of materials for the garden program. The City
of Bryan has a compost facility located at 2988 Pleasant Hill
Road and is donating a truck load of compost to the Special
Opportunity School. The County Engineer said he would be glad
to allow them the use of a truck. On motion by Commissioner

Commissioners Court meeting April 7,.1998
Cauley, seconded by Commissioner Sims, the Court voted
unanimously to approve the request from the Special
Opportunity School and allow them the use of a county dump
truck to transport compost from the compost facility to the
school site.
On motion by Commissioner Jones, seconded by Commissioner
Sims, the Court voted unanimously to adopt a Resolution in
opposition to the adoption and implementation of the EPA's
Phase II Stormwater Discharge Regulations as proposed. The
proposed regulations, if adopted in current form, will have
enormous economic consequences for many counties and require
local governments to conduct the proposed regulatory program.
Demetrios Basdekas, county resident commented on the
Resolution. He voiced concern about storm water runoff as it
relates to the burying of dead animals and the County charging
$180.00 to do so. He asked that, if the proposed regulations
are adopted, the County adopt an Ordinance requiring the
burial of dead animal or that the County do it at no cost.
The Court next considered the 1998 SB 102 /EMS Contract
with the Texas Department of Health. In a memo to the Court,
the County Auditor stated that the internal costs to monitor
the funds, document their use, and comply with audit
requirements appear to greatly outweigh the benefits to be
derived from the funding. He then recommended approval of a
$1,000.00 increase in funding for each EMS unit in the next
year's budget. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to reject the
grant. Commissioner Thornton asked for a breakdown point on
grants.
The Court proceeded to consider the following blanket

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The next matter before the Court was consideration of RFQ
No. 98 -018 for the study, plan and implementation for an
electronic imaging system. The Purchasing Department
solicited proposals for a Consultant to assist the County with
the Study, Plan and Implementation of an Electronic Records
Management System. After evaluating the proposals the members
of the ad hoc committee, Commissioner Carey Cauley, M. J. Deen
and Cheryl Turney, recommended the County begin negotiations
with Tanner Consulting. On motion by Commissioner Cauley,
seconded by Commissioner Sims, the Court voted unanimously to
accept the recommendation of the committee and begin
negotiations with Tanner Consulting for the study, plan and
implementation for an electronic imaging system.
The Court next considered approval of requisitions from
Capital Expenditures for the following purchases:
a) Migration Services from HP -UX 9.04 to HP-
UX 10.20 $7,000.00
b) HP Jet Direct ExPlus for Purchasing and
361st District Court $638.00
c) 'Replacement printers for stock $652.00
d) Laser Printer for Auditor's Office
$1,449.00
On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisitions to be paid from Capital Expenditures.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(7)(C). This is for the purchase of reclaimed
limestone, from Texcon General Contractors. The
Commissioners' Court determined that this was a single source
supplier. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the Exemption of Competitive Bidding Requirements and

authorized all such payments to the designated vendor for
purchases necessary during the 1997 -1998 fiscal year.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Tim Rogers on

Straub Road in Precinct 1 to install a 36 inch x 20 feet arch
i
in the driveway approximately 60 feet east of Straub Road. On
motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to authorize the work.

The Court next considered the request from Wickson Creek

Special Utility District to construct a road bore for a water
line installation in the right -of -way of Harris Lane
approximately 3,200 feet from its intersection with FM 2776.

The site is located in Precinct 2. The County Engineer stated
that all appeared to be in order and recommended approval. On

i motion by Commissioner Thornton, seconded by Commissioner
o Jones, the Court voted unanimously to approve the request from
i Wickson Creek Special Utility District and authorized the
installation. A copy of the request is attached hereto.
The Court received and accepted from Rural Fire
Prevention District 2, the year end report for the year
beginning October 1, 1996.
Under citizen input and /or concerns Demetrios Basdekas
once again commented on the Environmental Protections Agency
I Resolution.
The County Judge made the following comments:
1) The twelve Expo Center Committee members
j will be receiving a letter notifying them
of a meeting on Tuesday, April 28, 1998

at the Brazos Center.
2) We have asked Paul Martin to meet with
the Court on April 13, 1998 at 11:00 a.m
to discuss funding for the jail.
j 3) We will be looking at the current
j expenditure of C.O. funds.
4) Constable Precinct No. 2 has requested
the transfer of a vehicle from the
Sheriff's department.

5) He received a letter from Dr. Jim
Mazurkiewitz announcing his acceptance of
a position with TAMU. Dr. Mazurkiewitz
thanked the Court for its support.
6) He asked the Court to consider longevity
pay program for county employees.
Commissioner Sims made the following comments:
1) He asked the Commissioners and the County
Judge for discussion topics at the State
Convention.
Commissioner Sims made the following comment:
1) The Highway Department has allowed the
Road & Bridge Department to use asphalt
for County road construction.
There being no further business to come before the Court,
the meeting was adjourned.

IN THE COMMISSIONERS COURT
OF
BRAZOS COUNTY, TEXAS
WHEREAS, the Texas Court Improvement Project, a Task Force of the Supreme Court
of Texas, and the Honorable Olin Underwood, Presiding Judge of the 2nd Administrative Judicial
Region of Texas, have obtained grant funding to dedicate a visiting judge and court reporter /court
coordinator to hear Child Protective Services cases pending in the District Courts and County Courts
at Law (described as the "CPS Cluster Court);
WHEREAS, the Commissioners Court of Brazos County, Texas, is of the opinion that
having the assistance of such CPS Cluster Court could (1) provide the children involved with faster
access to a judicial determination that affects the children's future, and (2) assist the District Courts
and County Courts at Law in managing ever increasing caseloads;
WHEREAS, the additional expense to the taxpayers of this county, will be limited to the
salary differential between the state salary paid to a district judge and the salary supplement paid by
the county to a district judge, currently $28.62 per day, and providing the visiting judge with an
existing courtroom facility; and
WHEREAS, participation in the program by each court is entirely voluntary and can be
ended at any time by simply declining to request the regional judge to assign future cases;
NOW, THEREFORE, BE IT RESOLVED that the Commissioners Court of Brazos'
County, Texas, approves this County's participation in the CPS Cluster Court Program.

I, PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be Installed 1) within 3-5' of and parallel to the right -of -way Me and/or 2) in the
case of a road bore, perpendicular to the right -of -way line.
C) If clearing of brush, trees and other obstruction Is necessary, it shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from County right -of -way.
D) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall
be furnished to the office of the Bravos County Engineer.
E) Construction shall be In strict conformance to the latest Texas Manual of uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of Transportation,
and all other State and Federal laws governing utility construction.
