THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
MARCH 31, 1998 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE

COMMISSIONERS' COURT
REGULAR MEETING
MARCH 31, 1998
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, March 31, 1998, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
There was no citizen input and /or concerns.
The first matter before the Court was a presentation by
the Brazos Valley Arts Council concerning quarterly
activities. Julie Angelo, representative of the Arts council
invited the members of the Court to an open house at 5:30 p.m.
at the new Arts Council location.
The presentation by Judge J. D. Langley concerning the
Child Protective Services Cluster Court - Texas Court
Improvement Project will be delayed until later in the
meeting.
The next matter for the Court's consideration was a
presentation by a representative of the Economic Development
Corporation, concerning the Software Commercialization and
Innovation Center (SCIS) Proposal. The mission of the SCIC is
to stimulate the creation and growth of software technology
based business in Texas and facilitate software technology I'
•transfer from the Texas academic and entrepreneurial I

communities. Robert Worley, Representative of the Economic
Development Corporation, proposed that Brazos County and the
cities of Bryan and College Station fund an additional $10,000

to the Economic Development Corporation for Fiscal Year 1998,
for the purpose of the Economic Development Corporation
representing the community with a membership in SCIC. The
entire $30,000 would be paid to the SCIC for the membership.
The proposal includes the Economic Development Corporation
Chairman sitting as a voting member of the SCIC Board of
Directors and the EDC President /CEO serving on the SCIC Board
in an ex- officio non- voting capacity. Mr. Worley will
provide financial information.
The County Judge read aloud a Proclamation designating
the week of April 6 through 12, 1998 as "Public Health Week"
in Brazos County. The Court recognized the efforts of Public
Health professionals to assure the health and future of our
communities and affirms its support and appreciation for all
that Public Health does for the state. On motion by
Commissioner Sims, seconded by Commissioner Cauley the Court
moved to proclaim the week of April 6 through 12, 1998 as
"Public Health Week" throughout Brazos County.
The Court next considered Budget Amendment X197/98 -22.1
through 22.2, which would increase funds budgeted for Juvenile
Services and reallocate funds for the Computer Network
Services Department. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

The Court next considered the following Claims as
submitted by the County Treasurer for payment:
98- 004623 through 98- 004794
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered a request by the Road and
Bridge Department to purchase an Asphalt Pavement Patch
Machine. In a memo to the Court, the County Engineer stated
that the Road and Bridge personnel had tried several asphalt
pavement patching machines and found them to drastically
reduce labor time and produced a far superior patch. He
estimated the cost to be $46,900 and stated that there were
enough funds available in the departmental budget to purchase
such a machine. On motion by Commissioner Sims, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the purchase of an Asphalt Pavement Patch Machine.
The next matter for consideration was a request by the
Juvenile Services Department for Internet access for three
computers within the Juvenile Services Department. On motion
by Commissioner Cauley, seconded by Commissioner Sims, the
Court voted unanimously to authorize Internet access for three
computers in the Juvenile Services Department.
On motion by Commissioner Thornton, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the County Judge to execute a Tax Resale Deed to the following
individuals:
Adelfino Maldonado and Alice Maldonado - Tract #2:
Lots 8 and 9, Block C, Starlight Addition,
City of Bryan, Brazos County, Texas
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Special Tax Resale Deed to the following
individual:
Curtis Capps - Lot 31, West Side Addition,
City of Bryan, Brazos County, Texas

The Court next considered a request by Justice of the
Peace, Precinct No. 6, George Boyett, to modify the 3/4 time
clerk position to a full -time position. In a memo to the
Court, Judge Boyett argued that as a result of realignment
there was a dramatic increase in case filings. His clerks are
falling behind in working the mail, setting court dockets,
disposing of traffic cases, and responding to written requests
for information. He went on to say that they were several
months behind in issuing warrants and capias pro fine warrants
which translates to uncollected fines. On motion by
Commissioner Sims, seconded by Commissioner Jones, the Court
voted unanimously to approve the request by Justice of the
Peace, Precinct No. 6, George Boyett, to modify the 3/4 time
clerk position to a full -time position.
The Court proceeded to consider the following blanket
Purchase Orders:
Americlaen Jail $1,000
Ray Criswell Jail $ 500
Brazos Off Supply County Attorney $1,200
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of requisitions from
Capital Expenditures for the following purchases:
a) Material for Demonstration Garden for

b) Handheld radios for Constable, Precinct
No. 6 $459.95
c) Handheld radios for Sheriff's Office

d) Condensing Units for various offices for

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the

The Court next considered approval of requisitions from
General Fund for the following purchases:
a) Handheld radios for Juvenile Services
$1,402.50
b) Floor Buffer for Juvenile Services
$998.95
On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to approve the requisitions
to be paid from General Fund.
The Court next considered awarding the following bid:
Bid No. 98 -018 - Shop Supplies and Auto Parts.
Cheryl Turney, Purchasing Agent, recommended
acceptance of the bid on Section "A" submitted
by Hi /Lo Auto Parts and the bid on Section "B"
submitted by Carquest Auto Parts. On motion
by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to accept
the recommendation of the Purchasing Agent and
award the contract as noted. A copy of the
bid tabulation sheet is attached hereto.
The Court received, approved and ordered filed as
submitted the Treasurer's Investment Report for Quarter Ending
December 31, 1997. A copy of which is attached to and made a
part of these minutes.
There was no citizen input and /or concerns.
The County Judge made the following comments:
1) There will be a workshop meeting at 10:00
a.m. today to discuss the close out of
the Juvenile Justice Center Contract.
2) The waste Water Rules, as set out by the
TNRCC, will affect Brazos County. We
will need to prepare a Resolution for
adoption at the next Commissioners Court
meeting. Tony Jones will look at the
regulations.
3) He received a memo from the Texas County
and District Retirement System concerning
retirement statements.
4) He will not be at the next Commissioners
Court meeting.
5) The tax roll will be ready by July 31,
1998.
6) He will meet with Paul Martin concerning
using C.O. funds for the jail expansion .
7) The Compliant 2000 is complete on three
(3) modules.

Commissioners Court meeting March 31, 1998
The Court next heard a presentation by Judge J.D. Langley
concerning the Child Protective Services Cluster Court - Texas
Court Improvement Project. This program is aimed at
expediting hearings for abused children by having a visiting
Judge hear the cases. The cost to the county is $28.00 per
day that the Judge is hearing cases in that county.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 31st day of March 1998 at a regular meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
Wm. S. Thornton, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;

The following proceedings were held:
THAT WHEREAS, on March 31, 1998 the Court heard and approved
a budget amendment for the 1997 -1998 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 23,
1997 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).
