THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
DECEMBER 23,1997 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county- related issues not scheduled on the agenda. Please
limit subject matter to five minutes. The Commissioners will receive the information,

conducted on November 11, 1997 and November 25, 1997; and from a special meeting
conducted on November 10, 1997.
22. Acknowledge receipt of monthly reports from County officials and department heads.
23. Call for citizen input and/or concerns.
24. Announcement of interest items and possible future agenda topics.
25. Adjourn.

REGULAR MEETING
DECEMBER 23, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 23, 1997, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Jones gave the invocation and led the pledge
of allegiance.
Under citizen input and /or concerns, Commissioner Cauley
thanked those who had prayed for him during the time he was
having health problems.
The Court next considered Budget Amendment #97/98 -9.1
through 9.3, which would increase funds budgeted for all
departments for an increase in employer contribution rate for
retirement; transfer funds to Community Support from
Contingency, and reallocated funds for Risk Management. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.

It was noted that the Personnel Action form for Bronson Lewis
should show salary increase rather than completed probation.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The court next considered a request from the Maintenance
Department requesting approval to give a salary increase to an
employee completing the six months probation period. On
motion by Commissioner Jones, seconded by Commissioner Cauley,
the Court voted unanimously to approve the request and grant
the salary increase.
The next matter before the Court was acceptance of
donated property by a member of the Sheriff's Department.
Officer Alton Holmes is donating a Motorola Cellular Phone,
serial number JS4134874. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to accept the donated property from Officer Alton Holmes.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individuals:
Salmon Cisneros and Maricela Cisneros - Lot 249,
Benchley Oaks Subdivision, Brazos County, Texas.
The next matter for consideration by the Court was the
acknowledgment of a Clinical Psychology Services Agreement
between Brazos County and the Psychology Clinic in the
Department of Psychology at Texas A &M University.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and the Brazos
County Rape Crisis Center, Inc.. The Center will provide
support services to victims of sexual assault. The cost to
Brazos County will be $13,000.00 annually. The term of the
contract will be twelve (12) months beginning October 1, 1997
and terminating September 30, 1998. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to enter into contractual agreement with the
Brazos County Rape Crisis Center, Inc.. A copy of the
contractual agreement is attached hereto.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to table consideration of
the Fee Schedule for electronic filing for the District
Clerk's office.
The Court next considered entering into Agreement with
National Employee Benefits Administrators, Inc. as adminis-
trator of the County Section 125 Cafeteria Plan. Commissioner
Sims moved for approval. Commissioner Cauley seconded the
motion. Then Commissioners Sims and Cauley withdrew their
motion and second. On motion by Commissioner Jones, seconded
by Commissioner Cauley, the Court voted unanimously to enter
into agreement with National Employee Benefits Administrators,
Inc., as administrator of the County Section 125 Cafeteria
Plan pending review and authorized the County Judge to execute

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of requisitions
from Capital Expenditures for the following purchases:
a) Transceiver for Juvenile Services,

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve all the
requisitions to be paid from Capital Expenditures.
The Court next considered approval of a requisition from
the District Attorney's Crime Fund for the purchase of Bullet-
proof vests for the Brazos Valley Narcotics Trafficking Task
Force. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the requisition for the purchase of Bullet -proof vests for the
Task Force.

The next matter for consideration was approval for the
Purchasing Agent to advertise for bids for the following:
a) Cleaning Supplies for the Jail
b) Purchase 23 -24 Yard Dump Truck for Road & Bridge
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the
Purchasing Agent to advertise for the previously noted bids.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(10). This is for the purchase of labor and mowing
services at the Citizen Collection Sites performed under a
contract for community and economic development as defined in
LGC, Section 381.004 from Junction Five -O -Five. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve the Exemption of Competitive
Bidding Requirements and authorized such payments to the
designated minority vendor for purchases necessary during the
fiscal year 1997 -1998.
The Court next considered the request from GTE to
construct a road bore in the right -of -way of Silver Hill Road
at its intersection with SH 47. The site is located in
Precinct 4. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to approve the request from GTE and
authorized the installation. A copy of the request is
attached hereto.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Charles Dileo on
Bickham Cemetery Road in Precinct 2 to clean out a channel to
the pasture to allow water to drain from the culvert under the
roadway. On motion by Commissioner Thornton, seconded by

Commissioner Jones, the Court voted unanimously to authorize
the work.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in November, 1997 on the
following dates: 4, 11, 19, 25; Workshops held on November 11
and 25, 1997; and a special meeting held November 10, 1997.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the minutes as
submitted.
The Court acknowledged receipt of the Extension Service '
reports for November 1997 and acknowledged receipt of reports
from the following County and Precinct Offices showing
revenues collected and remitted to the County Treasurer:

The County Judge made the following comments:
1) On this date he and Commissioner Jones
met with Party Chairs to discuss filing
for the office of Justice of the Peace
and Constable. If the Court hears from
the Department of Justice today, a
meeting will be scheduled for Friday,
December 26, 1997. If we receive no word
today, then there will be a meeting
Friday, January 2, 1998 at 9:00 a.m..
2) The Agenda will be published for the
January 2, 1998 meeting.
Commissioner Sims made the following comment:
1) The Highway Department has allowed the
Road & Bridge Department to use asphalt
for County road construction.

On this the 23rd day of December 1997 at a regular meeting of the
Commissioners' Court, the following members were present:

THAT WHEREAS, on December 23, 1997 the Court heard and

reasonably included in the original budget adopted September 23,

Clinical Psychology Services Agreement between
the Brazos County Commissary Fund
and the Psychology Clinic in the
Department of Psychology at Texas AGM University
I. Purpose of Agreement
This contract outlines an agreement between the Brazos County Commissary
Fund and the clinical psychology program in the Department of Psychology
at Texas AbH University (henceforth referred to as TAHU) regarding a
clinical assistantship program between the two institutions.
The purpose of this agreement is to provide the terms whereby
(a) students enrolled in the Doctoral Clinical Psychology Program shall
receive on -site educational experiences at the Brazos County Jail, and
(b) Brazos County inmates shall receive clinical psychology services
provided by students enrolled in the Doctoral Clinical Psychology
Program.
II. Respective Responsibilities
A. TAHU agrees to:
1. Provide a masters -level graduate student in clinical psychology to
Brazos County Commissary Fund for 10 hours /week for 32 weeks during an
8 -month period (320 hours per term of the agreement).
2. Provide one hour per week of doctoral -level supervision for this
graduate student.
3. Bill Brazos County Commissary fluid monthly for services provided.
B. The student agrees to:
1. Provide clinical psychology services to Brazos County inmates for
10 hours /week. Scheduling of these 10 hours is to be negotiated on an
individual basis between the student and Brazos County sheriff.
2. Include within the 10 hours /week the following on -site activities:
Direct clinical services, staff meetings and consultations, and all
administrative responsibilities including preparation of written reports
and maintenance of clinical records.
3. Comply with policies established by the Brazos County sheriff
regarding code of ethics, confidentiality, and other issues relevant to
provision of clinical services in a multidisciplinary setting. The
student will supply appropriate certification of credentials and complete
agreements regarding confidentiality and other professional issues as
required by the Brazos County sheriff and his staff.

C. The Brazos County sheriff agrees to:
1. Submit a check payable to Texas A&M University 10 days following
receipt of the bill for services.
2. Provide case -by -case consultation to the student on an as- needed basis
by the Brazos County jail staff.
3. Provide written evaluation of the student to the director of clinical
psychology training at TAMU at the end of the term of this agreement.
4. Identify two weeks during the 8 -month period, in consultation with the
student, during which no clinical services will be provided by the
graduate student.
D. TAMU and Brazos County sheriff both agree to:
1. Selection of the graduate student for this clinical assistantship by
the Director of Clinical Psychology Training at TAMU in consultation with
program faculty and with appropriate Brazos County jail administrative
personnel.
2. Mutual evaluation of the graduate student throughout the term of this
agreement. In the event that difficulties arise with any component of
the assistantship program, the following steps will be undertaken:
a. Either the Brazos County sheriff or TAMU may initiate a joint
meeting with representatives from both institutions. including the
student assigned to the assistantship, to identify relevant issues
and plan appropriate interventions to remediate these difficulties.
b. In the event that appropriate interventions cannot be identified
or upon implementation and modification prove unsuccessful,
reasonable efforts will be made to continue the student's clinical
assistantship at Brazos County jail through the last month of the
current academic semester.
c. Should continuation of the assistantship or a given student
through the end of the current academic semester not prove
possible, this agreement may be cancelled upon 30 days written
notice by either the Brazos County sheriff or TAMU.
III. Professional Liability

IV. Cost of Agreement
1. This agreement constitutes a fixed -cost contract.
2. Brazos County Commissary Fund agrees to purchase these services for
the sum of $7,106.00 to be paid in 8 monthly installments of $888.25.
This sum is equivalent to $22.21 per service hour.
V. Term of Agreement
1. The term of this agreement shall be for a period of 8 months beginning
January 1st, 1998 and ending August 31st. 1998.
2. This agreement may be renewed if mutually agreed upon by both parties.

CONTRACT
THIS CONTRACT IS ENTERED INTO BY AND BETWEEN BRAZOS COUNTY, TEXAS,
acting by and through it duly elected County Commissioners (herein-
after "County"), and the BRAZOS COUNTY RAPE CRISIS CENTER, INC.
(hereinafter "Provider "), located in Bryan, Texas.
RECITALS:
WHEREAS, the County has the objective of providing support
services to the victims of sexual assault; and
WHEREAS, the Provider shares this common goal with the County; and
WHEREAS, the County desires to assist the Provider in providing
support services to victims of sexual assault through funds provided
by the County.
NOW THEREFORE the parties above stated agree to the following
terms and conditions to provide such support services.
TERM
This contract shall continue in force and effect for a term of
twelve (12) months commencing on the 1st day of October, 1997, and
terminating 30th day of September 1998.
CANCELLATION
This contract may be canceled by any parties hereto upon sixty
(60) days written notice as provided herein.
SERVICES TO BE PERFORMED BY PROVIDER
The Provider will provide services to victims of sexual assault
and their families. These services will include: a 24 -hour hotline
and 24 -hour escort service; one -on -one counseling; group counseling;
community awareness programs; Speaker's Bureau; training and
supervision of volunteers; training for law enforcement agency
personnel, the medical community, clergy, staff of the District
Attorney's office and psychologists.
USE OF COUNTY FUNDS
Funds to be furnished to Provider as stated herein below shall be
used to pay operational expenses of the Provider, including rent,
telephone expenses, and office supplies, as described in Exhibit A -
Budget, attached hereto and made a part hereof for all purposes.

COUNTY'S LIABILITY FOR PAYMENT
The County agrees to reimburse the Provider a maximum amount of
money totaling $13,000 for the term of this Contract.
This sum shall be paid upon the following date and in the
following amount:
January 2, 1998 $13,000.00
RESPONSIBILITIES OF PROVIDER
Provider will be responsible for providing the following services
pursuant to this Contract:
1. Maintaining this Contract;
2. Providing of the Provider's Services;
3. Maintaining data files on clients and the Services provided
thereto;
4. Respond to all and any inquiries by the County regarding the
Center and its Services;
5. Assist the County with information needed for audit purposes;
6. Provide the County with quarterly financial statements;
7. Provide the County with any and all certified audits of
Provider and the management letter prepared in connection
therewith;
8. Provide the Court with statistics evidencing the number of
Brazos County residents using the Provider's Services and the
percentage Brazos County residents comprise of the total
population using the Provider's Services.
RESPONSIBILITY OF COUNTY
The County shall be responsible for the following duties and
requirements:
1. Provide County funds for the payment of the consideration
stated herein.
2. Conduct a review of the Provider's performance in providing
the Services to be provided hereunder in order to assess
County's continued participation in the funding of the
Provider.

RECORD RETENTION
The Provider shall be responsible for record keeping on all
Services provided to those individuals using its services and all
financial records of the Center. The Provider agrees to maintain and
make available for inspection by the County upon request consistent
with personal privacy and subject to the limitation of state law, any
and all records the County determines, in its sole discretion, to be
necessary for the Court to justify its continued participation in
supporting the Provider with funding. Such records shall be retained
for at least four (4) years from the date the service was provided.
These records shall be made available for inspection and audit by the
County, if it so desires.
DISCRIMINATION
The Provider shall not discriminate against any employee or
applicant for employment because of race, color, religion, sex, or
national origin. The Provider shall take affirmative action to ensure
that applicants who are employed are treated during employment,
without regard to their race, color, religion, sex, or national
origin. Such action shall include, but not limited to, the following:
employment, upgrading, demotion, or transfer; recruitment or
recruitment advertising; layoff or termination; rated of pay or other
forms of compensation; and selection for training, including
apprenticeship. The Provider agrees to post in conspicuous places,
available to employees and applicants for employment, notices setting
forth the provisions of this nondiscrimination clause.
INDEMNITY
The parties hereto agree to indemnify one another for and hold one
another harmless from and against all suits, claims, demands,
liabilities or actions resulting or alleged to result form the breach,
violation or non - performance of the services stated herein and for any
damage to any person resulting form any action or omission or
negligence on the part of each party hereto.
INSURANCE
The parties hereto agree that the Provider shall be an independent
contractor and not any employee or agent of the County and that each
shall maintain at its own expense, adequate liability insurance to
insure against damages and liabilities which may arise due to the
duties and obligations contracted for herein.

COUNTY INVOLVEMENT
The County and Provider state that to the best of their knowledge,
no officer, agent or employee of the County who exercises any function
or responsibility in connection with the carrying out of this Contract
or the services to which it relates has personal interest direct or
indirect, in this Contract.
GOVERNING LAW
This Agreement shall be executed in and shall be governed by the
laws of the State of Texas.
NOTICES
All notices required to be given hereunder shall be deemed to be
duly given by delivering such notice or by mailing it, registered mail
to the other party at the following addresses:

FURTHER ASSURANCE
Each party hereto agrees to perform any further acts and to
execute and deliver any further documents which may be necessary to
carry out the provisions of this Agreement.
SEVERABILITY
In the event that any of the provisions or portions thereof, of
this Agreement, are held to be unenforceable or invalid by any court
of competent jurisdiction, the validity and enforceability of the
remaining provisions or portions thereof shall not be affected
thereby.
ENTIRE AGREEMENT
This Agreement contains the entire understanding between the
parties hereto concerning the subject matter contained herein. There
are no representations, agreements, arrangements, or understanding,
oral or written, between or among the parties hereto, relating to the
subject matter of the Agreements, which are not fully expressed
herein.

ASSIGNABILITY
Provider shall have the right to assign this Contract and any of
its rights hereunder to a wholly owned subsidiary or to a corporation
with which it may be merged without prior written consent of the
County; otherwise, this Contract is not assignable by the Provider
without the prior written consent of the County.

PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed 1) within 3 -5' of and parallel to the right-of-way line
and/or 2) in the case of a road bore, perpendicular to the right -of -way line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be the
Applicant's responsibility to do so and to remove all cleared brush, trees etc. from
County right -of -way.
D) Duch line shall be compacted to 90% standard density ASTM -Test Method No.
D -698; test shall be conducted by an independent Geotechnical testing firm;
copies of all test results shall be furnished to the office of the Brazos County
Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways published by the Texas
Department of Transportation, and all other State and Federal laws governing
utility construction.
