DECEMBER 16,1997 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE

REGULAR MEETING
DECEMBER 16, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 16, 1997, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
The first matter before the Court was a presentation to
the County Auditor of the Award for Financial Reporting
Achievement. This is the ninth year in a row that the
Auditor's office has received the award. The County Judge
congratulated the Auditor on his department's achievement.
There was no citizen input and /or concerns.
The Court next considered Budget Amendment #97/98 -8.1,
which would reallocate funds budgeted for the Agricultural
Extension Service. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

Commissioners Court meeting December 16, 1998
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered the adoption of an Order
Prohibiting or Regulating the Ownership and Keeping of
Dangerous Wild Animals in Brazos County. Robert Weir,
committee member, thanked the Court for allowing him to
participate on this committee. He went on to say that he did
not like the idea of restricting personal freedom. Commis-
sioner Sims asked if wolf hybrids would be controlled and
about monitoring the liability insurance. Dan Bates, resident
of Millican, commented on the number of animals dumped in the
rural area. On motion by Commissioner Jones, seconded by
Commissioner Thornton, the Court voted unanimously to adopt an
Order Prohibiting or Regulating the Ownership and Keeping of

Dangerous Wild Animals in Brazos County.
The Court next considered the appointment of four (4)
Fire Commissioners to the Brazos County Fire Prevention
District #4 Fire Commissioners Board. On motion by
Commissioner Cauley, seconded by Commissioner Thornton, the
Court voted unanimously to appoint the following persons to
the Brazos County Fire Prevention District #4 Fire Commis-
sioners Board:
Betty J. Putz - filling the unexpired term of Alvin
Phelps which began January 1, 1997
through December 31, 1998.
Anderson Jones - now serving as President
James Green
Sue Moody - now serving as secretary /treasurer
The next matter for consideration by the Court was a
request submitted by the County Attorney requesting approval

for out of state travel for Paul Mahoney and Steven Mills.
Mr. Mahoney and Mills would be traveling to Glynco, Georgia to
attend the Fugitive Investigator's Course January 5 -15, 1998.
On motion by the Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to grant the request from
the County Attorney and approved payment of out of state
travel expense for Paul Mahoney and Steven Mills.
The Court next considered adopting a Resolution
authorizing application to the Texas Department of Health for
grants for Emergency Medical Services and Trauma System
Development. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the County Judge to make application on behalf of Brazos
County to the Texas Department of Health and accept on behalf
of Brazos County such grant funds as may be tendered. A copy
of the resolution is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individual:
Saul Guevara - Lot 13, Block 3, Darwin - Kinnard Addition,
City of Bryan, Brazos County, Texas
The Court next considered approval of the Final Plat of
Willow Bend Subdivision in Precinct 3. Richard Vance, County
Engineer, stated that he had reviewed the plat and offered the
following comments:
1) Show existing right -of -way of Hardy Weedon Road
as was requested at Preliminary Plat review.
2) Physically show and dimension additional right -
of -way dedication as was requested at Preliminary
Plat review.
3) Show detail of drainage easements as was
indicated on the Preliminary Plat.
4) Per a request from Wickson Creek S.U.D.,
developer is strongly urged to plug an existing
water well that lies within a dedicated 20 feet
utility easement.
5) Per Brazos County Health Department, the water
well referenced in note #4 shall be shown on the
face of the plat.

6) Per 911, road name Willow Bend Lane" is not
acceptable and will need a new name.
7) Add drainage description.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approved the final plat
of the Willow Bend Subdivision subject to the developer
complying with the exceptions noted by the County Engineer.
The Court proceeded to consider the following blanket
Purchase Orders:

On motion by Commissioner Cauley, seconded by Commissioner
Thornton, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered awarding the following bids:

recommended acceptance of the bid

Commissioners Court meeting December 16, 1998
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to accept the
recommendations of the Purchasing Agent and award the
contracts as noted in bids 98 -015, 98 -016 and 98 -026. On
motion by Commissioner Jones, seconded by Commissioner
Thornton, the Court voted unanimously to accept the
recommendation of the Purchasing Agent and reject the bid
received for bid no. 98 -020.
The Court next considered approval of requisitions from
Capital Expenditures for the following purchases:
a) IBM Wheelwriter 1000 typewriter for
County Clerk, $564.00
b) Heavy Duty Wet /Dry Vacuum Cleaner for
Road and Bridge, $250.00
c) Pentium II Computer for Road & Bridge,
$1,812.00
d) HP9000 Model K220 for CNS, $22,567.00
e) Typewriter for District Clerk, $260.49
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve all the
requisitions to be paid from Capital Expenditures.
The Court next considered the following requisitions for
purchases through sealed competitive bids for the Road and
Bridge Department:

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the previously
listed requisitions for the Road and Bridge Department.
The next matter for consideration was approval for the
Purchasing Agent to advertise for RFP 98 -027, to upgrade the
elevator in the Courthouse Annex. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to authorize the Purchasing Agent to advertise for
bids to upgrade the elevator in the Courthouse Annex.

Commissioners Court meeting December 16, 1998
It was the consensus of the Court to table action on the
Clinical Psychology Service Agreement between the Brazos
County Jail and the Psychology Department of Texas A &M
University to allow the Sheriff to research the wording and
extent of County involvement.
Under citizen input and /or concerns, Dan Bates informed
the Court that the charter issued to Millican in 1871 would be
reactivated; there will be a celebration in Millican on
December 31, 1997 and elections will be held in 1998.
There being no further business to come before the Court,
the meeting was adjourned.

NO. 97/98 -8.1
On this the 16th day of December 1997 at a regular meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on December 16, 1997 the Court heard and
approved a budget amendment for the 1997 -1998 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 23,
1997 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

REGULATING THE OWNERSHIP AND KEEPING OF DANGEROUS
WILD ANIMALS IN BRAZOS COUNTY
THE STATE OF TEXAS §
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS §
THAT on this the /G r_L day of December, 1997, the Commissioners Court of Brazos
County, Texas, met in a duly called and convened lawful Session at the Brazos County
Courthouse in Bryan, Texas, with the following members present:
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct One
William Thornton, Sr., Commissioner, Precinct Two
Randy Sims, Commissioner, Precinct Three
Carey Cauley, Commissioner, Precinct Four
Where among other matters, came up for consideration and adoption of the following
ORDER.
WHEREAS, the Commissioners Court of Brazos County, Texas is vested with the
authority by State law, Local Government Code Section 240.001 et seq. 5, to prohibit or
regulate the ownership and keeping of a wild animal in Brazos County; and
WHEREAS, the Commissioners Court of Brazos County, Texas has determined
that wild or dangerous animals in the County should be controlled.
NOW THEREFORE, BE IT ORDERED BY THE COMMISSIONERS COURT OF
BRAZOS COUNTY, TEXAS THAT:
Section 1. Possession of Wild/Dangerons Animals Prohibited: No person shall
keep, or permit to be kept, on his premises any wild or dangerous animal
for exhibition, breeding, sale, or personal use.
Section 2. Definitions: The following words and terms, when used in this Order,
shall have the following meanings, unless the context clearly indicates
otherwise:
A. Breeding — Possession of a wild animal for the purpose of propagation.
B. Exhibition — Display of a wild animal to the members of the general
public for whatever reason, gratuitiously or for a fee.

C. Personal Use — Possession of a wild animal for any purpose other than
breeding or exhibition.
D. Wild or Dangerous Animal — A venomous reptile; elephant,
rhinoceros, or any hybrid of these animals; lion, tiger, ocelot, cougar,
leopard, cheetah, jaguar, hyena, bear, lesser panda, binturong, ape,
monkey, or any hybrid of these animals.
E. Permanent Identification — A microchip, scar, body markings or other
clearly distinctive characteristic or trait sufficient to distinguish an
animal as unique.
Section 3. Exemptions: This Order does not apply to the following:
A. Zoological Park accredited by the American Association of Zoological
Parks and Aquariums.
B. Federally licensed research institutions.
C. Any government agency or its employee who use the animals for an
agency related to education, propagation, or behavior program.
D. Anyone holding a valid rehabilitation permit from the Texas Parks and
Wildlife but only for animals which are in rehabilitation and scheduled
for release.
E. An exhibitor licensed under the Animal Welfare Act (7 U.S.C. 2131 et
seq.)
Section 4. Limited Exemption: Any person in possession or control of a wild or
dangerous animal at the time of passage of this Order shall be permitted to
keep such wild or dangerous animal upon application, within sixty (60)
days from passage of this Order, for a permit as set forth herein. Failure to
apply for and pursue the issuance of a permit within said sixty-(60) day
period shall be a violation of this Order.
Section 5. Permit Requirements For Limited Exemption Ownership: Any person
who qualifies to possess a wild or dangerous animal, as set forth in Section
4 hereof must:
A. Apply for a permit at the Brazos County Animal Control Division or
its designee, the Brazos Animal Shelter and provide the following
information and documentation:
(1) Proof that the animal to be permitted was purchased or acquired on
or before the date of this Order.

(2) A health certificate from a licensed veterinarian stating that the
animal is free from symptoms of infectious disease or is under
treatment. A new health certificate is required each time the
permit is renewed. A copy will remain with the Animal Control
Division.
(3) Present proof of liability insurance or financial responsibility in
the amount of One Hundred Thousand Dollars ($100,000.00) to
cover any damages, loss or liability arising out of an escape and/or
attack by the animal to be permitted.
(4) Present proof of satisfactory completion of a course approved by
the Animal Control Division in the care and maintenance of the
animal(s) in question, or has other approved advanced training in
such area.
(5) Present evidence of a Permanent Identification of the animal to be
registered.
B. Before a permit is issued, the Animal Control Division, or its designee,
shall inspect the facility where the animal is to be kept, which must
meet the following criteria:
(1) Not be within one thousand feet (1,00(Y) of a day care center,
school or church.
(2) Each enclosure must provide adequate exercise area and sleeping
quarters.
(3) Proper temperature control and ventilation for the particular
species must be provided in both areas of the cage.
(4) Each enclosure must be kept locked and designed so that no one
can enter or place appendages in the enclosure.
(5) Each enclosure must be sufficiently strong, and must be covered or
of sufficient height so as to prevent the animal from escaping.
(6) Each enclosure must be kept in good repair to prevent both escape
and injury to the animal.
() Each enclosure must have a water container which is secured to as
to prevent its being overturned. Water must be clean and
wholesome. The animal must be fed a veterinarian approved diet.

(8) The enclosure must be cleaned daily. Animal waste must be
disposed of so as not to create a health and safety risk.
(9) Double -entry cages may be required for some of the dangerous
exotic animals that pose a great public threat. These cages must
provide an area outside the animal's cage that allow people to
enter and leave the area surrounding the cage but prevent the
animal from escaping.
C. Owners keeping permitted restricted animals as pets inside their
residence (as approved by the Animal Control Division) are not
required to provide for the requirements of (1) through (9) above,
except there must be separate sleeping quarters. The animal(s) must
remain in the owner's home at all times, or in a prescribed enclosure,
if outdoors. If transported to a veterinarian, the animal must be kept in
an escape -proof cage previously approved by the Animal Control
division.
Section 6. Fee: The fee for a wild or dangerous animal permit shall be One Hundred
Dollars ($100.00) per animal per year. The permit shall expire one year
from the date of issuance and shall be renewed annually unless the animal
is no longer in the applicant's possession. Permits shall not be
transferable.
Section 7. Enforcement; Penalty
A. At the request of the County Animal Control Division, its designee,
the Brazos Animal Shelter, or on the sworn complaint of any resident
of the County that wild or dangerous animals are being kept in the
County, the county attorney or other prosecuting attorney for the
county, in order to protect the health and safety of the public, may file
an action in a district court to enjoin the violation or threatened
violation of this Order in accordance with Texas Rules of Civil
Procedure Rule 680 et seq.
B. A person commits an offense if the person violates a requirement or
prohibition of this Order. An offense under this Order is a Class C
misdemeanor punishable up to a Five Hundred and No /100 Dollars
($500.00) fine.
Section 8. Disposition of Wild or Dangerous Animal
A. If an injunction is issued pursuant to Section 7, the court shall order
the seizure of the wild animal pending a hearing in this matter.

B. The owner of the animal seized shall reimburse the County or its
designee, the Brazos Animal Shelter, for expenses incurred to keep
and maintain the animal in humane conditions until court
determination of the disposition of the animal.
If a Court finds a violation of this Order, the court may order the humane destruction of
the subject animal or that said animal be given to a non -profit animal shelter or society
for the protection of the animal. The destruction of the wild or dangerous animal must be
performed by one of the following:
(1) A licensed veterinarian.
(2) Personnel of the Brazos Animal Shelter.
(3) Personnel of a governmental agency responsible for animal control
who are trained in humane destruction of animals.

SUBJECT: Monies to be disbursed to counties for EMS and Trauma Systems
During the past legislative session, new legislation (SB 102) was passed providing funding for
Emergency Medical Services (EMS) and Trauma System Development for the first time (see
attached information sheet). While the rules governing disbursement of these funds have not been
finalized, we anticipate entering into a contractual relationship with the counties who will
distribute their share of the funds to eligible EMS and Trauma RACs.
This fiscal year, we will only have a few months to execute the contracts and disburse the money.
In order to save time, we are requesting some information in advance. Please mail or fax the
following to Terri Vernon by December 12, 1997 in the enclosed envelope or at this address:
