THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
DECEMBER 2,1997 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

2. Pledge of Allegiance - Commissioner Sims.
3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county- related issues not scheduled on the agenda. Please
limit subject matter to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for
discussion. (A record is made of the meeting; therefore, please give your name and
address for the record.)

COMMISSIONERS' COURT
REGULAR MEETING
DECEMBER 2, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 2, 1997, with the following members
of the Court present:
Alvin W. Jones, County Judge, PreAding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4, Absent;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
There was no citizen input and /or concerns.
The Court proceeded to consider the change of status of
the following employee.

Bennett, Linda Tax Office Resignation
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to approve the changes
as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
98- 001267 through 97- 001454
On motion by Commissioner Jones, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
The next matter for consideration by the Court was
participation in the City of College Station's Tax Increment
Finance Reinvestment Zone V. On motion by Commissioner
Jones, seconded by Commissioner Sims, the Court voted
unanimously to table consideration to allow the Court more
time to study the matter.

Commissioners Court meeting December 2, 1997
' The next matter for consideration was a correction of the
Flex Plan procedures and payment. The County had been
deducting insurance premiums from employee paychecks one month
in advance and then not reimbursing the employee for that
month when they stop the deductions. It was discovered that
this violates the Flex Plan rules and since the employee is
not given the option for reimbursement, this may also be a
violation of the Wage and Hour Laws. The Insurance Committee
recommended a correction of the plan. On motion by
Commissioner Jones, seconded by Commissioner Sims, the Court
voted unanimously to correct the Flex Plan procedures and
payment. A copy of the procedures is attached hereto.
The next matter before the Court was consideration of a
request from the Risk Management Department to revise the
current budget by the replacement of two (2) part -time
clerical positions with one full -time position. This is
necessitated due to the loss of the 3/4 time Clerk and will
require a budget amendment. Commissioner Sims moved to
approve the request. Commissioner Thornton seconded the
motion. Commissioner Sims then amended his motion to include
that monies would be transferred from Contingency.
Commissioner Thornton amended his second and it passed
unanimously.
The Court next considered the request from Wickson Creek
Special Utility District to place a road bore for water line
installation in the right -of -way of Dick Elliott Road
approximately 0.2 mile from FM 974 in Precinct 2. The County
i Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Thornton,

seconded by Commissioner Jones, the Court voted unanimously to
approve the request from Wickson Creek Special Utility
District and authorized the installation. A copy of the
request is attached hereto.

Commissioners Court meeting December 2,- 1997
The Court proceeded to consider the following blanket
Purchase Order:
Labatt Food Juvenile Services $7,500
On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of a requisition from
Capital Expenditures for the following purchase:
a) Radios for Road & Bridge $1,285.00
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to approve the
requisition to be paid from Capital Expenditures.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(4). This is for the purchase of the professional
survey services from Strong Survey. On motion by Commissioner
Sims, seconded by Commissioner Jones, the Court voted
unanimously to approve the Exemption of Competitive Bidding
Requirements and authorized the payment for all professional
services from the designated firm for the 1997 -1998 fiscal
year.
The Court next considered a request from the Agricultural
Extension Department for authorization to participate in the
Texas Agricultural Extension Service Computer Cost -Share
Program. This program allow the County to purchase computers
on a 50/50 basis with Texas Agricultural Extension Service.
On motion by Commissioner Sims, seconded by Commissioner
Thornton, the Court voted unanimously to approve the request
from Agricultural Extension Department for authorization to
participate in the Texas Agricultural Extension Service
Computer Cost -Share Program. This will allow the County to
purchase three (3) computers.
The Court next considered approval of the minutes of the
Commissioners' Court meeting held October 28, 1997. On motion
Commissioners Court meeting December 2, 1997
by Commissioner Sims, seconded by Commissioner Thornton, the
Court voted unanimously to approve the minutes as submitted.
There was no citizen input and /or concerns.
The County Judge made the following comments:
S 1. He received a request from Bryan Sheet
Metal, a subcontractor for the Juvenile
Justice Center, for payment of an unpaid
invoice.
2. The Commissioners Court meeting slated
for December 30, 1997 will be canceled.
3. Social Services for Aged has submitted a
billing for $7,500 for 1998.
There being no further business to come before the Court,
the meeting was adjourned.

I propose that Brazos County correct these errors immediately to be
in compliance with the Flex Plan and Wage and Hour= rules.
Following is a list of conditions and requirements that employees
have to satisfy.
ELIGIBLE CONDITIONS AND REQUIREMENTS
1. Change in Family Status: Employees that have a change in
family status, as listed in the Flex Plan rules will be
required to give a 30 day notice, unless the employee has no
control of the event. Such as, death of child or spouse, or
sudden loss of employment or other insurance coverage.
2. Resignation_ Employees that resign their position are
required to give notice as soon as possible to be allowed to
stop the premium deduction or to be reimbursed premiums
already deducted.
3. TERMINATION: Employees that are discharged are reimbursed
premiums deducted for the next months coverage, if continued
coverage is not needed, or if employee /dependent are not
eligible for COBRA coverage.
4. COBRA INELIGIBILITY: Employees that are not eligible to
continue coverage through COBRA (according to the federal
regulations), are allowed to stop the premium deduction or be
reimbursed premiums already deducted.
5. OPEN ENROLLMENT: During open enrollment, employees are
allowed to stop their premium deduction for be reimbursed
premiums already deducted for January's coverage.
If approval is made to deduct premiums in the month that coverage
is for, some of the wording of items 1 through 5 will have to be
changed. Also,, employees that re- enroll in the health coverage for
their dependents, would need to stop or be reimbursed deductions in
December and start deductions again in January, for January's
i coverage.

ITEM: Request from Wickson Creek Special Utility District to construct a road bore
for water line installation in the right -of -way of Dick Elliott Road approximately 0.2 mile
from FM 974. Site Is located in Precinct 2.
SOURCE OF FUNDS: N/A
I. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed 1) within 3 -5' of and parallel to the right -of -way line and/or 2)
In the case of a road bore, perpendicular to the right -of -way line.
C) If clearing of brush, trees and other obstruction is necessary, It shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from County right -of -way.
D) Ditch line shall be compacted to 90% standard density ASTM -Test Method No. D-698; test
shall be conducted by an independent Geotechnical testing firm; copies of all test results shall
be furnished to the office of the Brazos County Engineer.
E) Construction shall be In strict conformance to the latest Texas Manual of Uniform Traffic
Control Devices for Streets and Highways, published by the Texas Department of
Transportation, and all other State and Federal laws governing utility construc lon.

REQUEST FOR PROPOSED INSTALLATION IN COUNTY RIGHT -OF -WAY
TO THE COMMISSIONERS' COURT OF BRAZOS COUNTY, TEXAS

Formal notice Is hereby given that (applicant) wickson Creek SUD proposes to
place a (typq ater lineg&Alhe right -of -way of (road) Dick Elliott Rd.
In Brazos County, Texas as follows:
The location or description of the proposed Installation Is more fully shown by 3
copies of the drawings attached to this notice..
I understand and agree that
1. The County Engineer must by notified 72 hours prior to the beginning of
construction in order that he or his designated Inspector may inspect the
actual Installation.
2. That all damage to the roadways and rights -of -way will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate or
lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the
roadway or right -of -way.
4. That Brazos County will in no way be responsible for any damage which
might occur to any existing utility lines in the right -of -way.
S. That the line will be constructed and maintained on the County right -of -way In
accordance with the Utility Accommodation Policy which was adopted by the
Texas Department of Transportation on May 29, 1989.
6. That the line or lines will be constructed no less than twenty -four inches (241
lower than the lowest part of the drainage or bar ditch and the drainage Is to
be considered at least two feet (2) below the center of the roadway.
7. That all sites will be barricaded during the construction period.
