BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
NOVEMBER 25,1997 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county- related issues not scheduled on the agenda. Please

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the

Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, November 25, 1997, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
The first matter before the Court was a drawing for a
Thanksgiving turkey. The names of eligible participants came
from the list of County employees who donated blood at the
November 24, 1997 Red Cross Blood Drive.
There was no citizen input and /or concerns.
The Court next considered Budget Amendment #97/98 -6.1
through 6.3, which would reallocate funds budgeted for the
272nd District Court and Purchasing and adjust a grant amount
for Juvenile Service. On motion by Commissioner Cauley,
seconded by Commissioner Sims, the Court voted unanimously to
approve the budget amendment as submitted, a copy of which is
attached hereto.
The Court proceeded to consider the change of status of t
the following employees.

Commissioners Court meeting November 25, 1997
Commissioner Sims questioned the salary cut for Rene
Kazmierski. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
changes as submitted with no six month increase for Rene
Kazmierski.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
The next matter before the Court was the renewal of a
Contractual Agreement between Brazos County and Brazos County
Soil and Water Conservation District $450. The District will
provided soil and water conservation services to the residents
of Brazos County and to the County proper such as erosion
control, water management and rural development. The cost to
Brazos County will be $4,400.00 annually. The term of the
contract will be fiscal year 1998. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
f unanimously to enter into contractual agreement with the
Brazos County Soil and Water Conservation District $450. A
copy of the contractual agreement is attached hereto.
The Court next considered authorizing the Purchasing
Department to participate in the formation of a committee
charged with engaging a consultant for a new telephone system
for the County. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the Purchasing Department to participate in the formation of
a committee. The County Judge will recommend committee
members.
The Court received, approved and ordered filed as
submitted the Certification of the newly constructed Juvenile
Detention Facility located at 1904 Highway 21 West. The
inspection and certification was carried out by the Juvenile

Probation Board on November 19, 1997. A copy of the
Certification is attached hereto.
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to adopt a
resolution authorizing the County Judge to make application
to the Criminal Justice Division, Office of the Governor, for
grant funds for the Narcotics Trafficking Task Force and to
authorize the County Judge to accept such grant funds should
they be tendered.
The Court next considered authorizing the Auditor's
office to process recurring payment requests for Brazos County
Appraisal District. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to
authorize the Auditor's office to process the previously noted
recurring payment.
The next matter before the Court was consideration of the
renewal rates for the Brazos County Employee Group Health
Insurance for plan year January 1, 1998 through December 31,
1998. In a letter from Mark A. Grierson, representative of
Plumhoff & Associates, he states that there would be no
increase in the County contribution for employees nor in cost
for coverage for spouse, children or family coverage. On
motion by Commissioner Jones, seconded by Commissioner Cauley,
the Court voted unanimously to approve the renewal rates for
the 1998 Group Health Insurance plan year. A copy of the
rates is attached hereto.
The Court next considered approval of Amendment Three to
the Brazos County Employee Group Health Insurance Plans.
Commissioner Sims asked that the Court be advised of any
financial increases when amendments are submitted. On motion
by Commissioner Cauley, seconded by Commissioner Sims, the
Court voted unanimously to approve Amendment Three to the
Group Health Plan. A copy of Amendment Three is attached
hereto.

The next matter for consideration was the Amending of the
Flexible Benefits Plan Document specifically the Medical Care
Expense Reimbursement. In a memo to the Court, the Insurance
Committee recommended reducing the out of pocket medical care
expense reimbursement maximum from the current $5,000 to
$2,500. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to accept the
recommendation of the Insurance Committee and reduce the out
! of pocket medical care expense from $5,000 to $2,500.
The Court next considered the cancellation of the
existing AFLAC Flex Plan Contract effective January 1, 1998.
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to cancel the existing
AFLAC Flex Plan Contract effective January 1, 1998.
The Court next considered the appointment of National
Employe Benefit Administrator, Inc. as Flex Plan Administrator
effective January 1, 1998. On motion by Commissioner Jones,
seconded by Commissioner Thornton, the Court voted unanimously
to appoint National Employe Benefit Administrator, Inc. as
Flex ?lan Administrator effective January 1, 1998.
The Court next considered the request from GTE to install
buried cable in the right -of -way of Stousland Road beginning
4,500 feet south of its intersection with Taylor Lane
extending for a distance of 4,620 feet. The site is located
in Precinct 1. The County Engineer recommended approval of
the request to place cable 6 feet from the back of the right -
of -way line rather than the required 3 -5 feet to keep down
service interruptions due to crowded utilities. On motion by
Commissioner Jones, seconded by Commissioner Thornton, the
Court voted unanimously to approve the request from GTE and
authorized the installation. A copy of the request is
attached hereto.

system. The site is located in Precinct 4. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Cauley,
seconded by Commissioner Sims, the Court voted unanimously to
approve the request from Texas A &M University and authorized
the installation. A copy of the request is attached hereto.
The Court proceeded to consider the following blanket
Purchase Orders:

On motion by Commissioner Thornton, seconded by Commissioner
Sims, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of requisitions from
Capital Expenditures for the following purchases:
a) Carpet Extractor for Maintenance
$1,677.76
b) Mobile Radios for Sheriff's Office
$4,368.00
c) Overhead lights, speakers, sirens for
Sheriff's Office $3,186.75
d) Digital recording system for 272nd
District Court $10,000.00
On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to approve all
requisitions, A through D to be paid from Capital
Expenditures.
The next matter for consideration was approval for the
Purchasing Agent to advertise for bids for upgrading the
HP9000 Mainframe Computer. Commissioner Cauley informed the
Court that the specifications include down time while the
upgrade takes place. On motion by Commissioner Jones,
seconded by Commissioner Cauley, the Court voted unanimously

to authorize the Purchasing Agent to advertise for bids for
upgrading the HP9000 Mainframe Computer.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(6). The Court has determined there is a need to
construct a public road crossing in the right -of -way from
Union Pacific Railroad Company for the purpose of improving
the roadway on Gandy Road. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to grant the Exemption from Competitive Bidding Requirements
for this purpose.
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Buchanan /Soil
Mechanics, Inc. for Construction Materials Testing Services.
The cost to Brazos County will be per the attached fee
schedule. The contract will be effective January 1, 1998. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to enter into contractual
agreement with Buchanan /Soil Mechanics, Inc.. A copy of the
contractual agreement is attached hereto.
The next matter for consideration by the Court was the
modification of the Annual Hot Mix Contract, Bid No. 98 -003.
In a letter to the Court, Harold Hollingsworth, representative
of Young Contractors, Inc. indicated that due to the problem
Union Pacific Rail Road was having delivering aggregate to
them, they are having to truck materials into their plant to
produce hot mix. This, he went on to explain, has
substantially increased their cost to produce mix. He then
asked for a $4.50 per ton increase in their price for hot mix.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the increase
in price for hot mix.
The Court acknowledged receipt of the Extension Service

Demetrios Basdekas - asked if the County

received the Tax Abatement for Brazos Textiles.

then wanted to know what would be the return

investment.
Commissioner Thornton - introduced
his
grandchildren to the Court.
The County Judge made the following comments:
1. He recognized three additional people in
the audience.
2. The December 30, 1997 Commissioners Court
meeting is to be canceled.
3. There will be a very short meeting on
December 2, 1997. Items need to be in
the Judge's office by 5:00 p.m. today.
4. Juvenile Services has moved to the new
Juvenile Justice Center. He has had many
requests for parking spaces. No space
will be allocated at this time.
5. He wished all a Happy Thanksgiving.
6. Bryan Special Opportunity School
appreciates the assistance in hauling the
compost.
7. There will be a food and toy drive for
needy families.
8. He reminded all of the hamburger cookout
at the Road & Bridge Department on
Wednesday, November 26, 1997. Walter
Wilcox will once again cook hamburgers.
There being no further business to come before the Court,
the meeting was adjourned.

NO. 97/98 -6.1 through 6.3
On this the 25th day of November 1997 at a regular meeting of
the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
Wm. S. Thornton, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;

The following proceedings were held:
THAT WHEREAS, on November 25, 1997 the Court heard
and
approved a budget amendment for the 1997 -1998 budget year
for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity
to
meet unusual and unforeseen conditions which could not
be
reasonably included in the original budget adopted September
23,
1997 the following amendment(s) to the original are hereby
authorized, as described on the attached page(s).

RE: EXEMPTION FROM COMPETITIVE BIDDING REQUIREMENTS OF
LOCAL GOVERNMENT CODE, SECTION 262.024(x)(6).
Please be advised that on this 25'" day of November, 1997, at a Regular Session of the
Commissioners' Court on which the following members were present:

The Commissioners' Court has determined that there is a need to construct a public road
crossing in the right of way from Union Pacific Railroad Company for the purpose of

CONTRACTUAL AGREEMENT - -
BRAZOS COUNTY SOIL & WATER CONSERVATION DISTRICT
AND
BRAZOS COUNTY COMMISSIONERS COURT
Brazos County Soil and Water Conservation District #450, hereinafter
called the District, and Brazos County Commissioners Court, hereinafter
called the County, does hereby enter into a contractual agreement for the
District to provide soil and water conservation services to the residents
of Brazos County and to the County proper.
Those services will include, but not be limited to, erosion control,
water management, and rural development. This will- be carried out by
planning and application through informal agreements with land users, or,
as required by Federal or State law. An Information and recognition
program will be used to inform the public. Technical assistance is
utilized through a Memo of Understanding between the District and the
USDA - Natural Resources Conservation Service.
Erosion control will keep the land productive for its various uses for
many generations. Sediment resulting from erosion clogs our local steams
reducing water carrying capacity and resulting in local flooding.
Excessive siltation ruins our local wetlands, and; therefore, reduces a
dwindling wildlife habitat. Silt from erosion carries many pollutaants
dirextly into our local streams and rivers. Conservation practices
consists of erosion control structures, erosion control ponds, gully
shaping, diversions, vegetating old fields, proper management of grazing
resources.

Water management includes recommendations for proper irrigation, flood
control, and ester quality. Irrigated crops account for 75% of all water
used. Proper irrigation saves that resource for tomorrows uses including
domestic consumption. Proper irrigation helps to keep agriculture
pollutants from entering underground water supplies. Conservation
practices include total evaluation of irrigation systems and applicastion
procedures, precision land leveling, and underground pipelines. Water
managemnet includes floodplain management.
The District's role in Rural Development in Brazos County is in providing
fire protection utilizing dry hydrants. Insurance rates outside the city
limits can be lowered a great deal, as well as provide a reliable source
of water to fight rural fires. Farm ponds provide the water and we plan
the dry hydrant system. The District is evaluating the use of artifical
wetlands to replace septic tank filter fields. The prospects are very
promising, but, much work remains to be done before this technology can
be implemented. Water quality in rural Brazos County will be greatly
inhanced if this method can be used.

JUVENILE DETENTION FACILITY CERTIFICATION
We, the undersigned, hereby certify to the Commissioner's Court of Brazos
County, Texas, and the Texas Juvenile Probation Commission, that we have per-
sonally inspected the detention facilities at the Brazos County Juvenile Jus-
tice Center located at 1904 Highway 21 West in Bryan, Brazos County, Texas,
to determine whether the facility is suitable for the detention of children
as provided by Section 51.12(c) of the Texas Family Code.
We hereby find that:
1. Children in detention are not detained in or, committed to a compart-
ment of a jail in which adults are detained or committed;
2. Children in detention ' are not permitted contact with adults who
are detained or committed to jail;
3. The detention facility meets the requirements of Article 5115,
Revised Civil Statutes of Texas, 1925, as amended, defining "safe
and suitable jails ";
4. The detention facility meets the "Standards for Juvenile Detention
Facilities" as required by Section 75.041, Texas Human Resources
Code, and as adopted by the Texas Juvenile Probation Commission
effective the 11th day of November, 1986.
THEREFORE, the Brazos County Juvenile Justice Center is hereby certified
as a suitable facility for children until the next annual onsite inspection
due one year from the above personal visit. The Commissioner's Court of Brazos
County, Texas, shall be provided copies of said certification, and the original .
copy shall be filed with Juvenile Records in the County Clerk's Office.

AUTHORIZING THE SUBMISSION OF A GRANT REQUEST TO THE CRIMINAL JUSTICE
DIVISION OF THE GOVERNOR'S OFFICE FOR FUNDING TO BRAZOS COUNTY, TEXAS
FOR A PROGRAM KNOWN AS THE "NARCOTICS TRAFICKING TASK FORCE."
WHEREAS, the Commissioners' Court of Brazos County, Texas have the moral obligation to
a citizens and taxpayers of Brazos County to ensure that the criminal justice system operates in the most
efficient and coordinated manner possible, and
WHEREAS, the Commissioners' Court feels that the continuation of the Narcotics Trafficking
Task force will materially enhance the administration of justice in Brazos County, Texas; and
WHEREAS, in order to receive Federal matching grant funds, local governments, including
Brazos County have been responsible for providing local matching funds in the amount of twenty -five
percent of the money utilized in narcotics operations; and
WHEREAS, the opportunity exists to fund vital parts of this program through the Office of the
Governor of the State of Texas, Criminal Justice Division; and
WHEREAS, The Brazos County Commissioners Court has agreed that in the event of a loss or
misuse of the Criminal Justice Division funds, Brazos County Commissioners Court assures that the
funds will be returned to the Criminal Justice Division in full;
NOW, THEREFORE BE IT RESOLVED by the Commissioners' Court of Brazos County,
Texas at its meeting on the 25' of November 1997:
1. The County Judge of Brazos County, acting on behalf of Brazos County, be authorized
to make application to the Criminal Justice Division, Office of the Governor, for grant
funds resulting from the Narcotics Trafficking Task Force.
2. The County Judge be authorized to accept such grant funds should they be tendered.
3. This resolution becomes effective upon its adoption.

"HIPAA" shall mean the Health Insurance Portability and Accountability Act of
1996, as presently enacted and as it may be amended from time to time, together
with its related rules and regulations. References to any section of HIPAA
shall include any successor provision.
The Plan Sponsor of a non - Federal governmental plan may elect to be exempted
from any or all of the requirements identified below:
(1) Limitations on preexisting condition exclusion periods; (2) special
enrollment periods for individuals (and dependents) losing other
coverage; (3) Prohibitions against discriminating against individual
participants and beneficiaries based on health status; (4) Standards
relating to benefits for mothers and newborns (section 2704 of the PHS
Act); and (5) Parity in the application of certain limits to mental
health benefits (section 2705 of the PHS Act).
As a non - Federal governmental plan, this Plan has elected to be exempt from the
following sections of the Health Insurance Portability and Accountability Act
for the plan year January 1, 1997 to January 1, 1998:
(1) The limitations on imposing pre - existing conditions exclusions.
(2) The requirement to have special enrollment periods for employees and
dependents in certain circumstances.
(3) The prohibition against discrimination on the basis of health status.
(4) Standards relating to benefits for mothers and newborns (section 2704 of
the PHS Act) . Miis moans the Braazzos O=i y Health Plan has elected to be
eft and will not ly with the Newborns and Mattes iioalth Protection
Act. For a group plan with a plan year on or after January 1, 1998 that
is not exempt, this Act mandates that a Plan cannot:
a) restrict benefits for a maternity hospital stay for a mother and
her newborn to less than 48 hours following a vaginal delivery
or 96 hours following a Cesarean section.
b) require a provider to obtain authorization for this minimum
length of stay.
c) provide monetary payments or rebates to mothers to encourage
them to request less than this minimum coverage or restrict
benefits for any portion of the required minimum length of stay
in a manner which is less favorable than the benefits provided
for any preceding portion of such stay.
d) penalize, reduce or limit an attending provider's reimbursement
because the provider provided treatment to an individual
participant in accordance with this law.
(5) Parity in the application of certain limits to mental health benefits
(section 2705 of the PHS Act). This means that the Brazos County Health
Plan has elected to be wwapt and will not oaMply with the Mental Health
Parity Act of 1996. For a group plan with a plan year on or after

. • • January 1, 1998 that is riot exempt, this Act mandates that for groups with
50 or more employees offering employee coverage are forbidden from
maintaining different annual and lifetime maxim= for mental health
benefits. 'The same annual or lifetime limits must apply for medical
benefits and mental health benefits, or the medical and mental health
benefits must be ocmbined under one and /or lifetime limit. —
Zhis Plan will provide coverage loss certificates to participants who lose
coverage under the Plan.
This amendment shall be effective on January 1, 1998.

Formal notice is hereby given that GTE will construct a
communication line withing the right -of -way of a County Road in
Brazos County, Texas as follows:
GTE proposes to place a buried telephone cable along_
Stousland Road starting 4500 ft. south of the intersection
of Stousland Road and Taylor Lane. We request. due to
existing cable. to place new cable 6' off said R.O.W.
Description of this line and associated appurtenances is
more fully shown by two (2) copies of drawings attached to this
notice. The line will be constructed and maintained on the
County Road right -of -way in accordance with governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights, fanchise,
easement. license, authority, permission. privilege or right, now

LABORATORY, who agree ac follows:
1. DECLARATIONS. CLIENT desires to engage LABORATORY to provide Materials
Engineering and rclatcd amstruc:tion insaxx( ion and materials testing services in connections with
CLIENT's project ( "THE PROJECT ") described as follows:
Construction Matcrials Testine Services for 1998.
Costs will be in accordance with attached Fcc Schedule Rates
LABORATORY has submitted a fee schedule to CLIENT, a copy of which is attached
hereto and made a part hcrcof as EXHIBIT "A" for Materials Engineering and related
construction inspection and materials testing services, which fee schedule is acceptable
to CLIENT
2. SCOPE OF WORK. LABORATORY shall provide Materials Engineering and related
