Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct*l; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Mary Ann Ward, County Clerk. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve the annual • payroll disbursement in the amount of $15,495,303.00 for the t 1997/1998 fiscal year and Commissioners Court waiver to approve the payroll and related benefit distribution each pay period. The next matter before the Court was consideration of a funding addendum for the Brazos County Health Department for fiscal year 1998. Brazos County's monetary contribution is $143,896.00, the in -kind contribution is $238,549.00 for a total contribution of $382,418.00. This amount represents 26.33% of the Health Department budget. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to approve the funding addendum for the Brazos County Health Department. A copy of the addendum is attached hereto. The next matter for consideration was a request to realign personnel position in accordance with the 1997 -1998 budget. In a memo to the members of the Court, the Treasurer i asked that the personnel changes she made during the budget . process be rescinded and returned to the 1996 -1997 budget status with the 2.5% salary increase. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to approve the request of the County F, Treasurer and return the personnel changes in that department to the 1996 -1997 budget status with the 2.5% salary increase. i The Court next considered authorizing the Auditor's office to process recurring payment requests for the following: a) Ingram, Wallis & Co., for professional auditing services for Juvenile Services $2,600 b) Brazos Valley Council of Government, for indigent health care for $54,000 c) Ingram, Wallis & Co., for professional auditing services for Brazos County $41,400 PAL 0 Ivo d r r i f` Q • • • Commissioners Court meeting October 14, 1997 d) Ingram, Wallis & Co., for professional auditing services for the Health Department for $10,000 e) Advanta Financial Corp., for lease of metal detector for Juvenile Services for $2,513 f) Rany Cherian, M.D. for medical services for jail and Juvenile Services (2 payments) for $1,500 g) B /CS Chamber of Commerce, rental of office space for $4,713.66 On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to authorize the Auditor's office to process all the previously noted recurring payments. The Court next considered a request to the Texas Department of Agriculture to amend the Texas Herbicide Law, Chapter 75, and Regulations, Chapter 11, to clarify the boundaries of regulated areas of Brazos County. In a memo to the Court, the County Engineer asserted that these changes were necessary because of the decline in agricultural use of the properties covered in the present regulations and that the changes will more clearly delineate the ores that are covered by the regulations. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to approve the request to the Texas Department of Agriculture. A copy of the request is attached hereto. The Court next discussed authorizing the County Judge to execute a Quit Claim Deed of 0.246 acres out of the Stephen F. Austin League No. 9, Abstract 62, City of Bryan, Brazos County, Texas to Hallie Laugbridge. After discussion of the Deed and on motion by Commissioner Thornton, seconded by t Commissioner Sims, the Court voted unanimously to authorize the County Judge to execute the Quit Claim Deed to Hallie Laugridge for 0.246 acres out of the Stephen F. Austin League No. 9, Abstract 62, City of Bryan, Brazos County, Texas. The Court next considered entering into agreement with the Arts Council of Brazos Valley for the promotion and i VOL v. Commissioners Court meeting October 14, 1997 education about the performing, dramatic, visual, and literary arts. In return for those services provided, Brazos County will pay $18,500 for the year beginning October 1, 1997 and ending September 30, 1998. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to enter into agreement with the Arts Council of Brazos Valley and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to renew the current contract with Texcon for rental of equipment with operator with no price escalation for the period beginning November 15, 1997 through November 15, 1998. The next matter before the Court was approval of a requisition from the County Clerk Records Management Fund for typewriters for the County Clerk. On motion by Commissioner Sims, seconded by Commissioner Thornton, the Court voted unanimously to approve the requisition for two (2) typewriters for the County Clerk at a total cost of $1,128.00. The Court next considered approval of the Final Plat of Big Cedar Estates Subdivision in Precinct 3. Richard Vance, • County Engineer, stated that he had reviewed the plat and offered the following comment: 1) the word "RENEWABLE" needs to be added to Note #7 per a letter from the Health Department Commissioner Sims moved to approve the Final Plat of Big Cedar Estates Subdivision subject to the developer complying with the exception noted by the County Engineer. Commissioner Thornton seconded the motion. Commissioners Thornton, Sims and the County Judge voted "Aye ". Commissioner Jones abstained. The Court next considered acceptance of a Warranty Deed for right -of -way on Blue Ridge Drive in Precinct 1. On motion by Commissioner Jones, seconded by Commissioner Sims, the Court voted unanimously to authorize the County Judge to • accept on behalf of Brazos County a Warranty Deed from Cheryl J. Specifically, section 11.2 (e)(1) will be amended to read as follows: That portion of Brazos County lying east of the Brazos River and west of the following described line shall be regulated by the Code, Chapter 75, as amended, and regulations adopted thereunder. The impact on the citizens of Brazos County will be negligible and will benefit the agricultural produces by lessening the regulatory burdens and associated permit fees presently imposed by the regulations. Applicators who apply Restricted Use (RU) or State Limited Use (SLU) pesticides and Regulated Herbicides will still be required to obtain licenses. In addition, applicators whose uses are not restricted will also be regulated by state and federal pesticide laws.
