the rights -of -way of Cobb Road and Grassbur Road. Sites are located in Precinct 3.
19. Request from GTE to construct three road bores for buried cable installation in the right -
of -way of Stagecoach Road (Timbercrest Subdivision) beginning at its intersection with
Smuggler's Road and extending for a distance of 2500 feet. Site is located in Precinct
1.
20. Request from GTE to construct a road bore for buried cable installation in the right -of-
way of Grassbur Road beginning at its intersection with Elmo Weedon Road and
extending for a distance of 781 feet. Site is located in Precinct 3.
21. Reques'. from GTE to construct five road bores for buried cable installation within 10 feet
of the right -of -way of Dick Elliott Road beginning at its intersection with FM 974 and
extending for a distance of 16,427 feet. Site is located in Precinct 2.
22. Call for citizen input and/or concerns.
23. Presentation by the City of College Station regarding the creation of two tax increment
finance reinvestment zones in College Station.
24. Announcement of interest items and possible future agenda topics.

COMMISSIONERS' COURT
REGULAR MEETING
OCTOBER 7, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, October 7, 1997, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and /or concerns.
The County Judge read aloud a Proclamation designating
the month of October 1997 as "Breast Cancer Awareness Month ".
The Court joins with the local unit of the American Cancer
Society to urge all citizens to join in this campaign to save
lives, create awareness and continue the fight against breast
cancer. The County Judge then presented the signed
Proclamation to Mrs. Pat Mahand, representing the local Cancer
Unit.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the County
payroll in the amount of $557,000.00 for the October 9, 1997
payroll. This is the last payroll of the 96 -97 budget.
The Court next proceeded to set the time and date of the
regular term of Commissioners Court for fiscal year 1997 -1998.
On motion by Commissioner Sims, seconded by Commissioner
Jones, the Court voted unanimously to set Tuesday of each week
at 9:00 a.m. as the regular term of Commissioners Court for
fiscal year 1997 -1998.
The next matter before the Court was approval for the
Purchasing Department to issue a Request for Qualifications
(RFQ) for Consulting Services for a Records Management System
for Brazos County. Commissioner Cauley is attempting to
standardize record keeping for the County and asked the
department heads to cooperate with the consultant. On motion
by Commissioner Cauley, seconded by Commissioner Sims, the
Court voted unanimously to authorize the Purchasing Department
to issue a Request for Qualifications (RFQ) for Consulting
Services for a Records Management System for Brazos County.
The next matter for consideration by the Court was a
request asking approval for out of state travel for a yet
unnamed individual. This individual would be traveling to
Arizona with the Economic Development Corporation. On motion
by the County Judge, seconded by Commissioner Sims, the Court

voted unanimously to approved payment of out of state travel
expense for the unnamed individual.
The Court next heard a request by John Delaney, District
Judge, 272nd District Court to apply the 2.5% salary increase
to the court recorder compensation for two (2) employees. In
his memo to the Court, Judge Delaney indicated that this
compensation was set in 1989 and noted that there was a
failure to include court recorder compensation in computing
salary increase for his department. He asked the Court to
correct the error. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to
authorize the County Auditor to correct the error and transfer
the funds from Contingency.
The Court next considered a request from Constable
offices Precincts 4 and 5 to have access to the Internet and
E -Mail. On motion by Commissioner Cauley, seconded by
Commissioner Thornton, the Court voted unanimously to approve
the request for Internet and E -Mail access for the offices of
Constable Precinct 4 and 5.
The Court next considered authorizing the Auditor's
office to process recurring payment requests for the
following:
a) Jon Acklam, rent for office space at 1103
Anderson Street for Constable Pct. 7.
On motion by the County Judge, seconded by
Commissioner Jones, the Court voted unanimously to
authorize the Auditor's office to process recurring
payments to Jon Acklam.
b) Phyllis Hobson, rent for office space at
1502 Nantucket Drive for Justice of the
Peace Pct. 1
On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to
authorize the Auditor's office to process recurring
payments to Phyllis Hobson.
c) Fred Keller, rent for office space at
8991 East Highway 21 for Justice of the
Peace Pct. 3
On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
authorize the Auditor's office to'process recurring
payments to Fred Keller.

d) K.D. Timmons, rent for property at 1403
Briarcrest Drive for storage for the
Sheriff's department
On motion by Commissioner Jones, seconded by
Commissioner Sims, the Court voted unanimously to
authorize the Auditor's office to process recurring
payments to K. D. Timmons.
e) College Station I.S.D., rent for office
space at 100 Anderson Street for Justices
of the Peace Pct 7 -1 and 7 -2
Commissioner Sims moved to authorize the Auditor's
office to process recurring payment requests from
College Station I.S.D.. Commissioner Jones
seconded the motion. Commissioner Sims then
withdrew his motion and Commissioner Jones withdrew
his second. On motion by Commissioner Sims,
seconded by Commissioner Jones, the Court voted
unanimously to authorize the Auditor's office to
process recurring payments to College Station
I.S.D. for one (1) year.
f) Mike Hensarling, rent for office space at
14821 FM 2154 (2 payments) for Justice of
the Peace Pct. 2 and Constable Pct. 2
On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
authorize the Auditor's office to process recurring
payments to Mike Hensarling.
g) Comptroller of Public Accounts, repayment
of sales tax
On motion by Commissioner Thornton, seconded by
Commissioner Jones, the Court voted unanimously to
authorize the Auditor's office to process recurring
payments for repayment of sales tax from the
Comptroller of Public Accounts.
h) Star Armored, Inc., services (3 payments)
On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to
authorize the Auditor's office to process recurring
payments to Star Armored, Inc..
The Court proceeded to consider the following blanket
Purchase Orders effective October 1, 1997:
1. $1,200 to the Eagle for advertising
2. $1,000 to Progress Supply for plumbing supplies
3. $2,000 to EOS for office supplies
4. $500 to EOS for election supplies
5. $500 to Kinkos for reducing plats
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The next matter before the Court was the renewal of the
current System Support Agreement with Hewlett Packard. This

is for hardware support, software usage assistance, software
update licenses if applicable, and access to Hewlett Packard
support line. on motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the renewal of the System Support Agreement with Hewlett
Packard. A copy of the Agreement is attached hereto.
The Court next considered authorizing work outside of
county rights -of -way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Jerry Caldwell on
Hopes Creek Road in Precinct 1 to repair a drainage outlet.

On motion by Commissioner Jones, seconded by Commissioner
Sims, the Court voted unanimously to authorize the work.
The Court next considered the request from Cody Energy,
Inc. to place two (2) road bores for steel pipeline
installation in the rights -of -way of Cobb Road and Grassbur

check X400145154 in the amount of $1,000.00. The County
Engineer stated that all appeared to be in order and
recommended approval. On motion by Commissioner Sims,

installation. A copy of the request is attached hereto.

Under citizen input and /or concerns Mr. Demetrios
Basdekas made the following comments:
He addressed the use of the Internet and
E -mail and suggested the Court adopt
regulations and criteria for its use.
Item 23 on the agenda, the presentation by the City of
College Station concerning the creation of two (2) tax
increment finance reinvestment zones in College Station was
withdrawn.
Commissioner Cauley made the following comment:
He read a letter from the' Red Cross thanking the
County for the recent blood drive in which 42 units
of blood were given by County employees. He then
commended Rene Kazmierski for her work in
organizing the event.
The County Judge made the following comment:
Last week, there was a walk through Section "A" of
the new Juvenile facility that resulted in an 18
page punch list. Chappell Hill agrees that Section
"A" will be ready to store furniture. Any damage
to the walls will be repaired by Chappell Hill.

ITEM: Request from GTE to construct 5 road bores for buried cable installation within
10 feet of the right -of -way of Dick Elliott Road beginning at its intersection with FM
974 and extending for a distance of 16,427 feet Site is located in Precinct 2.
Recommend denial see explanation under Action Requested.
SOURCE OF FUNDS: N/A
I. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be Installed 1) within 3.5' of and parallel to the right -of -way line and/or 2)
In the case of a road bore• perpendicular to the right -of -way line.
C) If clearing of brush, trees and other obstruction Is necessary, It shall be the Applicant's
responsibility to do so and to remove all cleared brush, trees etc. from County right -of -way.

Formal notice is hereby given that GTE. will construct a
communication line withing the right -of -way of a County Road in
Brazos County, Texas as follows:
From the intersection of FM 974 and Dick Elliot Rd_
along the southwest R.O.W. of Dirk Elliot Rd. northwest
for a distance of 36.427 ft. Said cable to he within
10 ft. Of the R.O.W. In addition, Dick Elliot Rd. is
To be bored at 5 locations.
The location and description of this line and associated
appurtenances is more fully shown by two (2) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right -of -way in accordance with
governing laws.
Notwithstanding any other provision contained herein. it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights, fanc:hise,
