To make arrangements, call (409) 361 -4102. l COMMISSIONERS' COURT REGULAR MEETING SEPTEMBER 23, 1997 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, September 23, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Thornton gave the invocation and led the pledge of allegiance. There was no citizen input and /or concerns. The Court next considered Budget Amendment #96/97 -42.1 through 42.6, which would reallocate funds budgeted for the County Attorney, Constable Precinct 2, Road & Bridge, Sheriff's Jail Administration and Treasurer's office; and reduce the NTTF Grant. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of the following employees. VOL�..�:,�1���; I Commissioners Court meeting September 23, 1997 The Court next considered the following Claims as submitted by the County Treasurer for payment: 97- 010388 through 97- 010606 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the County payroll in the amount of $553,000.00 for the payroll period September 25, 1997. The next matter before the Court was approval of an Order Amending, Abolishing and Adopting Precincts for the election i of Justices of the Peace and Constables in Brazos County, 1 Texas. The County Judge read aloud the Order and then move to approve it. Commissioner Sims seconded the motion. The County Judge asked for discussion and the following people made comment: Chris Kling - 1511 Wayfarer in the Nantucket Subdivision admonished the Court for its misguided belief that consolidation of the Justice of the Peace Precincts would save tax dollars and still give people the service they needed. He strongly urged the Court to reject the Order. Mrs. Stanley Clark - whole heartedly supported Mr. Kling's comments. Jim Smith - College Station read in the newspaper that Madison County was going through the same process. Madison County is stagnant where as Brazos County is growing. It is one of the fasted growing counties in the state if not in the nation. He asked the County Judge to consider that the county is growing. I Wes Hall, Justice of the Peace Precinct 7 Place 2 - asked the Court to put the matter on hold until the new census figures are established. Some time in i• the future maybe some justice precincts may need to be abolished but this area under consideration is' the most dynamic growth area of the county. JP courts are very expeditious and this is what the people want. Tom McDonald, Senior District Judge - stated that i statistics play a big part in government but you can't go by them alone. He suggested the Court go back to the drawing board and gather more information. Demetrios Basdekas - recommended waiting and using the new census figures when available so that a VOL i I i • Commissioners Court meeting September 23, 1997 more prudent, intelligent decision can be made on this issue. Tony Jones, Commissioner Precinct 1 - stated that because the urban area was expanding into the rural area, combining Precincts 1 and 2 it would enable one Justice of the Peace and Constable to take care of the south end of the county. Unfortunately that was not the proposal before the Court and he could not support the one that was. No one spoke on behalf of the proposal. The County Judge then called for the vote. Commissioners Thornton and Sims and the County Judge voted "Aye ". Commissioners Jones and Cauley voted "No ". The motion was adopted with a vote of three (3) "Ayes" to two (2) "Nos ". The next matter before the Court was the adoption of the County budget for the fiscal year ending September 30, 1998. Commissioner Sims moved to approve the budget. Commissioner Cauley seconded the motion. Commissioner Thornton offered an amendment to the motion and second to include "as modified at the Public Hearing" held September 22, 1997. Commissioners Sims and Cauley agreed to amend the motion and second to include "as modified at the Public Hearing ". The County Judge said the salary increases will be effective with the pay period beginning October 4, 1997. The Court voted unanimously to approve the County budget with the additions for Fiscal Year 1998 as recommended at the Public Hearing September 22, 1997. A detailed outline of the modifications recommended at the Public Hearing on the budget is attached hereto. The Court proceeded to adopt a Resolution setting the tax rate for the year 1997. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to adopt the Resolution setting the ad valorem taxes against all property in Brazos County, Texas according to the following schedule: Maintenance & Operating Funds Permanent Improvement Debt Service TOTAL TAX RATE FOR 1997 VOL --PAGE, *70 $.3722 $.0452 $.4174 per $100 valuation 11 ' Commissioners Court meeting September 23, 1997 o. The next matter before the Court was the approval of an Agreement with the City of Bryan to house and maintain the Brazos County Law Library. The City and County are authorized to enter into this agreement under the Interlocal Cooperation Act, Chapter 791, Government Code. Term of the Agreement will be for one (1) year. The County agrees to pay to the City of Bryan an annual sum of $10,956.00 payable in installments of $913.00 per month as compensation for the labor, supplies, equipment, maintenance, and housing of the law library collection. On motion by Commissioner Thornton, seconded by Commissioner Sims, the Court voted unanimously to approve the Agreement with the City of Bryan to house and maintain the Brazos County Law Library. A copy of the Agreement is attached hereto. The Court proceeded to consider adopting a Resolution providing for the collection of additional filing fees for basic civil legal services for the indigent. SB 1534, that mandates the collection of fees, became effective September 1, 1997. The County may keep 5% of the additional fees only if the Commissioners Court adopts the Resolution. On motion by Commissioner Thornton, seconded by Commissioner Sims, the Court voted unanimously to adopt the Resolution providing for the collection of additional filing fees. A copy of the Resolution is attached hereto. The Court next considered renewal of a lease agreement between Brazos County and Brazos County Emergency Communi- cations District 9 -1 -1 (District) for rental of office space in the GTE building for the use by the Emergency Management office. This is in accordance with Texas Interlocal Govern- ment Cooperation Act, Article 4413(32C), V.T.C.S.. Term of the lease is for the period of one year commencing on October 1, 1997 and ending on September 30, 1998. The County agrees to pay Four Thousand Fifty Dollars ($4,050.00) annually. The next matter before the Court was the renewal of a Contractual Agreement between Brazos County and the Brazos County Emergency Communications District 9 -1 -1 for emergency communications services dispatching. Effective October 1, 1997, the District is appointed the emergency communications dispatching authority for Brazos County for the period October 1, 1997 through and including September 30, 1998. The County agrees to pay $174,241.00 for the services provided. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to enter into contractual agreement with the Brazos County Emergency Communications District 9 -1 -1 for emergency communications services dis- patching. A copy of the contractual agreement is attached hereto. The Court next considered the proposed budget for the Brazos County Emergency Communications District 9 -1 -1. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget for the Brazos County Emergency Communications District 9 -1 -1. The Court next considered approval of the Final Plat of Ginger Addition in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approved the final plat of the Ginger Addition. The Court next considered authorizing work outside of county rights -of -way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of C. W. Cobb on Nubbin Road in Precinct 3 to obtain water for use on the Riley Road improvements. On motion by Commissioner Sims, seconded .I vo .,PAUL . Commissioners Court meeting September 23, 1997 by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered approval of a requisitions for the following purchases: a) Stacking Chairs and Chair Truck for the Brazos Center $3,644.00 from Capital Expenditures b) Chairs for Community Supervision $1,372.00 c) Desk for Community Supervision $297.75 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the j requisitions. :{ The next matter for consideration was approval for the r j Purchasing Agent to advertise for bids for a used Pneumatic Roller for the Road and Bridge Department. FLU:., nic. t�:s..,.ta.��....1:i:....+a.K'- - ` � - .Lf. -...• .raa__ -..a _. _ _ _ _ - 1(� t { �l i •L ' 4 VOL PAGE, .. 4 � 1 4ti 11 .� 1 a � ft t BUD BUDGFT AMENDMENT'S VOL PAGE, .. 4 � 1 4ti 11 .� 1 a � ft t i 1 I r t 4 r STATE OF TEXAS S S COUNTY OF BRAZOS S AN ORDER AMENDING, ABOLISHING AND ADOPTING PRECINCTS FOR THE ELECTION OF JUSTICES OF THE PEACE AND CONSTABLES IN BRAZOS COUNTY, TEXAS WHEREAS, the Commissioners Court of Brazos County has undertaken to effect certain changes to Justice and Constable Precincts for the convenience of the people pursuant to its authority under Article 5, Section 18 of the Texas Constitution; and WHEREAS, through a series of public meetings and public hearings, the Commissioners Court has received and considered oral testimony and written evidence regarding the need for changes to existing Justice and Constable Precincts; and WHEREAS, the Commissioners Court finds that it is appropriate to reduce the number of existing Justice and Constable Precincts from six to five, through the abolishment of Justice and Constable Precinct One, with the territory of that Precinct consolidated into existing Justice and Constable Precinct Two; and WHEREAS, the Commissioners Court finds that it is appropriate to abolish Justice and Constable Precinct Seven, creating a new Justice and Constable Precinct Six comprised of certain territory and reflected in the map attached hereto as Exhibit "A"; and WHEREAS, existing Justice and Constable Precincts Three, Four and Five shall be unchanged, and shall be unaffected by the Order; IT IS THEREFORE ORDERED, by the Commissioners Court of Brazos County, Texas that: 1. The above recitals are found to be true and correct and are specifically incorporated herein as findings of fact. 2. Pursuant to Article 5, Section 18 of the Texas Constitution, the Commissioners Court hereby makes the following changes to existing Justice and Constable Precincts: A. Precinct One is hereby abolished in its entirety, with the territory of that Precinct consolidated into Precinct Two. B. Precinct Seven is hereby abolished in its entirety, with the Territory of that Precinct consolidated into Precincts Two and new Precinct Six, as more fully set forth in the map attached hereto as 1 vc) .PA k 7� F � I I r 0 _ .v W Exhibit "A" which is incorporated herein by reference and is made a part of the Order. C. The boundaries of Precinct Two are hereby amended to include the territory reflected in the map attached hereto as Exhibit "A ". D. Precinct Six is hereby created as a new Justice and Constable within the County, with the territory of new Precinct Six being that set forth in the map attached hereto as Exhibit "A ". 3. The Territory comprising existing Justice and Constable Precincts Three, Four and Five is unchanged, and such Precincts are unaffected by this Order. 4. The Changes to Justice and Constable Precincts ordered herein shall become effective January 1, 1998. The parties to this agreement are authorized to make and enter into this agreement under the Interlocal Cooperation Act, Chapter 791, Government Code. TEXT Gov`r CODE ANN. §791 (Vernon 1994 & Supp. 1996). Said Act shall govern the relationship between the parties to the extent required to bring this agreement under the authority of the Act. The parties agree as follows: 1. MUTUALLY BENEFICIAL AGREEMENT 1.1 In and for the consideration of mutual benefits as set forth herein, COUNTY agrees to loan the Brazos County Law Lbcary to MY for CITY to house and maintain in the Bryan Public Library, a place known to be both convenient and accessible to the judges and litigants of Brazos County, Texas. 1.2 CITY acknowledges it benefits from having the law library collection housed in the Bryan Public Library in that it serves as a valuable resource for legal information that is available to the general public, students, litigants, business professionals, and city and county government officials. 1.3 COUNTY acknowledges it benefits from having CIT)t house and maintain the law library collection in that the county is relieved of operating a professional law library maintained by professional librarians, all located in a quiet, academic environment open to the public six days a VOL- i week. By housing the law library collection in the Bryan Public Library the county is afforded the considerable benefit of not being required to provide and maintain supervision, electronic surveillance, furnishings, rest rooms, water fountains, telephones, copiers, additional book shelves, and a workroom. 2. TERM 2.1 This Agreement shall remain in full force and effect for a term of one year beginning with the date specified in the Preamble and may be renewed annually. Any party desiring to terminate this agreement shall give advance notice of its intention by written notice to the other party not less than ninety (90) days before the next annual renewal date. HOUSING, LABOR, SUPPLIES, EQUIPMENT, AND MAINTENANCE 3.1 In consideration for CITY agreeing to house and maintain the Brazos County Law L wy, COUNTY agrees to pay to CITY the annual sum of $10,956.00, payable in installments of $913.00 per month, as compensation for the labor, supplies, equipment, maintenance, and housing of the law library collection. 2 D 3.2 COUNTY shall pay the first monthly' installment within ten (10) days of the day this Agreement is executed by the parties. 3.3 COUNTY shall pay the second monthly installment on the fifteenth (15th) day of the month following the month this Agreement is executed. 3.4 Each subsequent payment shall be on the fifteenth (15th) day of each month until the Agreement is terminated by one of the parties. 3.5 The final payment under this Agreement shall be calculated on a pro rata basis; the pro rata figure is to be calculated by dividing the monthly payment by thirty (30) days. 3.6 The annual sum payable from COUNTY t7 CM shall be reviewed on an annual basis and, when deemed necessary by the parties to this agreement, revised to reflect a more equitable arrangement. Any review and revision shall take place in July; the effective date shall be the first month of COUNTY's fiscal year which, at the time of this agreement, is October - September. 3.7 COUNTY shall compensate CITY by payments made from current rfvenues available to COUNTY. 4. USE 4.1 At the time of this Agreement. the Brazos County Law L wary includes the following: (a) Legal publications and materials owned or leased by COUNTY; (b) Equipment consisting of a video cassette recorder, card catalog, monitor, utility cart, book truck, kick - stool, and three (3) Remington -Rand bookcases (14 sections per range); and (c) Legal publications and materials on loan to COUNTY'from members of the Brazos County Bar Association 3 VOL--Z/,.PAGE. F r F • O 4.2 Title to these publications, materials, and items shall remain vested in COUNTY and those members of the Brazos County Bar Association who have loaned publications and materials to the Brazos County Law Library. 4.3 All requests by the members of the Brazos County Bar Association to remove their loaned materials from the Brazos County Law Labrary shall be approved by COUNTY and submitted to CITY for fulfillment. 4.4 CITY agrees to house the Brazos County Law Library in the Bryan Public Library where it will be available to the public during the normal operating hours of the Library. 4.5 Use of the law library collection shall be subject to the rules and regulations of the Bryan Public Library as they now exist or as they are later amended. 4.6 The law library collection shall not be available for circulation to patrons. 4.7 CITY shall seek to protect the law library 'collection by using any electronic surveillance or electronic book monitoring system which is utilized throughout the Bryan Public Library. Any charge or expense, including labor, for the implementation of such a system as it pertains to the law library collection shall be borne by COUNTY. S. PROPERTY INSURANCE Insuring the collection and equipment of the Brazos County Law Library shall be the responsibility of County and at COLJNTY's expense. 6. SELECTION OF PUBLICATIONS AND MATERIALS 7.1 The selection of publications and materials to be added to or deleted from the law library collection shall be made by the County Law Library Committee of the Brazos County Bar Association. 7.2 Pur n artt to Section 323 of the Local Government Code, the actions of the committee are subject to approval of the commissioner's court. Tex. Loc. Gov't. Code Arm. §323.024 (Vernon 1988 and Supp. 1996). 7.3 All additions, as well as the cost of keeping the law library collection current (i.e., pocket parts, new and revised volumes, and other supplemental materials) shall be borne by COUNTY.
