Request from United Telephone to place several road bores and parallel installations in the right -of -ways of Chisolm Trail, Paradise Way, Pioneer Drive and Westward Ho in 7 -11 Ranch Subdivision. Site is located in Precinct 1. 17. Request from GTE to place a road bore in the right -of -way of Steep Hollow Road for placement of a new fiber optic cable. Site is located in Precinct 3. 18. Request from Wickson Creek Special Utility District to place a service bore in the right - of-way of Dilly Shaw Tap Road approximately 1,400 feet north of Fawnlake Drive. E' I r, a 4 COMMISSIONERS' COURT REGULAR MEETING AUGUST 19, 1997 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 19, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Thornton gave the invocation and led the pledge of allegiance. There was no citizen input and /or concerns. The County Judge read aloud a Proclamation designating August 26, 1997 as "Brazos County United Way Kick Off Celebration Day ". The Court joins with the Cities of Bryan and College Station in proclaiming their encouragement for individuals and businesses to participate in and contribute to the Brazos County United Way annual campaign. The County Judge then presented the signed Proclamation to Bob Fleisher and Kay Wetteman, representing the local United Way chapter. The Court next considered Budget Amendment #96/97 -37.1 through 37.7, which would transfer funds from contingency to the Sheriff's department, reallocate funds budgeted for 361st District Court, Juvenile Services, Road & Bridge and set up grant line items for the Sheriff's office and for Emergency Management. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. II VIDL L.PAGE . The Court next considered the following Claims as submitted by the County Treasurer for payment: 97- 009354 through 97- 009551 On• motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The next matter before the Court was an application by Juvenile Services to Mobil Oil Company for a Classroom Educational Grant. Ernie Wentrcek, Director -of Juvenile Services, explained that Don Dabbs, local Mobil Oil distributor, was sponsoring the grant in the amount of $500.00. The money will be used for classroom supplies for the Boot Camp. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Director of Juvenile Services to make application on behalf of Brazos County to the Mobil Educational Alliance and accept on behalf of Brazos County such grant funds as may be tendered. A copy of the application is attached hereto. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to table consideration of the new guidelines and criteria for granting tax abatements for Brazos County. VC) ,PAQF. �/a Commissioners Court meeting August 19, 1997 The Court next considered lease agreements for occupancy of the Brazos Center with the following organizations: a) Brazos Valley Art League b) Junior League of Bryan /College Station, Inc. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve both lease agreements. The only change is in the contract with the Junior League. It is now for two (2) years with no change in l� rent. The next matter before the Court was a Tax Abatement for Universal Computers Services, Inc.. On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to table consideration until a later date. The Court proceeded to consider the following blanket Purchase Order: B /CS Eagle Personnel $2,000 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Blanket Purchase Order as submitted. The Court next considered awarding the following proposal: RFP No. 97 -051 - Election Services and Supplies for Constitutional Election on November 4, 1997 Cheryl Turney, Purchasing Agent, recommended acceptance of the only quotation submitted, that being from Texas Voting Systems, Inc. in the amount of $16,900.00. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Texas Voting Systems, Inc.. A copy of the bid tabulation is attached hereto. Under citizen input and /or concerns, Demetrios Basdekas made the following comment: He said he was in favor of the County recovering its cost for the burial of dead animals but he felt that if the $180.00 fee is passed, a lot of animals i may go unburied resulting in the spread of disease. The County Judge made the following comments: a) He informed the Court that Fortune Magazine had listed Bryan /College Station as one of the smartest locations in the nation. b) He received a letter from State Senator Steve Ogden listing bills passed by the legislature that are unfunded mandates. c) Senator Saforini will study all laws that require governments to provide funds for mandates. d) He received a letter from TxDOT dealing with the adoption of speed limits on Farm to Market roads. The county can request a change in the speed limit on these roads. Since each school has many worthwhile programs in need of support, you may want to consider a program that does not currently have other support so that you can be a key participant in the success of that program. In some cases, a major project at a school —such as raising funds for a new library—may be such on important goal for the school that you may wish to support it, even though there are a number of other supporters already on board. You will want to speak with the principal on how to let people know about the grant and your support, for example, through school communications with parents, the PTA and the general community. This is especially important If you will be planning activities at your station to support the program and possibly help raise additional funds during the school year. Since the funding is limited, it is best not to commit to providing a $500 grant. Be sure the school officials understand that the application Is a "request." This might include special books, films, outside speakers or field trips Volunteer Programs — Educators believe that nurturing a commitment to community service is an important part of education. Funding might be used to help students become involved in volunteer service or to help them carry out their community service efforts The grant is not intended to be a contri- bution to the community or charitable effort that the students are working on behalf of Scholarships /Awards — Many schools offer scholarships and awards to students who excel in scholastic or other school activities This might include: honor students• sports achievement. perfect attendance, good citizenship or achievement in a particular area of study Extra - curricular Activities — These programs provide enrichment for students outside the classroom. If Lessee will not require the use of the requested rooms for the general membership meeting on any given first Tuesday, Lessee will give Lessor at least 30 days notice. It is generally understood and agreed by Lessor and Lessee that the general membership meetings will be held in either Assembly I or in Lecture /Rehearsal 102 5. Those areas designated on Exhibit "A" as Room 106, Room 108, and Room 102 may be used for committee, council, board, and or provisional meetings are also covered in this contract at no extra charge provided the following conditions prevail a Meetings in small rooms are to be held only during normal business hours, or after 5 P M. when another activity is scheduled requiring a Brazos Center attendant to be on the premises b. The Lessee must give the Lessor notice of the meeting at least one week in advance. If the space used for the meeting has been previously set -up for a meeting scheduled at a later bme by another group, the committee chairman will be responsible for determining that the room is in the exact state as when the room was entered. 6. MAINTENANCE AND SURRENDER Lessor shall maintain the roof, foundation, underground and otherwise concealed plumbing, the structural soundness of the exterior walls, and all other parts of the building and other improvements on the leased premises in good repair an; condition Lessor shall be responsible and keep in a good state of repair all interior plumbing, windows, window glass, plate glass, doors, heating system, air conditioning equipment, fire protection, sprinkler system and the interior of the building in general including the reasonable care of the entrance and exit of the premises Lessee shall provide all furniture for the leased premises. VII. UTILITIES Lessor shall pay all utility charges for electricity, heat, gas and water and power used in and about the leased premises. Formal notice is hereby given that the United Telephone Company of Texas, Inc. proposes to install buried communications cable upon and along the nghl -of -way of county roads in Brazos County, Texas, as follows: IMPROVED ROADS (paved) - The contractor will plow cable in backslope with 8' of right -of -way line. Pipe will be bored under all paved county roads extending from ditch line to ditch line with a minimum cover of 30'. IMPROVED ROADS (gravel) - The contractor will plow cable in the backslope of the road, one track of the plow tractor on the backslope the other may come to the shoulder of the road neither whole tractor or plow will be on the road surface. UNIMPROVED ROADS (dirt) - Same as improved, unless because of ditches, trees and other terrain features, it is more practical to plow in the center of the road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be bumed or disposed of and nbt left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30' except where crossing dams or ditches, at which locations the depth of cables will be at a minimum of 36'. The following are requirements which are made on the contractor. 1. The plowing equipment shall be subject to the approval of the Engineer and the Public Authorities having jursidiction over highway and road rights -of -way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks, ditches, driveways, and roads caused by the equipment shall be immedeiately repaired to the satisfaction of the Engineer and Public Authorities having jursidiction over highway and road right -of- way where involved. 4. Trenches shall be promptly back - filled with earth, and mechanically tamped at six (6) Inch lifts so that the earth Is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. No trenches shall be left open overnight. S. The County Commissioners Court may require the owners to relocate this line, for valid reasons under the law, by giving thirty (30) days written notice. a. Where communication facilities are located on county road ROW the Telephone Company will relocate said facilities at no expense to the County. b. Where communication facilities are located on private property the county will reimburse the Telephone Company for the relocation of said facilities. At any place where a communications line crosses over a county road, it shall be constructed and maintained at least eighteen (18) feet above the surface of the traffic lane. Please notify forty -eight (48) hours prior to starting construction of the line, in order that a representative may be present. The locations of the proposed lines are more fully shown by the copies attached to this notice. Construction of this line will begin on or after the 4_day of Auoust .1997.
