COMMISSIONERS' COURT REGULAR MEETING AUGUST 5, 1997 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, August 5, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. The County Judge gave the invocation and led the pledge of allegiance. There was no citizen input and /or concerns. The Court next considered Budget Amendment #96/97 -35.1 through 35.8, which would increase funds budgeted for Autopsies, Juvenile Services Contract Placement, Jail Administration, reallocate funds for the Road & Bridge Department, Environmental Protection, amend the budgeted revenue to show actual revenue and amend the TJPC Grant. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of the following employees. The Court next considered the following Claims as submitted by the County Treasurer for payment: 97- 008972 through 97- 009171 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. The Court next considered an update of Schedule "A" for the contract between Brazos County and Texas Commercial Waste for solid waste removal services. Commissioner Cauley asked if a "White Goods" contain had been placed at the Mumford Road Citizen Collection Site. The County Engineer answered yes it was out there. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the update of Schedule "A" for the contract between Brazos County and Texas Commercial Waste for solid waste removal services. A copy of the contract update is attached hereto. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to appoint the following persons as presiding judge and alternate judge for the current voting year at the following voting precincts: Pct 0 Election Judge Alternate Judge 1 LaVone Hayes 17 Elizabeth Cunha 20 Mike Middleton (Aug) 27 Tom McMullin (Aug) 35 Doris Scurry (Aug) 36 Renee Taylor (Aug) 61 Ruby Rosier (Aug) The Court next considered adopting the proposed County Sick Leave Pool Policy. The County Judge informed the Court that a legislative ruling affecting sick leave had been issued since the policy was put together. One item changed was Section III (4), the clarification of time donated. The law allows an employee to transfer up to five (5) days per fiscal year. The County Judge however, wants to establish a maximum VOL ,l 1: Commissioners Court meeting August 5, 1997 of three (3) days with the option to increase the maximum of time to five (5) days at a latter time. Item 10 in Section III spells out when an employee is eligible to use the sick pool. Ernie Wentrcek, Director of Juvenile Services asked if a transfer of time could be designated for a particular individual. The answer was no. Isaac Butler, Constable Precinct 5, asked how long an employee could stay on the plan. The answer was 1/3 of the balance of time in the sick leave pool or ninety (90) days. Commissioner Cauley moved to approve the policy with the changes noted. Commissioner Jones seconded the motion and it carried unanimously. On motion by Commissioner Cauley, second by Commissioner Jones, the court voted unanimously to make the effective date of the program October 1, 1997, the beginning of the new fiscal year. Ruth McLeod and Kay Hamilton, County Treasurer, will recommend names of people to serve on the committee to oversee details of the sick leave pool. A copy of the policy is attached. The Court proceeded to consider the following blanket Purchase Orders: B /CS Eagle Purchasing $ 900 Scarmardo Produce Jail $ 3,000 Alliant Food Jail $11,500 Performance Food Jail $ 3,000 Butterkrust Bakery Jail $ 1,400 Lilly Dairy Jail $ 2,400 Cain's Coffee Jail $ 1,500 Sysco Food Ser Jail $ 2,000 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Blanket Purchase Orders as submitted. The next matter before the Court was the implementation of Juror Payment Authorization Forms and designation of choices for donations. This is a form letter that when signed by the prospective juror, directs the County Treasurer to donate all of the prospective juror's reimbursement for jury service to: I 1) the compensation to victims of crime fund under Subchapter B, Chapter 56, Code of Criminal Procedure; VOL PAGE l •I 101 i t i• i a Y 6 I k i t i 2 i } e i f t 4 Commissioners Court meeting August 5, 1997 2) the child welfare service fund under Chapter 264, Family Code; 3) any program selected by the Commissioners Court that is operated by a public or private nonprofit organization that provides shelter and services to victims of family violence; or 4) any other program approved by the Commissioners Court of the county. The District Clerk asked the Court if there was a program they wished to add to the list. Commissioner Sims asked if Crime Stoppers and the Dispute Resolution Center were eligible. The District Clerk said that those two (2) organizations did not meet the criteria of being a shelter or providing services to victims. Commissioner Jones asked if we could leave a blank space for the juror to fill in with his choice. The District Clerk replied that we could not because any program had to be approved by the Commissioners Court. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to approve the Juror Payment Authorization Form submitted by the District Clerk. The next matter for consideration was approval of a contract with Multi- Information Systems, Inc. for the Justice of the Peace computerized court system. One question asked was could the clerk sit at her desk and retrieve information from all the JP offices without having to travel to each office. The answer was yes. On motion by Commissioner Cauley, seconded by Commissioner Jones, the Court voted unanimously to approve the contract with Multi- Information Systems, Inc. for the Justice of the Peace computerized court system. A copy of the contract is attached hereto. The Court next considered the rejection of bid 97 -012 - Microfilming, Indexing and Storage for Brazos County Offices other than the County Clerk. The Purchasing Agent requested this action because it was discovered that each office has unique needs and requirements and this bid was only suitable for the County Clerk. on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously vo�a(! The next matter for consideration was approval for the Purchasing Agent to advertise for bids for the following items: 1) Inmate Telephone Service and Equipment 2) Law Enforcement Management Hardware and Software On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for the previously mentioned items and asked the Purchasing Agent, Director of CNS, the Sheriff and the Jail Administrator to form a committee to write specifications. The Court next considered authorizing work outside of county rights -of -way for the health, safety and welfare of the general public. - The Road and Bridge Department requested permission to enter the private property of James B. Fickey on Kurten Cemetery Road in Precinct 2 to dispose of dead livestock. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The next matter for consideration was the discontinuance of county maintenance status on Redman Lane as requested by Shirley Redman. Mrs. Redman asked that the status of the road be considered "Private" hereafter. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to discontinue county maintenance on Redman Lane and return the road to "Private" status. The Court next considered acceptance of the City of Bryan's cost estimate of $1,600.00 for relocation of an electrical distribution pole for improvements on Zweifel Road in Precinct 2. On motion by Commissioner Thornton, seconded by Commissioner Sims, the Court voted unanimously to accept the City of Bryan's cost estimate of $1,600.00 for relocation of an electrical distribution pole on Zweifel Road. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1) In General notes #3, change note to read "Private" Road rather than County Road. 2) In title block, should read "Preliminary" Plat rather than Shortform Plat. Commissioner Sims moved to approve the final plat of the Big Cedar Estates Subdivision subject to the developer complying with the exceptions noted by the County Engineer. Commissioner Cauley seconded the motion. Commissioners Thornton, Sims and Cauley and the County Judge voting "Aye ". Commissioner Jones abstained. The Court next considered approval of the Re -Plat of Lot 1 and Lot 2 Simoneaux Subdivision in Precinct 4. Richard Vance, County Engineer, stated that he had reviewed the plat r and offered the following comments.4 1) Show all existing utility easements on original �! plat. The Court next considered approval of the Final Plat of Lot 9A, 9B and reserved Tract 9, Block 2, Franklin Estates being a portion of a 423.8 acre tract located in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approved the final plat of Lot 9A, 9B and reserved Tract 9, Block 2, Franklin Estates. The Court next considered approval of the Resubdivision Plat of Willow Run, Phase One, a resubdivision of Lots 3 and 4 of Willow Run, Phase One, 28.711 acres located in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. Commis- sioner Jones moved to approve the Resubdivision Plat of Willow Run, Phase One, a resubdivision of Lots 3 and 4 of Willow Run, Phase One. Commissioner Sims seconded the motion. Commissioners Jones, Sims and Cauley voted "Aye ". Commissioner Thornton abstained. The motion carried. The Court next considered approval of the Final Plat of Austin's Creek Subdivision located in Precinct 3. Richard Vance, County Engineer, stated•that he had reviewed the plat i and offered the following comment: 1) Show approximate centerline of Old Reliance Road on Sections A,B, and C. On motion by Commissioner Sims seconded by Commissioner Cauley, the Court voted unanimously to approved the final plat of the Austin's Creek Subdivision subject to the developer complying with the exception noted by the County Engineer. Chappell Hill Construction had replied to his �• letter and supplied him with a substantial completion schedule The County Judge made the following comments: 1) We currently do not have a policy for county vehicles traveling outside the county lines. We need a policy on that. 2) The early vote total was 795 as of Friday, August 1, 1997. 3) He received a letter from the City of College Station re- establishing Investment Zone #4. 4) There will be a workshop with Mr. Ernie Moore at 10:30 a.m. and budget hearings for the rest of the week. All interest earned on the Capital Improvement funds invested during the year have been recorded as interest revenue in the General Fund. No intcrfund transaction was recorded monthly to reflect this activity. Instead, on a monthly basis the investment interest is recorded as cash in the bank in the General fund and interest income. In reality the interest income is earned by the Capital Improvement Fund and then transferred to the General Fund. This amendment properly reflects the activity. The General Fund budget included 100% of the anticipated interest income for both General and Capital Improvement funds. The budget amendment does not increase the budget of the General Fund, but it does reclassify the source of the revenue. BENEFIT APPLICATION - an employee, prior to applying for benefits from the county sick leave pool. must have already exhausted all accrued vacation, sick leave. and compensation time that has been credited in their behalf. Section III - ADMINISTRATION OF SICK LEAVE POOL. The following rules have been adopted by the Brazos County r Commissioners Court relating to the operation and administration of the County Sick Leave Pool Program. 11. The Commissioners Court will designate a person to administer the sick l ea ve program annually and a three or five membe r Advisory Board for the Administra(or. " 2). The designated Administrator and a representative of the Commissioners Court will develop the criteria to be considered a "catastrophic injury or illness ", and submit the criteria to Commissioners Court for- approval. Any changes to the criteria must be approved by Commissioners Court fourteen (14) days in advance of any action taken. Such criteria shall-be made part of this policy and marked as "Addendum A ". .i.) The Administrator is responsible for the administration of the County Sick Leave Pool in accordance with this policy. The 1 Administrator will approve or deny, in writing, both ` contributions to the County Sick leave Pool and requests for the use of time from the County Sick Leave Pool. 4), An employee may transfer not less than one day nor more than three (3) days of accrued sick (cave time earned into I/tv 2 voL I m,=. The contributing employee's accrued sick leave account on their personal record will be reduced by all amounts that they have elected to contribute as if tie or she had used it. The Personnel Dlepartmcnt will notify the Administrator of the number of days that the employee has elected to contribute to the sick leave pool, and a copy of the employee's election form. The Administrator will deliver a copy of the employee's request to the Payroll Officer who will adjust the employee's sick leave- record. The Personnel Department is responsible for keeping the election forms for a period of four ,years. 8). Contribution of time to the sick leave pool cannot be designated for a particular use or for a particular employee. Use of the pool is based on the evaluation of the Administrator. 9)• An employee absent on sick !cave assigned from the County Sick Leave Pool is treated for all purposes as if the employee were absent on earned sick leave. 10). Marijane Deen, CNS Director for Brazos County, to the Justice of the Peace Software Search Committee. This letter defines most of the capability of our OASys Municipal Court Software. One of main goals in this project will to be to deliver an Excellent Justice of the Peace Computerized Court System. A System that will meet or exceed the requirements imposed by the Judges and the Auditors Office, (as far as Court applications are concerned) and to meet the programming quality required by the Director of Brazos County CNS. Our goal is to do it right and do it right the first time. We also have the experience of just recently redesigning our entire Law Enforcement Management Information System, including the Municipal Court System. The new MIS runs in an open environment. This means that any computer that cah run UNIX, AIX, Xenix, DOS, and /or networking can run our new System. Our New System, OASys - Office Automation Systems for Law Enforcement and Municipal Courts, is written in Zortec's "System Z" which is a 4CL, Relational Data Base Management System. Never again will data entry clerks have to re -enter data that has already been entered by another part of the System. The primary purposes of rewriting this system is to accomplish the followings Speed up data entry Faster searches �I Eliminate dual entries where applicable Normalize all data formats and violation descriptions Minimize data entry errors by using pop -up prompts Elimination of proprietary operating systems Make meaningful information available to Administrators, Customization of indivival Agencies thru Software Switches MISI has achieved this flexibility thru Menu driven screens and Agency customisation thru tables which get loaded at the time of installation. Another feature of user friendliness is the on -line documentation. MISI submits the following plan to assist your Agency bys Providing our OASys Municipal Court Software System to the Brazos County Justice of the Peace as the Criminal portion of the JPCCS software package 1 i , 1. Juveniles in April of 1977 and added six (6) more agencies to the list of users. In January 1979 I decided to go full time with MISI and my partner wanted to stay full time with the Dallas Police Department, so I bought him out. The number of Incoterm user eventually grew to about seventy (70). In 1983 MISI had a request to convert the Floppy Disk System to the Alpha -Micro System, a multi -user, multi- taeking hard -disk system. It took approximately eight months to complete this task. In 1984 we were approached about developing a Municipal Software Package for that cities Court. This was defined and the system was programmed to use the same techniques as the Police Management System so the two can integrated together. In 1985 we decided that we must either find or write a Data Base Management System that would work for the special needs of the Law Enforcement Agencies. We could not find an acceptable DBMS on the market, so we defined and wrote our own name "DATACC" for data access. At about this same time we developed a multi -user interface, MISICOM BOX, that would interface to the various states that use the Bell 8A1 line protocol for communications. The purpose of this was to relieve some pressure from the dispatcher and allow other officers in the department to make their own inquiries on TLETS I. Also in 1985 we started the development of a Computer Aseioted Dispatching System. This was developed on a PC /AT compatible and was designed to be machine independent as to the interfacing Hoot computer. Working with the Grapevine, Euless, Hurst and Bedford Police Departments and Electro -Com, provider of In -Car Terminals, we developed software to serve as a Switcher for the four agencies. The ewitcher is capable of routing messages Car -to -Car, City -to -City, to the State (TCIC) and to the National Crime Center in Washington, D.C. (NCIC). The Switcher is also interfaced to the CAD system so calls may be sent by the Dispatcher to the car digitally or by voice or both. The MISI team is introduced in the next few paragraphs and a more detailed description of their capabilities are shown later under the heading of Corporate Resources and History. The Project Director, Mr. Joe Doucet has been defining and programming Law Enforcement and Municipal Court Systems in Z for approximately 4 years. His previous background was as a Police Officer holding various ranks over his career. Mr. Garland D. 'Buddy' Bellamy, formed Multi- Information Systems in 1975 for the exclusive function of writing Law Enforcement and related Software. MISI has an outstanding reputation throughout Texas for meeting the customers needs and requirements. Mr. Bellamy's area of responsibility will be working with Me. Deen's staff in the area of Training and Documentation. 2.2 History of Multi- Information Systems, inc. Multi- Information Systems, inc. was formed in 1975 and a contract was signed with nine area cities to develops a Police Management Information System. This work was performed at night and on week -ends and with the approval of the then Chief of Police for Dallas, Mr. Frank Dyson. The participating cities were: 2 o 1 M. 01 101 via the CAD screen. If the officer hits a certain function key, it i transmits to the CAD system that he has arrived at the scene. The 'time of j arrival' is automatically 'time stamped' on the dispatcher's terminal, but in a different color than if the dispatcher had arrived him. If the officer picks another key it will allow him to 'clear from his call' with a disposition code. I have said all of this to give you an indication of the type of design work that MISI is capable of doing. f t a 2.3 Personnel - Corporate Resources Garland D. Bellamy has been president of MISI since December of 1975. Prior to this position, Mr. Bellamy was Director of Police Data Processing for the Dallas Police Department from March 171 to December 178. Prior to this Mr. Bellamy was a programmer for the Vought Aerospace Corporation from March 164 to Feb. 171. Mr. Bellamy has a highly trained full time staff as well as several part -time personnel associated with various Law Enforcement Agencies around this area. The part -time personnel are used to perform some of the training, since they do these types of functions every day. Mr. Joe Doucet, a former Police Officer, had been in Law Enforcement for over twelve years. During those years Mr. Doucet served in almost every capacity within a Police Department and has also been heavily involved in training at the NCTCOG Police Academy in Arlington, Texas. He holds an advanced certificate as well as his Instructors Certificate. Mr. Doucet retired from the Corsicana Police Department in 1992 in order to devote himself full time to the Computer business. Mr. Doucet has five years of programing DataBases and is doeply involved in writing the new version of the Municipal Court Management Information and the Law Enforcement System. Mr. Doucet brings a very through understanding of the needs at the grass roots level. Mr. Karl M. Kemp, CPA, has programmed for MISI since October, 1982. Prior to that, Mr. Kemp was employed as Assistant Director of Accounting at Sul Ross State University in Alpine, Texas. Since returning to the Dallas /Ft. worth area in 1981, he has been involved in programming and accounting work for business and Municipal Courts. Mr. Kemp has performed the programming required to convert the assembly language programs to the Alpha -Micro Basic System. Mr. Kemp is now the Director of Data Processing for Arkansas College and remains as a consultant to MISI. Over the past 10 years we have installed and implemented more than a few Municipal Court Systems in the State of Texas and have learned something new at each one. This experience has been incorporated into our latest Court System, OASye, and this is the system that we will be bringing to your Courts. The other side of our experience is working with government agencies on the entry, storage and retrieval of Law Enforcement data. 3.0 SOFTWARE DESCRIPTION 3.1 System Software MISI will utilize the same Operating System and version of System Z that Brazos County is now using. This will allow Brazos County Data Processing to utilize our Z experience which will get the Court software up and running in j I a timely manner. MISI'S plan is to deliver our existing software and software written by both MISI and Brazos County DP personnel both at our site and yours. This software will have been tested prior to implementation into the JPCCS. We will then install the system at your site and test each program for operational performance to insure that all systems are operating properly. i Installation will include, but not restricted to, teats covering ENTRY, MODIFY, INQUIRIES and PRINTED REPORTS. i 3.2 Application Software we recommend the following work aesignments for our personnel: Joe Doucet - I I 1. Finalize his analysis of the System with Judges Boyett and Truelove. 2. Design the Civil aspect of the System based on the above. 3. Review the Design with Judges, Auditor and DP personnel. 4. Receive a working definition of the existing Brazos County JP Court data format as it will be exported from the existing system. Brazos County will have to determine who will be the designated trainer once the project is completed. 10.Assist Brazos County in the Documentation of the JPCCS System Source Code. 11.He will make sure that a copy of the final version of the Object and Source Code is installed on the Brazos County System. The Source Code is covered by a separate Contract or Agreement attached to this Proposal. Garland D. 'Buddy' Bellamy - 1. He will work with Brazos County personnel in the defining and writing of the Application documentation. 2. Perform the user training of the Criminal aspect of OASys. This will be performed under the 'Train the Trainer' concept even though there will be court personnel in the classes. Brazos County will have to determine who will be designated trainer once the project is completed. 3. In order for the two above items to happen he must cc- ordinate very closely with everyone involved in the project, both MISI and Brazos County personnel, to make sure he is aware of the latest additions and /or modifications. 3.3 Local /State Code Translation Table Brazos County will furnish MISI all Violation Codes and Violation Code translations between the Brazos County and the State, which MISI will integrate into the software. Documentation for the programs will include two RUN manuals and the Codes that are used in these programs. The RUN manuals will cover each sub- system on a program by program basis and the Source Code will have comments on every line of code that is not obvious. Most of this will be accomplished by Brazos County personnel, assisted by MISI personnel. 4.0 MAINTENANCE /WARRANTIES (SOFTWARE) MISI will not guarantee the proposed software to be error or bug free, however we do guarantee, for a period of 90 days after completing the contract, to correct any problem at no charge to the customer, assuming that the customer's employee's have not in any way modifLed the actual source or 6 VoL /L__PAQL.2f�. Normally all problems can be solved via a modem, however we have one person operating from Oklahoma and another in Texas in case a problem requires on -site personnel. Special request programming and modifications will be at the $67.50/hr. rate. 5.0 TRAINING AND TECHNICAL SUPPORT SERVICES MISI'S plan is to provide on -site training at your facility. We will use manuals which are developed by MISI and Brazos County personnel and actual source code to train on the Application Programs with your CNS personnel. 6.0 PROJECT SCHEDULE MISI will deliver, install and train your Court personnel on the OASys Criminal aspect of the JPCCS and the Civil aspect up to the point that certain form capabilities (defined by Judges Boyett and Truelove) will be active by July 1, 1997. The remaining Civil aspect of the system will be completed on a beet effort approach, working with Ms. Deen's personnel, the two previously mentioned Judges and the Auditor's Office. We would like to be more specific, however there are too many unknowns. The OASYS Municipal Court software is a full featured package for dockets, filing, warrants, and receipts, etc. It included many extras the Judges were looking for. At this time it fulfills all the needs of the Criminal Docket and with minor tuning could be used in the JP Courts. OASYS is written in System Z which is our in -house language. This presents the opportunity to purchase only a copy of the source code and use either in -house staff or MISI personnel (or preferably both) to expand the package to also include a Civil Docket and other miscellaneous dockets. This package would reside centrally in our HP 9000 and all the JPs would share one database. This provides the best solution for sharing information among the Courts as well as with the Sheriff, the District Attorney and the County Attorney. For example, the new system will allow for outstanding ticket searches across all the courts. The JP system will check all CJIS warrant information, and CJIS booking system will check for tickets in the JP database at book -in. Paragraph 3.2, Application Software, shall be altered as follows: Under tasks of Joe Doucet, subparagraph 10 shall be altered to read as follows: "Prepare that portion of the documentation of the JPCCS System Source Code that he has worked on and for which he is responsible pursuant to the terms of this Agreement. Brazos County personnel will prepare the Source Code documentation for that portion of the work it had agreed to undertake pursuant to this Agreement." ' I Under duties performed by Garland D. Bellamy, subparagraph 1 shall be altered to read as follows: "He will define and write the application documentation with the aid of the County personnel." Paragraph 3.3, Local /State Code Translation Table, will be altered to include the following language: MISI shall include, as part of the contract price, the production and delivery of duplicate copies of two (2) run manuals, one for the criminal portion of the Software, and a second for the civil portion of the Software. The civil run manual will involve work by County personnel, but shall be edited by MISI for final content. The following sentence will be struck: "Most of this will be accomplished by Brazos County personnel, assisted by MISI personnel." Paragraph 4.0, Maintenance /Warranty Software, shall be altered by striking the first paragraph and replacing it with the following: "MISI will not guarantee the proposed Software to be error or bug free, however, MISI does hereby guarantee and warrant to correct any problem with the Software and its correct functioning at no charge to the County. All references to rates of pay for repair of the Software and its proper functioning shall be deleted as nonapplicable as such repairs are to be performed without charge. MISI is fully aware of the County's requirements and intended uses of the Software, and MISI guarantees that the Software shall satisfy such requirements and is fit for such intended use. MISI warrants and guarantees that the Software shall conform to the description of its functioning set forth in the Executive Summary of this Agreement. For purposes of this Agreement acceptance shall occur upon (i) the completion of the design of the Software, (ii) the successful operation of this Software for a thirty (30) day period, (iii) training of all appropriate County personnel has been completed, and (iv) all documentation required by this contract has been delivered. Upon satisfaction of the above, the County Commissioner's Court will issue a Letter of Acceptance to MISI accepting this System. This acceptance shall in no way affect MISI's obligation to correct any problems with the Software or operation thereof, at no cost to the County. Paragraph 5.0, Training and Technical Support Services, shall be altered to include the following language: MISI shall provide, as part of the contract price, forty (40) hours of training to Brazos County personnel in both the civil and criminal aspects of the Software. The amount of hours devoted to the training in a particular aspect of the Software will be in the sole discretion of Brazos County. Paragraph 7.0, Cost of System, shall be altered by changing the last sentence of the section to read as follows: MISI guarantees to the County the maximum cost of the project will not exceed $25,000.00.
