JULY 29, 1997 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE

COMMISSIONERS' COURT
REGULAR MEETING
JULY 29, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, July 29, 1997, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Cauley gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #96/97-34.1,
which would reallocate funds budgeted for the Constable
Precinct 7 office. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted with the exception noted.
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
County payroll in the amount of $554,000.00 for the 07-31-97
payroll.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to appoint the following
persons as presiding judge and alternate judge for the current
voting year at the following voting precincts:

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute the following Tax Resale Deed:
Ella M. Bonds - Lot 16, Block 1, McCulloch Subdivision
City of Bryan, Brazos County, Texas.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute the following Tax Resale Deed:
C.E. Holmes - the East One-Half (E. i) of Lot 2 and
all of Lot 3, Block 166, City of Bryan,. Brazos
County, Texas.
The Court next considered approval of a requisition from
General Fund for the following purchase:
a) i ton Pickup for Task Force $17,473.00
on motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the requisition
to be paid from General Fund.

The court proceeded to consider the following blanket
Purchase Orders:
Brazos Office Sup Tax Office $1,200
Lange Micrographic District Attorney $2,500
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase orders as submitted.
The Court next considered awarding the following bid:
Bid No. 97-043 - Annual Contract for Oil and Filter
changes
Kay Wetteman, Assistant Purchasing Agent,
recommended acceptance of the bid
submitted by Midas Service Center. On
motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Assistant Purchasing Agent and
award the contract to Midas Service
Center.
The next matter before the Court was the modification to
Bid Number 96-045.- Annual Contract for Flexible Base. The
County Engineer explained that it has become increasingly
common for Brazos County to reduce the truck weight on county
roads from 80,000 lbs. to 54,420 lbs. for materials being
hauled for county road projects because heavier trucks are
damaging the seal coated roads. Bid Number 96-045 does not
distinguish the price for the different load limits. The Road
& Bridge department currently has a road project on Timberline
Drive and Blue Ridge Drive in Precinct 1. If the loads are
not reduced then serious damage will occur to two other county
! roads. The County Engineer explained that there will be a
$1.80 cost increase per ton to reduce the loads. He continued
by saying that this decision was critical to the Road & Bridge
Department in the continuity of their scheduled work and
because rental equipment is waiting on the job site. He then
asked the Court to approve the modification of Bid No. 96-045.

On motion by Commissioner Sims, seconded by Commissioner

Cauley, the Court voted unanimously to authorize the
modification of Bid No. 96-045 to allow for the reduced loads
' and the $1.80 increase per ton for those reduced loads.

The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(7)(D). The Commissioners' Court determined that
this is a single source supplier and grants an exemption from
the competitive bidding requirement for the repair and
maintenance for Broce Broom and Etnyre Distributor Equipment
from R&B Everett. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the Exemption of Competitive Bidding Requirements and
authorized the payment for said costs for the fiscal year
1996-1997.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of John Bradley on
Bradley Road in Precinct 1 to dispose of dead livestock. On
motion by Commissioner Jones, seconded by Commissioner Sims,
the Court voted unanimously to authorize the work.
The next matter for consideration was GTE Is cost estimate
of $18,500.00 for the relocation of 2,500 feet of fiber optic
cable for the Elmo Weedon Road widening project in Precinct 3.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to accept the cost
estimate and authorized the payment of $18,500.00 for the
relocation of fiber optic cable along Elmo Weedon Road.
The next matter before the Court was the renewal of a
Contractual Agreement between Brazos County and the Brazos
Valley Development Council for the administration of the
Brazos County Indigent Health Care Program. The cost to
Brazos County will be $54,00.00 annually. The term of the
contract will cover the period October 1, 1997 through
September 30, 1998. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to enter
into contractual agreement with the Brazos Valley Development
Council for the administration of the Brazos County Indigent

Health Care Program. A copy of the contractual agreement is
attached hereto.
The next matter for consideration by the Court was a
request submitted by the Director of Juvenile Services
requesting approval for out of state travel for Stephani
Luebben. Ms. Luebben would be traveling to Alabama to attend
US Army Military Police School July 28, 1997 through August 8,
1997. Commissioner Sims questioned the timing oil the request
and the need to travel all the way to Alabama. Dan German,
representative of Juvenile Services, replied that since Grant
funds were being used for travel and transportation they did
not realize the request needed to go through Court. Also,
there is no equivalent school in the state and since Ms.
Luebben was a Boot Camp officer they felt she needed the
experience. On motion by the County Judge, seconded by
Commissioner Sims, the Court voted unanimously to grant the
request from the Director of Juvenile Services and approved
out of state travel for Ms. Stephani Luebben.
The Court next considered a right-of-way purchase for
widening of FM 158 by the City of Bryan and TxDOT. The County
Judge moved to convey, at no charge, the right-of-way for the
project to the City of Bryan and to TxDOT. Commissioner
Thornton seconded the motion. Commissioner Sims disagreed
with the Judge saying that he would like to keep all projects
on a cash basis because that was a good way to track it. He
said that the City of Bryan charges the County for relocating
utilities so the City should pay for right-of-way. Sheila
Walker, Director of the Brazos Center asked if the driveway
will be restored to its previous condition. Commissioner Sims
replied that it would not. The County Judge then withdrew his
motion and Commissioner Thornton withdrew his second. On
motion by the County Judge, seconded by Commissioner Cauley,
the Court voted unanimously to table consideration to allow
the Court more time to gather information.

The Court next considered setting fees collected for
vehicle registration for 1998. on motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to continue collecting $10.00 for each vehicle
registered in the county for the county road and bridge fee
and $1.50 for each vehicle registered to fund the school
crossing guard program.
The next matter for consideration was an amendment to the
contract with the Economic Development Corporation. The
amendment provides for additional funding to the organization
and includes additional information relative to public t
purpose. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the amendment to the contract with the Economic Development
Corporation. A copy is attached hereto.
The Court next considered Change Order No. 15 for the
Juvenile Justice Center Construction Contract. The Change
order would make the following changes:
Adding of tapered roof insulation to obtain
required slope and adding $2,561.00 to the cost. ;
ASI No. 33 - Adding a Pull station at door 202A
and adding $990.00 to the cost.
On motion by Commissioner Jones, seconded by Commissioner
Sims, the Court voted unanimously to approve Change Order No.

The Court next considered a request from Mothers Against l
Drunk Driving (MADD) to erect a cross in memory of Michelle

Elizabeth James at the intersection of North Dowling Road and

Beeler Road. The County Engineer requested that the cross be f

placed at the right-of-way line and be in compliance with
TxDOT requirements. On motion by Commissioner Jones, seconded s
by Commissioner Sims, the Court voted unanimously to approve
the request from Mothers Against Drunk Driving (MADD) to erect
a cross in memory of Michelle Elizabeth James at the
value.

The next matter before the Court was discussion regarding
the regulation of dangerous wild animals in Brazos County.
The County Judge explained that this was necessary because the
state regulation expire on September 1, 1997 and the Animal
Shelter might have a problem if there are no regulations in
effect after that date. He then asked Ruth McLeod and Susan
Gandy to work on this project.
There was no citizen input and/or concerns.
The County Judge made the following comments:
a) He received a phone call from Mr. Sam
Wilson of TxDOT asking for right-of-way
on Martin Luther King and San Jacinto
Streets. The County no longer owns the
property which was sold in a tax sale.
b) The cost to repair the County scales is
$3,353.00. He asked the Sheriff to check
on other available scales for use by the
County. He said he had checked on three
(3) sites and that they were not located
in areas that would provide ease of
access for the county. He then
recommended using contingency funds to
repair scales.
c) Connie Hooks, City Secretary of the City
of College Station has asked to hold a
joint election on November 5, 1997.
d) He announced a Public Hearing to discuss
realignment fo the Justice of the Peace
and Constable Precincts will be held at
the Brazos Center on August 4, 1997,
beginning at 7:00 p.m..
e) There will be a records management
workshop September 9, 1997.
There being no further business to come before the Court,
the meeting was adjourned.

Commissioners' Court, the following members were present:

THAT WHEREAS, on July 29, 1997 the Court heard and approved a

Texas.

Dear Judge Jones:
The contract for administration of the Brazos County Indigent Health Care Program has three
options to renew for a period of one year in each instance. Each renewal will follow
consecutively upon the expiration of the term and of any renewal period and all other terms
and conditions of the original contract will remain the same.
The renewal of the contract betweei. the Brazos Valley Development Council and Brazos
County is for the amount of 554,000. If mutually agreed upon, this contract will be extended
to cover the period October 1, 1997 - September 30, 1998.

REGISTRATION YEAR 1998
We respectfully request that you indicate below your county's intentions for collection of these fees
for registration year 1998 (January 1 through December 3.1, 1998). These fees will first appear on
February renewals. (Refer to Motor Vehicle Information Circular No. 1-85).
For registration year 1998, BRAZOS County will
1. Retain the current fees of $ 11 - 5 0 (No court order required);
2. Discontinue the County Road and Bridge Fee of
(Court order required prior to September 1st);
3. Impose a new County Road and Bridge Fee of
(Court order required prior to September 1st);
4. Discontinue the Child Safety Fund Fee of
(Court order required prior to September 10th); and/or
5. Impose a new Child Safety Fund Fee of
(Court order required prior to September 10th).
If you indicate that action will be taken as stated in 2, 3, 4, and/or 5 above, you must submit a
County Commissioners Court Order to that effect prior to the applicable statutory date of
September 1st (County Road and Bridge Fee) or September 10th (Child Safety Fund Fee).
Please return your county's intentions so designated for registration year 1998 In the enclosed
postage-paid self-addressed envelope as soon as possible. A faxed response (512/465-3034) will
also be acceptable. However, if such response requires a County Commissioners Court Order,
we request that the original Order be mailed to us no later than the date indicated above.

AMENDMENT TO CONTRACT BY AND BETWEEN
THE COUNTY OF BRAZOS AND BRYAN/COLLEGE STATION
ECONOMIC DEVELOPMENT CORPORATION FOR FISCAL YEARS 1997-1999
OCTOBER 1, 1996 - SEPTEMBER 30, 1999
TIIIS AMENDMENT is made and entered into this 24 of July. 1997, by and
between Brazos County (hereinafter referred to as "County"), and the Bryan/College Station
Economic Devclopnient Corporation, a Texas Non-Profit Corporation (hereinafter referred to
as "EDC"), and
WHEREAS, the County and EDC entered into a contract for the funding of development
and promotional efforts by the EDC of the County dated October 1, 1996 for fiscal year 1997,
and automatically renewable each year. (herein the "Contract"); and
WI{EREAS, the development and promotional efforts of the EDC serve a public purpose
in that it provides jobs and economic opportunities for the tax payers of the County, thereby
enhancing and improving the area and the general welfare of the citizens living in it, and
WI-IEREAS, during such fiscal year 1997 [lie EDC greatly expanded its marketing plan
and secured for the local area a number of prospects; and
WI•IEREAS, as a result of these efforts the EDC needs additional money for [lie 1997
fiscal year through the 1999 fiscal year; and
WHEREAS, the County has agreed to increase its annual contribution for fiscal years
1997 through 1999 only to aid the EDC in securing such prospects; and
WHEREAS, the parties hereto wish w amend the Contract to provide for such additional
monies
NOW 'THEREFORE KNOW ALL MEN BY 'I'IlE E 11RE-SENTS that for and iii
consideration of the mutual covenants and provisions hereafter set forth. and the providing of
an important public service to the County on a shared cost basis with other governmental
entities. the receipt and sufficiency of which i% hereby acknowledged, the parties agree to amend
the Contract as follows:
1. The County %hall increase its funding of the for the fiscal years 1997
through 1999 by the sum of a maximum of $250M. payable annually as
determined by the Commissioners' Court. in its %ole discretion (herein
"Additional Monies").
2. These Additional Monies shall he utilized for the purposes %er forth on Exhibit
"A" and "B" in any manner determined by the EDC. in its sole di%creuon.

provided however, such funds must be utilized within the geographical boundaries
of Brazos County, Texas, and for a public purpose.
3. The County shall have the right to terminate this Agreement in whole or in
part if it determines that the CDC has failed to comply with the terms and
conditions hereof. Should the County terminate this Agreement it shall be
entitled to the return of any monies granted to the EDC hereunder but not spent
or pledged prior to such notice of termination.
4 In the event any of the Additional Monies are spent by the EDC for economic
incentives to specific and identifiable development prospects, including but not
limned to Universal Computer Systems, Inc., and such economic incentives are
returned to the I:DC as it result of the failure by such third party development
prospects to comply with the terms and conditions of the contract by which these
economic Incentlaes were granted. such Addmonal Monies shall either (1) he
applied towards future years contributions of the County, the EDC hereby
acknowledging that in such event it will not seek, expect, or budget for future
funding of the EDC by the County a( prior year`' levels or (it) he returned to the
County, at the County's sole option.
5. This Contract shall renew automatically subject to the County's right to
change the funded amounts each year, unless upon thirty (30) days written notice
by either party, this Agreement is canceled.
In all other terms, conditions, and respects (lie Contract is hereby confirmed, ratified,
and reaffirmed.

Dear Mr. Smith.
Mothers Against Drunk Driving (MADD). Brazos Valley is writing to
respectfully request permission to erect a cross in memory of
Michelle Elizabeth James. This cross would be located at the
site where the crash occurred which claimed her life. The site
is at the intersection of North Dowling Road and Beeler Road.
MADD. Texas State has erected a number of crosses across the
state. It is our understanding that the Texas Highway Department
has established a policy that these crosses will be approved as
long as they meet the following guidelines:
1. Can be erected in such a manner that it does not create
a possible traffic hazard
2. Crosses must be for victims of drunk driving crashes
• 3. Next-of-kin of the victim must approve the erection of
the cross
4. Crosses will be under 24" high and will be constructed
of white wood
5. Crosses cannot be placed in front of developed property
unless written permission is obtained from the property
owner
6. UPDATED YQL,ICY: the plaques on the crosses must now
read "Killed by a Drinking Driver" unless the driver
has received a final conviction. then the plaque can
read "Killed by a Drunk Driver"
Please be advised that the family has requested the cross.
Therefore. I am requesting your prompt attention to this matter.
The crosses are constructed in a uniform manner such that they
will meet the above outlined guidelines.
