THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
JULY 8, 1997 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

3. Presentation by the Bush Presidential Library Opening Events Planning Committee.
4. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not scheduled on the agenda. Please
limit subject matters to five minutes.- The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for

COMMISSIONERS' COURT
REGULAR MEETING
JULY 8, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, July 8, 1997, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Jones gave the invocation and led the pledge
of allegiance.
The Court heard a presentation by the Bush Presidential
Library Opening Events Committee representative, Dr. Jerry
Gaston. Dr. Gaston updated the Court on the progress of the
library and the other buildings in the complex. He announced
the following schedule for opening ceremonies:
September 9, 1997 - Dedicate the Bush School of
Government and Public Service
September 10, 1997 - President Bush and Governor
Bush arrive for dedication ceremonies
October 30, 1997 - Media tour of library/museum
November 5, 1997 - Private events pertaining to the
library
November 6, 1997 - Dedication of library at 11:00
a.m.. President and Mrs. Clinton, President and
Mrs. Ford, President and Mrs. Carter; former first
ladies Mrs. Johnson and Mrs. Regan are expected.
November 7, 1997 - Community Day and dedication of
i the International Center.
Under citizen input and/or concerns, Commissioner Cauley
made the following comment:
He announced that to date we have collected $501.00
for the victims of the tornado that struck Jarrell,
Texas. He went on to thank the employees for their
generosity.

Commissioners Court meeting July 8, 1997
The Court next considered Budget Amendment $96/97-31.1
through 31.2, which would increase funds budgeted for the
4 District Clerk and reallocated funds budgeted for the County
Clerk. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individual:
Cheryl Johnson - Lot 8, Block 186, City of Bryan,
Brazos County, Texas
on motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to execute a Tax Resale Deed to the following
individual:
Melinda Gillum - Lot 2, Block B, Starlight Addition,
City of Bryan, Brazos County, Texas
The next matter before the Court was to consider adoption
of an order for the relocation of polling places for voting
Commissioners Court meeting July 8, 1997
precincts 3A/3B, 13A/13B, 23 and 31. This is necessary due to
the original polling sites are under construction and will not
be available for the August 9, 1997 Special Constitutional
Amendment Election. On motion by, Commissioner Jones, seconded
by Commissioner Cauley, the Court voted unanimously to adopt
the Order for relocation of polling places for voting
precincts 3A/3B, 13A/13B, 23 and 31. Commissioner Sims asked
the County Clerk to please notify the public. A copy of the
Order is attached hereto.

The next matter before the Court was acceptance of the
City of Bryan's cost estimate of $150.00 for the Riley Road
widening project in Precinct 3. The final cost will be billed
on the actual "as built" expenditures. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to accept the City of Bryan's cost estimate
of $150.00 for the Riley Road widening project in Precinct 3.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the

general public. The Road and Bridge Department requested ,
permission to enter the private property of Alan Gandy on
Riley Road in Precinct 3 to haul hay donated to the County for
use in erosion control along county rights-of-way. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the work.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested

permission to enter the private property of H. R. Ayers on

Mensik Road in Precinct 2 to upgrade the existing turn-around
at the end of the roadway. On motion by Commissioner

Commissioner Sims questioned the need for a laptop computer by
the District Clerk. The District Clerk replied that it would
replace the one he gave to his staff. The County Judge asked

where the' televisions would be placed. Dan German,
representative of the Juvenile Services Department replied
that they will go in each of the training rooms. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve the previously noted requisitions
to be paid from Capital Expenditures.
The Court proceeded to consider the following blanket
Purchase Orders:

KC Copy Boy Extension Serv $1,000
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase orders as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise for RFP's for utility bill audit
services. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the Purchasing Agent to advertise for RFP's for utility bill
audit services. If shortcomings are found, the company doing
the audit will receive 50% of the savings.
The next matter for consideration was the approval of an
Interlocal Agreement with Texas A&M University for the
purchase of supplies and materials. This agreement is
authorized by the Interlocal Cooperation Act, V.T.C.A.
Government Code Chapter 791, to enter into joint contract and
agreements for the performance of governmental functions and
services including administrative functions normally
associated with the operation of government such as purchasing
of necessary material and supplies. TAMU will be responsible
for administrative duties necessary to facilitate processing
and preparation of bids for the purchase of any commodity
provided. Brazos County will pay by invoice for items
purchased through the TAMU Procurement and Material Services.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to Approve the Interlocal

The Court next considered approval of the minutes of the
Commissioners' Court meeting held June 17, 1997. on motion by
Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to approve the minutes as submitted.
' Under citizen input and/or concerns Mr. Demetrios
Basdekas made the following comments:
Mr. Basdekas informed the Court that he was not
running for any political office. He went on to
say that there was a possibility of there being
funds available this year for improvements to SH
21. He thanked the County Judge for his work on
the SH 21 project.
The County Judge made the following comments:
1) He received a telephone call from the
Eisenhower Group in reference to proposed
projects. He asked the department heads
to help come up with a project for the
group.
2) He visited with Mr. Dobbins in reference
to the use of telephone lines for
internet access. Mr. Dobbins reminded
the Judge of the limited number of trunk
lines available and explained that if you
tie up 1 or 2 trunk lines with internet
calls our current telephone system will
have major problems. He told Ruth McLeod
to meet with M.J. Deen, Mr. Dobbins and
himself to discuss this further.
3) He asked the County Auditor to inform the
Court of audit problems.
Commissioner Sims made the following comment:
1) He asked about the Water Study. Commis-
sioner Jones replied that he would have
} an informative presentation for the Court
{ in September of this year.

the meeting was adjourned.

On this the 8th day of July 1997 at a regular meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on July 8, 1997 the Court heard and approved a
budget amendment for the 1996-1997 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted August 8, 1996'

polling places which can not be used for the purpose of conducting
the Special Constitutional Amendment Election on August 9, 1997;

ORDER RELOCATING POLLING PLACE FOR VOTING PRECINCT 3A/3B VOTING
PRECINCT 13A 13B, VOTING PRECINCT 23 AND VOTING PRECINCT 31
and
WHEREAS, the polling place for voting precinct 3A/3B is
located in the Precinct 4 Volunteer Fire Station, located at
Smetana Road, 6 miles West of Bryan on North side of State Hwy. 21,
Bryan,•Texas; and
WHEREAS, the Precinct 4 Volunteer Fire Station has been
relocated to a new location; and
WHEREAS, the Commissioner's Court is desirous of
continuing to conduct elections for voting Precincts 3A/3B in the
Precinct 4 Volunteer Fire Station which has been relocated at
Fazzino Road, 8.5 miles West of Bryan on North side of State Hwy
21, Bryan, Texas; and
WHEREAS, the polling place for voting precinct 13A/13B is
located in the Henderson Elementary School located at 801 Matous
Street, Bryan, Texas; and
WHEREAS, the Commissioners Court has been notified by the
Bryan Independent School District that the school building is under
construction and will not be completed in time to hold the Special
Constitutional Amendment Election on August 9, 1997; and
WHEREAS, the Commissioners Court is desirous of
temporarily relocating the polling place for voting precinct
13A/13B at the Brazos Valley Workforce Center located in the
Townshire Shopping Center at 1905 South Texas Avenue, Bryan, Texas

for the Special Constitutional Amendment Election to be held on
August 9, 1997; and
WHEREAS, the polling place for voting precinct 23 is
located in the Johnson Elementary School located at 3800 Oak Hill
Drive, Bryan, Texas; and
WHEREAS, the Commissioners Court has been notified by the
Bryan Independent School District that the school building is under
construction and will not be complete in time to hold the special
Constitutional Amendment Election on August 9, 1997; and
WHEREAS, the , Commissioners Court is desirous of
temporarily relocating the polling place for voting precinct 23 in
the Bryan High School, located at 3401 E. 29th Street, Bryan, Texas
for the Special Constitutional Amendment Election to be held August
9, 1997; and
WHEREAS, the polling place for voting precinct 31 is
located in the A&M Consolidated High School located at 701 West
Loop South, College Station, Texas; and
WHEREAS, the Commissioners Court has been notified by the
College Station Independent School District that the building is
under construction and will not be complete in time to hold the
Special Constitutional Amendment Election on August 9, 1997; and
WHEREAS, the Commissioners Court is desirous of
temporarily relocating the polling place for voting precinct 31 to
the A&M Church of Christ, located at 1001 FM 2818 East, College
Station, Texas for the Special Constitutional Amendment Election to
be held August 9, 1997;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSIONERS COURT
OF BRAZOS COUNTY, TEX4S THAT:
Pursuant to section 43:031(d) of the Texas Election Code
that the location of the polling places be relocated in Brazos
County to wit:
(1) THAT the polling place for voting precinct 3A/3B be
located at Precinct 4 Volunteer Fire Department be relocated on
Fazzino Road, 8.5 miles West of Bryan on North side of State Hwy
21, Texas; and

INTERLOCAL AGREEMENT
THE STATE OF TEXAS
COUNTY OF BRAZOS
THIS CONTRACT AND AGREEMENT, made and entered into this day
of 1997, by and between the County of Brazos and Texas A&M
Uni ersity, each participating government acting by and through its respective executive
office hereunto duly authorized by resolution of the governing body.
WITNESSETH:
WHEREAS, the respective participating governments are authorized by the
Interlocal Cooperation Act, V.T C A. Government Code Chapter 791, to enter into joint
contracts and agreements for the performance of governmental functions and services
including administrative functions normally associated with the operation of government
such as purchasing of necessary materials and supplies,
WHEREAS, it is the desire of the aforesaid participating governments to comply
with and further the policies and purposes of the Interlocal Cooperation Act,
WHEREAS, the participating governments cannot normally obtain the best
possible purchase price for materials and supplies acting individually and without
cooperation; and
WHEREAS, it is deemed in the best interest of all participating governments that
said governments do enter into a mutually satisfactory agreement for the purchase of
supplies and materials;
NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants
and conditions contained herein, promise and agree as to each of the other parties and as
! to all of the parties as follows-
1. Texas A&M University shall be responsible for all such administrative duties as
may be necessary to lawfully facilitate processing and preparation of any bids
as may be required for the purchase of any commodity provided,
1 2. Brazos County shall pay by invoice on a cost recovery basis the cost of any
items purchased through the Texas A&M Procurement and Material Services,
3. Nothing in this agreement shall prevent Brazos County from purchasing and/or
accepting and awarding bids for commodities subject to this agreement on its
own behalf
WHEREFORE, the parties hereto have caused this agreement to be executed by
their authorized officers listed below;
