SIY,~~:.._y...S,:>.~~,Si..•....u.._._. , _ - - u a 4 § COMMISSIONERS' COURT t REGULAR MEETING JULY 1, 1997 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, July 1, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in 11• attendance. The County Judge gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns, Commissioner Cauley made the following comment: He informed the Court that to date we had collected $481.00 for the Williamson County Disaster Relief Fund and thanked everyone for their generosity. j The Court next considered Budget Amendment #96/97-30.1 through 30.5, which would reallocate funds budgeted for the a Agricultural Extension Service; transfer funds from Contingency to Constable Precinct 2 and Building Maintenance; and transfer funds from Fines District Ct. 272nd and Fines County Court at Law 2, to the 272nd District Court and to the District Clerk. Commissioner Sims questioned amendments 30.4 and 30.5 noting that there were no line items for fines and that the money was coming from contingency. Commissioner Thornton asked for clarification on the need to transfer more money into the Rental-Office Space line item for Constable Precinct 2. The Auditor indicated that it was a clerical error. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. Judge Delaney explained that the salary increase was due to Mrs. Calvin being a certified law enforcement officer and her four years of experience as a Court s Coordinator. The County Judge asked if this person leaves I county employment, will the position revert back to the original amount? Judge Delaney replied it would. Commissioners Jones and Cauley recommended waiting for the Ray & Associates survey. The District Clerk praised Mrs. Calvin's expertise and said she was a very worthwhile employee. Commissioner Sims moved to approve the changes. Commissioner c, i Cauley seconded the motion. Commissioners Jones, Thornton, Cauley and the County Judge voted "Aye" Commissioners Sims voted "No". The motion carried. The Court next considered the following Claims as submitted by the County Treasurer for payment: 97-007831 through 97-007924 On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Jones, seconded by Commissioner Thornton, the Court voted unanimously to approve the County • • C] Commissioners Court meeting July 1, 1997 payroll in the amount of $550,000.00 for the July 3, 1997 payroll. The next matter before the Court was the introduction and acceptance of the applicant for the County Extension Agent- Family and Consumer Sciences position. Ms. Zelda Williams, District Extension Director, from the Texas Agricultural Extension Service introduced Ms. Guadalupe Landeros and recommended her for the position of County Extension Agent. on motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to accept the recommendation of Ms. Williams and approve the appointment of Ms. Guadalupe Landeros as County Extension Agent-Family and Consumer Sciences. The County Judge welcomed Ms. Landeros to Brazos County. The next matter for consideration by the Court was a request submitted by Constable Precinct 7 seeking approval for out of state travel for himself. Constable Sikes would be traveling to Glyno, Georgia to attend the "Fugitive Investigator Course" sponsored by the United States Marshall service from July 7 through the 17, 1997. Commissioner Sims asked how much the Constable had in his budget for travel. Constable Sikes replied that he had $900.00. The County Auditor explained that there were law enforcement training funds available for Constable Sikes to use. Bill Jeanes, Risk Manager, informed the Court that he had spoken with the U.S. Marshall's office about bringing the course here and was told that they could do it if there were funds available. The County Auditor reiterated that there were funds available in the law enforcement training fund. Commissioner Sims moved to approve the request. Commissioner Cauley seconded the motion. Commissioners Jones, Thornton, Sims and Cauley voted "Aye". The County Judge abstained. The next matter for consideration by the Court was a request submitted by the County Extension Agent for approval for out of state travel for Extension Agents Eric Zimmerman, VOL r Commissioners Court meeting July 1, 1997 Katie Harris and himself. They will be traveling to New York City as chaperons for members of the Brazos County 4-H Exchange Club July 9 through the 14, 1997. On motion by commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from the Extension Agent and approved payment of out of state travel expense for Extension Agents Eric Zimmerman, Katie Harris and Dr. Mazurkiewitz. The Court next considered approval of the certification of the county maintained road mileage as submitted by the County Engineer. Richard Vance, County Engineer informed the Court the County maintained 461.8 miles of roads. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the certification submitted by the County Engineer and forward a copy to the State Department of Highways and Public Transportation. The next matter for consideration was a request from County Court at Law II Judge, Sarah Ryan, for a temporary employee for her office to help handle a large backlog of : work. In her request, Judge Ryan asked for a reallocation of funds from her budget to fund the position. She also indicated that the position would be limited to FY 1997 and unexpended funds only. He suggested having Mr. Dobbins, department head of the building maintenance department bid the project. Commissioner Sims then moved to approve items "A" through "I" and item "K" to be paid from Capital Expenditures. The motion was seconded by Commissioner Cauley. Commissioners Jones, Thornton, Sims and Cauley voted "Aye". The County Judge voted "No". Item "J" was tabled to allow Mr. Dobbins to secure bids on the framing. The next matter for consideration was approval for the Purchasing Agent to advertise for the following bids: a) Electrical Supplies for Maintenance b) Plumbing supplies for Maintenance c) Multiple form printing for District Clerk d) Pager Services for all County offices e) Election Services for November 7, 1997 election. f) File Stamping/Cashiering System for County Clerk (Record Preservation/Automation) On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise for the previously noted bids. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(4). This is for the purchase of Professional Services for Juvenile Placement Services. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized the payment for said services. The next matter before the Court was approval of an agreement between Brazos County and Texas Voting Systems (TVS). TVS will provide service of assembly of 250 voting devices, printed ballot cards and supplies to conduct the August 9, 1997 Special Constitutional Amendment Election. The cost to Brazos County will be $13,500.00. On motion by pAnE VoIL i f iF k i Commissioners Court meeting July 1, 1997 • • • Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into contractual agreement with TVS to conduct the August 9, 1997 Special Constitutional Amendment Election. A copy of the contractual agreement is attached hereto. The Court next considered Internet access for the Purchasing Department. The Purchasing Agent asked for internet access for each of her four (4) employees. Commissioner Sims asked how many buyers there were. The Purchasing Agent replied that there were three (3). Commis- sioner Jones moved to approve the request. Commissioner Cauley seconded the motion. Commissioners Jones, Thornton, and Cauley voted "Aye". Commissioner Sims voted "No". The Court next considered awarding the following bid: Bid No. 97-042: Low/Mid and Mid Volume Copiers Cheryl Turney, Purchasing Agent, recommended acceptance of the bid submitted by CTWP for the Low/Mid Volume Copiers with option 2 and IKON for the Mid level copier. The Court discussed the need for a 20 bin sorter versus a 10 bin sorter. The County Engineer said his office did not need a 20 bin sorter. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to award the contract to IKON for both the Low/Mid Volume Copier and the Mid Level Copier. A copy of the bid tabulation is attached hereto. The next matter before the Court was the approval of the Bank depository Contract with First American Bank for the District Clerk Trust Accounts. The District Clerk informed the Court that he had Depository Contracts with four (4) other banks and that they were all the same, no penalty for early withdrawal. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to enter into Contract with First American Bank for the District Clerk Trust Accounts. The Road and Bridge Department requested permission to enter the private property of Pat Holland on Wixon Road in Precinct 2 to haul hay bales to county rights- of-way for erosion control. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Ray Latham on Old Bundick Road in Precinct 2 to clean out a ditch in order to correct a drainage problem. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Howard Pate on Kurten Cemetery Road in Precinct 2 to haul water from the owners pond to be used for improvements to Kurten Cemetery Road. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered approval of the resubmitted Preliminary Plat of Austin's Creek Subdivision in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comments: 1) Area along the southeast right-of-way line of Old Reliance Road is very cluttered (difficult to read) and needs further clarification. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approved the resubmitted plat of Austin's Creek subject to the developer complying with the exceptions noted by the County Engineer. The Court next considered the request from Wickson Creek Special Utility District to place a road bore in the right-of- way of Broach Road located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Wickson Creek Special Utility District and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from GTE to place approximately 600 feet of buried cable in the right-of-way of Rabbit Lane located in Precinct 2. The County Engineer stated that the location is narrow, that care should be taken to not damage the ditch flowline or the roadway and then he recommended approval. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from GTE and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from Sprint/Untied Telephone Company to place a buried cable in the right-of-way of Pioneer Drive, Paradise Lane and Frontier Lane; roads located in 7-11 Ranch Subdivision in Precinct 1. On motion by Commissioner Thornton, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from Sprint/United Telephone and authorized the installation. The Road and Bridge Department requested permission to enter the private property of Randall Pratt on f Haupt Road in Precinct 1 to dispose of dead livestock. On motion by Commissioner Jones, seconded by Commissioner Sims, ' the Court voted unanimously to authorize the work. The Court next considered approval of the Final Plat of 1 High Country Subdivision in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the ' following comments: I 1) Show 20 feet utility easements along all lot lines (10 feet on either side). 2) Need road profiles (Article VII, C on Page 23, Subdivision and Development Regulations). 3) The block 1 indication on the northeast side of Sunup Drive is confusing as it is not contiguous with the rest of block 1. • I I 4) In the temporary turn-around of Sunup Drive I there is a 1IR40" shown, clarify what it indicates. On motion by Commissioner Thornton, seconded by Commissioner Sims, the Court voted unanimously to approved the final plat of High Country Subdivision subject to the developer complying with the exceptions noted by the County Engineer. The Court next considered acceptance of a Warranty Deed for right-of-way on Elmo Weedon Road in Precinct 3. On motion • by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Arlene C. Jolly for the expansion and improvements to Elmo Weedon Road. The Court next considered approval of the minutes of the Commissioners' Court meetings held April 25, 1997, May 6, 13, 20, 27, 1997, June 3, 10, 1997 and Workshops held on May 6, 1997, May 27, 1997 and June 3, 1997. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the minutes as submitted. There was no citizen input and/or concerns. The County Judge made the following comments: 1) He voiced concern over the number of paper ready inmates currently being held in the Brazos • County Jail. 2) There was favorable response from the Transportation Commission at the June 25, 1997 meeting in Austin to the request to expand SH 21 to 4 lanes. Michael Parks, from the MPO, stated that TxDot had innovative financing methods to help offset expenses for highway construction. These are in kind services supplied by a County to help get the needed construction. Commissioner Sims made the following comment: He now has a very good layout of the Greens Prairie Extension to Highway 30. This was done with the County Road & Bridge GIS program and if anyone wishes to see the map, it is in the Commissioners conference room. Pipe will be bored under all paved county roads extending from ditch line to ditch line with a minimum cover of 30-. IMPROVED ROADS (gravel) - The contractor will plow cable in the backslope of the road, one track of the plow tractor on the backslope the other may come to the shoulder of the road neither whole tractor or plow will be on the road surface. UNIMPROVED ROADS (dirt) - Same as improved, unless because of ditches, trees and other terrain features, it is more practical to plow in the center of the road. In these cases, the cable will be plowed in the center of the road. Not applicable in County. BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or disposed of and not left in the ditch. Rocks brought up by tractor or plow will be disposed of. DEPTH OF CABLE - All cables will be placed at a minimum depth of 30' except where crossing dams or ditches, at which locations the depth of cables will be at a minimum of 36'. The following are requirements which are made on the contractor. 1. The plowing equipment shall be subject to the approval of the Engineer and the Public Authorities having jursidiction over highway and road rights-of-way. 2. The equipment and construction methods used by the contractor shall be such as to cause minimum displacement of the soil. The slot made in the soil by the cable plow shall be closed immediately by driving a vehicle track or wheel over the slot or by other suitable means. 3. Damage to banks, ditches, driveways, and roads caused by the equipment shall be Immedelately repaired to the satisfaction of the Engineer and Public Authorities having jursidiction over highway and road right-of- way where Involved. 4. Trenches shall be promptly back-filled with earth, and mechanically tamped at six (6) inch lifts so that the earth Is restored to original grade to assure no hazard to vehicular, animal or pedestrian traffic. No trenches shall be left open overnight.
