BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
MAY 20, 1997 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.
I. Invocation - Judge Jones.

3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not scheduled on the agenda. Please
limit subject matters to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for

Site is located in Precinct 2.
16. Request from Brushy Water Supply Corp. to place a 2" service bore in the right-of-way
of Kemp Road for water line installation. Site is located in Precinct 4.
17. Permission for Road & Bridge to enter Terry Pruitt's property located off Bird Pond Road
for the purpose of disposing of dead livestock for the health, safety and welfare of the
general public. Site is located in Precinct 3.
18. Request from GTE to amend work order no. 5416-7F001 AL for cable installation in the
right-of-way of Greens Prairie Road (at its intersection with Live Oak Street) previously
approved in Commissioners' Court on February 12, 1997. GTE is requesting to open-cut
Live Oak Street. Site is located in Precinct 1.
19. Blanket Purchase Orders.
20. Award the following bids:
a. Bid No. 97-012 Microfilming, Indexing, and Storage Services for County Clerk.
b. Bid No. 97-022 Temporary Employment Services.
21. Requisition from Capital Projects for a Monitor Replacement for Justice of the Peace,
Precinct 4.
22. Request by Computer Network Services for a staff member to travel to Nashville,
Tennessee to attend a Zortec Users Conference.
23. Approval of minutes from Commissioners Court meetings conducted on March 25, 1997,
April I, 1997, April 8, 1997 and April 22, 1997.
24. Call for citizen input and/or concerns.
25. Announcement of interest items and possible future agenda topics.
26. Adjourn.

COMMISSIONERS' COURT
REGULAR MEETING
MAY 20, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, May 20, 1997, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #96/97-26.1
through 26.3, which would increase funds budgeted for the
Appellate Judicial Fund, the Risk Management Department and
Non-Departmental. On motion by Corranissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

Commissioner Sims moved to approve the changes as submitted. i
Commissioner Cauley seconded the motion. There was discussion
about hiring an employee in the Justice of the Peace 4
department at a group 5 step 3 position. Commissioner Sims

then amended his motion to say that the employee in the
Justice of the Peace 4 department be hired at a group 5 step
2 position with no six (6) month increase. Commissioner
Cauley amended his second. The Court voted unanimously to
approve the changes as amended.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
97-006613 through 97-006851
On motion by Commissioner Jones, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
County payroll in the amount of $546,000.00 for the payroll
period May 22, 1997.
The Court next considered a request from the Sheriff's
office for a budget amendment to fund a temporary clerk
position. In a memo to the Court, the Jail Administrator,
Wayne Dicky, said that due to the inability to fill two
detention officer/nurse positions the jail was experiencing
problems maintaining medical records and had a backlog of
filing. The clerk would allow the nursing staff to focus
their attention on providing medical care while he/she could
assume the responsibility of completing the indigent health
care applications required for medical health care cost
assistance for inmates. On motion by Commissioner Cauley,
seconded by Commissioner Sims, the Court voted unanimously to
approve a budget amendment to fund a temporary clerk position
in the Jail.
The Court next considered a personnel adjustment for two
part-time temporary positions at the Brazos Center. In
Director's memo to the Court, she explained that the two part-
time temporary positions had used more hours than budgeted
while the full time positions had been vacant for an extended
period of time. She was therefore asking for the transfer of

$3,400.00 from the full time positions to the part time
temporary positions. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the request for a personnel adjustment for the Brazos Center.
The next matter before the Court was approval of the
Contract and Agreement between Brazos County and the Brazos
County Emergency Communications District (9-1-1). The
contract is for the purchase of services for computer aided
dispatch equipment maintenance and network charges for the
fiscal year 1998. This is in accordance with the Interlocal
Cooperation Act, V.T.C.A. Government Code Chapter 791 that
authorizes governmental entities to enter into joint contracts
and agreements for the performance of governmental functions
and services. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the Contract and' Agreement between Brazos County and the
Brazos County Emergency Communications District (9-1-1). A
copy of the contract is attached hereto.
The court next considered a proposed work plan' and
revised pre-approval request form with Esmond Engineering,
Inc. for additional soil boring/monitor well at the former
county shop complex. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the proposed work plan and revised pre-approval request form
and that the contract amount be part of the reimbursement
request from the TNRCC.
The next matter for consideration was the acceptance of
a grant award for the Brazos Valley Narcotic Trafficking Task
Force. On motion by Commissioner Cauley, seconded by
Commissioner Jones, the Court voted unanimously to accept the
grant in the amount of $500,849.00 from Criminal Justice
Division.

satisfy unpaid final bond forfeitures owed to Brazos County.
Commissioner Jones moved to approve the request of the County
Attorney to foreclose on the property. Commissioner Cauley
seconded the motion. Attorney Frank Steelman, representing
Ramiro Quintero, asked the Court to grant Mr. Quintero a six
(6) month extension before foreclosing on the property. Kay
Magness, Assistant County Attorney explained that the money
had been owed for over five (5) years and that the bankruptcy
judge had entered an order removing the property from the
control of the bankruptcy court and Mr. Quintero and ordered
Brazos County to sell the property. Mr. Quintero owes Brazos
County $66,000.00. Commissioner Cauley commented that
property values were often times set without the property ever
being seen by an appraiser. Commissioners Sims and Jones and
the County Judge expressed compassion for Mr. Quintero but all
commented that there appeared to be no good faith shown by Mr.
Quintero in getting the debt reduced. Kay Magness informed
the court that taxes have been due on the properties since
1987 and that the excess amount was due to an accumulation
over the years and not from a high appraisal. Commissioner
Thornton said there needed to be absolute control over any
sales. He asked if there was a mechanism in place to assure
Mr. Quintero was getting fair market value should there be a
sale of the property. Kay Magness said "no". Commissioner
Thornton said that this concerned him. Commissioners Jones
and Cauley withdrew their motion and second. On motion by
Commissioner Jones, seconded by Commissioner Cauley, the Court
voted unanimously to table consideration until the next
Commissioners Court meeting on May 27, 1997 and in the interim
Mr. Quintero was to provide the Court an itemized break down
of income and expenses for the last ninety days (90) for each
of the seven (7) properties in question. This is due in Ruth
McLeod's office by 3:00 p.m. on Friday, May 23, 1997.
The next matter before the Court was a Letter of
Agreement for warranty deed terms for a certain property

located on Elmo Weedon Road in Precinct 3. The property owner
is Dr. E. L. Paine who is conveying 1.51 acres of land to the
County for improvements to Elmo Weedon Road. Commissioner
Cauley asked if the County was paying for a fiber optic
easement. Commissioner Sims answered that we were. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the
Court voted unanimously to approve the Letter of Agreement
with Dr. E. L. Paine for 1.51 acres of land to be conveyed for
improvements to Elmo Weedon Road. A copy of the letter is
attached hereto.
The Court next considered approval of the Replat of
Melody Acres Subdivision, Lot 2, 2.00 Acre Tract, in Precinct
2. Richard Vance, County Engineer, stated that he had
reviewed the plat and offered the following comment:
1) Shown 10 feet utility easement along Old
Reliance Road should be 20 feet.
On motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court unanimously approved the Replat of the
Melody Acres Subdivision, 2.00 Acre Tract, Lot 2 subject to
the developer complying with the exception noted by the County
Engineer.
The Court next considered the request from Brushy Water
Supply Corporation to place a 2 inch service bore in the
right-of-way of Kemp Road for water line installation. The
site is located in Precinct 4. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Cauley, seconded by Commissioner Sims,
the Court voted unanimously to approve the request from Brushy
Water Supply Corporation and authorized the installation. A
copy of the request is attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Terry Puritt on
Bird Pond Road in Precinct 3 to dispose of dead livestock. On

motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to authorize the work.
The Court next considered the request from GTE to amend

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered awarding the following bids:
Bid No. 97-012 Microfilming, Indexing, and storage

Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Government Records.
Bid No. 97-022 Temporary Employment Services

On motion by Commissioner Cauley, seconded by Commissioner
Jones, the Court voted unanimously to accept the
recommendation of the Purchasing Agent and award the contract
to Government Records for microfilming, indexing and storage
services. for the County Clerk and to Express Personnel for

Temporary Employment Services. A copy of each bid tabulation
is attached.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of a monitor replacement
for Justice of the Peace Precinct 4. Cost of the monitor is
$264.00. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
requisition in the amount of $264.00 to be paid from Capital
Expenditures for the purchase of a monitor replacement for
Justice of the Peace Precinct 4.
The next matter for consideration by the Court was a
request submitted by the Computer /Network Services department
requesting approval for out of state travel for Ernest Laney.
Mr. Laney would be traveling to Nashville, Tennessee to attend
the Zortec International User Conference June 9 through the
11, 1997. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to grant the
request from the Director of the Computer /Network Services
department and approved payment of out of state travel expense
for Mr. Ernest Laney.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held on March 25, 1997 and on
the following dates in April 1997: 1, 8, and 22,. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the
Court voted unanimously to approve the minutes as submitted.
There was no citizen input and/or concerns.
The County Judge made the following comments:
a) He reminded the Court of the CUC meeting
in Austin on May 21, 1997.
b) He received a letter of thanks from the
Precinct 4 Volunteer Fire Department for
the work on the driveway at their fire
station.
c) He reminded the Court of the intergovern-
mental meeting.
d) He informed the Court that the auction
had netted the County $51,000.00.

NO. 96/97-26.1 through 26.3
On this the 20th day of May 1997 at a regular meeting of the
Commissioners' Court, the following members were present:.
Alvin W. Jones, County Judge, Presiding
Tony Jones, Commissioner, Precinct 1;
Wm. S. Thornton, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;

The following proceedings were held:
THAT WHEREAS, on May 20, 1997 the Court heard and approved a
budget amendment for the 1996-1997 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted August 8, 1996
the following amendment(s) to the original are hereby authorized,
as described on the attached page(s).

THE STATE OF TEXAS
COUNTY OF BRAZOS
THIS CONTRACT AND AGREEMENT, made and entered into this,,AA4_day of May, 1997,
by and between the County of Brazos and Brazos County Emergency Communications
District, and possibly any other public entity, each participating government acting by and
through its respective executive office hereunto duly authorized by resolution of the governing
body.
WITNESSETH
WHEREAS, the respective participating governments are authorized by the Interlocal
Cooperation Act, V.T.C A. Government Code Chapter 791, to enter into joint contracts and
agreements for the performance of governmental functions and services including
administrative functions normally associated with the operation of government such as
necessary materials, supplies and services-
WHEREAS, it is the desire of the aforesaid participating governments to comply and further
the policies and purposes of the Interlocal Cooperation Act
WHEREAS, the participating governments cannot normally obtain the best possible service for
computer aided dispatch equipment and network charges acting individually and without
cooperation; and
WHEREAS, it is deemed in the best interest of all participating governments that said

Dear Dr. Payne:
The Commissioners' Court of Brazos County agrees to the following terms and conditions in
exchange for you conveying 1.51 acres of land out of the T.J. Allcom Survey, Abstract No. 61,
Brazos County, Texas and being part of a called 102 acre tract of land further described in the
attached Warranty Deed.
1. The land to be conveyed by Warranty Deed to Brazos County for improvements to
Elmo Weedon Road will be 1.51 acres. Said 1.5 acres being a combination of 0.64 of
one acre in the existing prescriptive right-of-way and 0.87 of one acre across the
prescriptive right-of-way. The purchase price for the 0.87 of one acre will be $2,272.44
which is based on the appraised value of $2,612.00 per acre.
2. Brazos County will construct approximately 1,012' of new fencing using the
following materials: corner posts will be cedar, line posts will be cedar, landscape timbers
will be used for bracing, 5 strands 12 1/2 ga. barbed wire, I (one) 12' heavy duty
galvanized tubular gate. A second fence will be constructed approximately 10' behind the
first fence using the same materials. The length of this second fence will be based on the
second fence currently in place.
3. Trees cleared from the new right-of-way will be left for land owner's use and
disposal. Only those trees whose drip-line are within the GTE Fiber Optic Easement will
be considered for damages in the event these trees are damaged or destroyed during

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc. from County right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test
Method No. D-698; test shall be conducted by an independent Geotechnical
testing firm; copies of all test results shall be furnished to the office of the
Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published ¢y the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

SUBJECT. Recommendation for Bid No 97-012 Microfilming, Indexing, and Storage
+ for Brazos County Offices
When the Purchasing Department issued the above mentioned bid, it was our intention to
award one bid for all County offices who utilize microfilming/microfiche services. During
the research to establish specifications and subsequently upon receipt of the bids, we have
discovered that that is no easy task due to the fact that each office has unique needs and
requirements The bids received were not comparable (apples and oranges). We are

currently asking for assistance to help us standardize the microfilming process for all the
offices other than the County Clerk. The County Clerk has unique applications that do
not apply to other offices. We chose a cross section of documents received by the

County Clerk and used them to calculate prices. Five documents were chosen and a dollar

value was calculated to film, index, and store these documents. Government Records was
the lowest bidder on a total cost basis The remaining three vendors were very close in
price for filming only. The major variance in price was for indexing, record books,
shelving, and storage.
Purchasing recommends that we award the County Clerk's office to Government Records

and the other offices microfilming needs will be awarded at a later time pending the
results of an analysis to standardize all the other offices.
