Road for the purpose of using land owners surplus fill material to build up area for
relocation of cattleguard and also for improvements to approximately 600 feet of Elmo
Weedon Road. Site is located in Precinct 3.
15. Request from Sprint/United Telephone Company to place a buried cable in the right-of-
way of Clay Street (in Millican, Texas) beginning at its intersection with Buchanan Street
and extending east for a distance of 664 feet. Site is located in Precinct 1.

COMMISSIONERS' COURT
REGULAR MEETING
MAY 6, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 3:00
p.m. on Tuesday, May 6, 1997, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1, Absent;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The Court heard a presentation by Dianne Moore,
representative of Valik, concerning deferred compensation and
the possibility of offering Valik products to County
Employees. The Court thanked her for the information.
The Court next considered Budget Amendment #96/97-24.1
through 24.2, which would reallocate funds budgeted for the
Narcotics Task Force and increase the budget of the Substance
Abuse Program in Juvenile Services. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The next matter for consideration was a personnel
adjustment for the District Attorney's Office. The request
from the District Attorney to combine the two (2) part time
positions so as to reinstate the juvenile attorney position to
a full time position was originally approved at the
Commissioners Court meeting dated April 22, 1997. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the

Court voted unanimously to approve the request of the District
Attorney and reinstate the juvenile attorney position as a
full time position.
The Court proceeded to consider the change of status of

Cauley, the Court voted unanimously to approve the County
payroll in the amount of $539,000.00 for the payroll date of
May 8, 1997.

The next matter for consideration was an application
submitted by the City of Bryan to conduct an outdoor music

festival at Lake Bryan Park on June 6 and 7, 1997. The Court

held a Public Hearing on May 6, 1997 at 1:00 p.m. to consider

commentary for and against the granting of the permit. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the application
submitted by the City of Bryan to conduct an outdoor music
!
festival at Lake Bryan Park on June 6 and 7, 1997.
The next matter for consideration was Change Order No. 11
for the Brazos County Juvenile Justice Center to modify secure
yard fence to a vertical fence with razor ribbon thus reducing
the contract amount by $5,400.00. This change order will

delete the radius fence top at all security yard fencing, will
add a straight vertical fence with razor ribbon at the top
portion and additional razor ribbon will be placed on top of
the parapet at the low wall adjacent to the gym. On motion by

Commissioner Sims, seconded by Commissioner Cauley, the Court

voted unanimously to approve Change Order No. 11 for the
Juvenile Justice Center Construction Contract. A copy of the
Change Order is attached hereto.
The Court next considered Change Order No. 12 for the
Juvenile Justice Center Construction Contract. The Change
Order would add light fixtures in areas as requested by Ernie
Wentrcek, Director of Juvenile Services and increase the
contract amount by $1,409.00. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve Change Order No. 12 for the Juvenile Justice Center
Construction Contract. A copy of the Change Order is attached
hereto.

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to use Certificate of
Obligation Funds for the previously noted Brazos County road
projects.
The Court next considered authorizing work outside of f

county rights-of'-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested i

permission to enter the private property of Mildred Murphy on
Red Angus Road in Precinct 3 to use surplus fill material to
build up an area for the relocation of a cattle guard and
improve approximately 600 feet of Elmo Weedon Road. On motion
by Commissioner Sims, seconded by Commissioner Cauley, the

Court voted unanimously to authorize the work.
The Court next considered the request from Sprint/United

The Court proceeded to consider the following blanket

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered an Exemption from Competitive
Bidding Requirements of Local Government Code, Section
262.024(a)(7)(A). This is for the purchase of CD-ROM
Electronic Law Research from West Group. The Commissioners'
Court determined that this was a single source supplier. On
motion by Commissioner Sims, Seconded by Commissioner Cauley,
the Court voted unanimously to approve the Exemption of
Competitive Bidding Requirements and authorized the payment
for said cost in an amount not to exceed $18,000.00.
The Court next considered authorizing the execution of
the West Group Order Form, the Subscriber Agreement/CD ROM
Libraries and the West Group Training Form for the District
Judges, County Court at Law Judges, the District and County
Attorneys. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
authorize the execution of the West Group Order Form, the
Subscriber Agreement/CD ROM Libraries and the West Group
Training Form.
The Court next considered approval of following

item P for eight (8) users at this time with additions to be
made at a later date if necessary.

the General Fund for the purchase of a Fingerprint/Palmprint
machine for Juvenile Services. Cost of the machine is $633.00.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the requisition
in the amount of $633.00 to be paid from the General Fund for
the purchase of a Fingerprint/Palmprint machine for Juvenile
Services.
The Court next considered the list of surplus equipment
and miscellaneous supplies scheduled for auction on May 17,
1997. On motion by the County Judge, seconded by Commissioner
Cauley, the Court voted unanimously to approve the list of
surplus equipment and miscellaneous supplies scheduled for
auction on May 17, 1997. A copy of the list is attached
hereto.
The next matter for consideration was approval for the
` Purchasing Agent to advertise for bids for copier replacements
for Road & Bridge and Juvenile Services. On motion by
i Commissioner Cauley, seconded by Commissioner Sims, the Court
voted unanimously to authorize the Purchasing Agent to

copy of which is attached to and made a part of these minutes.
The Court acknowledged executing a request for ownership
of the Package Disaster Hospital.
There was no citizen input and/or concerns.
The County Judge made the following comments:
a) He has received proposals concerning the
collection of outstanding fines & fees by Constable
Precinct 4
b) He announced that Ernie Wentrcek's grandmother
had passed away.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 6th day of May 1997 at a regular meeting of the
Commissioners' Court, the following members were present:

i right-of-way of Clay Street (in Millican Texas) beginning at its intersection with
Buchanan Street and extending east for a distance of 664 feet Site is located in
Precinct 1.
SOURCE OF FUNDS: N/A
1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
} line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc. from County right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test
Method No. D-698; test shall be conducted by an independent Geotechnical
testing firm; copies of all test results shall be furnished to the office of the
Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of
j Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

Dear Sir.
Formal notice is hereby given that the United Telephone Company of Texas.
Inc. proposes to Install buried communications cable upon and along the
right-of-way of county roads in Brazos County, Texas, as follows:
IMPROVED ROADS (paved) - The contractor will plow cable in backslope with
8' of right-of-way line. Pipe will be bored under all paved county roads
extending from ditch line to ditch line with a minimum cover of 30'.
IMPROVED ROADS (graveQ - The contractor will plow cable in the backslope
of the road, one track of the plow tractor on the backslope the other may
come to the shoulder of the road neither whole tractor or plow will be on
the road surface.
UNIMPROVED ROADS (dirt) - Same as improved, unless because of ditches,
trees and other terrain features, it is more practical to plow in the center
of the road. In these cases, the cable will be plowed in the center of the road.
Not applicable in County.
BRUSH DISPOSAL - Any brush, trees, etc., that are cut will be burned or
disposed of and not left in the ditch. Rocks brought up by tractor or
plow will be disposed of.
DEPTH OF CABLE -All cables will be placed at a minimum depth of 30'
except where crossing dams or ditches, at which locations the depth of
cables will be at a minimum of 36'.
The following are requirements which are made on the contractor.
1. The plowing equipment shall be subject to the approval of the
Engineer and the Public Authorities having jursidiction over highway
and road rights-of-way.
2. The equipment and construction methods used by the contractor shall
be such as to cause minimum displacement of the soil. The slot made
In the soil by the cable plow shall be closed immediately by driving
a vehicle track or wheel over the slot or by other suitable means.
3. Damage to banks, ditches, driveways, and roads caused by the equipment
shall be Immedeiately repaired to the satisfaction of the Engineer and
Public Authorities having jursidiction over highway and road right-of-
way where Involved.
4. Trenches shall be promptly back-filled with earth, and mechanically
tamped at six (6) Inch lifts so that the earth is restored to original
grade to assure no hazard to vehicular, animal or pedestrian traffic.
No trenches shall be left open overnight.
5. The usual 10%fees withheld from contractor until repairs are made
satisfactory with Engineer and Public Authorities having jurisdiction
of right-of-way Involved.

equipment such as maintainers, hole diggers, etc. In the event of
such damages the Telephone Comapany will be notified immediately. '
The County Commissioners Court may require the owners to relocate this
line, for valid reasons under the law, by giving thirty (30) days
written notice. f
a. Where communication facilities are located on county
road ROW the Telephone Company will relocate said i
facilities at no expense to the County. F
b. Where communication facilities are located on private
property the county will reimburse the Telephone Company
for the relocation of said facilities. ►
At any place where a communications line crosses over a county road, it
shall be constructed and maintained at least eighteen (18) feet above ;
the surface of the traffic lane`

1. Governing Agreements. This Order Form is a binding agreement. Customer acknowledges and agrees that the products ordered on
thls Order Form are govemed by its terms and also by the separate agreements identified below. Terms used in this Order Form have the
meanings attributed to them in the separate agreements.

2. Gubserlption Qervlce. Subscription service for 1110 products ordered on this Order form will be provided at the then•curtrenl prices until
further notice by either party Subsenplion service for each product may consist of the following.
a) CD-ROM LlbradesTv: Full Service Subscription: Update. Supplemental and Enhanced CD-ROMs, online updates andlor
advanco sheets
b) Books Pocket parts, pamphlets, recompiled, continuation, replacement or auxiliary volumes, additional volumes, looseleaf
pages and/or supplements and volumes of a new series of editions.
e) Diskette Products Updated.
d) CD-ROM Software. Now Versions
e) WESTLAW Software New versions.
2. CD-ROM Charges and Billing initial or level changes will be billed on the date West Group ('West`) processes Subscriber's order
('vrorassing Date') ?Aonthty subscription charges for Libraries with initial charges will ba:gin on the first day or viv second month following
the Processing Data and will be bltod as of the first day of each month thereafter. Monthly subscription charges for Libranes with level
charges will begin on the first day of the fourteenth (14 ) month following the Processing Date and wilt be billed as of the first day or each
month thereafter Subscription charges ay be annualized. All charges are non-refundable. Upon termination of a Library subscription,
West, at its option, may declare all CD-ROM Ctwrgas with respect to such subscription immediately due and payable, inCluding au
unmatured installments of initial charges and all level charges agreed to by the Subscriber.
4. General Provisions. The Order Form Is subject to, and shall be effective upon, approval and execution by West In St. Paul, Minnesota,
Seles. use, personal property, ad valorem and other taxes are the responsibility of Customer. West rotains a purchase money security
Interest in all purchased products until fully paid A reproduction or this slgnaa Order Fort wit bo considered as an original and maybe
used as a financing statement This Order Form shall be govemed and construed under Minnesota law Customer may be charged
interest fur overdue Installments and subscriptions for other open account charges Interest, d charged, maybe adjusted to the then
highest current rate allowable on Minnesota contracts. Transfer or assignment of tights or obligations by urstorner constitutes a matedat
breach or this order form and its goveming agreement(s). If Customer transfers the collateral hereunder, or if any installments,
subscriptions or open account charge; remain unpaid 90 days after maturity, all unmatured installments shalt become due and payable
at the option of west AN collection fees. Including but not limited to attorneys fees, are payable by customer. Tranapomlation and
'handling will be added unless otherwise Stated.

Y 1997, is hereby submitted as required by Local Government Code § 114.025, Vernon's Texas
Codes Annotated. The statutes require the County Auditor to issue a monthly report on the
County's financial position and activity.

Financial Statement Responsibility

'I'hc Brazos County Auditor is responsible for the preparation of monthly financial reports, and
the preparation of the financial statements for the fiscal year ending September 30. Each report
consists of financial statements, budgetary reports and supporting informational schedules. Z~he
statements and reports have been prepared in accordance with generally accepted accounting
principals. 3'he County Auditor's office is responsible for the objectivity and integrity of the
data included in the statements, reports and schedules. This process requires the County Auditor
to make informed judgments and estimates of the expected events and transactions that have not
hcen concluded, by the end of the month or the end of the year, respectively.
'To provide some assurance of the objectivity and integrity of the financial statements, and to
insure that the assets of the County arc protected from loss or misuse, tl~c management of the
County is responsible for designing and maintaining an internal control system. The system of -
intemal controls provides for the segregation of duties and is documented through written ~
policies and procedures. The Brazos County Auditor's office has an internal audit function to
continually review and monitor the operations of the County, to insure that the County is ,
complying with statutory requirements. While County management agrees that there are many
areas that need additional review, the existing internal control system is adequate to accomplish
the objectives as required by statute. Management at all levels has considered the
recommendations made by the Brazos County Auditor's office concerning internal controls, and !
has taken appropriate action to address these recommendations.

COMMENTS WITN REGARDS TO FINANCIAL DATA ~
Combined Statement of Assets and Other Debits:
For the six months ended March 31, 1997 it is no►ed that cash and Other Debits increased {
$6.8 million since the beginning of this fiscal year. $5.2 million is the remainder from the sale of ~
certificates of obligation in July 1996. The Taxes Receivable represent 13.9% of the current Ad
Valorem tax levy and the collected taxes are invested until they are needed'o fund expenditures.
Combined Statement of Liabilities, Equity and Other Credits:
Total liabilities at September 30, 1996 increased $4.1 million over the period a year before.
The majority of this increase is due to the fully encumbered contract for the new Juvenile
Detention Facility ($1.9 million, remaining on the contract).
Accrued salary and compensated leave increased ] 1 % over the level a year before. This was ~
due to (1) earned vacation leave increased 2 l % over the prior year l 06,000) (2) accrued salary ,
and wages was for five days compared to 3 days the year before ($100,000).
The "Note Payable-State of Texas" was created last year due to the fact that the County had
received excessive sales tax revenue over a four years. Evidently, an out of state supplier had
incorrectly coded sales for Brazoria County to Brazos County. The County has entered into an
agreement with the State of Texas to repay the sales tax at the rate of $3,000 per month,

beginning in January 1997. The note does not bear interest, and will be repaid over a period of
36 months. •
It is pointed out that the Internal Service Fund's (Health and Life) retained earnings dropped
from $218,626 at September 30, 1995 to $63,353 `at September 30, 1996. At September 30, 1994
the level of retained earnings was $285,874. The retained earnings maintained by the fund
represent excess revenues over expenditures that have accumulated, and which are available to
assist the fund in paying claims that may be in excess of projected levels. At September 30,
1994 there was sufficient funds on hand to handle an excess equal to one month's average
claims. At September 30, 1996 there are only sufficient funds available to handle claims for an
average week.
The reduction in available retained earnings was in keeping with the budget as estimated for
the year. It was anticipated that there would be $238,000 more costs than revenues. To offset
the short fall would have required an increase in the premium levels or a change in available
benefits. No action was taken to increase premiums. Benefit levels were adjusted January 1, .
• 1997.
,
It is noted that at September 30, 1996 the General Fund for the County has an Undesignated
fund balance of $8,537,685. While there is no statutory requirement on the part of
` , ~ Commissioners Court to retain any Fund Balance, it would be financially responsible to retain
operating capital sufficient to fund three months of operational requirements ($7.0 million). This
• ~ would leave $1.5 ,
• ~ million that the Court could designate to be used as a resource in other areas.
t At March 31, 1997, the undesignated fund balance is reported to be $15,982,026 which
represents an increase of $7,444,341 from current year revenues. This increase is due primarily

• to the collection of 86% of the Ad Valorem taxes which are invested and held to finance the
remainder of the 1996-97 budget.

~ ~ ' In the Capital Projects Fund (Capital Improvement Fund) there is $6,289,000 of resources
~ , , which have been set aside to be used for capital improvements throughout the County. In the
. 1996-97 budget all of these funds were budgeted for a defined purpose. However, the source of
~ these funds were from "public funds" and therefore, the Court has the ability to re-designate the ~
use of the funds as required.

General Fund Revenue Analysis:
The revenues collection of Ad Valorem Taxes is 86% of the 1996-97 levy as of March 31,
1997. The County has experience an increase in Fine revenue due to the release of collections ~ t'
from the Community Services and Corrections Department which have been held pending
"payment in full" status. Progress is being made on computer programs to allow partial ~
payments of fines and court costs which will have a positive impact on the revenue resowces.
General Fund Expenditure Analysis
Overall the General Fund reflects that there was $27,444,348 resowced for expenditures, and
only $11,372,973 has been used. This represents a spending level of 41.44% .
Comparative Analysis Of Expenditures By Function
The over all expenditure level of the County actually decreased (from $30,379,338 to
$29,629,798) from the year before. This is the first time in the past ten years that a decrease in
total expenditwes from the previous year's level has occurred. ,
