APRIL 29, 1997 AT 3:00 P.M. IN THE COMMISSIONERS COURTROOM OF THE

COMMISSIONERS' COURT
! REGULAR MEETING
APRIL 29, 1997
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 3:00
p.m. on Tuesday, April 29, 1997, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Thornton gave the invocation and led the
pledge of allegiance.
The County Judge read aloud a Proclamation designating
May 1, 1997 as "National Day of Prayer". The Court joins with
the National government in asking the citizens to join
together in prayer to recognize our blessings, acknowledge our
wrongs, and to ask for Divine guidance to better our future.
On motion by Commissioner Cauley, seconded by Commissioner
Sims the Court moved to proclaim May 1, 1997 as "National Day
of Prayer" throughout Brazos County. The County Judge then
presented the signed Proclamation to Ms Ann Horton,
representing Aldersgate United Methodist Church.
The County Judge read aloud a Proclamation designating
the week of May 5 through 9, 1997 as "Texas Chamber of
Commerce Week". The Court recognizes the Bryan-College
Station Chamber of Commerce and its many dedicated volunteers
for its steadfast work on behalf and support of Brazos County.
i On motion•by Commissioner Sims, seconded by Commissioner
Cauley the Court moved to proclaim the week of May 5 through
' 9, 1997 as "Texas Chamber of Commerce Week" throughout Brazos
County. The County Judge then presented the signed

Proclamation to Ronnie Morrison, President of the Chamber of
Commerce, Tom Augenbaugh and Celia Goode-Haddox, representing
the local Chamber of Commerce.
Under citizen input and/or concerns, Susan Gandy made the
following comment:
There will be a prayer meeting at the Brazos Center
at 7:00 p.m. on May 1, 1997.
The Court next considered Budget Amendment #96/97-23.1
through 23.3 which would reallocate funds budgeted for the
office of Justice of the Peace Precinct 7 Place 2, create a
line item for the office of Justice of the Peace Precinct 4
Place 2 and to increase the budget for Justice of the Peace
Precinct 1. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
budget amendment as submitted, a copy of which is attached
hereto.

Commissioner Sims questioned the position in the District
Clerk's office and asked the District Clerk if there would be
'a six month increase. The District Clerk
replied there would
not be. on motion by Commissioner
Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the changes as submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.

On motion by Commissioner Cauley, seconded by
Commissioner Jones, the Court voted unanimously to adopt a
resolution in support of a Federal Divisional Court for
Bryan/College Station. A copy of the Resolution is attached
hereto.
The next matter before the Court was an application by
the City of Bryan for a Mass Gathering Event. On motion by
the County Judge, seconded by Commissioner Cauley, the Court
voted unanimously to table consideration until the next
Commissioners Court meeting. The County Judge then announced
that the Public Hearing to hear commentary for or against the
event would be held Tuesday, May 6, 1997 at 1:00 p.m..
The Court next considered changing the meeting time and
frequency for Commissioners Court. On motion by the County
Judge, seconded by Commissioner Sims, the 'Court voted
unanimously to table consideration until the Commissioners
Court meeting of May 13, 1997.
The next matter before the Court was a request by the
County Attorney to allow the County Treasurer to endorse the
certificate of deposit held as security on final bail bond
forfeitures to satisfy judgments entered against J & J
Bonding. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the County Treasurer to endorse the certificate of deposit
held as security.
The next matter for consideration was a request by
Juvenile Services for the purchase of a fingerprint/palmprint
machine. Commissioner Cauley moved to authorize the purchase.
Commissioner Sims seconded the motion. After considerable
discussion, Commissioner Cauley moved to rescind his motion.
Commissioner Sims seconded the motion to rescind. Then on
motion by Commissioner Thornton, seconded by Commissioner
Cauley, the Court voted unanimously to table consideration
until a later date.

The Court next considered the renewal of an Agreement for
Commodities (National School Lunch Program) for Juvenile
Services. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to renew the
Agreement for Commodities (National School Lunch Program) for
Juvenile Services. A copy of the Agreement is attached
hereto.
The next matter for consideration was a request by the
County Clerk to reclassify the Record Management Clerk from a
one-half time position to a full-time position. In her note
to the Court, the County Clerk said that the clerk would have
more responsibility. She also said that there would be no six
(6) month increase. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to
authorize the reclassification of the Record Management Clerk
from a one-half time to a full-time position.
The Court next considered a request from the Precinct 4
' Volunteer Fire Department for authorization for the Road and

Bridge Department to assist them with improvements to their

driveway. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the Road and Bridge Department to assist the Precinct 4
Volunteer Fire Department with improvements to their driveway
subject to the County Engineer determining the specifications.
The next matter to be considered was a Letter of
Agreement for warranty deed terms for certain property located
on Elmo Weedon Road, in Precinct 3. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to table consideration until a later date.
The Court next considered the request from Ferguson-
Burleson Gas Gathering System to relocate their North Wellborn
6 inch gas pipeline on North Dowling Road (for roadway
improvements) at an estimated cost to the County of $70,000.00
j (cost does not include removing the old pipe). The site is
I located in Precinct 1. The County Engineer stated that all

appeared to be in order and recommended approval. On motion
by Commissioner Jones, seconded by Commissioner Cauley, the
Court voted unanimously to approve the request from Ferguson-
Burleson Gas Gathering System and authorized the payment of
$70,000.00 from Major Projects. A copy of the request is
attached hereto.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Jerome and Jaye
Congleton on Valley Circle in Precinct 1 to dispose of dead
livestock. On motion by Commissioner Jones, seconded by
Commissioner Cauley, the Court voted unanimously to authorize
the work.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of W.H. Shenkir on
Merka Road in Precinct 3 to dispose of dead livestock. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to authorize the work. The County
Judge appointed Commissioners Sims and Thornton to work with
the County Engineer to arrive at a cost for this service.
The Court next considered the request from GTE to replace
buried cable in the right-of-way of Dowling Road beginning at
its intersection with FM 2154 and ending at I&GN Road. The
site is located in Precinct 1. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Jones, seconded by Commissioner Cauley,
the court voted unanimously to approve the request from GTE
and authorized the installation. A copy of the request is
attached hereto.
The Court next considered approval of the Re-Plat of
Melody Acres Phase II Subdivision in Precinct 2. Richard
Vance, County Engineer, stated that he had reviewed the plat

and all appeared to be in order. On motion by Commissioner
Thornton, seconded by Commissioner Cauley, the Court
unanimously approved the re-plat of the Melody Acres
Subdivision.
The next matter for the Court's consideration was Change
Order No. 10 for the Brazos County Juvenile Justice Center.
In the Change Order the Architect, Charles Croslin, requested
an additional $5,145.00 for the sanitary sewer connection and
20 additional days added to the contract period because of bad
weather. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the Change Order and increase to the contract price $5,145.00
and period by 20 days. A copy is attached hereto.
The Court proceeded to consider the following blanket
Purchase Orders:

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of the following
requisitions from Capital Expenditures:
a) Samsung Syncmaster 3 NE Replacement for
District Attorney's office $264.00.
On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
approve the requisition in the amount of $264.00 to
be paid from Capital Expenditures for the purchase
of a Samsung Syncmaster 3 NE Replacement.
b) Western Digital 4.1G Caviar Eide for the
Road & Bridge GIS $1,416.00.
On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
approve the requisition in the amount of $1,416.00
.to be paid from Capital Expenditures for the
purchase of Western Digital 4.1G Caviar Eide for
the Road & Bridge GIS.

Commissioners Court meeting April 29, 1997
The Court next considered approval of a requisition from
the General Fund for the purchase of a Facsimile System to be
! shared by the offices of Justices of the Peace Precinct 4 and
the 361st District Court. Cost of the Fax Machine is $649.00.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the requisition
in the amount of $649.00 to be paid from the•General Fund for
the purchase of a Facsimile System to be shared by the offices
of Justice of the Peace Precinct 4 and the 361st District
Court.
The Court next considered awarding or rejecting the
following bids:
a) Bid No. 97-040 Second or Additional Seal

for Juvenile Justice Center Landscaping
Cheryl Turney, Purchasing Agent,
recommended rejection of the bids
received. On motion by Commissioner
Sims, seconded by Commissioner Cauley,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and reject all bids received.
c) RFQ 97-009 Comprehensive Review &
Revision of Brazos County Classification,
and Compensation Plan
Cheryl Turney, Purchasing Agent,
recommended acceptance of the quote
submitted by Ray and Associates. On
motion by Commissioner Sims, seconded by
Commissioner Jones, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Ray and Associates.

Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Aggieland Carpets. On
motion by Commissioner Cauley, seconded
by Commissioner Sims, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Aggieland Carpets and that
the cost not exceed the budgeted amount.

motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Stewart & Stephenson.
The Court next considered the following requisitions for
purchases through sealed competitive bids for the Roa(j and
Bridge Department:

Cauley, the Court voted unanimously to approve the above

Under citizen input and/or concerns Mr. Demetrios
Basdekas made the following comments:
He expressed his thanks to the Court and
the Road and Bridge Department for
completion of the work on Old Reliance
Road.
The County Judge made the following comments:
a) He asked the Sheriff's department about
. taking over the disaster.hospital unit.
b) He visited with M.J. Deen, Computer-
Network Services Department Head, about
access to the Internet. She provided him
with guidelines for use of the internet.

c) He commented that the legislature is
winding down and that he had a copy of a
tax bill that he would be glad to share.
d) He said he was going to Austin to attend
a Coalition of Urban Counties meeting.
e) He said that he had received a requi-
sition from Croslin & Assoc. that
includes charges the County owes up to
77% of the project management fee that is
based on construction cost. He asked for
a spread sheet on the total paid to
Croslin & Assoc..
f) He and the Director of Juvenile Services
are working on the fence portion of the
plans looking into using razor ribbon on
the fence for an additional $5,000 plus
$600 to attach it to the building.
There being no further business to come before the Court,
the meeting was adjourned.

On this the 29th day of April 1997 at a regular meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on April 29, 1997 the Court heard and approved
a budget amendment for the 1996-1997 budget year for Brazos County,
Texas.
-WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted August 8, 1996
the following amendment(s) to the original are hereby authorized,-
as described on the attached page(s).

WHEREAS, Bryan and College Station are currently within the jurisdiction of the Federal
Court of the Houston Division of the Southern District of Texas, which happens to serve one of
the largest population centers in the United States; and
WHEREAS, it is apparent the creation of a Federal District Divisional Court in
Bryan/College Station would be beneficial to business, law enforcement and the citizenry; and
WHEREAS, the creation of a six county Federal District Divisional Court, consisting of
Brazos, Grimes, Madison, San Jacinto, Walker and Waller Counties of the State of Texas would
provide the citizenry of all counties greater access to the Federal Court System; and
WHEREAS, legislation is to be introduced in Congress creating this Federal District
Divisional Court by Senator Phil Gramm and Senator Kay Bailey Hutchinson; and
WHEREAS, it is in the best interest of the Brazos Valley, and more specifically Brazos
County, for this Federal District Divisional Court to be located in Bryan/College Station to serve
its citizenry; and
WE NOW, THEREFORE, hereby resolve that the Brazos County Commissioners Court,
after hearing the history and need for the creation of this new Federal District Divisional Court,
endorses this proposition and will lend appropriate support to aid in the creation of the new
Federal District Divisional Court.

FOOD SERVICE MANAGEMENT COMPANY
Federal regulations allow a contracting organization (recipient agency (RA)) to employ a food service management company (FSMC) or Non-
Profit Organization (NPO) to conduct the food service operations of non-profit summer camps for children, charitable institutions, nutrition
programs for the elderly, schools, non-residential child care institutions, and service institutions. Federal regulations also require some
FSMCs to have processing contracts with DHS and some NPOs to meet certain requirements prior to signing agreements with an RA. If
an FSMC or NPO is employed to provide such services, the RA must enter into a written agreement with the FSMC or NPO, which expressly
' provides that:
any donated foods received by the RA and made available to the FSMC or NPO shall be utilized solely for the purpose of providing
benefits for the RA's food service operation and, it is the responsibility of the RA to demonstrate that the full value of all donated foods
is used solely for the benefit of the RA;yypp

• the books and records of the FSMC or NPO pertaining to the food service operation of the agency must be available for a period of thre
years and 90 days after the contract periods ends or, if the agreement has no specific termination date, for three years and the clog
of the federal fiscal year to which they pertain;
• in the case of non-profit summer camps for children, charitable institutions, and nutrition programs for the elderly, the contract shall b l
in effect for no longer than one year and may be extended at the option of both parties for two additional one-year periods. Contract
may be terminated for cause by either party upon 30 days written notice; and
• FSMCS or NPOs that are not under contract with a school participating in the National School Lunch Program, School Breakfast Program
or a commodity school, are subject to biennial reviews by DHS.

CERTIFICATION
A Regarding Debarment, Suspension, Ineligibility, or Voluntary Exclusion For Covered Contracts - The contractor certifies, by executior
of this agreement, that neither it nor its principals is presently debarred, suspended, proposed for debarment, declared ineligible, of
voluntarily excluded from participating in this contract by any federal department or agency or by the State of Texas. By making this
certification, the contractor agrees to the following terms:

The above certification is a material representation of fact upon which reliance was placed when this contract was entered into. If it
is later determined that the contractor knowingly rendered an erroneous certification, in addition to other remedies available to the federal
government, the Department of Health and Human Services, United States Department of Agriculture or other federal department or
agency, or the Texas Department of Human Services may pursue available remedies, including suspension and/or debarment.
The contractor shall provide immediate written notice to the person to which this certification is submitted if at any time the contractor
learns that the certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

The words 'covered cdntract', 'debarred% 'suspended', 'ineligible% 'participant', 'persons', 'principal', 'proposal', and 'voluntarily
excluded', as used in this certification having meanings based upon materials in the Definitions and Coverage sections of federal rules
implementing Executive Order 12549.
The contractors agrees by submitting this certification that, should the proposed covered contract be entered into, it shall not knowingly
enter into any subcontract with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in
this covered transaction, unless authorized by the Department of Health and Human Services. United States Department of Agriculture
or other federal department or agency, and/or the Texas Department of Human Services, as applicable.
The contractor further agrees by submitting this certification that it will include TDHS Form 2046 titled 'Certification Regarding
Debarment, Suspension, Ineligibility, and Voluntary Exclusion for Covered Contracts' without modification, in all covered subcontracts
and in solicitations for all covered subcontracts.
A contractor may rely upon a certification of a subcontractor that is not debarred, suspended, ineligible, or voluntarily excluded from the
covered contract, unless it knows that the certification is erroneous. A contractor must, at a minimum, obtain certifications from its
covered subcontractors upon each subcontract's initiation and upon each renewal.
Nothing contained in all the foregoing shall be construed to require establishment of a system of records in order to render in good faith
the certification required by this certification document. The knowledge and information of a contractor is not required to exceed that
which is normally possessed by a prudent person in the ordinary course of business dealings.
Except for contractors authorized under paragraph 4 of these terms, if a contractor in a covered contract knowingly enters into a covered
subcontract with a person who is suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition
to other remedies available to the federal government. Department of Health and Human Services, United States Department of
Agriculture, or other federal department or agency, as applicable, and/or the Texas Department of Human Services may pursue available

B. Regarding Federal Lobbying - This certification applies only to this contract and is a material representation of fact upon which reliance
was placed when this Vansaction was made or entered into. Submission of this certification is a prerequisite for making or entering into
this transaction imposed by section 1352, title 31• U.S. Code. Any person who fails to file the required certification shall be subject
to a civil penalty of not less than 610,000 and not more than $100,000 for each such failure.

'Certification Regarding Debarment, Suspension, Ineligibility, orVohmtary Exclusion for Covered Contracts'; and TDHS Form 2047 titled
'Certification Regarding Federal Lobbying', found in the Forms Section of the Food Distribution Handbook) from subcontractor. These
forms will be maintained for three years and 90 days after the end of the contracted period, or for three years and the close of the federal
fiscal year to which the contract pertains. The contractor further certifies and understands that failure to comply with this requirement
is a violation of the Food Distribution Program commodity contract and could result in termination of that contract.
D. The contractor certifies that if it is a corporation, it is either a non-profit corporation or is otherwise not subject to payment of franchise
taxes to the State of Texas.
E. The contractor certifies that all information submitted pursuant to this agreement is true and correct. The contractor understands that
deliberately misrepresenting or withholding information violates this contract and may result in prosecution under applicable state and
federal statutes.

The estimated cost to relocate our North Wellborn 6" Lateral, line # 151003 is $70,000. The
work would include rerouting approximately 2,735 feet of 6" pipeline and extending a 4"
pipeline 41 feet. The 4" pipeline ties into the 6" pipeline so we would have to relocate the valve
setting to a new location. The cost does not include removing the old pipe. We will purge it of
hydrocarbons, seal it with a pickling solution and abandon it in place.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Road in
Bra;os County, Texas as follows:
Starting at the intersection of FM 2154 and Dowling
Road in the town of Wellborn, GTE proposes to begin
placing a telephone cable in an existing 4" PVC pipe
that runs under FM 2154 and west along the north R.O.W.
of Dowling Road. We will be digging up the existing
4" PVC and placing four (4) 3X5 handholes every 1000'
from FM 2154 west on Dowling Road on the north R.O.W.
to the intersection of Dowling Road and.TGN Road.

The location and description of this line and associated
appurtenances is more fully shown by two (2) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights, franchise,
easement, license, authority, permission, privilege or right now
granted by law or may be granted in the future and any provision or
provisions so construed be null and void.
