Greens Prairie Road beginning approximately 51 feet from Woodlake Drive and extending
a distance of 70 feet. Site is located in Precinct 1.
26. Permission to enter Melvin D. Hartsfield's property located off Riley Road for the purpose
of excavating a drainage channel from Riley Road into the Hartsfield property to allow
water to drain from Riley Road and to build up roadway past tank dam to convect erosion.
Site is located in Precinct 3.
27. Request from GTE to place a buried cable in the right-of-way of Peach Creek Cut-Off
beginning approximately 1696 feet from SH 6 and extending a distance of 850 feet. Site
is located in Precinct 1.

COMMISSIONERS' COURT
REGULAR MEETING
APRIL 8, 1997
A regular meeting of the commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 3:00
p.m. on Tuesday, April 8, 1997, with the following members of
the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Wm. S. Thornton, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #96/97-21.1
through 21.5, which would reallocate funds budgeted for the
Jail, Environmental Protection, Narcotics Task Force and Non
Departmental; and set up a commodities budget in the Juvenile
Services Department. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

Commissioners Court meeting April 8, 1997
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following claims as
submitted by the County Treasurer for payment:
97-005378 through 97-005658
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to approve the County
payroll in the amount of $537,000.00 for the April 10, 1997
pay period.
The Court next considered a policy excluding Department
Heads and others hired into exempt positions from salary
increases after six months of satisfactory service. The
County Judge stated that he did not want the precedent to
continue. Jim Kuboviak, the County Attorney, stated that he
did not disagree for Department Heads but exempt employees
should not be penalized. This, he said is an incentive to
keep employees. If they do not complete the probationary
period then they will not work for the County. The increase
is a reward for completing the probationary period. Steve
Smith, Judge County Court at Law I, said he would hesitate to
deny exempt employees the increase. Elected Officials and/or
Department Heads need to have the ability to offer an
incentive to employees. The County Judge said he had not
thought it out sufficiently and offered to remove the item
from consideration. Commissioner Cauley said that the Court
could not micro-manage 500 plus employees. It is up to the
Department Head to use this good management tool. No action
was taken.
The County Judge read aloud a Proclamation designating
April as "Sexual Assault Awareness Month". The Court joins
with the local Rape Crisis Center in intensifying efforts to

promote public understanding of sexual violence and victims of
sexual violence. The County Judge then presented the signed
Proclamation to Ms Sherry Hostetter, representing the local
Rape Crisis Center.
The Court next considered salary survey proposals. In a
memo to the Court the Purchasing Agent indicated that she had
not been given a clear direction to proceed after the March 6,
1997 workshop. She recommended three (3) options. Those
being:
1) allow presentations from each of the
three (3) consulting firms who submitted
proposals;
2) award the contract based on the
content of the RFP itself;
3. reject all proposals received.
Commissioner Jones commented that since there was no
specifications list provided to the bidders, they did not have
something cohesive to bid on. Commissioner Sims stressed the
importance of having good job descriptions. Commissioner
Cauley recommended that the Court reject the RFP's and then
formulate guidelines (specifications) so that everyone is
bidding on the same thing. Commissioner Jones moved to reject
the RFP's. Commissioner Cauley seconded the motion and it
carried unanimously. Commissioner Jones then moved to draft
a list of specifications for the scope of work and then ask,
the bidders to resubmit proposals. Commissioner Cauley
seconded the motion and it carried unanimously. The County
Judge asked Commissioners Jones and Cauley to serve on a
committee to oversee the writing of the specifications. He
asked that Commissioner Sims serve as an alternate and that
the Purchasing Agent, Ruth McLeod and the Personnel Department
participate.
The Court next considered authorizing an increase in
funding for the health and life insurance for county
employees. This increase is necessary due to a projected
increase in the cost of claims. The Auditor's office

presented two (2) options. One being to increase the premiums
paid by employees for dependent health insurance and to
increase the amount paid by Brazos County for employee health
insurance by $57.50 per month per employee or to maintain the
premiums for dependent care and only increase the amount paid
by Brazos County. The second option would be an increase to
the County of $70.00 per month per covered employee. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to increase the County's monthly
allocation per employee from $250.00 to $320.00 per month,
with the funding to come from contingency.
The next matter for consideration was for authorization
for Brazos County offices and departments to obtain audio
visual training tapes from the Texas Association of Counties
and for the payment of the required insurance fee for their
return. On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the various departments and offices to obtain the training
tapes and pay the required insurance fee.
The Court next considered corrections to the personnel
budgeted and actual salaries listed for Jail Administration.
In a memo to the Commissioners Court, Jail Administrator,
Wayne Dicky pointed out that employee #1631 class 4032-8 was
currently budgeted for 2184 hours annually, however, the pay
record reflects 80 hours per pay period rather than the
budgeted 84. He asked that the correction be made and that
the necessary funds for the $1,020.00 shortfall be moved from
class 4032-7 to employee #1631 class 4032-8. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve the correction to the personnel
budgeted and actual salaries listed for Jail Administration.
The Court next considered the reappointment of the County
Judge to the Bryan-College Station Economic Development
Corporation Board of Directors. On motion by commissioner
Sims, seconded by Commissioner Cauley, the Court voted

unanimously to reappoint the County Judge to the Bryan-College
Station Economic Development Corporation Board of Directors.
The next matter for consideration was the approval of the
official bond for William S. Thornton, Commissioner, Precinct
2. On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the official
bond for William S. Thornton, Commissioner, Precinct 2.
The Court next considered the appointment of a County
representative to the Brazos County Housing Finance
Corporation. On motion by the County Judge, seconded by
Commissioner- Cauley, the Court voted unanimously to appoint
Commissioner Thornton to be a County representative to the
Brazos County Housing Finance Corporation. This action was
necessary due to the resignation of Commissioner Sandie
Walker.
The court next considered the appointment of a County
representative to the Brazos County Health Facilities
Development Corporation. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to appoint Commissioner Thornton to be a County representative
to the Brazos County Health Facilities Development
Corporation. This action was necessary due to the resignation
of Commissioner Sandie Walker.
The next matter before the Court was the appointment of
a liaison for the Brazos Center. On motion by the County
Judge, seconded by Commissioner Sims, the Court voted
unanimously to appoint commissioner Thornton to be the
Commissioners Court liaison for the Brazos Center. This
action was necessary due to the resignation of Commissioner
Sandie Walker.
The next matter for consideration was an Agreement
between the Social Security Administration and the Sheriff's
office for reporting Social Security SSI recipients that are
in jail. The Sheriff's office will provide the Social
Security Administration with a list of people that are

confined in jail during each month. The Social Security
Administration will then stop the SSI payments to individuals
meeting certain requirements. Should the individual remain
in jail for a full month, the Sheriff's office will then
receive an incentive payment. On motion by Commissioner
Cauley, seconded by the County Judge, the Court voted
unanimously to enter into Agreement with the Social Security
Administration for reporting Social Security SSI recipients
that are in jail. A copy of the Agreement is attached hereto.
The next matter for consideration was the authorization
for payment to Esmond Engineering for costs exceeding
contracted amount for engineering services. The County
Engineer informed the Court that he had received a letter
requesting withdrawal of the invoice, so no action would be
necessary.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held on February 18 and 25, 1997
on March 4, 11, 18, 1997 and a Workshop held on March 6, 1997.
On motion by Commissioner Jones, seconded by Commissioner
Sims, the Court voted unanimously to approve the minutes as

The Court next *considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge, Department requested
permission to enter the private property of Ivan Lorenz on
Dick Elliott Road in Precinct 2 to fill in a low area caused

The Court next considered the request from Wickson Creek
Special Utility District to relocate 1,400 feet of water line

The Court next considered the request from GTE to place
a road bore for buried cable installation in the right-of-way

tank dam in order to correct erosion. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to authorize the work.

The Court next considered the request from GTE to place

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of the following
requisitions from Capital Expenditures:
a) Memory for Road & Bridge GIS $1,000

On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
approve the requisition in the amount of $1,000 to
be paid from Capital Expenditures for the purchase
of memory for the GIS equipment at Road & Bridge.
b) Two (2) Water Pumps for Road & Bridge $459.98
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to
approve the requisition in the amount of $459.98 to
be paid from Capital Expenditures for the purchase
of water pumps for Road & Bridge.
The Court next considered approval of the following
requisitions from the General Fund:
a) Camera for Jail $399.95
On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to
approve the requisition in the amount of $399.95 to
be paid from the General Fund for the purchase of a

b) Electronic bird repeller for Environmental Services
$669.05

On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to
approve the requisition in the amount of $669.05 to
be paid from the General Fund for the purchase of
an electronic bird repeller for Environmental
Services.
There was no citizen input and/or concerns.
The County Judge made the following comments:

a) He informed the Court that Fred Forsthoff,
Director of Emergency Management had completed a
survey of the disaster hospital supplies and was
asking the Court to make a decision on the
disposition of the supplies.
b) He.asked for the status of the bills they had
divided up at the previous meeting.
Commissioner Thornton informed the Court that the
fraudulent liens bill passed with very minor
changes.
c) Tuesday, April 13, 1997 will be Chamber
Legislative Day in Austin.
d) Dennis Goehring will be putting on a Jail
Communications demonstration.
e) The CUC meeting will be April 9, 1997 in
Austin.
f) County Legislative Day will be April 16, 1997
in Austin.
g) The Commissioners Court meeting scheduled for
Tuesday, April 15, 1997 has been canceled.
h) He and the Auditor are working on the budget
process and will send the budget request forms out
on April 15, 1997.
At 4:29 p.m. the County Judge announced the meeting
closed to the public so that the Court could meet in closed
executive session to discuss acquisition of real property as
allowed under Section 551.072 of the Texas Government Code and
to discuss pending litigation as allowed under Section 551.071
of the Texas Government Code.

At 5:33 p.m. the County Judge announced the meeting open
to the public. On motion by the County Judge, seconded by
Commissioner Jones, the Court voted unanimously to authorize
Linda Muegge, Right-of-Way Agent, to negotiate with Mrs.
Jefferson on Jones Road and make the following offers:

a) Offer the payment of $3,666.00 which is the
established value of the property in question plus
offer a reversion clause.
b) offer the payment of $6,000.00 with no
reversion clause.
c) Return all property to its state prior to the
negotiations for the widening of Jones Road.
on motion by Commissioner Thornton, seconded by Commissioner
Sims, the Court voted unanimously to ratify and confirm the
action taken by the law firm of Bruchez and Goss on behalf of
Brazos County.
There being no further business to come before the Court,
the meeting was adjourned.

Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding

The following proceedings were held:
THAT WHEREAS, on April 8, 1997 the Court heard and approved a
budget amendment for the 1996-1997 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted August 8, 1996
the following amendment(s) to the original are hereby authorized,
as described on the attached page(s).
ADOPTED AND APPROVED this the 8th day of April 1997.

1. The TAC Safety Resource is a non-commercial audiovisual library to loan videos
and training programs for use in your safety training program.
2. Video and training program loans are made only after this form is completed and
on file at the TAC office.
3. You may call, mail or fax your request for videos or training programs. Items will
be shipped upon availability. There is a limit of 3 videos per order and a limit of 1
training program per order.
4. After use, please rewind the video. Make surf; that video and/or training program
is in the correct case. Please note any damage to the video or training program so
that it can be repaired before being sent out again.
5. There is a two week return policy on all videos and training programs unless
additional days have been requested. The videos and training programs must be
insured for 5400 each when returned in case lost or damaged during transit.
6. Copyright regulations prohibit any duplication or tampering of the videos. Anyone
violating the regulations may face a misdemeanor charge. This signed policy is
your agreement not to copy or videotape the program.

Subject- Memorandum of Understanding with Social Security Administration
This Memorandum of Understanding with the Social Security Administration will make the Brazos
County Sheriffs Office eligible to receive payments for reporting Social Security SS) recipients that
are in jail. Under the provisions of this agreement, the Sheriffs Office will provide the Social
Security Administration with a list of people that are confined in jail during each month. The SSA
will then take action to stop the SSI payments to individuals meeting certain requirements.
In circumstances were the Sheriffs Office reports confined individuals who are receiving SSI
payments and the individuals remain in jail throughout a full month, the County will receive an
incentive payment. The Sheriffs Office will become eligible for a payment of $400 if the confined
person is reported within 30 days and $200 if the confined individual is reported in 31-90 days.

Enclosed are two copies of the Memorandum of Understanding (MOU)
we talked about today. I need one copy back with original an
signature. Some items of interest to you in the MOU are:
- the first report should contain the names, SSNs, etc. of all
current inmates in your facility (page 4);
- each year an annual report is required of all inmates who
entered your facility during the year;
the incentive payment will be paid by direct deposit to the
account you designate on the form located behind the MOU;
we need the names of your personnel in Article IX, D., E.,
and F. (page 8);
we will be able to tell you which SSNs you report are
assigned to the person reported, but the Privacy Act
prevents us from telling you which persons are actually
receiving a monthly benefit check.

AGREEMENT BETWEEN
THE SOCIAL SECURITY ADMINISTRATION
AND THE
Brazos County Sheriff's Office, Brazos County, Texas
Article I, Purpose & Legal Authority
•
This agreement is entered into by the parties in accordance with
section 1611(e)(1)(I) of the Social Security Act (the Act). The
agreement provides the terms and conditions under which the
reporting entity (Reporter) will provide to the Social Security
Administration (SSA) information about certain confined
individuals, on its own behalf and/or on behalf of other
facilities/institutions for whom it will report as identified in
Article III B.1 of this agreement and under which SSA will pay
facilities/institutions for information that results in the
suspension of payments to certain confined individuals receiving
Supplemental Security Income (SSI) payments under title XVI of
the Act, 42 U.S.C. 1381 et sue. The responsibilities of each
party to the agreement are also provided.
Title XVI of the Act sets forth the conditions under which
individuals are eligible for SSI payments.
Section 1611(e)(1)(A) of the Act provides, with certain
exceptions, that an individual shall not be eligible for SSI
payments for any month throughout which he or she is an inmate of
a public institution. '
Section 1611(e)(1)(I)(i) of the Act authorizes SSA to enter into
an agreement described in that section with a specified type of
interested State or local institution (such as a jail, prison, or
cther penal institution or correctional facility or other
institutions in which people are confined by court order at
public expense). Section 1611(e)(1)(I) of the Act provides the
general terms and conditions under which, pursuant to the
agreement, the Reporter will provide information about confined
individuals to SSA.
Section 1611(e)(1)(I)(ii) exempts this agreement, and information
exchanged pursuant to this agreement, from the provisions of the
Privacy Act, 5 U.S.C. 552a, including those relating to computer
matches.
Article II, Definitions
E
A. "Confined individuals" are individuals who are confined to a
facility/institution described in Article I of this agreement
under authority of law at any time during the period covered
by this agreement.

B "Disclosure" means the release of information (data) with or
without the consent of the individual(s) to whom the
information pertains.
C. "Facility Identification Code" means the six digit code that
SSA will assign to a facility or institution which confines
• individuals and is covered by this agreement. This code must
be furnished with each submission of inmate data to SSA
concerning the facility/institution's confined individuals in
order for SSA to process any incentive payments due the
facility/institution under this agreement.
D. "Record" means any item, collection, or grouping of
information about an individual that is maintained by an
entity including, but not limited to, the individual's
criminal history, name, Social Security number (SSN), date of
birth, gender, date of confinement, place of confinement and
prisoner or inmate status.
E. "Reporter Identification Code" means the four digit code
assigned by SSA to the Reporter that is party to the
I agreement and that will report information on its own behalf
and/or on behalf of. other facilities/institutions identified
in this agreement.
F. "Throughout a month" means that an individual is confined in
an institution as of the first instant of a calendar month
and stays through the last instant of the month.
Example 1: If an individual enters an institution on April
30 and is released on June 3, the individual would be
confined throughout May.
Example 2: If an individual enters an institution on May 1
and is released on June 30, the individual would not have
been confined in an institution throughout either May or
June.
Under the SSI program, an individual who is confined in a public
institution is considered as remaining confined in a public
i institution if he is transferred from one such institution to
I another or if he is temporarily absent for a period of not more j
f than lei consecutive days. Also, an individual is considered
confined in an institution throughout a month if he is confined
in the institution as of the beginning of a month and dies in the
institution during the month.
Article III, Description of Records to be Matched
A. General
1. The Reporter will identify confined individuals for SSA.

2. SSA will determine which of these confined individuals are
receiving SSI payments.
B. Source of Reporter Records
1. These records are compiled from the Brazos County Jail
(list all of the facilities/institutions that are covered
by this agreement).
2. The following are the data elements that the Reporter
must provide for confined individuals:
a. Social Security number (provide all numbers the
individual has been known to use);
b. Name (provide all names the individual has been known
to use);
C. Date of birth (known or alleged);
d. Confinement commencement date;
e. Such other identifying information as designated in
the attached guide; and
f. Facility identification code.
3. All records will be prepared and transmitted as
prescribed in Article IV with clear identification of the
facility/institution that is the source of such records.
C. SSA Records
SSA will match the data from the Reporter for the purpose
described in this agreement. The data will be matched
against the Supplemental Security Income Record (SSR)
HHS/SSA/OSR 09-60-0103.
Article IV, Functions to be Performed
The information on confined individuals must be provided
electronically (i.e., a computer tape, cartridge, or diskette).
Compliance with this specification is mandatory. SSA will allow
the Reporter 12 months from the effective date of this agreement
to comply with this specification. During this 12-month period,
SSA will accept paper reports from the Reporter. SSA will not
accept paper reports for the purpose of this agreement after the
12-month period.
The Reporter agrees that it will furnish SSA with an electronic
file (or paper reports if appropriate) containing the data
elements listed in Article III B.2 above on individuals whose

confinement commences on or after March 1, 1997. The first
submission of data, whether done electronically or by paper, will
be a total inmate population report. After the first report,
these files are to be submitted for each calendar month with data
only for those individuals who are admitted to the
facility/institution at any time during the period from the first
day of the reporting month to the last day of such month.
In addition to the first submission of the total inmate
population and the subsequent monthly reports required under this
IPMOU, SSA requests the Reporter to submit, at the end of each
calendar year, a complete list of all inmates who entered the
facilities/institutions for whom it reports. SSA will use this
annual report to identify inmates who may have filed for SSI
after a Reporter's monthly report or whose application for SSI
payments had not been adjudicated at the time the data was
processed. Compliance with this request helps SSA in its efforts
to ensure that SSI payments are made only to those eligible under
the law. Incentive payments will be paid, based on the
provisions in this IPMOU, if SSI payments are suspended as a
result of data exchanged in the annual report.

The instructions for creating the electronic file are attached.
Once the SSN is validated, and the identity of the confined
individual is verified based on SSA's records, SSA will:
1. Determine if the individual is receiving SSI;
2. Verify that the individual has been confined throughout a
calendar month;
i 3. Notify the individual of the suspension action and provide
! the individual with an-opportunity to contest the planned
action under applicable regulations;
4. Suspend SSI payments as required by law;
5. Pay the appropriate facility/institution as specified under
Article V.

Article V, Incentive Payment Process
In accordance with section 1611(e)(1)(I)(i)(II) of the Act, SSA
will pay an incentive payment to a facility/institution covered
by this agreement for information on a confined individual which
the Reporter furnishes to SSA within the time periods specified
below, provided that the confined individual is:
o Eligible for an SSI payment for the month preceding the first
month throughout which the confined individual is in such
facility/institution; and
o Determined by SSA to be ineligible for an SSI payment for such
first month as a result of the information provided by the
Reporter under this agreement.
SSA will pay such facility/institution:
0 $400 if the Reporter furnishes the information on a confined
.individual described above to SSA within 30 days after the
date the individual's confinement in such facility/institution
begins; or
0 $200 if the Reporter furnishes such information to SSA after
30 days after such date but within 90 days after such date.
If SSA cannot validate the SSN of a confined individual, no
further action will be taken by SSA.
SSA will not pay an incentive payment for information concerning
a confined individual if, prior to SSA's receipt of the
information, SSA has already determined that the individual is
ineligible for SSI payments.
Payments made by SSA under this agreement represent incentive
payments accruing as a result of SSA's efforts in processing the

data provided pursuant to this agreement when such data results
in the suspension of SSI payments to confined inmates. The time
to complete the verification process, any case development
necessary to determine whether an individual's SSI payment must
be suspended and the time to complete the due process
requirements that must be accorded an individual subject to a
suspension action may vary from case to case and may represent
several months.
SSA will pay incentive payments to a facility/institution on a
monthly basis by electronic transfer of funds. The facility/
institution will name a financial institution and provide the
information required on the attached Automated Clearing House
(ACH) Vendor/Miscellaneous Payment Enrollment Form (SF 3881) to
receive its incentive payments by electronic transfer of funds.
SSA will provide the Reporter with a notice of the amount of the
incentive payment, the payment date and the total number of
suspended individuals. Disputes involving these incentive
payments will be considered by•the Regional Prisoner Coordinator
designated in Article IX. The Reporter should forward a written
request describing the dispute in detail to the Regional Prisoner
Coordinator designated 'in Article IX within 30 days of its
receipt of the relevant incentive payment notice.
Article VI, Records Usage, Duplication and
Redisclosure Restrictions

SSA agrees to use the information provided by the Reporter only
to determine which of the confined individuals are receiving SSI
payments and to suspend these SSI payments as required by law.
SSA will adhere strictly to the provisions of section
1611(e)(1)(I) of the Act in any usage, duplication, or
redisclosure of information provided by the Reporter under this
agreement.
As required by section 1611(e)(1)(ii)(II) of the Act, SSA may
redisclose the information obtained pursuant to this agreement to
any Federal or Federally assisted cash, food, or medical
assistance program, for eligibility purposes.
Article VII, Notice, Verification and Opportunity
to Contest
SSA agrees to verify information obtained under this agreement
prior to initiating any adverse action against an individual.
Pursuant to its applicable SSI regulations, SSA will inform the
individual by written notice that it has received specified
information indicating that the individual is confined under the
jurisdiction of a named prison system or is an inmate of a public
institution throughout a calendar month beginning March, 1997 and
that, by law, SSI payments must be suspended. SSA will afford

the individual the opportunity to contest and submit information
concerning the planned action and to appeal a determination by
SSA to suspend SSI payments in accordance with applicable
regulations.
Article VIII. Term of the Agreement
This agreement supersedes any previous agreement(s) between SSA
and the facility/institutions identified in this agreement
effectuating the exchange of prisoner information for the purpose
of enforcing section 1611(e)(1)(A) of the Act.
This agreement shall be effective upon the signatures of both
parties and shall remain in effect until terminated by either of
the parties. The agreement may be terminated upon written
notification by either party 90 days in advance of the
termination date.

I. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the nght-of-way
line
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc from County right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test
Method No. D-698, test shall be conducted by an independent Geotechnical
testing firm, copies of all test results shall be furnished to the office of the
Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of a County Roads in
Brazos County, Texas as follows:
Beginning at a point 51' northwest of the junction
of Greens Prairie Road and Woodlake Drive, 51' of
buried cable will be placed southeast at 5' within
the northeast R.O.W. of Greens Prairie Road; then
a 70' road bore will be made southeast across Greens
Prairie Road; then buried cable will continue for 19'
northeast at 5' within the southeast R.O.W. of Greens
Prairie Road.
The location and description of this line and associated
appurtenances is more fully shown by two (2) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights, franchise,
easement, license, authority, permission, privilege or right now
granted by law or may be granted in the future and any provision or
provisions so construed be null and void.
Construction of this line will begin on or after July' 30,
1997.
