COMMISSIONERS' COURT REGULAR MEETING APRIL 1, 1997 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 3:00 p.m. on Tuesday, April 1, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Wm. S. Thornton, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. 'Attached 'is a list of the citizens and officials in attendance. Commissioner Cauley gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns, the following comments were made: Demetrios Basdekas - shared some information he received from TxDOT regarding county bridge AAO- 169-005 located on old Reliance Road. The Court next considered Budget Amendment #96/97-20.1 through 20.2, which would create a line item within the Permanent Improvement Fund for professional services and reallocate funds budgeted for the MPO's Department. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the budget amendment as submitted, a-copy of which is attached hereto. i . 1 F' Commissioners Court meeting April 1, 1997 The Court proceeded to consider the change of status of the following employees. Commissioner Sims seconded the motion. Commissioner Sims then questioned the County Auditor about bringing in and employee I at a step 2 and asked if there would be a six (6) month increase. The Auditor said that there would not. The County Judge offered an amendment to the motion and second to approve an increase of 4% for the Risk Manager rather than the 6.3% submitted. Commissioner Sims agreed to the amendment but Commissioner Cauley did not amend his motion to include it. The County Judge then asked for a vote on accepting the changes as submitted. Commissioners Cauley and Jones voted "Aye". Commissioner Sims and the County Judge voted "No" and Commissioner Thornton abstained. The motion did not carry. The County Judge then moved to approve the changes but to amend the change for the Risk Manager to a 4% increase from the 6.3% originally submitted. Commissioner Sims seconded the motion. Commissioner Sims and the County Judge voted "Aye". Commissioners Cauley and Jones voted "No" and Commissioner Thornton abstained. The motion did not carry. The County Judge the began considering the changes by department. Commissioners Court - On motion by the County Judge, seconded by Commissioner Jones, the Court voted unanimously to approve the changes as submitted. ,f. W. "Bill" Jeanes, Jr. - Commissioner Cauley moved to approve the change as submitted. Commissioner Jones seconded the motion. Commissioner Cauley voted "Aye". Commissioners Jones, Sims and the County Judge voted "No". Commissioner Thornton abstained. Risk Management - A. W. "Bill" Jeanes, Jr. Commissioner Jones moved to approve a 4% increase in salary. Commissioner Cauley seconded the motion. Commissioner Jones, Sims and Cauley voted "Aye". The County Judge and Commissioner Thornton abstained. SO/Jail - On motion by the County Judge, seconded by Commissioner Cauley, the Court voted unanimously to approve the change as submitted. Tax Office/County Attorney - On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to approve the change as submitted. • • Tax Office - On motion by Commissioner Sims, -seconded by Commissioner Cauley, the Court voted unanimously to approve the change as submitted. The Court next considered the ' following Claims as submitted by the County Treasurer for payment: 97-005202 through 97-005377 On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Claims as submitted. The Court next considered approval of the Preliminary Plat of Macy-Bundick Subdivision in Precinct 2. Richard Vance, County Engineer, stated that he had reviewed the plat and there was only a very minor change. On motion by Commissioner Thornton, seconded by Commissioner Sims, the Court unanimously approved the Preliminary Plat of Macy- Bundick Subdivision. The Court next considered the request from GTE to place ; buried cable in the right-of-way of Smetana Road beginning ; approximately 385 feet south of Lucy Ellen Parkway and extending for a distance of 489 feet. The site is located in I Precinct 4. The County Engineer stated that all appeared to be in order and recommended approval. On motion by i f Commissioner Cauley, seconded by Commissioner Sims, the Court i voted unanimously to approve the request from GTE and AZZd Commissioners Court meeting April 1, 1997 authorized the installation. A copy of the request is attached hereto. The Court next considered authorizing work outside of county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Eunice E. Williams on Graham Road in Precinct 1 to clear brush and trim trees for site distance. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered the request from' Texas Utilities Fuel Company to install steel pipe casings around six (6) locations of their existing 24 inch old Ocean Pipeline where it crosses Enloe Drive, Woodale Circle, and Barnes Road in Heritage Hills Subdivision and Westway Road and J. C. Long Drive in Lakewood Estates Subdivision. The site is located in Precinct 4. Included with the request is company check #102413 in the amount of $3,000.00. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the request from Texas Utilities Fuel Company and authorized the installation. A copy of the request is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to appoint Pat Hiler to serve on the Brazos County Historical Commission until December 31, 1998. The Court next considered entering into Agreement with the Brazos Animal Shelter to operate a rabies control program utilizing people and equipment interacting closely with the animal shelter. This is in compliance with Chapter 826, the Rabies Control Act of the Texas Health and Safety Code that expressly authorizes agreements of this nature. In exchange for services, Brazos County will pay the Animal Shelter $1,500.00 in three quarterly payments for the balance of fiscal year 1996-1997. Thereafter, the Animal Shelter will submit an annual operating budget to the County. On motion by Commissioner ::auley, seconded by Commissioner Sims, the Court voted unanimously to enter into agreement with the Animal Shelter and authorized the County Judge to execute the Agreement on behalf of Brazos County. A copy of the Agreement is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Jones, the Court voted unanimously to adopt a Resolution of the Commissioners Court authorizing the submission of a Texas Community Development Program application to the Texas Department of Housing and Community Affairs for the Community Development Fund and authorizing the County Judge to act as the County's executive officer and authorized representative in all matter pertaining to the County's participation in the Community Development Program. This is for the Wixon Creek Special Utility District water system improvements project. A copy of the Resolution is attached. VOL...,.11......:P A Q F, :.`~14 6 ~w f Commissioners Court meeting April 1, 1997 On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to appoint Commissioner Jones to fill the vacancy on the Brazos Valley Development Council Board created by the resignation of Sandie Walker. Commissioner Jones will serve out the unexpired term which ends September 30, 1998. On motion by the County Judge, seconded by Commissioner • Sims, the Court voted unanimously to appoint Commissioner Thornton to fill the vacancy on the Board of Directors of Brazos Beautiful created by the resignation of Sandie Walker. The Court next considered a request from the County Clerk for the reallocation of funds from Class No. 8065, Position 4, to Class No. 8066, Position 1. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the request from the County Clerk to reallocate funds from Class No. 8065, Position 4, to Class No. 8066, Position 1. The Court next considered approval of the amended January 1997 Treasurer's Report and the February 1997 Treasurer's Report. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve -the amended January 1997 Treasurer's Report and the February 1997 Treasurer's Report. A copy of which is attached to and made a part of these minutes. The Court proceeded to consider the following blanket Purchase Orders: Advantage Rental Juvenile Sefvices $1,000 B.I.S.D. Timmons Task Force $ 700 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Blanket Purchase Orders as submitted. The Court next considered approval of the following requisitions from Capital Expenditures: a) Hardware Upgrade for GIS for Road & Bridge $1,009.00 a i Commissioners Court meeting April 1, 1997 b) 710V2 Monitor for Auditor - $549.00 • c) Deskpro 5133-2000 for Auditor - $1,118.00 d) Samsung 3NE Monitor for Auditor - $264.00 e) Microsoft Office Pro 97 License for R&B $594.00 f) Combination TV/VCR for County Court at Law 2 - $335.00 g) One high-speed floor burnisher for Brazos Center - $519.00 h) 15 gallon shop vac for Brazos Center - $299.52 On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to approve items a through g, table item h and to pay for the purchases from Capital Expenditures. Brenham Bottom Ash 3100 Loaded N/B $2.00/ton Loaded/Hauled $11.36/ton FOB Plant Minimum Order Yes No Required Amt. 20/ton Delivery (days) 3 1 Cheryl Turney, Purchasing Agent, recommended acceptance of the bid submitted by JTM Industries. Bid No. 97-030 - Recommendation for Excess Risk Insurance Cheryl Turney, Purchasing Agent stated that she met with Randy Sims and Ruth McLeod on Thursday, March 27, 1997 to review and evaluate the bids received for Excess Risk Insurance, Bid No. 97-030. They unanimously agreed that it would be in Brazos County's best interest to maintain the current stop loss insurer, Life of Georgia submitted by Plumhoff & Associates. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract for Bottom Ash to JTM Industries of Brenham, Texas and to reject all bids received for Excess Risk Insurance. The Court next considered the annual subscription agreement for a DTN Weather Center Lease for the Road & Bridge Department. This is a weather information computer system that is leased at a cost of $68.00 monthly. On motion by commissioner Sims, seconded by Commissioner Cauley, the Court L Commissioners Court meeting April 1, 1997 r voted unanimously to authorize the County Judge to execute the Subscription Agreement. A copy of the Agreement is attached hereto. The Court next considered an Exemption from Competitive Bidding Requirements of Local Government Code, Section 262.024(a)(7)(A). This is for the purchase of System "Z" Source Code for Justice of the Peace Case Management Software from Multi-Information Systems, Inc.. The Commissioners' Court determined that this was a single source supplier. on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the Exemption of Competitive Bidding Requirements and authorized payment for the software in an amount not to exceed $25,000.00. There was no citizen input and/or concerns. Commissioner Jones made the following comments: a) He asked-the County Judge about consolidating committee assignments and asked for a list of committees that each Commissioner serves on. b) Commissioners Jones, Sims and Cauley will be traveling to Austin to testify before a subcommittee on a bill allowing the Court to meet- in places other than the Courthouse. c) He introduced Sarah Wirt, Field Representative from the Texas Association of Counties.- The County Judge made the following comments: a) He referred to a letter from Jim Allison dated March 27, 1997 in which Mr. Allison outlined those bills pending before the legislature that will affect the County. He asked the Commissioners to select several of the bills to work on individually so that the Court can inform our legislators of its stand on these issues. b) He referenced a letter from Jim Lewis about collecting fines. c) He received a letter from Jack Crump concerning unannounced jail inspections. The cable will extend north for a distance of 489' at a depth of 30". The location and description of this line and associated appurtenances is more fully shown by four (4) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws. Notwithstanding any other provision contained herein, it is expressly understood that tender of this notice by the GTE Southwest Incorporated does not constitute a waiver, surrender, abandonment of impairment of any property rights, franchise, easement, license, authority, permission, privilege or right now granted by law or may be granted in the future and any provision or provisions so construed be null and void. Construction of this line will begin on or after April 7, 1997. This work will include excavating an open trench across the county road to expose our pipeline. Road detours and closures will be coordinated with the Commissioner's Court, local residents and businesses. Enclosed are permit applications along with location maps and descriptions of the work. A check in the amount of $3,000 is also enclosed as payment for the applicable fees for the six crossings. The work will be staggered to work with local residents as practical so that construction at one road crossing will complete before construction on the next begins. The casings will extend two feet beyond the limits of the county road right-of-way. The basic procedure for installing a split casing will be as follows: 1. Acquire county permit. 2. Notify the jurisdictional County Commissioner prior to the commencement of work. Also, inform and notify affected land owners of work schedule and set up road construction signs as specified by the jurisdictional county commissioner. 3. Expose the carrier pipe at the road crossing by excavating a trench approximately ten feet outside the width of the right-of-way. 4. Remove old pipe coating, clean and re-coat the exposed pipe. 5. Install centralizers on the carrier pipe at the road crossing. 6. Cut a 30" diameter pipe approximately four feet longer than the width of the road right- of-way, then split the 30:' precut pipe lengthwise. 7. Place the two halves of the 30" pipe around the carrier pipe. 8. Weld the two halves together on each side along it's entire length. 9. Install vent pipes at each end of the casing. 10. Install end seals. 11. Backfill the trench, compact the backfill, resurface the pavement to match existing road surface, re-work slopes and ditches, seed and mulch the right-of-way according to county specifications. 12. Paint the vent pipes and hang TUFCO gas pipeline warning signs. Rabies Control Services: "Rabies Control Services" shall mean the services provided by the Corporation in accordance +vitli tt~e hereinabove GRANT that are necessary to effectively carry out an rabies control program for the un-incorporated county. These services shall include; but not be limited to tl~e conduct of rabies control cases throughout the un- incorporated county, apprehension of animals found to be in violation of the state rabies control statutes, and all associated administrative duties. B. Animal Slrcltcr: "Animal Slrcltcr' shall mean the facility known as the Brazos Animal_ Slrcltcr, currently located at 2207 Finfcatlter Road in Bryan, Brazos County, Texas drat keeps or Icgall}• impounds str~ry, lrorncless, abandoned, un++•antcd animals, or quarantine animals. C. Count}•: "County" shall mean Brazos County with its corporate oRices located at Brazos County Courthouse, 300 E. 2G~' ST., Br}•an, Brazos County, Texas. D. Corporation: "Corporation" shall rncan the Texas non-profit corporation known as flit Bravos Animal Slrcltcr and with its primary business office at 2207 Finfeather Road in Bryan, Bravos County, Texas. E. Any ++•ords or phrases not specifically defined herein shall have as their rncaning the ordinary and commonly understood meaning except for specific animal control or veterinary tcrnrs. , III. Corporation shall contract and purchase from its o+vn budgeted funds all supplies, equipment, materials and services, including professional services, necessary to provide _ rabies control services for County. Tlrcrcaticr, Corporation shall prepare an annual opcrrting budget in accordrnce ++•itlr County's budget guidelines and submittal schedule. Said funds shall be paid to Corporation quarterly throughout the budget ya~r. County understands and agrees that the Corporation . ~ also has other funding sources and County shall not require such funds to utilized for Count}• services, the intent being drat County funds shall be annually appropriated for its ~ own needs distinct from overall Corporation needs or funding. - ~ - ~ - ~ i ' ' i ~ ~~~~~7~i . . , - , ~ • :a; ti, \i 0 0 A Corporation and County agree that all expressly budgeted funds and other revenues generated from the provision of rabies control services, shall be deposited in the Corporation's operating accounts. Corporation agrees to pay for all rabies control services from these accounts. All funds designated for rabies control shall be deposited in the name of and to the credit of the Corporation with such depositories as shall from time to time be designated by the Corporation in accordance with law. Any payments made by Corporation shall only be made in accordance with generally accepted accounting practices with appropriate accounting codes arc established so that an annual audited account of funds expended can be provided to the County. Corporation shall maintain separate account records of all rabies control expenditures and funds. Account records shall be open to inspection at any reasonable time by County. Corporation shall submit an audited financial report of rabies control activities annually. Corporation shall not borrow money nor shall it approve any fund expenditure for claims nor incur any obligation on behalf of Brazos rabies control operations unless there is sufficient unencumbered cash in the appropriate fund credited to the Corporation with which to pay the same. Except pursuant to a mutual written agreement to terminate this contract, any individual party electing to terminate its participation in this agreement shall and hereby does forfeit its part of any contingency or capital improvement funds accrued. F. Reports: Corporation shall submit a comprehensive annual report of all rabies control activities to County within thirty (30) days of the close of each fiscal year. Corporation shall provide to County upon request a copy of any other report which it may be required to prepare and submit to any federal., state or other local jurisdiction in the course of its rabies control activities. Corporation shall also render to County reasonable intervals, such reports and accounting as County from time to time require. G. Default- In the event County fails to appropriate funds to supportapproved and required capital, operating costs or other programs mutually agreed upon. Corporation shall cause written notice to be given of its intent to terminated this agreement unless County complies with the provisions of the agreement and eliminates written notice. If County fails to eliminate the cause for default, Corporation shall return the responsibility for rabies control functions to the County in accordance with paragraph E lereinabove. H. Tcrm: This agreement shall be effective for a period of one year (1) from and after the date of execution by both parties. The Agreement shall automatically rene%v itself annually tliereafter except upon sixty (60) days prior written notice at any time of either parry. Prior to the first anniversary date this agreement may be terminated by mutual written consent of the parties. If such termination occurs, assets, equipment, and personnel may be returned to the County in accordance with paragraph E hereinabove. If this agreement is terminated by mutual agreement prior to the completion of its first tern, any improvements tmade to the animal shelter shall become the property of the Corporation. All costs and liabilities incurred by the Corporation on behalf of the County prior to the termination shall be the responsibility of the County.. VUL I 1. Insurance: Corporation shall at all times relevant to the fulfillment of this Agreement have, keep, and maintain insurance protecting itself, with County as an additional insured, and covering general public liability, worker's compensation if required by State law, and automobile public liability. The General Public Liability insurance shall have as its minimum limit for bodily injury not less than $300,000.00 per person and $500,000.00 per occurrence and for property damage not Icss than $100,000.00 per occurrence. Automobile Public Liability insurance shall be continuously held with limits for bodily injury liability of not less than $250,000.00 per person and $500,000.00 per occurrence and for property damage of not Icss than $100,000.00 on all self-propelled vehicles used in connection with the animal control operation, whether o%%-ned, non-owned or hired. Copies of certificates evidencing such insurance as herein required shall be sent to the County for its records. All certificates shall rcncct that no change in policy amounts or coverages shall occur upon 30 days prior written notice to County. J. Amendments: This agreement may be amended at any time by mutual consent of both parties and subject to the approval of lie County Commissioner and Animal Shelter Board of Directors. K. As a part of this Agreement, there arc certain schedules attached hereto for Services Goals, Capital, Statistical reports, etc. These schedules arc incorporated herein by this reference hcrcto for all purposes by the parties and form a part of the overall agreement. IV. GENERAL PROVISIONS . A. Scvcrability Clausc: The parties intend for tic various provisions of this agreement to be severable so that the invalidity, if any, of any one section (or More) shall not affect the validity of the remaining provisions or sections. B. This document may be executed in any number of original signature counterparts, cacti of which shall for all purposes by deemed an original, and all such counterparts shall constitute one and the same document. C. Each of tic parties hcrcto cxprcssly warrants that in the execution hereof, it has obtained the full authority of any required governing authority and, by its execution hereof, intends to bind same. D. Corporation agrees to retain any records it makes in compliance with this Agreement for a period of three (3) years aficr the ultimate termination of tlae contract. E. This Agreement shall be interpreted in accordance with the law of the State of Texas and in Brazos County, Texas. Any animal seized shall be delivered to the Animal Shelter, or to a local Veterinarian for rabies quarantine. 2. County shall pay fees for rabies control services. Said payments shall be credited by Corporation toward any budgeted funds appropriated and paid by County to Corporation. 3. All reports or financial statements shall be submitted to County in a form as approved by County. 4. Corporation shall provide administration, management, and supervisory support for the rabies control program for County. This shall include training and licensing responsibilities. 5. At all times, County shall provide budget support for up to 50 rabies control cases. Should rabies control case load exceed 50 cases in fiscal year 96-97, Brazos Animal Shelter would bill on a per case bases $30.00 per hour. 6. Corporation will provide 24 hour dispatch for rabies control for un-incorporated Brazos County. -7. County shall provide Sheriff "back-up" support for all emergency or dangerous situations at the request of Corporation. 8. County and Corporation agree that Brazos County Sheriff shall provide livestock control in un-incorporated Brazos County. 9, All cases not involving animal bites and scratches will be informed that there is no comprehensive animal control for Brazos County.
