REGULAR MEETING
MARCH 11, 1997
A regular meeting of the commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 3:00
p.m. on Tuesday, March 11, 1997, with the following members of
the Court present:
Alvin W. Jones, County Judge, Absent;
Tony Jones, Commissioner of Precinct 1, Absent;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3, Presiding;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Cauley gave the invocation' and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment #96/97-17.1
through 17.3, which would reallocate funds budgeted for the
Building Maintenance department, Auditor's office. and increase
the budget of Constable Precinct 5. On motion by Commissioner
Cauley, seconded by Commissioner Walker, the Court voted
unanimously to approve the budget amendment as submitted, a
copy of which is attached hereto.
The Court proceeded to consider the change of status of
the following employees.

Commissioners Court meeting March 11, 1997
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
97-004523 through 97-004756
On motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to approve the Claims as
submitted.

On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the County payroll in the amount of $541,000.00 for the March
13, 1997 payroll.
The court next considered a request by the Justice of the
Peace to acquire a Court Management Software Program. Justice
of the Peace Precinct 7 Place 1, George Boyett was the
spokesman for the group of Justices. He explained the
problems they are facing with several programs being used
simultaneously. On motion by Commissioner Walker, seconded by
Commissioner Sims, the Court voted unanimously to authorize
the Justices of the Peace to go out for RFP's with
consultation being provided by the Computer/Network Services
Department and to form a committee composed of Judge Boyett,
Judge Truelove, M. J. Deen, John Reynolds and Commissioner
Cauley to study the situation.
On motion by Commissioner Cauley, seconded by Commis-
sioner Walker, the Court voted unanimously to authorize the
County Judge to execute a Tax Resale Deed to the following
individual:
Jocklyn Wallace - Lot 1, in the Figgures Tract as
described in Volume 119, Page 267, Deed Records of
Brazos County, Texas.
The Court next considered approval of a requisition from
Capital Expenditures for the purchase of a refrigerator for
the County Court at Law I office. Cost of the refrigerator is
$455.00. On motion by Commissioner Walker, seconded by

the requisition in the amount of $455.00 to be paid from

On motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered awarding the following bid:
Bid No. 97-033 Sheriff Office Uniforms

Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by R&R Uniforms. On motion by
Commissioner Walker, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to R&R Uniforms. A copy of the
bid tabulation is attached hereto.
The court next considered the request from Fairview
Smetana W.S.C. to place a 2.0 inch road bore in the right-of-
way of Enloe Drive approximately 900.0 feet southwest of J.C.
Long Drive for water line installation. The site is located
in Precinct 4. The County Engineer stated that all appeared
to be in order and recommended approval. On motion by

Gathering System and authorized the installation. A copy of
the request is attached hereto.
The Court acknowledge receipt of the Financial Report for

On this the 11th day of March 1997 at a regular meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on March 11, 1997 the Court heard and approved
a budget amendment for the 1996-1997 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted August 8, 1996
the following amendment(s) to the original are hereby authorized,
as described on the attached page(s).

SOURCE OF FUNDS: N/A
1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be Installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees
etc. from County right-of-way.
D) Ditch line shall be compacted to 90% standard density ASTM-Test
Method No. 0-698; test shall be conducted by an independent Geotechnical
testing firm; copies of all test results shall be fumished to the office of the
Brazos County Engineer.
E) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

The location or description of the proposed Installation is more fully shown by
copies of the drawings attached to this notice.
I understand and agree that:
1. The County Engineer must be notified 72 hours prior to the beginning
of construction In order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.

4. That Brazos County is in no way responsible for any damage that might
occur to any existing utility lines In the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.

borrow ditch.

System proposes to place n (type) pipeline within lite right-of-wny of
(road) ~ ~ A - - „0_ in Brnzos County, Texas as follows:
The location or description of the proposed insinllalion is more fully shown by one copies
of the drawings attached to this notice.
I. The County Engineer must he notified prior to the beginning of constriction in order that
they might he on hand in designate the actual location of Ilia installation.
2. 71uat all damage to the rnndways and rights-of-way will he repaired to their original
condition to the satisfaction of the County Engineer.
3. That BRAZOS COUNTY reserves ilia right to require Applicant to relocate or lower any
such line at no coat to BRAZOS COUNTY, should same become necessary due to
widening or lowering, or other alteration of the roadway or right-of-way.
4. That BRAZOS COUNTY is in no way responsible for any damage that might occur to
any existing utility lines in lite right-of-way.
5. That the line will 'be cnnsinicted and maintained on the county right- of-way in
accordance with governing laws.
6. That the line or lines will he constructed no less than forty-eight inches (48') lower than
the lowest part of the drainage or liar ditch and else drainage to to be considered at least
two feet (2') below the center of the roadway.
7. That all roads shall he bored in accordance with Ilia Utility Aceomodation Policy of the
Texas Department of Transportation dated 1989.
8. Tliat all sites will be harricaded during construction period.
9. That the normal charge it( $500 per crossing and/or $40 per rod when paralleling ilia
roadway established by clue Commissioners' Court on January 28. 1985.
10. Ditch line shall he compacted en 90% standard density ASTM-Test method No. D-698;
test shall be conducted by an independent Geotechnical testing firm; copies of all test
results shall be furnialied Ie the ollice of the Brazos County Engineer.
11. Constriction shall he strict conformance to the latest Texas Manual on Unifonn
Traffic Control Devices for Streets and Highways, published by the Texas Department
of Transportation, and all other State and Federal laws governing utility construction.
