' I a, . _ ' JLSC - ..4 . r ~ _ H. roti • r ~1~r ' i,,~ ~ .i', r' y" 1 ~1 • • , 11 • COMMISSIONERS' COURT REGULAR MEETING MARCH 4, 1997 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 3:00 p.m. on Tuesday, March 4, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4, Absent; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Sims gave the invocation and led the pledge of allegiance. Under citizen's input and/or concerns, the County Judge presented Ray Crow, representative of the Road & Bridge department, with a Texas Flood Plain Management Association Certificate designating him as a Certified Floodplain Manager. This is a professional development and certification program designed to recognize the knowledge and technical skills of the state's floodplain managers. There are only'25"certified flood plain managers in the State of Texas. The Court next considered Budget Amendment #96/97-16.1 through 16.3, which would reallocate funds budgeted for the Constable Precinct 7 Department; set up two line items in Juvenile Services one for reimbursement and the other for donations. On motion by Commissioner Sims, seconded by Commissioner Walker, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. VO L- 6 . The Court proceeded to consider the change of status of submitted by the County Treasurer for payment: 97-004324 through 97-004522 On motion by - Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as -submitted. The Court next considered the following Claims as 19 ~:.I sponsorship of a Texas Community Development Program grant application for the rehabilitation of the water system in the Oakland Lakes Subdivision in Precinct 3. This is a Community Development Grant for the Wickson Creek Special Utility District to improve the substandard water system for the fifty (50) homes currently using it. It is the intent of the SUD to design a water system that will meet current needs and those of future additional customers. On motion by Commissioner Sims. seeended by Commissioner walkPr_ the court vn*pA oil z r • • i The Court next considered a request from the Sheriff's Department to retain one vehicle previously scheduled to be returned to inventory. In his memo to the Court, Sheriff Kirk stated that since taking office, Crime Stoppers no longer supplied him with a vehicle. This coupled with the replacing of an investigator in the Sheriff's previous position has led to the need to retain the vehicle. Commissioner Jones moved to approve the request from the Sheriff's department to retain the vehicle. Commissioner Walker seconded the motion. Commissioners Jones, Walker and Sims voted "Aye". The County Judge voted "No". The motion carried. The next matter for consideration by the Court was a written request submitted by County Court at Law I Judge, Steve Smith, requesting approval for out of state travel for himself. Judge Smith would be traveling to San Francisco, California to attend the annual "National Conference of Special Court Judges" during the week of July 31 through August 4, 1997. Judge Smith would be paying the airfare from personal funds. Cost of lodging will be $650.00 and per diem would be $125.00. Commissioner Walker moved to grant the request. Commissioner Sims seconded the motion. The County Judge asked that the motion be amended to limit room expense to $65.00 per day and allow a $25.00 per diem. There was no second to the amendment. Commissioners Jones, Walker and Sims voted "Aye". The County Judge voted "No". The Court next considered the request from GTE to place a buried cable in the right-of-way of Fickey Road beginning at its intersection with Opersteny Lane and extending for a distance of 2075.0 feet. The site is located in Precinct 2. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Walker, seconded by Commissioner Jones, the Court voted unanimously to approve the request from GTE and authorized the installation. The next matter for consideration was approval for the Purchasing Agent to advertise for bids the following bids: Bid No. 97-036 Bottom Ash for Road & Bridge Bid No. 97-034 Annual Contract for Elevator Maintenance Bid No. 97-038 Industrial Tilt Trailer for Road &*Bridge on motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to authorize the Purchasing Agent to advertise for bids for the previously noted bids. The Court received, approved and ordered filed as submitted the Treasurer's report for January 1997. A copy of which is attached to and made a part of these minutes. VOL-1.9,PAUk i I r I A • • Under citizen input and/or concerns: E E i i 1 l 1 i) Sheriff Kirk submitted a copy of HB 341-Solomon that allows for a $35.00 per day fee to be collected from the State for inmates picked up on Blue Warrants. The Sheriff is to collect more data. 2) Mr. Demitrios Basdekas - said that citizens who come to court do not know what is happening and suggested that the court take time to inform the public what it will be considering. The Judge's secretary will post the cover sheet for Personnel Action, budget amendments and blanket purchase orders. The County Judge made the following comments: 1) He received a telephone call from Senator Steve Ogden's office asking that the Court waive the fee for use of the Brazos Center on June 5, 1997. Senator Ogden will be having a town meeting that day. 2) He is working on budget dates for the 97-98 budget. 3) He will be out of town on March 11, 1997. B) The line shall be Installed within 3-6' of and parallel to the right-of-way line. C) If clearing of brush, trees and other obstruction Is necessary. It shall be the Applicant's responsibility to do so and to remove all cleared brush, trees etc. from County right-of-way. D) Ditch line shall be compacted to 900/6 standard density ASTM-Test Method No. D-698; test shall be conducted by an independent Geotechnical testing firm; copies of all test results shall be furnished to the office of the Brazos County Engineer. E) Construction shall be in strict conformance to the latest Texas Manual of ' Uniform Traffic Control Devices for Streets and Highways, published by the Texas Department of Transportation, and all other State and Federal laws governing utility construction.
