BRAZOS COUNTY COMMISSIONERS COURT
THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
FEBRUARY 25,1997 AT 3:00 P.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET. SUITE 115, BRYAN,
TEXAS.
1. Invocation - Commissioner Walker.
2. Pledge of Allegiance - Commissioner Walker.
3. Citizens input and/or concerns. At this time, the Judge will open the floor to citizens
wishing to address the Court on county-related issues not schedulcd on the agenda. Please
limit subject matter to five minutes. The Commissioners will receive the information,
conduct research into the matter, and/or place the matter on a future agenda for

REGULAR MEETING
FEBRUARY 25, 1997
I
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 3:00
p.m. on Tuesday, February 25, 1997, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Tony Jones, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Walker gave the invocation and led the
pledge of allegiance.
There was no citizen input and/or concerns.
The Court next considered Budget Amendment x{96/97-15.1
through 15.7, which would reallocate funds budgeted for the
office of Constable, Precinct 5, Tax Office, District Clerk,
Road and Bridge, increase the Community Support budget,
create a line item .for Juvenile Services and establish a
budget for State reimbursement to the County for inmate
transportation. On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the budget amendment as submitted, a copy of which is attached
hereto.
The Court proceeded to consider the change of status of
the following employees.

Commissioners Court meeting February 25, 1997

On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
97-004149 through 97-004323
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Walker, seconded by
Commissioner•Cauley, the Court voted unanimously to approve
the County payroll in the amount of $543,000.00 for the period
ending February 27, 1996.
The Court next considered approval of a Long Distance
Service Agreement between Lufkin-Conroe Communications through
TCA Communications and Brazos County. On motion by
Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to approve the Long Distance Service
Agreement between Lufkin-Conroe Communications through TCA
Communications. A copy of the Agreement is attached hereto.
The Court next considered approval of the Replat of Lot
14, block 1 Enchanted Oaks Subdivision in Precinct 3'. Richard
Vance, County Engineer, stated that he had reviewed the plat
and all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner.Cauley,
' the Court unanimously approved the Replat of Lot 14, block 1
Enchanted Oaks Subdivision as submitted.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Frank Holubec on
Opersteny Road to dispose of dead livestock. on motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to authorize the work.

The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private' property of Fred Banks on
Walter Banks Road in Precinct 4 to remove the old fence, clean
debris and excessive overgrowth from the right-of-way and
replace the fence. On motion by Commissioner Cauley, seconded
by Commissioner Sims, the Court voted unanimously to authorize
the work.
The Court next considered authorizing work outside of

general public. The Road and Bridge Department requested
permission to enter the private property of Patricia Jones on
Walter Banks Road in Precinct 4 to dispose of dead livestock.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to authorize the work.
The Court next considered approval of the following
requisitions from Capital Expenditures:
a) Detention Response Team Equipment for the Sheriff's
office $6,426.25
b) GIS Software for Road and Bridge $558.00
On motion by Commissioner Walker, seconded by Commissioner
Sims, the Court voted unanimously to approve the two (2)
• requisitions in the total amount of $6,984.25 to be paid from
Capital Expenditures for the purchases.
The Court next considered awarding the following bids:
Bid No. 97-021 - Depository Contract for Biennium
beginning March 1, 1997
Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Norwest Bank. Commissioner
Cauley moved to accept the recommendation
of the Purchasing Agent and award the
contract to Norwest Bank based on
negotiations. Commissioner Sims seconded
the motion. Commissioners Jones, Walker,
Sims and Cauley voted "Aye". The County
Judge abstained.

submitted by Phillpot Motors and to
purchase four (4) trucks rather than two
(2). On motion by Commissioner Sims,
seconded by Commissioner Cauley the Court
voted unanimously to accept the
recommendation of the Purchasing Agent
and accept the bid submitted by Phillpott
Motors. A copy of the bid tabulation is
attached hereto.

The next matter for consideration was approval for the
Purchasing Agent to advertise for Bid No. 97-035, plants,'
trees and shrubs for the Juvenile Justice Center Landscaping
by -the Brazos Center. On motion by Commissioner Walker,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the Purchasing Agent to advertise for bids for
landscaping by the Brazos Center.

the Court voted unanimously to appoint Diana Rurten to
the
Fire Prevention District N2 Fire Commissioners Board.
The Court acknowledged receipt of the Year End Report
for
tax year beginning October 1995 from the Rural Fire Prevention
District N2.
There was no citizen input and/or concerns.
Commissioner Sims made the following comments:
1) The County will be applying for a grant to
upgrade the water system by Wickson Creek Special
Utility District and it will appear on the agenda
for the next Commissioners Court meeting.
Commissioner Jones made the following comments:
1) He would like to see the Court consider finding
a licensed engineer to oversee finalization of the
Juvenile Services Facility. Commissioners Sims and
Jones will look for an individual to put together a
punch list.
The County Judge made the following comments:
1) He received a letter from the Health Department
concerning new regulations for on site inspections
of septic systems.

2) The Jail Commission will inspect the jail soon.
There being no further business to come before the Court,
the meeting was adjourned.

The following proceedings were held:
THAT WHEREAS, on February 28, 1997 the Court heard and
approved a budget amendment for the 1996-1997 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget.adopted'August 8, 1996

The clerks of the county courts have the need to invest funds which have been placed
with them for safe keeping. These funds are to held in trust until the court orders the funds to
be disbursed. The clerks prefer these funds to be placed in an interest bearing account.
While none of the institutions arc set up to handle the peculiar needs of the County:
1. Earn Interest at the T-Bill rate
2. Allow for periodic interest to be earned (other than monthly)
3. Allow for periodic disbursals
4. Monthly reporting
5. All funds must be 105% collateralized
three have noted that programs could be set up to tend to these needs:

Recommendation:

The current depository request for proposal allows the County to contract with a
financial institution for two years and at the end of the term. the County and the institution
have the opportunity to review the existing contract and extend it for an additional two year
period. This proposal makes sense. It is expensive to the County to change depositories and
it is expensive to the institution to enter' into a short term agreement, which doesn't allow it the
opportunity to recover its costs and make a profit.
All four proposals are adequate and the County Treasurer and Tax Assessor (the two
parties which have the most interaction with the depository) would be able, to work with each.
As one will note in the overview, all four of the institution's proposals reflect good points.
However, the County has been offered an opportunity to allow its banking activity to enter the
electronic age. Both Commerce National Bank and Norwest Bank Texas have the capability
for the County to go "on-line" and review banking activity on daily or even hourly basis.
This will provide the County with the ability to expedite several of its current financial
transaction:
Electronic Transfers
Payroll Time sheets could be turned in on Mondays
Bank Reconciliations could be performed as required instead of at month end
All available funds could be maintained in interest bearing accounts until
required to cover checks as they clear.
ACH transfers and receipts could be handled on a real time basis

As the attached worksheet reflects, the additional cost for this service would be about
$3,600 per year. The time savings to the County Treasurer's office can not be measured at
this time. However, if the County can maintain an additional $100,000 in an interest bearing
position on a daily basis the County would earn an additional $5,000 each year.
The service that Commerce National and Norwest offer are similar. 1 would propose
that the Commissioners Court consider the Norwest offer, if the Court decides to take the next
step forward with electronic financial activity. This decision is based on:
1. Commerce National/Compass merger will not be final until March 1997
and some of the services will not be available locally when the County is ready to move.
2. Commerce's monthly service cost will be about $1,500 more than
Norwest for recurring services.
3. Norwest's Business Express is in place and operational in Bryan.
4. Norwest's response to inquiry's have been handled very rapidly on a
local basis, Commerce National has been slow to. respond, and many times inquiries are
channeled to Houston or Pensacloa.
If the Commissioners Court decides not to make the move to electronic access, then I
would recommend that First American's proposal be considered for acceptance.
