VO V 9)~E • f I COMMISSIONERS' COURT REGULAR MEETING ` FEBRUARY 18, 1997 K f .r A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, February 18, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Jones gave the invocation and led the pledge • through 14.2, which would reallocate funds budgeted for Capital Projects. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of A of allegiance. • There was no citizen input and/or concerns. A.Oi.7~r'V•~. ,+IM.J • t Commissioners Court meeting February 18, 1997 The Court next considered the following Claims as submitted by the County Treasurer for payment: 97-003946 through 97-004148 On motion by Commissioner walker, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. .I On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute the a Tax Resale Deed to the following 5 individual: Richard Pena - Lot 9, Block 34, City of Bryan, Brazos County, Texas on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to execute the a Tax Resale Deed to the following individual: r Shon M. Link - Tract of land out of the Crawford Burnett ' Survey as described in Volume 116, Page 24, Deed Records. _ The next matter for consideration by the Court was a written request submitted by the Sheriff requesting approval for out of state travel for Jail Administrator, Wayne Dickey. ~x Mr. Dickey would be traveling to Salt Lake City, Utah to attend the "American Jail Association" conference during the • week of May 18 through the 22, 1997. Estimated expenses are $843.00. Commissioner Sims asked if this training was not held in this state. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to grant the request from the Sheriff and approved payment of out of state travel expense for Mr. Wayne Dickey, Jail Administrator. The Court next considered contributing matching funds in the amount of $2,585.00 for a Brazos Animal Shelter Crematorium. In a memo to the Court the Director of the Animal Shelter cited several advantages to having this method of disposal. Mrs. Bice, the Director of the Shelter informed the Court that the percentage was derived by usage and that private fund donors were asking the shelter to move forward on this project. On motion by Commissioner Cauley, seconded by Commissioner Walker, the Court voted unanimously to approve the funding of matching funds in the amount of $2,585.00 to be taken from contingency funds for the purchase of a crematorium. The Court next considered two (2) requests from the Special Opportunity School of the Bryan Independent School District for the Road & Bridge Department to provide dwnp trucks for the transport of materials for the garden program. Once again they have received a donation of mushroom soil fertilizer from the Monterey Mushroom growing facility in Madisonville, Texas but have no means of transporting it to their campus. Also this year they have access to horse manure donated by the Dick Freeman Arena at Texas A&M University but again have no way to transport it. Therefore they are requesting the use of two (2) dump trucks to haul mushroom fertilizer and three (3) dump trucks to haul manure to the campus. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the use of Road and Bridge dump trucks to haul materials for the garden program for the Bryan Independent School District Special Opportunity School. H• z' r• The Court next considered approval of the following requisitions from Capital Expenditures: a) Samsung Monitor for District Clerk $264.00 b) Side Chairs for Purchasing $661.59 c) Water Meter Connection to Juvenile Center $685.00 On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to approve the requisitions to be paid from Capital Expenditures for the previously noted purchases. The Court proceeded to consider the following bids: a) Bid 97-021 - Depository contract for biennium beginning March 1, 1997 b) Bid No. 97-027 - Two (2) 1/2 ton pickups for Road and Bridge c) Bid No. 97-028 Two (2) 3/4 ton pickups for Road and Bridge On motion by the County Judge, seconded by Commissioner Walker, the Court voted unanimously to table consideration of all three bids. The next matter for consideration was approval for the Purchasing Agent to advertise for bids for Bid No. 97-034 Maintenance Contract for Elevators. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the Purchasing Agent to advertise-for bids for a Maintenance Contract for Elevators. The Court next considered awarding the following bids: Bid No. 97-031 - Landscape Irrigation for Juvenile Justice Center All labor, materials, services, and equipment necessary for completion of work installing automatic irrigation system. Prince Bio Energy Irrigation Landscape $18,500.00 $31,301.00 Cheryl Turney, Purchasing Agent, recommended acceptance of the low bid submitted by Prince Irrigation. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to Prince Irrigation. I /__-1. Y Commissioners Court meeting February 18, 1997 is J .1 Bid No. 97-023 Annual Gasoline & Diesel Fuel Contract Cheryl Turney, Purchasing Agent, recommended acceptance of the bid submitted by K. D. Timmons based on variance. On motion by Commissioner Jones, seconded by Commissioner Walker, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract to K. D Timmons. A copy of the bid tabulation is attached hereto. The Court next considered Modifying Bid No. 97-031, Landscape Irrigation for Juvenile Justice Center. The - modification is at the request of Brazos County and would a reduce the bid amount by approximately $4,000.00. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously to approve the change order modifying Bid No. 97-031. A copy is attached hereto. The Court next considered authorizing work outside of • C~ county rights-of-way for the health, safety and welfare of the general public. The Road and Bridge Department requested permission to enter the private property of Kim Tunnel on Gold Nugget Road in Precinct 3 to dispose of dead livestock. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the work. The Court next considered the request from Wellborn Water Supply Corporation to place a water line in the right-of-way of Cherokee Drive in Precinct 1. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Jones, seconded by Commissioner Cauley, the Court voted unanimously'to approve the request from Wellborn Water Supply Corporation and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from GTE to place a road bore in the right-of-way of Brown Lane in Precinct 4. The County Engineer stated that-all appeared to be in order and recommended approval. The Court next considered the request from Ferguson Burleson County Gas Gathering System to place a road bore in the right-of-way of Chisolm Trail approximately 50 feet south of its intersection with Weesaw Lane. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Jones, seconded by Commissioner Walker, the Court voted unanimously to approve the request from Ferguson Burleson County Gas Gathering System and authorized the installation. A copy of the request is attached hereto. The Court next considered approval of the Final Plat of Wiese Subdivision Lot 6, Block 1 Proposed 15.44 Acres in Precinct 1. Richard Vance, County Engineer, stated that he had reviewed the plat and all appeared to be in order. On motion by Commissioner Jones, seconded by Commissioner Walker, the Court unanimously approved the final plat of Wiese Subdivision Lot 6, Block 1 Proposed 15.44 acres. The next matter for consideration was approval of the -additional cost of $10,025.37 for Seminole Pipeline Company's relocation project on Greens Prairie Trail. In a letter to the County Engineer, Gil S. Petcoff, representative of Seminole Pipeline Company, enumerated several factors that contributed to the additional cost to the County. The County Judge questioned if funds were available. On motion by Commissioner Jones, seconded by Commissioner Walker, the Court voted unanimously to approve the payment of $10,025.37 to Seminole Pipeline Company for additional expenses incurred on the relocation project. The Court next considered acceptance of a Warranty Deed for right-of-way on Fickey Road in Precinct 2. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Herbert 0. Wilson for the expansion and improvements to Fickey Road. On motion by Commissioner Walker, seconded by Commis- sioner Cauley, the Court voted unanimously to approve the December 1996 Treasurer's Report and the Quarter Ending December 31, 1996 Report as presented and submitted as true and correct by Kay Hamilton, Treasurer of Brazos County. On motion by Commissioner Sims, seconded by, Commissioner Cauley, the Court voted unanimously to acknowledge receipt of the Investment Report for Quarter Ending December 31, 1996. A copy of which is attached to and made a part of these minutes. The Court acknowledged receipt of the Extension Service reports for January 1997 and acknowledged receipt of reports from County and Precinct offices showing revenues collected and remitted to the County Treasurer. An excerpt from those reports is attached hereto. There was no citizen input and/or concerns. The County Judge made the following comments: a) He received a letter from Bobby Slovak asking for funding for students making a trip to Washington D.C. b) He read a letter from Isaac Butler recognizing Ruth McLeod and Susan Gandy's contribution to the orientation seminar. c) He announced that Carolyn Nobles has accepted a position with Prairie View A&M University and will be leaving Brazos County employ. d) He mentioned that the television program Nightline recently dealt with Republic of Texas judgements filed against property owners. The changes are at the request of the Client, are based upon recommendations made by John Prince of Prince Irrigation, Irrigation Contractor, and are approved by the Landscape Designer 1 Substitution of Hunter Industries PGP rotor heads for proposed Hunter Industries 140 rotor head 2 Substitution of 16 gauge irrigation valve control wire for proposed 12 gauge wire. 3. Substitute existing conlrollm with one RainBird ESP 12 station controller. 4. Install required double check valve underground as per standard practices and local codes as aorced by Landscape Designer and irrigation Contractor on 2/10/97 S Substitute I" valve for proposed 3/4" valves in drip irrigation zones on sheaf L 3 2. 6 Rezone sheet L 3 2 spray heads into five valve zones with 1 1/2" valves at each zone. Valve make and manufacture is as previously specified. Carey Cauley, Commissioner Ruth McLeod, Administrative Assistant FROM: Kay Hamilton, County Treasurer RE: Quarter Ending 12-31-96 Investment Report This report 1s made in accordance with provisions of Gov.Code 2256, The Public Funds Investment Act, which require quarterly reporting of investment transactions to the Commissioners' Court. For the quarter of October 01, 1996, through December 31, 1996, Brazos County earned an average yield of 53779% on invested funds and received a total of $406,699.50 of actual interest dollars. The Brazos County Investment Committee met on November 15, 1996. During this meeting the future of Texpool under the management of the State Comptroller's office was discussed. (John Sharp may consider involving a private investment firm to manage Texpool in the future.) The Committee decided that Brazos County would continue to utilize TexPool for the time being and would initiate procedures for selecting an additional pool and/or mutual fund for alternative investment options. The average invested balance in TexPool over the last three months has remained stable and the interest rate has continued to be comparable to U.S. treasury and agency notes. Brazos County's average investment rate for the quarter ending December 31, 1996 was 53779%. The average monthly T-Bill rate for December of 1996 was 5.35% which positions the investment portfolio above our benchmark. (Note: Past quarterly reports have compared the Brazos County Portfolio to. the nine- month T-Bill rate per the last day of the reporting quarter.
