I .M COMMISSIONERS' COURT REGULAR MEETING FEBRUARY 11, 1997 A regular meeting of the Commissioners' Court of Brazos County, Texas was held in the Commissioners' Courtroom in the Courthouse in Bryan, Brazos County, Texas, beginning at 9:00 a.m. on Tuesday, February 11, 1997, with the following members of the Court present: Alvin W. Jones, County Judge, Presiding; Tony Jones, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. The County Judge gave the invocation and led the pledge of allegiance. Under citizen input and/or concerns the following people / made comments: Robert Weir - Leases land on Jones Road from a Mrs. Jefferson and asked the County to restore to property owners land that was traded for the straightening of Jones Road. Linda Muegge, of the Road & Bridge Department had contacted Mrs. Jefferson and stated that the lady did not want to sell her land to the County. Commissioner Cauley said that they were working with everyone along Jones Road to straighten out the deeds. The court next considered Budget Amendment $96/97-13.1 through 13.3, which would transfer funds budgeted for Contingency to the 85th District Court and the County Auditor's offices and transfer funds from Foster Care to Contingency. Commissioner Walker questioned why the budget amendments for the 85th District Court and Auditor's offices were just now coming through Court. The Auditor replied that they had originally been submitted in October but were returned to the Auditor's office then overlooked and misplaced. Commissioner Sims asked that since the Auditor was chief counsel to the budget officer, why was this done after Commissioners Court meeting February 11, 1997 • C7 0 the budget was set. The Auditor said that he had no control over the timing of meetings. The County Judge commented that the two (2) budget amendments totaled approximately $32,000.00 and that he would send a letter to the District Judges. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court proceeded to consider the change of status of the following employees. The Court next considered the following Claims as submitted by the County Treasurer for payment: 97-003692 through 97-003945 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the County payroll in the amount of $560,000.00 for the period ending February 13, 1997. The Court next considered a change of the Commissioners Court meeting time during the State Legislative Session. On motion by the County Judge seconded by Commissioner Sims, the Court voted unanimously to hold Commissioners Court at 3:00 P.M. on Tuesdays throughout the legislative term. The first meeting at the new time will be held on February 25, 1997 and will remain at that time until changed by the Court. ~l... M'. J . t r r..r ♦r t. Ws~ 1. Commissioners Court meeting February 11, 1997 The next matter for consideration was the amendment of the job title and job description for the position of Pavement Management Technician as approved by the Commissioners Court on December 17, 1996. On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to change the title to Engineering Aide II and the entry level salary will be pay group 13 step 1. The Court next considered adopting a policy relating to the placing of individual names on County Property. On motion by the County Judge, seconded by Commissioner Sims, the Court voted unanimously to adopt a policy stating that no names will be added to signs, buildings or facilities. The next matter before the Court was the payment of overtime earned by the County Clerk's deputies for working elections. This had been tabled from a previous Commissioners Court meeting. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the payment of overtime for the deputy County Clerks for election work and to fund the payment from the Elections budget. The Court next considered the approval of locations, monthly fee and handling fee for Texas Commercial Waste concerning the citizens collection sites. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve "Schedule All submitted by Texas Commercial Waste for solid waste removal services. A copy of the schedule is attached hereto. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to appoint Commissioner Tony Jones as liaison to the Health Insurance Committee. The Court next considered acceptance of a Warranty Deed for right-of-way on Fickey Road in Precinct 2. On motion by Commissioner Walker, seconded by Commissioner Sims, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Matthew O. Seymour for the expansion and improvements to Fickey Road. The Court next considered acceptance of a Warranty Deed for right-of-way on Elmo Weedon Road in Precinct 3. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to authorize the County Judge to accept on behalf of Brazos County a Warranty Deed from Frank A. Orts and wife Pearl L. Orts for the expansion and improvements to Elmo Weedon Road. The Court next considered approval of the Final Plat of Risinger Estates Subdivision (formerly Steep Hollow Estates) in Precinct 3. Richard Vance, County Engineer, stated that he had reviewed the plat and offered the following comment: Preliminary plat was approved at December 10, 1996 Commissioners Court meeting with a variance allowing the right-of-way width to be 60 feet rather than the standard 70 feet requirement. Formal request for variance was not submitted by developer. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court unanimously approved the final plat of the Risinger Estates Subdivision subject to the developer complying with the exception noted by the County Engineer. The Court next considered the request from GTE to place a road bore for buried cable in the right-of-way of North Dowling Road beginning at its intersection with Hopes Creek Road for a distance of 2,750 feet in Precinct 1. The County Engineer offered the following exceptions: 1) Dowling Road should be North Dowling Road. 2) The side of North Dowling Road which this proposed construction is to occur*is very narrow. Care should be taken to not damage the edge of the road surface or shoulder of the road. Spot field adjustments may be necessary to assume no road surface damage. 3) There are two road bores shown on the plan, the County's road bore specifications must be adhered to. On motion by Commissioner Jones, seconded by Commissioner Walker, the Court voted unanimously to approve the request from GTE and authorized the installation subject to GTE complying with the exceptions noted by the County Engineer. A copy of the request is attached hereto. The.Court next considered the request from GTE to place road bores in the right-of-way of Blue Ridge Drive and Valley Circle beginning at the intersection of Blue Ridge and Hopes Creek Road extending for a distance of 2,595 feet in Precinct 1. The Court next considered approval of a requisition from Capital Expenditures for the purchase of a typewriter for the office of Constable Precinct 5. This is a budgeted item in the 1996/1997 county budget. Cost of the typewriter is $260.49. On motion by Commissioner Cauley, seconded by Commissioner Walker, the Court voted unanimously to approve the requisition in the amount of $260.49 to be paid from Capital Expenditures for the purchase of a typewriter for the Office of Constable Precinct 5. The Court proceeded to consider the following blanket Purchase Orders: Drummond Ame Jail $3,500 Century Papers Jail $2,500 On motion by commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase orders as submitted. The next matter for consideration was the renewal of Bid 96-026 for Bridge Repair Service. In a letter to the Purchasing Department, A. C. Fulton, representative of Universal Bridge Construction Company, Inc., offered a one (1) year extension of Bid Request 96-026 for a period beginning February 15, 1997 through February 14, 1998 with the same conditions and unit prices as originally set forth. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to renew Bid No. 96-026 for Bridge Repair Service. The Court proceeded to consider the•following bids for Road and Bridge: Bid No. 97-023 - Annual gasoline and diesel fuel on motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to table consideration until a later date. A copy of the bid tabulation is attached hereto. Bid No. 97-025 - Annual bridge pilings Cheryl Turney, Purchasing Agent, recommended acceptance of the bid submitted by Conroe Creosote. A copy of the bid tabulation is attached hereto. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to accept the recommendation of the Purchasing Agent and award the contract for decking to Olsen & Guerra as primary and Conroe Creosote r as secondary and award the contract for bridge pilings to Conroe Creosote. The Court next considered the following requisition for purchases through sealed competitive bids for the Road and Bridge Department: Bid a) Bid 97-023 - Annual gasoline and diesel fuel On motion by- Commissioner Sims, seconded by Commissioner Walker, the Court voted unanimously to table consideration of *the annual gasoline and diesel fuel bid. b) Bid 97-024 - Decking Timber Primary - Olsen & Guerra Secondary - Conroe Creosote c) Bid 976-025 - Bridge Pilings Conroe Creosote On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the above listed requisitions for the Road and Bridge Department. The Court next received the Depository Bids and the County Judge asked the Auditor and Purchasing Agent to evaluate them. The following banks submitted bids: First National Bank of Bryan First American Bank Norwest Bank Compass Bank There was no citizen input and/or concerns. The County Judge made the following comments: a) He said that he had received a letter in reference to the law library being moved to the Courthouse when a vacancy occurs. Commissioners Jones, Sims, Cauley and Ruth McLeod will oversee the requests for additional space. b) He said he had received a notice from TAC concerning a Supreme Court case on the collection of taxes and would share the information. c) He plans to go to Austin for the Coalition of Urban Counties meeting. d) The Court will not be discussing furnishings for the Juvenile facility at the workshop session on February 13, 1997. • e) The Legislature is changing the process for handling paroles to speed it up. Commissioner Sims made the following comments: a) The Auditor notified him that most entities are exempt from Hotel/Motel Tax and feels it should be addressed with the legislators to include counties in the exemption. b) We need to contact our legislators to change a word in a bill that would allow counties to meet with other entities at a location other than the courthouse. Cheryl Turney, Purchasing Agent made the following comment: a) She has received proposals for the salary survey and would like,to know who gets the copies. b) She is requesting information on finding resources for out sourcing the security system for the Courthouse. EXCEPTIONS: 1) Dowling Road should be North Dowling Road. 2) The side of North Dowling Road which this proposed construction Is to occur is very narrow. There may not be 8' of space between the road surface and the right-of- way line. Care should be taken to not damage the edge of the road surface or shoulder of the road. Spot field adjustments may be necessary to assume no road surface damage. 3) There are 2 road bores shown on the plan, the County's road bore specifications must adhered to. ll. PRESENTATION: A) No work will be permitted between front slope and/or back slope B) The line shall be installed within 3-5' of and parallel to the right-of-way line C) 11 clearing of brush, trees and other obstruction is necessary, it shall be the Applicant's responsibility to do so and to remove all cleared brush, trees etc. from County right-of-way.
