THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
DECEMBER 10, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE

REGULAR MEETING
DECEMBER 10, 1996
A regular meeting of the commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 10, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in

The County Judge gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The Court proceeded to consider the change of status of
the following employees.

on motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to approve the changes as
submitted but to deny a six (6) month increase to Phyllis L.
Fuller, new employee in the District Clerk's office.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
97-002080 through 97-002312
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as .
submitted.

The Court next considered Budget Amendment #96/97-07,
which would reallocate funds budgeted for Juvenile Services

and the Computer Network Services Department. On motion by
Commissioner Walker, seconded by Commissioner Cauley, the

Court voted unanimously to approve the budget amendment as

submitted, a copy of which is attached hereto.
The next matter before the Court was consideration of a
funding request submitted by the Alternative Dispute
Resolution Center. Mike Hoelscher, Chairman of the Board of
the Center, updated the Court on the organizational progress
made toward opening the Center in early 1997. He then
requested that the funds accumulating through the increase in
civil filing fees along with the one time contribution
approved by the Commissioners Court of $5,000.00 be authorized
;
to be paid to the Center. On motion by the County Judge,
seconded by Commissioner Norton, the Court voted unanimously
to'authorize the payment of the funds contributed and the

civil filing fees collected to the Dispute Resolution Center.

The next matter for consideration was a request for
additional personnel for the Jail. In a memo to the Court,
Jail Administrator, Ralph Jones explained the need for the
'
nine (9) additional detention officers. The County Judge
;
moved to authorize five (5) additional officers on an interim
basis which would cost the County $132,860.20. Commissioner

Norton seconded the motion. Commissioners Norton, Walker,
Sims and Cauley voted "No". The motion failed. The County
Judge then asked if certification could be a condition of

employment. He recommended that detention officers get

training on their time and the County not pay a salary while
they are getting their certification. Commissioner Cauley
•
commented that it appeared that the County was already short
handed. Commissioner Sims asked if the Minimum Security Jail
would, be getting any new jailers and if there were any

certified jailers on the list of prospects for hiring. On
motion by Commissioner Sims, seconded by Commissioner Norton,

Commissioners Court meeting December 10, 1996
the Court voted unanimously to authorize the Sheriff to hire
nine (9) additional jailers. On motion by Commissioner
Cauley, seconded by the County Judge, the Court voted
unanimously to fund the positions from Contingency.
The Court next considered Change Order No. 09 for the
contract with Chappell Hill Construction Company for the
Juvenile Justice Center. The City of Bryan requested that
three (3) 8 inch isolation valves be included for safety
purposes. Additional cost to the County will be approximately
$8,500.50. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to approve
Change Order No. 09 subject to recalculation of cost. A copy
is attached hereto.
The next matter for consideration was a contract with
Texas Energy Engineering Services, Inc. for detailed
engineering assessment of County facilities. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to enter into contract with Texas
Energy Engineering Services, Inc. for the engineering
assessment of County facilities. The cost to the County will
be $6,925 to be funded from the Commissioners Court budget.
This is subject to the receipt of the contract documents.
The Court next considered the appointment of three new
members to the Brazos County Child Welfare Board. On motion
by Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to appoint Dr. Danny Stribling, Ms.
Pam Walker, and Ms. Margaret Sutton as new members to the
Brazos County Child Welfare Board.
On motion by the County Judge, seconded by Commissioner
Sims, the Court voted unanimously to table the appointment of
three members to the Loan Administration Board of the Brazos
Valley Development Council's Revolving Loan Fund.
The next matter for consideration was a Partial Release
of Judgement Lien on property described as a 0.404 acre tract
or parcel of land lying and being situated in the S. F. Austin

League #9 to Mr. Joe Marin. In Cause Number 28,497-85 styled
Brazos County, Texas v. Joe Marin, Brazos County (Judgement
Creditor) acknowledged satisfaction of the judgement and
releases to Joe Marin, (Judgement Debtor) all liens existing
by reason of the judgement and the filing of the abstract of
judgement against the afore described property. On motion by
Commissioner Sims, seconded by Commissioner Cauley, the Court
voted unanimously to approve the release of all liens existing
by reason of the judgement and the filing of the abstract of
judgement on the 0.404 acre tract or parcel of land lying and
being situated in the S. F. Austin League #9.
The Court next considered approval of the Preliminary
Plat of Weise Subdivision Lot 6, Block 1 in Precinct 1.
Richard Vance, County Engineer, stated that he had reviewed
the plat and offered the following comment:
1) Lot # 2 is below the one acre requirement.
On'motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to approved the
Preliminary Plat of the Weise Subdivision as submitted.
The Court next considered approval of the Subdivision of
the Replat of a portion of Lots 10, 11, 12, 13 and 14, Village
of Minter Springs Subdivision in Precinct 1. Richard Vance,
County Engineer, stated that he had reviewed the plat and all
appeared to be in order. On motion by Commissioner Norton,
seconded by Commissioner Cauley, the Court unanimously
approved the Subdivision of the Replat of a portion of Lots
10, 11, 12, 13 and 14, Village of Minter Springs Subdivision
in Precinct 1.
The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission-to enter the private property of Ray Truelove on
Old Bundick Road in Precinct 2 to dispose of dead livestock.
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to authorize the work.

The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Bill Turner on FM
159 in Precinct 1 to dispose of dead livestock. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to authorize the work.
The Court next considered approval of the Preliminary
Plat of Steep Hollow Estates Subdivision in Precinct 3.
Richard Vance, County Engineer, stated that he had reviewed

the plat and offered the following comments:
1) Risinger Lane to be 60 foot right-of-way rather
than the 70 foot required by the Brazos County
Subdivision Regulations, Section IV, Paragraph C,
Line 6.
2) Add a 20 foot utility easement along the south
boundary of the TMPA power line easement.
3) Show radii on both sides of Risinger Lane
intersection with Steep Hollow Road.
4) Dedicate additional right-of-way along Steep
Hollow Road so that the new right-of-way line is 35
feet from the centerline of existing Steep Hollow
Road right-of-way ranging from approximately 2.5_
feet to approximately 4.0 feet.
5) Change subdivision name to not be duplicating or
similar to other subdivision names.
Commissioner Norton questioned the variance of right-of-way
along Risinger Lane. On motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted unanimously to approve
the Preliminary Plat of the Steep Hollow Estates Subdivision
subject to the developer complying with the exceptions noted
by the County Engineer and to grant the variance of the 60
foot right-of-way.
The Court next considered approval of the following
requisitions from Capital Expenditures:
a) Typewriters for Tax office - $2,824.90
b) Commercial meat slicer for Juvenile
Services - $707.70
c) Laptop Computer for CCL#1 - $2,131.68
d) Software for Brazos Center - $569.00
e) Asphalt distributer for Road & Bridge -
94,734.79
f) Self-Propelled road sweeper for Road &
Bridge - $27,889.68.

Commissioner Sims questioned the purchase of a slicer and a
lap top computer. On motion by Commissioner Norton, seconded
by the County Judge, the Court voted unanimously to approve
the requisitions from Capital Expenditures for the previously
named items.

Purchase Order:

On motion by Commissioner Sims, seconded by commissioner
Norton, the Court voted unanimously to approve the Blanket
Purchase Order as submitted.
The next matter for consideration was approval for the
Purchasing Agent to advertise for the following.bids:
a) Depository Contract for County
On motion by the County Judge, seconded
by Commissioner Sims, the Court voted
unanimously to authorize the Purchasing
Agent to advertise for bids for the
Depository Contract for the county.
b) Electronic legal research software for
County
on motion by Commissioner Sims, seconded
by Commissioner Cauley, the Court voted
unanimously to authorize the Purchasing
Agent to advertise for bids for the
Electronic legal research software for
County.

c) Construction for courthouse security
renovations
On motion by Commissioner Norton,
i seconded by the County Judge, the Court
voted unanimously to table consideration
of advertising for construction for
courthouse security renovations.

On motion by Commissioner Cauley, seconded by
Commissioner Walker, the Court voted unanimously to cancel
the Commissioners Court meeting of December 24, 1996.

Commissioners Court meeting December 10, 1996
Under citizen input and/or concerns, the following
comments were made:

a) Demitrios Basdekas - thanked the Court
for funding the Dispute Resolution Center
and for honoring the request submitted by
the jail administrator. He encouraged
the Court to look down the road at
crowded jails and discuss this with the
judges so that they can find alternative
sentencing rather than jail time.
b) Bill Williamsen - asked about prior
compensatory time owed him and when will
the Court make its decision.
The County Judge made the following comments:
a) He asked Ed Dobbins to work with
Commissioner Walker and himself on the
construction plans for courthouse
security.
b) He has received requests for additional
telephone lines. He will look into
consolidating lines in various offices.
c) The inmate telephone services contract is
a roll over contract. Ralph Jones will
work with the County Judge in deciding
whether -to keep the contract or change

d) Ernie Wentrcek asked about the status of
1 a contract with a physician for medical
services.

e) He announced a workshop session with the
Eisenhower Group will be held December
11, 1996.
f) Water meters at the Brazos Center and
Rodeo Arena will be switched to
individual meters. The County Engineer
will look at a separate meter for the
Juvenile Facility for irrigation
purposes.
Commissioner Sims made the following comment:
a) He wants a discussion of insurance
funding at the next workshop session.
Commissioner Cauley made the following comment:
a) He wants the appointment of Justice of
the Peace, Precinct 5 placed on the
agenda of the next Commissioners Court
meeting.
There being no further business to come before the Court,
the meeting was adjourned.

won't the deletion of the 16' bore also be included (a deduct cost of $3.900.00).

statement? Please clarify this for me. I believe the cost should br $8,735.00 less $3,900.00. winch is $4.835.00.
