Jones, County Judge, Presiding; Gary Norton, Commissioner of Precinct 1; Sandie Walker, Commissioner of Precinct 2; Randy Sims, Commissioner of Precinct 3; Carey Cauley, Jr., Commissioner of Precinct 4; Mary Ann Ward, County Clerk. Attached is a list of the citizens and officials in attendance. Commissioner Cauley gave the, invocation and led the -pledge of allegiance. There was no citizen input and/or concerns. The Court proceeded to consider the change of status of the following employees. NAME DEPARTMENT REASON Spears, Kerry M District Attorney Sal Increase. Stephens, Rebecca Purchasing New Employee' on motion by Commissioner Sims, seconded by Commissioner Norton, the Court voted unanimously to approve the changes as submitted. The court next considered the following Claims as submitted by the County Treasurer for payment: 97-001978 through 97-002079 On motion by Commissioner Cauley, seconded by Commissioner Sims, the Court voted unanimously to approve the Claims as submitted. On motion by Commissioner Walker, seconded by Commissioner Norton, the Court -voted unanimously to approve the County payroll in the amount of $543.000.00 for the period ending December 5, 1996. VOL-E..._ PAnk jf 7~ 7 01 91 r F i f a r ti , S Commissioners Court meeting December 3, 1996 The Court next considered Budget Amendment #95/96-47, which would transfer funds budgeted for the Contingency Fund to various departments. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. The Court next considered Budget Amendment #95/96-48, which would transfer funds budgeted for the Contingency Fund to other revenue budgets and set up interest accounts. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the budget amendment as submitted, a copy of which is attached hereto. On motion by Commissioner Walker, seconded by Commissioner Cauley, the Court proceeded to set the holidays to be observed by Brazos County for 1997: January 20, Martin Luther Ring Day March 28, Good Friday May 26, Memorial Day July 4, Independence Day September 1, Labor Day November 27 & 28 Thanksgiving December 24, 25 & 26 Christmas January 1, 1998 New Year's Day One (1) Floating Holiday The Court proceeded to consider the following Blanket Purchase Order: Furrows Brazos Center * tsuu on motion by Commissioner Walker, seconded by Commissioner Cauley, the Court voted unanimously to approve the Blanket Purchase Orders as submitted. The next matter before the Court was the release of Irrevocable Letter of Credit No. 106 from Commerce National Bank for Dennis A..Sullens/Quality Enterprises in the amount of $67,000.00 for road and drainage construction in Nantucket, Phase V in Precinct 1. On motion by Commissioner Norton, seconded by Commissioner Cauley, the Court voted unanimously to authorize the release of Irrevocable Letter of Credit No. 106 from Commerce National Bank. VOL T" r i r Commissioners Court meeting December 3, 1996 The Court next considered the request from GTE to place a road bore in the right-of-way of Hardy Weedon Road. The site is located in Precinct 3. The County Engineer stated that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from GTE and authorized the installation. A copy of the request is attached hereto. The Court next considered the request from GTE to place a buried cable in the right-of-way of Steep Hollow Road. The site is located in Precinct 3. The County Engineer stated f f t a r f that all appeared to be in order and recommended approval. On motion by Commissioner Sims, seconded by Commissioner Cauley, the Court voted unanimously to approve the request from GTE and authorized the installation. A copy of the request is attached hereto. Under citizen input and/or concerns, O. D. Butler, leaseholder on land owned by Gerry L. Saum and Susan M. Wood on North Dowling Road, asked the Court, that since it was cutting through a tract of land to straighten out two 902 curves, to replace the fencing with King Ranch wire rather 'than the standard barbed wire fence, and to furnish stalls and water to the tract that was cut off with the taking. The County Judge made the following comments: 1) Constable Precinct 5 has asked for office space. 2) The Judge will meet with the Sheriff to discuss the request from the Jail Administrator asking for a staff • increase. Commissioner Sims asked to see the recommendation prior to the Commissioners Court meeting. 3) Mentioned the jail phone contract and his desire to negotiate a better contract. 4) Announced a workshop meeting immediately following this Commissioners Court meeting. 5) He is still working with Ernie Wentrcek to recess the Commissioners Court meeting of December 10, 1996 and reconvene Court at the new Juvenile facility. A copy, notarized by a duly authorized party to the County of Brazos to be true and correct, of the document giving the CONTRACTOR written notice to commence work, including the specific date such notice was given. Such document must verify that sufficient time has been allowed to complete the work under the terms and conditions of the AGREEMENT. 3. A notarized statement from a duly authorized employee of the County of Brazos stating that all reasonable efforts have been made to facilitate the satisfactory completion of the work specified in the AGREEMENT by the CONTRACTOR, and that such completion will require the County of Brazos to use funds drawn under this Letter of Credit to do so. I V t Z r i t t i i 7 f P E a This Letter of Credit shall not be assignable and shall become null and void on January 11, 1997 at 2:00 p.m. local time, or immediately upon receipt of a notarized statement from a licensed and professional engineer that the CONTRACTOR has substantially completed all work in connection with the AGREEMENT, whichever occurs first. Partial drawings are not permitted. All drafts must be marked "drawn under Commerce National Bank Letter of Credit No. 106" and all drawings negotiated under this credit must be endorsed on the reverse hereof by the party so negotiating. Except so far as otherwise expressly stated, this credit is subject to the Uniform Customs and Practice for Commercial Documentary Credits fixed by the Thirteenth Congress of the International Chamber of Commerce. We hereby agree with you and negotiating banks or bankers that drafts drawn under and in compliance with the terms of this Letter of Credit shall be duly honored on due presentation to the drawce. The location and description of this line and associated appurtenances is more fully shown by two (2) copies of drawings attached to this notice. The line will be constructed and maintained on the County Road right-of-way in accordance with governing laws.
