REGULAR MEETING
DECEMBER 3, 1996

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, December 3, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Cauley gave the, invocation and led the
-pledge of allegiance.
There was no citizen input and/or concerns.
The Court proceeded to consider the change of status of
the following employees.

on motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve the changes as
submitted.
The court next considered the following Claims as
submitted by the County Treasurer for payment:
97-001978 through 97-002079
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.
On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court -voted unanimously to approve
the County payroll in the amount of $543.000.00 for the period
ending December 5, 1996.

Commissioners Court meeting December 3, 1996
The Court next considered Budget Amendment #95/96-47,
which would transfer funds budgeted for the Contingency Fund
to various departments. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to approve the budget amendment as submitted, a copy of which
is attached hereto.
The Court next considered Budget Amendment #95/96-48,
which would transfer funds budgeted for the Contingency Fund
to other revenue budgets and set up interest accounts. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court proceeded to set the holidays
to be observed by Brazos County for 1997:
January 20, Martin Luther Ring Day
March 28, Good Friday
May 26, Memorial Day
July 4, Independence Day
September 1, Labor Day
November 27 & 28 Thanksgiving
December 24, 25 & 26 Christmas
January 1, 1998 New Year's Day
One (1) Floating Holiday
The Court proceeded to consider the following Blanket
Purchase Order:

on motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The next matter before the Court was the release of
Irrevocable Letter of Credit No. 106 from Commerce National
Bank for Dennis A..Sullens/Quality Enterprises in the amount
of $67,000.00 for road and drainage construction in Nantucket,
Phase V in Precinct 1. On motion by Commissioner Norton,
seconded by Commissioner Cauley, the Court voted unanimously
to authorize the release of Irrevocable Letter of Credit No.
106 from Commerce National Bank.

The Court next considered the request from GTE to place
a road bore in the right-of-way of Hardy Weedon Road. The
site is located in Precinct 3. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the request from GTE
and authorized the installation. A copy of the request is
attached hereto.
The Court next considered the request from GTE to place
a buried cable in the right-of-way of Steep Hollow Road. The
site is located in Precinct 3. The County Engineer stated

that all appeared to be in order and recommended approval. On
motion by Commissioner Sims, seconded by Commissioner Cauley,
the Court voted unanimously to approve the request from GTE
and authorized the installation. A copy of the request is
attached hereto.
Under citizen input and/or concerns, O. D. Butler,
leaseholder on land owned by Gerry L. Saum and Susan M. Wood
on North Dowling Road, asked the Court, that since it was
cutting through a tract of land to straighten out two 902
curves, to replace the fencing with King Ranch wire rather
'than the standard barbed wire fence, and to furnish stalls and
water to the tract that was cut off with the taking.
The County Judge made the following comments:
1) Constable Precinct 5 has asked for office
space.
2) The Judge will meet with the Sheriff to
discuss the request from the Jail
Administrator asking for a staff
• increase. Commissioner Sims asked to see
the recommendation prior to the
Commissioners Court meeting.
3) Mentioned the jail phone contract and his
desire to negotiate a better contract.
4) Announced a workshop meeting immediately
following this Commissioners Court
meeting.
5) He is still working with Ernie Wentrcek
to recess the Commissioners Court meeting
of December 10, 1996 and reconvene Court
at the new Juvenile facility.

On this the 3rd day of December 1996 at a regular meeting of the
Commissioners' Court, the following members were present:
Alvin W. Jones, County Judge, Presiding
Gary Norton, Commissioner, Precinct 1;
Sandie Walker, Commissioner, Precinct 2;
Randy Sims, Commissioner, Precinct 3;
Carey Cauley, Commissioner, Precinct 4;

The following proceedings were held:
THAT WHEREAS, on December 3, 1996, the Court heard and
approved a budget amendment for the 1995-1996 budget year for
Brazos County, Texas.
WHEREAS, an expenditure is necessary due to the necessity to .
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted September 26,
1995 the following amendment(s) to the original are hereby

At the request of Dennis A. Sullens dba Quality Enterprises, we, Commerce National Bank,
2405 Texas Avenue South, College Station, Texas 77840, have opened an IRREVOCABLE
LETTER OF CREDIT in your favor in an amount equal to Sixty-Seven Thousand and no/ 100
Dollars (67,000.00) available by your drafts at Commerce National Bank. The specific purpose
of this letter is to guarantee payment for required work to be completed by Dennis A. Sullens
dba Quality Enterprises, hereinafter termed CONTRACTOR, in conformity with terms and
conditions detailed within the AGREEMENT, dated December 27, 1995, entered into between
Nantucket, Ltd., hereinafter termed OWNER, and the CONTRACTOR in which the OWNER
agrees to pay CONTRACTOR $67,580.00
Drafts must be presented to the drawee no later than January 11, 1997 and contain the following:
1. A notarized statement from a licensed and professional engineer to the effect that
the work has not been completed in accordance with specifications set forth in the
AGREEMENT.
2. A copy, notarized by a duly authorized party to the County of Brazos to be true
and correct, of the document giving the CONTRACTOR written notice to
commence work, including the specific date such notice was given. Such
document must verify that sufficient time has been allowed to complete the work
under the terms and conditions of the AGREEMENT.
3. A notarized statement from a duly authorized employee of the County of Brazos
stating that all reasonable efforts have been made to facilitate the satisfactory
completion of the work specified in the AGREEMENT by the CONTRACTOR,
and that such completion will require the County of Brazos to use funds drawn
under this Letter of Credit to do so.

This Letter of Credit shall not be assignable and shall become null and void on January 11, 1997
at 2:00 p.m. local time, or immediately upon receipt of a notarized statement from a licensed
and professional engineer that the CONTRACTOR has substantially completed all work in
connection with the AGREEMENT, whichever occurs first.
Partial drawings are not permitted.
All drafts must be marked "drawn under Commerce National Bank Letter of Credit No. 106"
and all drawings negotiated under this credit must be endorsed on the reverse hereof by the party
so negotiating.
Except so far as otherwise expressly stated, this credit is subject to the Uniform Customs and
Practice for Commercial Documentary Credits fixed by the Thirteenth Congress of the
International Chamber of Commerce.
We hereby agree with you and negotiating banks or bankers that drafts drawn under and in
compliance with the terms of this Letter of Credit shall be duly honored on due presentation
to the drawce.

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, it shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees,
etc. from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

COMPANY LINE INSTALLATION
November 18, 1996
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of County Road in Brazos
County, Texas as follows:
From intersection of Dyess Rd., west on Hardy Weedon
Rd. 1st new house on right from culvert 230' (west
towards Hwy. 30) to roadbore.
The location and description of this line and associated
appurtenances is more fully shown by two (2) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights, franchise,
easement, license, authority, permission, privilege or right now
granted by law or may be granted in the future and any'provision or
provisions so construed be null and void.
Construction of this line will begin on or after November 26,
1996.

1. PRESENTATION:
A) No work will be permitted between front slope and/or back slope.
B) The line shall be installed within 3-5' of and parallel to the right-of-way
line.
C) If clearing of brush, trees and other obstruction is necessary, It shall be
the Applicant's responsibility to do so and to remove all cleared brush, trees, -
etc from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of
Uniform Traffic Control Devices for Streets and Highways, published by the k
Texas Department of Transportation, and all other State and Federal laws
governing utility construction.

GENERAL TELEPHONE NOTICE OF COMMUNICATION
COMPANY LINE INSTALLATION
November 19, 1996
TO THE COMMISSIONER'S COURT OF BRAZOS COUNTY
ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of County Road in Brazos
County, Texas as follows:
Approximately 2500' west of the intersection of
Elmo Weedon Rd. and Steephollow Rd. we will place
a buried line along, parallel to and 5' inside
R.O.W. of Steephollow Rd. a distance of 200'.
The location and description of this line and associated
appurtenances is more fully shown by two (2) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights; franchise,
easement, license, authority, permission, privilege or right now
granted by law or may be granted in the future and any provision or
provisions so construed be null and void.
Construction of this line will begin on or after December 1,
1996.
