THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
NOVEMBER 5, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the

Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, November 5, 1996, with the following members

Commissioner Sims gave the invocation and led the pledge

There was no citizen input and/or concerns.
The first matter before the Court was a notice received
by the Juvenile Services Department of the number of run-away
children in Brazos County for 1994 and 1995. Mr. Ernie
Wentrcek, Director of Juvenile Services informed the Court
'that David Haines was accepted into a training program in
Colorado. He then went on to say he had received a letter
from the Texas Juvenile Probation Commissioner saying that
Brazos County had surpassed its quota for runaway children
1994 and 1995. In 1994 the legislature set a quota not to
exceed 238 runaways. We had 294 runaways. In 1995 the quota
was 240. The County had 331. Brazos County is 1 of 15
counties that exceeded their
quotas. The Legislature -
recommended that the Chief Probation Officer approach the
Court for additional funding. Currently, Juvenile Probation
has an officer dedicated to truancy and runaways. He will
approach the Eisenhower Group in the spring to do a study of
the problem. Commissioner Sims asked how the state determined
• the quota, whereupon Mr. Wentrcek said it was based on

population. Commissiner Sims thanked Mr. Wentrcek for the
information.
The Court proceeded to consider the change of status of
the following employees.

on motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as
submitted by the County Treasurer for payment:
97-001013 through 97-001220
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered Budget Amendment #96/97-03,
which would adjust funds budgeted for the TJPC Challenge Grant
and the State Lateral Road fund and reallocate funds in the
General Permanent Improvement Fund. Commissioner Sims
questioned the adjustment to the State Lateral Road Funds. On
motion by Commissioner Walker, seconded by Commissioner Sims,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The Court next considered Budget Amendment #95/96-46,
%.:ich would transfer funds budgeted for Non Departmental to
the County Extension office and County Court at Law #2. On
motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court. voted unanimously to approve the budget
amendment as submitted, a copy of which is attached hereto.
On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to approve
the County payroll in the amount of $539,000.00 for the
period ending November 7, 1996.

Commissioner Walker, the Court voted unanimously to appoint

The next matter before the Court was approval of a

Contractual Agreement between the Arts Council of Brazos

Valley and Brazos County. The Council will provide assistance
to local arts organizations of the county through funding and
support which improves the quality of life in the county.
The cost to Brazos County will be $18,500.00 annually. The

term of the contract will be from October 1, 1996 through

September 30, 1997. On motion by Commissioner Cauley,
seconded by Commissioner Norton, the Court voted unanimously

to enter into contractual agreement with the Arts Council

Brazos Valley. A copy of the contractual agreement is

attached hereto.
The Court next considered entering into agreement with
the Texas Department of Criminal Justice for the transfer of
'
inmates from the Brazos County Jail to an Intermediate
Sanction Facility. The State of Texas shall assume
responsibility for the physical custody and care of certain

prisoners previously incarcerated by the county. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to enter•into agreement with the Texas
'
Department of Criminal Justice and authorized the County Judge
to execute the Agreement on behalf of Brazos County. A copy
of the Agreement is attached hereto.
The Court next considered a request by the County
Attorney to combine two temporary clerk positions in to one
full time temporary clerk position. On motion by Commissioner
Sims, seconded by Commissioner Cauley, the Court voted
unanimously to approve the request of the County Attorney to

recommended acceptance of the low bid
submitted by Dabbs Oil. On motion by
Commissioner Norton, seconded by
Commissioner Cauley, the Court voted
unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Dabbs Oil. A copy of the bid

c) Bid No. 97-003 - Oversized Limestone Aggregate

recommended acceptance of the bid
submitted by Austin Crushed Stone as
primary and the bid submitted by Young

motion by Commissioner Walker, seconded

unanimously to accept the recommendation

primary and the bid submitted by Young

unanimously to accept the recommendation
of the Purchasing Agent and award the
contract to Edgar Machinery and R. B.

The Court next considered approval of the following

approve the requisition in the amount of $2,336.10
to be paid from Capital Expenditures for the
purchase of terminals for the Computer Net Services
Department.
b) Printers for County Court at Law $1 and Risk
Management $654.00
On motion by Commissioner Walker seconded by
Commissioner Norton the Court voted unanimously to
approve the requisition in the amount of $654.00 to
be paid from Capital Expenditures for the purchase
of Printers for the County Court at Law 1 and the
Risk Management Department.

Commissioner Cauley the Court voted unanimously to
approve the requisition in the amount of $915.99 to

of a desk and chair for the County Attorney's
office.

Commissioner Norton the Court voted unanimously to
approve the requisition in the amount of $995.00 to
be paid from Capital Expenditures for the purchase
of a Trailer for the Brazos Center.
The Court next considered authorizing work outside of

county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of A. Calobreves on
Wilson Pasture Road in Precinct 2 to add material to driveway
to repair damage caused by a county truck. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to authorize the work:
The Court next considered the request from Brushy Water
Supply Corporation to place a 2 inch service bore in the
right-of-way of Kemp Road. The site is located in Precinct 4.
The County Engineer stated that all appeared to be in order
and recommended approval. On motion by Commissioner Cauley,
seconded by Commissioner Norton, the Court voted unanimously
to approve the request from Brushy Water Supply Corporation
and authorized the installation. A copy of the request is
attached hereto.
On motion by Commissioner Walker, seconded by
Commissioner Sims, the Court voted unanimously to approve and
ordered filed as submitted the Treasurer's. Quarterly report
for quarter ending September 30, 1996. A copy of which is
attached to and made a part of these minutes.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in March, 1996 on the
following dates: 5, 12, 19, 26. On motion by Commissioner

The Court next considered approval of the minutes of the
Commissioners' Court meetings held in June, 1996 on the

The Court acknowledged receipt of the report on the
implementation of salary increases for 1997.
Under citizen input and/or concerns, the following
comments were made:
Demetrios Basdekas - said the state had received
federal funds to put more police on the streets and
asked if the County had been notified. He then
said that he hoped some of this money would go to
county roads.
Commissioner Sims made the following comments:
1) There will be a special meeting on Thursday
November 7, 1996 to canvass the votes.
There being no further business to come before the Court,
the meeting was adjourned.

THIS AGREEMENT, made and entered into this .S day of 6ctvber, 1996, by
and between ARTS COUNCIL OF BRAZOS VALLEY, a private nonprofit corporation
chartered by the State of Texas, acting by and through its duly authorized agent
and officer, hereinafter referred to as ACBV, and the County of Brazos, State of
Texas acting by and through its County Judge, duly authorized to act, hereinafter
referred to as County.
WITNESSETH:
WHEREAS, Article 3, Section 52-a of the Constitution, Section 381 of the Local
Government Code of the State of Texas and V.A.T.S. 55190.6 provide for COUNTY
to engage in economic development activities; and
WHEREAS, a primary focus of economic development inquires is the quality of
arts programs in a community; and
WHEREAS, ACBV provides assistance to local arts organizations of the
COUNTY through funding and support which improves the quality of life in COUNTY
and which assists in attracting industry and business to COUNTY; and

WHEREAS, COUNTY provides various youth-related services; and
WHEREAS, ACBV has provided funding and support for programs involving
substance abuse prevention and education for Brazos County children through arts

programs and continues to proved arts-related programs and scholarships for young
1 people which foster positive self-image and thereby assists in prevention of drug and
alcohol use and abuse; and
WHEREAS, Article 152m, V.A.T. S. recognizes that the health, education, and

general welfare of the citizens of the State of Texas require promotion and education
about the performing, dramatic,, visual, and literary arts; and

WHEREAS, said Article permits COUNTY to provide funding for cultural
education facilities, and is to be liberally construed; and
WHEREAS, ACBV provides funding to member organizations, in part, for
facilities acquisition and upkeep, and
WHEREAS, Article 5190.7, V.A.T.S. permits COUNTY to assist with urban
enterprise zones, and
WHEREAS, ACBV through its funding programs has provided benefit to
Brazos County, Texas through programs attracting over 25,000 participants, and
resulting in significant purchases of goods from Brazos County merchants; and
WHEREAS, ACBV has provided funding to assist local performing arts groups;
and
WHEREAS, Chapter 318 of the Local Government Code of the State of Texas
provides for historic preservation activities by COUNTY; and
WHEREAS, ACBV provides funding to member organizations for historic
preservation; and
WHEREAS, other programs provided by COUNTY are directly benefitted by
ACBV and its member organizations.
NOW, THEREFORE, COUNTY and ACBV hereby agree as follows:
I.
ACBV through its funding and support of members organizations agrees to
provide the above enumerated services which it has provided and agrees to continue
to engage in support of arts organizations.
II.
COUNTY, for and in consideration of the services provided to COUNTY,
hereby agrees to pay to ACBV a lump sum payment of EIGHTEEN THOUSAND FIVE
HUNDRED DOLLARS ($18,500) for the year beginning October 1, 1996 and ending
September 30, 1997.

ACBV hereby agrees to hold COUNTY, its officers, agents, servants, and

PRISONER CUSTODY AGREEMENT
This Prisoner Custody Agreement ("AGREEMENT") is entered into as
of November 5, 1996 by and between the Commissioners Court of
Brazos County ("COUNTY") and the Texas Department of
Criminal justice, Parole Division.
RECITALS
WHEREAS, the Texas Department of Criminal Justice, Parole
Division ("TDCJ-PD") has an agreement with a private organization to
operate an intermediate sanction facility ("FACILITY") as a secure
correctional center for certain persons described herein who are
under the jurisdiction of TDCJ-PD and in the custody of COUNTY
authorities, and who have violated the terms and/or conditions of
their parole;
WHEREAS, TDCJ-PD and'the COUNTY desire to enter into this
AGREEMENT to which the State of Texas shall assume responsibility
for the physical custody and care of certain prisoners previously
incarcerated by COUNTY pursuant to the COUNTY's authority to detain
prisoners in a secure- detention facility operated by a private
organization under Local Government Code Section 351.101;
1. ASSUMPTION OF CUSTODY. In accordance with and subject to
the terms o this AGREEMENT, TDCJ-PD shall assume physical custody,
care and control of certain prisoners for whom a blue warrant has
been issued by the TDCJ-PD (hereinafter referred to as Blue Warrant.
Prisoners) with constructive custody maintained by the COUNTY.
Except as otherwise set forth herein, TDCJ-PD shall bear all
expenses associated with such physical custody, care and control of
these Blue Warrant Prisoners transferred to a FACILITY.
2. ELIGIBILITY REQUIREMENTS. Prisoners eligible for transfer
to the FACILITY shall be 1 ted to technical parole violators
incarcerated by COUNTY who are under the jurisdiction of TDCJ-PD by
virtue of having had issued against them a Blue Warrant, which shall
remain in effect, and who (a) have violated their parole, (b) are in
reasonably good health, with no current and/or existing medical
problem that could cause hospitalization or would prevent
participation in the program, and (c) have had a specified time of
confinement authorized by TDCJ-PD as a condition of the continuance
of their parole. TDCJ-PD or its designee shall be authorized to
refuse to accept for incarceration, or after incarceration shall be
authorized to return to the physical custody of the COUNTY at
COUNTY's expense, any prisoner who does not meet the eligibility
requirements for incarceration at the FACILITY as set forth in this
paragraph.
Pursuant to TEX. HEALTH AND SAFETY CODE ANN. art. 89.054,
(Vernon Supp. 1993), County shall provide a copy of a Blue Warrant
Prisoner's medical record at the time of transfer to the Facility.

3. MAXIMUM PRISONERS. COUNTY may initially transfer BLUE
WARRANT PRISONERS for incarceration at the FACILITY, beginning on
the date specified by notice which shall be given by the TDCJ-PPD to
COUNTY at least seven (7) days in advance with the maximum number of
prisoners to be designated by TDCJ-PPD subject to increase or
decrease upon two (2) days notice to COUNTY.
4. JAIL STANDARDS. The FACILITY shall be operated and
maintained in accordance with minimum jail standards of Texas
Commission on Jail Standards ("COMMISSION"), including such
variances from Jail Standards as may be approved by the COMMISSION
or TDCJ-PPD. If the COMMISSION or TDCJ-PPD, at any time, determines
that the FACILITY does not meet Jail Standards, either party may
terminate this AGREEMENT without penalty, at which time all BLUE
WARRANT PRISONERS shall be returned to the physical custody of
COUNTY.
5. TRANSPORTATION. The COUNTY shall provide transportation
from the county jail to the TRANSPORTATION SITE as designated by
TDCJ-PPD. Upon COUNTY's request, the TDCJ-PPD's designee shall
provide, at the TDCJ-PPD's or its designee's expense, transportation
of all eligible BLUE WARRANT PRISONERS from a transportation site to
the FACILITY and back to the TRANSPORTATION SITE.

6. RELEASE OF PRISONERS. BLUE WARRANT PRISONERS who are to
be released from the FACILITY shall be returned to the physical
custody of the COUNTY at the TRANSPORTATION SITE for release or
transfer to the Institutional Division of the Texas Department of
Criminal Justice by the COUNTY that incarcerated the prisoner.
7. PRISONER CLOTHING. Blue warrant prisoners in the County
Jail who are indigent or otherwise without appropriate clothing upon
release to the FACILITY shall be provided with appropriate clothing
by the COUNTY before transferring prisoners to the facility.
8. INITIAL TERM. This AGREEMENT is effective on the date set
forth in the initial paragraph of this agreement and shall continue
in full force and effect, subject to appropriations, or unless
earlier terminated as hereinafter provided, for the initial one (1)
year term.
9. RENEWAL. Following the initial term, this agreement may
automatically be renewed for each successive year thereafter upon
written notice from the County to TDCJ-PPD, given at least sixty
(60) days prior to the then current expiration date, or unless
either party delivers to the other its written intention not to so
extend at least (30) days prior to the then current term expiration
date, at which time TDCJ-PPD shall return to the physical custody of
the county each of its Blue Warrant Prisoners.
10. NOTICE. All notices required to be given hereunder shall
be effective upon receipt by the party tp which notice is given.

11. ASSIGNMENT OF OBLIGATIONS. COUNTY acknowledges that it
is aware t Fa- the TDCJ-PD has contracted with the private
organization to provide for the care, physical custody and control
of prisoners at the FACILITY, and hereby consents to TDCJ-PD's
assignment to the private organization of all of its obligations
hereunder with respect to the physical custody, care and control of
COUNTY BLUE WARRANT PRISONERS.
12. TERMINATION AND RETURN OF PRISONERS. In the event that
(a) TDCJ-PD s contract with the private organization for the care
and physical custody of prisoners at the FACILITY is terminated for
any reason, or (b) TDCJ-PD is for any reason prevented from using
the FACILITY to house BLUE WARRANT PRISONERS, then this AGREEMENT
shall terminate immediately and TDCJ-PD or its designee shall return
the BLUE WARRANT PRISONERS to the physical custody of the COUNTY at
the TRANSPORTATION SITE, and COUNTY shall accept into its custody
any BLUE WARRANT PRISONERS incarcerated at the FACILITY who were
previously incarcerated by COUNTY.
Executed as of the date set forth in the initial Paragraph of this
AGREEMENT.

1. The County Engineer must be notified 72 hours prior to the beginning
of construction in order that they might be on hand to designate the actual
location of the installation.
2. That all damage to the roadways and right-of-ways will be repaired to
their original condition to the satisfaction of the County Engineer.
3. That Brazos County reserves the right to require Applicant to relocate
or lower any such line at no cost to Brazos County, should same become
necessary due to widening or lowering, or other alteration of the roadway
or right-of-way.
4. That Brazos County is in no way responsible for any damage that might
occur to any existing utility lines in the right-of-way.
5. That the line will be constructed and maintained on the County right-of-
way in accordance with governing laws.
6. That the line or lines will be constructed no less than forty-eight inches
(48") lower than the center of the roadway whether there is, or is not, a
borrow ditch.
'7. That all sites will be barricaded during the construction period.

RE: Quarter Ending 09-30-96 Investment Report
This report is made in accordance with provisions of Gov.Code 2256, The Public
Funds Investment Act, which require quarterly reporting of investment
transactions for county funds to the Commissioners' Court.
For the quarter of July 01, 1996, through September 30, 1996, Brazos County
eamed a weighted average yield of 5.279% on invested funds and received a
total of $355,223.17 of interest income.
A comparison of the 9 month T-Bill rate of 5.539 on September 30, 1996 to the
Brazos County Portfolio's weighted average yield of 5.2799 depicts a lower rate
of interest earned by the portfolio of approximately 25 basis points. This
difference was slightly less than last quarter. As stated last quarter, this would
suggest a need for some securities with a longer investment term. Because of a
large quantity of year end expenses, it was necessary to have the majority of the
funds readily available. We will look toward longer termed Investments in
October with the intent to reduce difference between the portfolio and the
bench mark.
TexPool's average invested balance has dropped from $4.7 billion in June 1996
to $4.3 billion in September according to the "News from TexPool" newsletters
received by the Treasurer's office monthly. The number of participants has
increased from 1,490 as of June 30, 1996 to 1,498 as of September 30,1996. This
Information is being reviewed monthly In an effort to monitor the stability of
TexPool and to determine it an alternate investment tool should be added to
the Brazos County portfolio. So for, there has not been a significant change in
TexPool's performance since it was moved into the State Comptroller's Office.

The proceeds from the sale of the Certificates of Obligation were deposited into
TexPool pending the repayment of funds previously expended for the juvenile
Justice Center and Road Projects from the General Permanent Improvement
Fund. Following the settlement of these accounts, $1 million of each fund was
invested in government agency securities and the balance was left in TexPool
until October.
The Brazos County Investment Committee did not meet during the quarter
ending 09-30-96.

This budget includes a print-out of the job positions and salaries for the employees in your
department. Please review this information carefully. UNLESS YOUR OFFICE GIVES THE
PERSONNEL DEPARTMENT OTHER DIRECTIONS ON OR BEFORE. OCTOBER 4.
