A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, October 29, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
Commissioner Norton gave the invocation and led the

Sims, the Court voted unanimously to approve the changes as
submitted.
The Court next considered the following Claims as

On motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Claims as
submitted.
The Court next considered approval for the correction of
1996-1997 actual salaries for certain employees. On motion by
Commissioner Walker, seconded by Commissioner Cauley, the
Court voted unanimously to correct the salaries of certain
employees in the Sheriff's office and in Court and Jury
Services.
The next matter for consideration was the payment of one
day's wages to a former clerk in the District Clerk's office.
Due to a clerical error on the part of the District Clerk, the
hire date was incorrectly reported. The employee reported for
work on October 23, 1996 then called in on the following day
saying she would not be returning. On motion by Commissioner
Walker, seconded by Commissioner Cauley, the Court voted
unanimously to pay the former clerk one day's salary.
On motion by Commissioner Norton, seconded by
Commissioner Sims, the Court voted unanimously to appoint the
following persons as presiding judge and alternate judge for
the current voting year at the following voting precincts:

The next matter before the Court was approval of a
Contract and Agreement for Secure Long Term Boot Camp Services
for Juvenile Offenders Space Available between the 32nd

age, referred for a act of delinquency or an act indicating
the need for supervision, in the post dispositional treatment
prescribed by the Court. The cost to Brazos County will be
$78.00 per client per day. The term of the contract will be
from September 1, 1996 to August 31, 1997. On motion by
Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to enter into contractual agreement
with the RECOR. A copy of the contractual agreement is
attached hereto.
The next matter for consideration by the Court was a

written request submitted by the County Judge requesting
approval for out of the country travel for himself. Mr. Jones
would be traveling to Turkey with representatives of the EDC
in an effort to lure a 130 million dollar business to the
Brazos Valley. On motion by Commissioner Sims, seconded by
Commissioner Walker, the Court voted unanimously to grant the
request from the County Judge and approved payment of out of
country travel in accordance with the County travel policy.
The next matter before the Court was approval of a
Contractual Agreement between the Brazos Maternal & Child
Health Clinic, Inc. and Brazos County. The clinic will
provided interviews, lab work, physical exams, educational
information and medicine as needed to the poor and indigent of
Brazos County. The cost to Brazos County will be $60,000.00
annually. The term of the contract will be from October 1,
1996 to September 30, 1997. On motion by Commissioner Sims,
seconded by Commissioner Cauley, the Court voted unanimously
to enter into contractual agreement with the Brazos Maternal
& Child Health Clinic. A copy of the contractual agreement is
attached hereto.
The next matter for consideration by the Court was the
resubmittal of a request by the County Extension Agent-FCS
asking approval for out of State travel for herself. Ms.
tNobles would be traveling to Annapolis, Maryland to attend a
Epsilon Sigma Phi organizational meeting during the week of

receipt of further information from Ms. Nobles. Having
received that information and on motion by Commissioner
Walker, seconded by Commissioner Cauley, the Court voted
unanimously to grant the request from the County Extension E

Agent and approved payment of out of state travel expense for #

The next matter for consideration was the authorization
for Brazos County to continue to participate in TexPool. On
motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the County
Judge to complete the Certificate of Incumbency authorizing
the Treasurer to execute the TexPool Participation Agreement.
The Court next considered the request from GTE to replace
an existing pedestal with a new structure in the right-of-way
of Hopes Creek Road at its intersection with Trotter Lane.
The site is located in Precinct 1. The County Engineer stated
that all appeared to be in order and recommended approval. On
motion by Commissioner Norton, seconded by Commissioner
Walker, the Court voted unanimously to approve the request
from GTE and authorized the installation. A copy of the
request is attached hereto.
On motion by Commissioner Norton, seconded by
Commissioner Walker, the Court voted unanimously to reject the
only bid received for Request for Proposal (RFP) 96-043 1+
Long Distance Service that completely satisfied the RFP
requirements. t
The next matter for consideration was approval for the
Purchasing Agent to advertise for RFP's for 1 + Long Distance
Service. On motion by Commissioner Cauley, seconded by i
Commissioner Norton, the Court voted unanimously to authorize `
the Purchasing Agent to advertise for RFP's for 1 + Long
Distance Service.

On motion by Commissioner Sims, seconded by Commissioner
Norton, the Court voted unanimously to approve all the
requisitions to be paid from Capital Expenditures.
The next matter before the Court was approval of a
Contractual Agreement between the Bryan-College Station Eagle
and Brazos County for Municipal Advertising. The Eagle will
guarantee a set price per inch for the contract period without
regard to the number of inches run each month nor will there
be a minimum number of inches required. The term of the
contract will be from November 1, 1996 through October 31,

1997. On motion by Commissioner Norton, seconded by
commissioner Cauley, the Court voted unanimously to enter into
contractual agreement with the Bryan-College Station Eagle.

Commissioners Court meeting October 29, 1996
The next matter before the Court was approval of a Rental
Agreement between Advanage Rent-a-Car and Brazos County. On
motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to enter into contractual
agreement with the Advantage Rent-a-Car. A copy of the rental
car comparison is attached hereto.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in January, 1996 on the
following dates: 9, 16, 23, 30 and Workshops held on January
22 and 29, 1996. On motion by Commissioner Norton, seconded
by Commissioner Walker, the Court voted unanimously to approve
the minutes as submitted.
The Court next considered approval of the minutes of the
Commissioners' Court meetings held in February, 1996 on the
following dates: 6, 13, 20, 27 and two (2) workshops held on
February 12 and workshops held February 27 and 28, 1996. On
motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to approve the minutes as
submitted.
The Court next heard a presentation by Linda Muegge,
representative of the Road and Bridge Department, concerning
the Jones Road project. It was the consensus of the Court
that Mrs. Muegge continue working on the project.
The next matter before the Court was a presentation of
audit findings on compensatory time submitted from the office
of Constable Precinct 7. The County Auditor presented this
findings of the claims made September 26, 1996 relevant to
compensatory time hours for three employees in the Constable's
office. Constable Pittman requested that a member of the
Court meet with him, his employees and the County Auditor to
review the Auditor's findings. Constable Pittman stated that
he preferred a court member who was familiar with law
enforcement. The County Judge stated that he felt that the
accumulation of the number of compensatory time hours was due
to gross mismanagement for the department. Constable Pittman

stated he took exception to that statement because many times
in the past he had asked for additional help and had been
denied. He again asked for a member of the Court to work with
his department and the Auditor to review the findings. The
County Judge stated it was not placed on the agenda as a
decision matter and he then moved on to the next agenda item.
The Court next discussed the renewal of the county health
insurance. It was the consensus of the Court that the
Purchasing Agent compose a letter to Plumbhoff requesting an
extension of coverage.
There was no citizen input and/or concerns.
The County Judge made the following comments:
1) He had received a document from the
Attorney General's office discussing the
Republic of Texas movement.
2) He read aloud the number of total votes
cast during early voting
3) He will not be at the Commissioners Court
meeting of November 5, 1996 as he will be
traveling to Turkey with representatives
of the EDC.
There being no further business to come before the Court,
the meeting was adjourned.

CONTRACT AND AGREEMENT FOR S . IRF. LONG-TERM
BOOT CAMP SERVICES FOR JUVENILE OFFENDERS
SPACE AVAILABLE
This contract and Agreement made and entered into by and between the 32nd
Judicial District Juvenile Board (Board) acting by and through its duly authorized
Contract Manager, Rehabilitation and Corrections Corporation (RECOR) and the County
of Brazos County acting by and through their duly authorized representative, as
evidence by their signatures below, to be effective from the 1st day of Se to embr,
192(L- through the 31st day of August ,1922.
WITNESSETH:

Whereas, RECOR as the Contract Manager for the Board operates the Sweetwater
Regional Juvenile Detention Facility and whereas this facility has been duly inspected
and certified as being suitable for the detention of children; and,
Whereas, Brazos County in order to carry out and conduct their juvenile
programs in accordance with the Texas Family Code have need of the use of detention
facilities to house and maintain children of juvenile age, referred for an act of
delinquency or an act of indicating a need for supervision, in the post dispositional
treatment prescribed by the Court; and,
Whereas the Board, through RECOR, desires to make the facility available to
Brazos County for such use and purpose, and Brazos. County desires to contract for the
use of said facility: Now, therefore, the parties agree as follows:

(1) The term of this Contract shall terminate on the _31- day of August, 1921
After a mutual good faith effort has been made toward the success and performance of the
contract, if either party hereto feels in its judgment that the contract cannot be
successfully continued, and desires to terminate the contract, then the party so desiring to
terminate may do so by notifying the other party in writing, by certified mail or personal
delivery to its principal office, of its intention to terminate the contract thirty (30)
calendar days from the date of Notice of Termination is received by the other party.
Notice to the Board shall be mailed to the following address: 32nd Judicial District
Juvenile Probation Department, P.O. Box 1624, Sweetwater, Texas 79556. A copy of
such notice shall also be mailed to RECOR at the following address: Sweetwater
Regional Juvenile Detention Facility, 2101 W. Alabama, P.O. Box 628, Sweetwater,
Texas 79556. At 12:00 o'clock Midnight, thirty (30) calendar days thereafter, this
contract shall terminate, become null and void, and be of no further force or effect. After
receipt of notice of termination Brazos County shall remove all children placed in the
facility on or before the termination date.
(2) The Board and RECOR agree to provide a space if space is available at the
time that Brazos County requests the space.
(3) RECOR will provide room, board, twenty-four (24) hours per day, seven (7)
days per week supervision, routine'medical examination and treatment within the facility
(but shall not provide nor pay for emergency examination, treatment, or hospitalization
outside the facility); an approved educational program; recreation facilities; and
counseling to each child placed within the facility.
(4) Brazos County agrees to pay the Board the daily rate of 578.00 per day for
each and every day each child is in detention. The daily rate shall be paid to the Board
upon billing and in accordance with payment procedures agreed upon by the Board and
Brazos County.

(5) If emergency examination, treatment or hospitalization outside the facility is
required for a child placed in the facility by Brazos County, then Brazos County
guarantees that such costs will be paid in full. The Administrator of the facility shall
notify within twenty-four (24) hours, the department that placed the child of the
emergency and/or treatment.
(6) Each child placed in the facility by Brazos County shall be placed therein
under proper order of the Juvenile Court, and the Administrator will be famished a
certified copy of said order.
(7) Each child placed therein shall be required to follow the rules and regulations
of conduct as fixed and determined by the Administrator and staff of the facility.
(8) If a child is accepted to the facility and such child thereafter is found to be, in
the judgment of the Administrator, mentally unfit, dangerous, or unmanageable to either
of such conditions or characteristics, or whose mental or physical condition would or
might endanger the other occupants of the facility, then the Administrator's judgment
upon such determination and notification by the Administrator to the Chief Probation
Officer of the 32nd Judicial District Juvenile Probation Department, a Juvenile Probation
Officer or Deputy Sheriff of the placing County shall immediately and forthwith remove
or cause to be removed such child from the detention facility.
(9) RECOR agrees *hat the facility will accept any child qualified hereunder,
without regard to such child's religion, race, creed, color, sex, or national origin.
(10) It is further understood and agreed by the parties hereto that children placed
in the care of the facility shall not be discharged therefrom without:
(a) Receipt of the facility of an Order signed by the Judges having
juvenile jurisdiction of Brazos County, duly certified by the Clerk of said Court, or
(b) By authorization of the Juvenile Probation Department who originally
detained the child, or

f (c) As provided in paragraph (8) above.
(11) It is further understood and agreed by the parties hereto that nothing in the
Contract shall be construed to permit Brazos County, their agents, servants, or
employees in any way to manage, control, direct or instruct the Board, its servants or
employees in any manner respecting any of their work, duties or functions pertaining to
i the maintenance and operation of the facility. However, it is also understood that the
i Juvenile Court of each individual County shall control the conditions and terms of
detention supervision as to a particular child pursuant to Texas Family Code Section
51.12.
(12) It is further understood and agreed by the parties hereto that the County
placing the child in the facility is responsible for any damages caused by the child that is
placed at the facility.
(13) RECOR will provide a monthly progress report for each resident to Brazos
County. These reports are to include the following information:
(a) Behavior in Program
(b) Progress in Treatment
(c). Progress in School
(d) Pear and Staff Relationships
(e) Family Relationships
(f) Aftercare Goals
This Contract is in lieu of all previous contracts between the Board, RECOR and
Brazos County for these purposes. Said previous contract to terminate, become null and
void, and be of no further force or effect as of the date this contract becomes effective.

This Contract and Agreement this date executed is made by and between the parties
hereto; it being the declared intention of the parties hereto that the above and foregoing
Contract, is a Contract providing for the care of children who have allegedly committed
an act of delinquency or an act indicating a need for supervision and payment of such
care by the Judge of Brazos County for such children placed in the facility by the
Judge of Brazos County having juvenile jurisdiction.

CONTRACT
THIS CONTRACT IS ENTERED INTO BY AND BETWEEN BRAZOS COUNTY,
TEXAS, acting by and through its duly elected County Commissioners (hereinafter "County"), and
the BRAZOS MATERNAL & CHIIA HEALTH CLINIC, INC. (hereinafter "Provider"), located in
1720 Barak Lane, Bryan, Texas 77802,
RECITALS:
WHEREAS, the medical care of the County's poor and indigent has become a growing
problem; and
WHEREAS, the County recognizes that good medical care of pregnant women results in
healthier babies and less costly medical expenses incurred for the child in the future by the parents and
the Community; and
WHEREAS, the Court is interested in promoting such care through the Provider,
NOW THEREFORE the parties above stated agree to the following terms and conditions to
provide such indigent health care.
TERM
This contract shall continue in force and effect for a term of twelve (12) months commencing
on the 1 st day of October, 1996 and terminating 30th day of September, 1997.
CANCELLATION
This contract may be canceled by any of the parties hereto upon sixty (60) days written notice
as provided herein.
SERVICES TO BE PERFORMED BY PROVIDER
Provider shall provide the following services through trained, salaried staff to pregnant women
who qualify for such services pursuant to the guidelines currently implemented for making such
determination: interviews, lab work, physical exams, educational information and medicine as needed
(herein "Services").
USE OF COUNTY FUNDS
Funds to be furnished to Provider as stated herein below shall be used to pay the partial salary
of the Director of Provider and the entire salary of the Billing Clerk as described in Enclosure (1)
attached hereto and made a part hereof for all purposes The County and Provider acknowledge that
the County's purpose in providing funds hereunder is to provide medical assistance to qualified

COUNTY'S LIABILITY FOR PAYMENT
The County agrees to reimburse the Provider for actual cost of the salaries as stated on Exhibit
"A" up to a maximum of Sixty Thousand and No/100 Dollars ($60,000.00) for the term of this
Contract.
This sum shall be paid upon the following dates and in the following amounts:
December 15, 1996 $15,000.00 -

June 15, 1997 $15,000.00

applicants and that the funding of salaries for the trained personnel of Provider is designed to
accomplish that goal.
RESPONSIBILITIES OF PROVIDER
Provider will be responsible for providing the following Services pursuant to this Contract:
1. All necessary application forms to potentially eligible individuals.
2. Obtaining and compiling information on each applicant for Providers Services with
regard to residency and financial qualifications.
3. Maintaining this Contract.
4. Providing of the Provider's Services.
5. Maintaining data files on clients and the Services provided thereto.
6. Respond to all and any inquiries by the County regarding the Clinic and its Services.
7. Assist the County with information needed for audit purposes.
8. Provide the County with quarterly financial statements.
9. Provide the County with any and all certified audits of Provider and the management
letter prepared in connection therewith.

10. Provide financial statements evidencing how County funds are spent. Such statements
to be submitted to County one week prior to the funding dates set forth herein above.
11. Provide the Court with statistics evidencing the number of Brazos County residents
using the Provider's Services and the percentage Brazos County residents comprise of
the total population using Provider's Services.
RESPONSIBILITY OF COUNTY
The County shall be responsible for the following duties and requirements:
1. Provide County funds for the payment of the consideration stated herein.
2. Conduct a review of the Provider's performance in providing the Services to be
provided hereunder in order to assess County's continued participation in the funding
of the Provider.
RECORD RETENTION
The Provider shall be responsible for record keeping on all Services provided to those
individuals using its services and all financial records of the Clinic. The Provider agrees to maintain
and make available for inspection by the County upon request consistent with personal privacy and
subject to the limitation of state law, any and all records the County determines, in its sole discretion,
to be necessary for the Court to justify its continued participation in supporting the Provider with
funding. Such records shall be retained for at least four (4) years from the date the service was
provided. These records shall be made available for inspection and audit by the County, if it so
desires.
DISCR5111NATION
The Provider shall not discriminate against any employee or applicant for employment because
of race, color, religion, sex, or national origin. The Provider shall take affirmative action to ensure
that applicants who are employed are treated during employment, without regard to their race, color,
religion, sex, or national origin. Such action shall include, but not be limited to, the following-
employment, upgrading, demotion, or transfer, recruitment or recruitment advertising, layoff or
termination; rated of pay or other forms of compensation; and selection for training, including
apprenticeship. The Provider agrees to post in conspicuous places, available to employees and
applicants for employment, notices setting forth the provisions of this nondiscrimination clause
INDEMNITY
The parties hereto agree to indemnify one another for and hold one another harmless from and
against all suits, claims, demands, liabilities or actions resulting or alleged to result from the breach,
violation or non-performance of the Services stated herein and for any damage to any person resulting

from any act or omission or negligence on the part of each party hereto.
INSURANCE
The parties hereto agree that the Provider shall be an independent contractor and not any
employee or agent of the County and that each shall maintain at its own expense, adequate liability
insurance to insure against damages and liabilities which may arise due to the duties and obligations
contracted for herein.
COUNTYINVOLVEMENT

The County and Provider state that to the best 'of their knowledge, no officer, agent or
employee of the County who exercises any function or responsibility in connection with the carrying
out of this Contract or the Services to which it relates has personal interest direct or indirect, in this
Contract.
GOVERNING LAW
This Agreement shall be executed in and shall be governed by the laws of the State of Texas.

All notices required to be given hereunder shall be deemed to be duly given by delivering such
notice or by mailing it, registered mail to the other party at the following addresses:

FURTHER ASSURANCES
Each party hereto agrees to perform any further acts and to execute and deliver any further
documents which may be necessary to carry out the provisions of this Agreement.
SEVERABILITY
In the event that any of the provisions or portions thereof, of this Agreement, are held to
be unenforceable or invalid by any court of competent jurisdiction, the validity and enforceability
of the rcmaining provisions or portions thereof shall not be affected thereby.
ENTIRE AGREEMENT
This Agreement contains the entire understanding between the parties hereto concerning
the subject matter contained herein. There are no representations, agreements, arrangements, or
understandings, oral or written, between or among the parties hereto, relating to the subject matter
of the Agreements, which are not fully expressed herein.
ASSIGNABILITY
Provider shall have the right to assign this Contract and any of its rights hereunder to a
wholly owned subsidiary or to a corporation with which it may be merged without prior written
consent of the County, otherwise, this Contract is not assignable by the Provider without the prior
written consent of the County.

etc from county right-of-way.
D) Construction shall be in strict conformance to the latest Texas Manual of

ATTENTION COUNTY JUDGE:
Formal notice is hereby given that GTE will construct a
communication line within the right-of-way of County Road in Brazos
County, Texas as follows:
At the junction of Trotter Land and Hopes Creek Road
a GTE pedestal will be removed and a 4X8X4 ground level
handhole and a X-connect cabinet will be put in its
place to contain an existing splice. The new structures
will be within the R.O.W. of Hopes Creek Road.
The location and description of this line and associated
appurtenances is more fully shown by four (4) copies of drawings
attached to this notice. The line will be constructed and
maintained on the County Road right-of-way in accordance with
governing laws.
Notwithstanding any other provision contained herein, it is
expressly understood that tender of this notice by the GTE
Southwest Incorporated does not constitute a waiver, surrender,
abandonment of impairment of any property rights, franchise,
easement, license, authority, permission, privilege or right now
granted by law or may be granted in the future and any provision or
provisions so construed be null and void.
