21. Request from GTE to place a buried cable in the right-of-way of Old Reliance Road
beginning approximately 0.25 miles from its intersection with Wallis Road and extending
for a distance of 1,685 feet. Site is located in Precinct 3.
22. Permission for Road & Bridge to enter Don Goodwin's property located off Old Bundick
Road for the purpose of cleaning debris from driveway culvert to allow water to drain
properly from culvert and roadway for the health, safety and welfare of the general public.

REGULAR MEETING
OCTOBER 22, 1996
A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, October 22, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Presiding;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of the citizens and officials in
attendance.
The County Judge gave the invocation and led the pledge
of allegiance.
Under citizen input and/or concerns the following
citizens made comments:

All spoke out against the development of the
property next to Fawn Lake Subdivision into a 560+
lot mobile home park. Their objects were as
follows:
Health and Safety Impact
1. Increased Potential for crime in area
2. Traffic hazards/damage to county roads increased
3. Fire protection needs will exceed fire
district capabilities
4. Increased school bus traffic endangers Fawn
Lake morning walkers
5. Questionable adequacy of water supply to meet
increased demand
Environmental Impact
1. Fill-in to affect up and down stream flooding
and backup
2. . Loose pets spread disease as transient
occupants leave
3. Garbage collection fee problems encourages
illegal dumping

Brazos Valley Development Impact
1. Increased school enrollment
2. Increased busing/more traffic on county roads
County Tax Impact
1. Builds image that this part of the county is
for low income development
2. County challenged to collect taxes from
invisible investors
3. Neighboring property values decrease

5. Lower Fire District Income
6. Tax rates will have to be raised to be able to
supply additional services needed
Linda Reed Haas, one of the owners and developers of the
proposed mobil home park made the following comments:
Feels that residents are making a lot of
assumptions that are incorrect. Wants to develop a
mobile home park not a trailer home park. Invited
the concerned citizens to meet with the developers.
The Court proceeded to consider the change of status of

Commissioner Sims questioned the Personnel Change of status
submitted by the District Clerk. On motion by Commissioner
Walker, seconded by commissioner Norton, the Court voted
unanimously to approve the changes with no six (6) month
increase for the new employee in Juvenile Services.

On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court voted unanimously to approve the Claims as
submitted.
_ On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the County
payroll in the amount of $536,000.00 for the period ending
October 24, 1996.
The Court next considered Budget Amendment #95/96-45,
which would reallocate funds budgeted for the various
departments in order to balance the 1995/1996 budget. On
motion by Commissioner Sims, seconded by Commissioner Walker,
the Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to appoint the following
persons as presiding judge and alternate judge for the current

The Court next considered an Agreement for Services with
a
DeLucia Mail Services. In a letter to the Court, Scott
DeLucia, proposes to process 1st class mail for a charge of
c 6.2 cents per piece plus postage of .238 cents which totals to
i 30 cents per piece of mail. This will be a savings of 2 cents
per piece against full postage mail. On motion by
# Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to enter into an Agreement for
f Services with DeLucia Mail Services for the processing of
county mail. A copy of the Agreement is attached hereto.
The next matter for consideration was a contract for
Juvenile Detention Services with the Brazos Valley Development
Council (BVDC). The BVDC has received $45,136.00 FY 97 grant
from the Criminal Justice Division to be used to purchase

juvenile services for the seven counties in the BVDC region.
Brazos County Juvenile Services is a certified detention
facility for one or more of the counties in the BVDC region.
The BVDC proposes to reimburse Brazos County $91.00 per client
per day. Brazos County will in turn keep all project records.
On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to enter into contract with
the BVDC for reimbursement for housing juvenile offenders in
the Brazos County Juvenile Detention facility. A copy of the
contract is attached hereto.
The next matter before the Court was the renewal of a
Contractual Agreement between the Brazos County Emergency
Communications District and the Brazos Valley Narcotics
Trafficking Task Force for the purchase of services for
computer aided dispatch equipment maintenance and network
charges for the giscal year 1997. On motion by Commissioner
Norton, seconded by Commissioner Walker, the Court voted
unanimously to approve the contractual agreement between the
Brazos County Emergency Comnunications District and the Brazos
Valley Narcotics Trafficking Task Force for computer aided

dispatch equipment maintenance and network charges for the
fiscal year 1997 effective October 22, 1996. A copy of the
contractual agreement is attached hereto.
The next matter for consideration was a Contract for

Services with the Brazos County Community Supervision and

Corrections Department for payroll and personnel services.
The contract contains the same provisions as the contract for

the period of September 1, 1995 to August 31, 1996 except for
the final provision that allows for automatic continuation
rather than requiring a new contract every year. On motion by
Commissioner Walker, seconded by Commissioner Norton, the

Court voted unanimously to approve the Contract for Services
with the Brazos County Community Supervision and Corrections
Department for payroll and personnel services. A copy is
attached hereto.

Commissioners Court meeting October 22, 1996
The next matter before the Court was approval of a
Contractual Agreement between Brazos County and Brazos
Beautiful. Brazos Beautiful will provide assistance to the
I community in litter control and beautification. The cost to
Brazos County will be $12,000.00 for fiscal year 1996-1997.
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to enter into contractual
agreement with the Brazos Beautiful. A copy of the
contractual agreement is attached hereto.
The Court next considered renewal of a lease agreement
between Brazos County and Mike Hensarling of Brazos County for
rental of office space in the building located 14821 FM 2154
at the corner of Church Street, in Wellborn, Texas, for the
use of the Constable for Precinct 2. Term of the lease is for
the period of one year commencing on October 1, 1996 and
ending on September 30, 1996. The County agrees to pay Mr.
Hensarling the amount of One Hundred Forty Dollars ($140.00)
per month. On motion by Commissioner Sims, seconded by
Commissioner Cauley, the Court voted unanimously to renew the
lease agreement between Brazos County and Mr. Hensarling for
the period stated above. A copy of the lease agreement is
attached.
The Court next considered renewal of a lease agreement
between Brazos County and Mike Hensarling of Brazos County for
rental of office space in the building located 14821 FM 2154
at the corner of Church Street, in Wellborn, Texas, for the
use of the Justice of the Peace for Precinct 2. Term of the
lease is for the period of one year commencing on October 1,
1996 and ending on September 30, 1997. The County agrees to
pay Mr. Hensarling the amount of Four Hundred Sixty Dollars
($460.00) per month. On motion by Commissioner Norton,
seconded.by Commissioner Walker, the Court voted unanimously
to renew the lease agreement between Brazos County and Mr.

The next matter before the Court was approval of a
Contractual Agreement between Brazos County and the Brazos
County Rape Crisis Center. The Center will provided services
to victims of sexual assault and their families. The cost to
Brazos County will be $13,000.00 annually. The term of the
contract will be from October 1, 1996 to September 30, 1997.
On motion by Commissioner Norton, seconded by commissioner
Cauley, the Court voted unanimously to enter into contractual
agreement with the Brazos County Rape Crisis Center. A copy
of the contractual agreement is attached hereto.
The Court next considered and Agreement with the City of
Bryan and Brazos Beautiful for the planting of Crepe Myrtles
at the Brazos Center. This will be at no cost to the County.
On motion by Commissioner Walker, seconded by Commissioner
Cauley, the Court voted unanimously to enter into agreement
with the City of Bryan and Brazos Beautiful for the planting
of Crepe Myrtles at the Brazos Center. Prior to planting the
trees, the Director of the Center must see a planting diagram.
The next matter for consideration by the Court was a
written request submitted by the County Extension Agent
requesting approval for out of state travel for herself. Ms.
E Nobles would be traveling to Annapolis, Maryland to attend a
Epsilon Sigma Phi national conference during the week of
December 4 through the 7, 1996. Commissioner Cauley moved to
approve the request. Commissioner Walker seconded the motion.
Commissioner Sims questioned what kind of conference this was
and the cost of $115.00 per night for the room. The County
Judge wanted more information. Commissioner Cauley withdrew
his motion and Commissioner Walker withdrew her second. On
motion by Commissioner Norton, seconded by Commissioner Sims,
the Court voted unanimously to table consideration until such
time as more information can be gathered.
The Court next considered approval of the Final Plat of
Melody Acres Phase II Subdivision in Precinct 2. Richard

Commissioners Court meeting October 22, 1996
VAnce, County Engineer, stated that he had reviewed the plat
and offered the following comments:

1) Show utility easements along sides and rear of
lot perimeter.
2) Show a 20 foot utility easement along front of
lot.
3) Show additional right-of-way dedication and
dimensions.
4) Items 2 & 3 should be shown in a larger scale
detail.
5) The note in the lower left corner of drawing
should be changed to indicate a 20 foot utility
easement in addition to the City of Bryan 4.5 foot
right-of-way dedication requirement.
6) Add a paragraph and signature line for the
County Judge.
On motion by Commissioner Walker, seconded by Commissioner
Norton, the Court unanimously approved the final plat of the
Melody Acres Subdivision subject to the developer complying
with the exceptions noted by the County Engineer.
The Court next considered the request from GTE to place
_ a road bore/buried cable (approximately 4,455 feet) in the
right-of-way of Koppe Bridge Road. The site is located in
Precinct 1. The County Engineer stated that all appeared to
be in order and recommended approval. On motion by
Commissioner Norton, seconded by Commissioner Walker, the
Court voted unanimously to approve the request from GTE and
authorized the installation. A copy of the request is
attached hereto.
The Court next considered the request from GTE to place

The Court next considered authorizing work outside of
county rights-of-way for the health, safety and welfare of the
general public. The Road and Bridge Department requested
permission to enter the private property of Don Goodwin on Old
Bundick Road in Precinct 2 to clear out debris from a driveway
culvert to allow water to drain properly from the culvert and
roadway. On motion by Commissioner Walker, seconded by
Commissioner Norton, the Court voted unanimously to authorize
the work.
The Court next considered approval of the following
requisitions from Capital Expenditures:

Commissioner Norton moved approve the requisitions to be paid
from Capital Expenditures. The motion was seconded by

Commissioner Walker. Commissioners Norton, Walker, Sims and
Cauley voted "Aye". The County Judge abstained.
The court next considered approval of a requisition from
the Narcotics Traffick Task Force for the purchase of a Ford
Explorer. Cost of the Explorer is $21,829.30. On motion by
Commissioner Walker, seconded by Commissioner Norton, the
court voted unanimously to approve the requisition in the
amount of $21,829.30. $14,000 to be paid from Grant Funds and

On motion by Commissioner Sims, seconded by Commissioner
Cauley, the Court voted unanimously to approve the Blanket
Purchase Orders as submitted.
The Court next considered approval of the minutes for
meetings held in November 1995 on the following dates: 7, 14,
21, 28 and a Public hearing held on November 14, 1995. On
motion by Commissioner Cauley, seconded by Commissioner
Walker, the Court voted unanimously to approve the minutes as
submitted.
The Court next considered approval of the minutes for
meetings held in December 1995 on the following dates: 5, 12,
19, and 27; an Executive Session held on December 18, 1995; a
Public Hearing held on December 13, 1995; Special Meetings
held on December 6 and 13, 1995; and a workshop held on
December 1, 1995. On motion by Commissioner Cauley, seconded
by Commissioner Walker, the Court voted unanimously to approve
the minutes as submitted.
The Court received, approved and ordered filed as
submitted the Treasurer's report for September 1996. A copy
of which is attached to and made a part of these minutes.
The Court acknowledged receipt of the Extension Service
reports for September 1995 and acknowledged receipt of reports
from County and Precinct offices showing revenues collected
and remitted to the County Treasurer. An excerpt from those
reports is attached hereto.

payroll deductions. It was the consensus of the Court to
discuss this in a Workshop Session.
There was no citizen input and/or concerns.
The County Judge made the following comments:
1) He has spoken spoke with Greg Hudson concerning
the realignment of the Justice of the Peace
Precincts
2) On November 4, 1996 he will be traveling to
Turkey with EDC representatives in an attempt to
lure a business to the area. Will ask the County
to approve out of country travel and pay for
lodging expenses.
There being no further business to come before the Court,
the meeting was adjourned.

AGREEMENT FOR SERVICES
This contract is between DeLucia Mail Services and Brazos County for processing of 1st
class mail. Under this agreement the mail will be processed through Houston by Gulf
Coast Presort. The mail will be transported by a bonded courier each day for processing.
For this service we will charge 6.2 cents per piece service charge. Postage will be .238
cents per ounce. So cost of bar-coded mail will be .30 (.238+.062=.30). A savings of 2
cents per piece against full postage mail Any mail which cannot be bar-coded will be
charged 8.2 cents to bring it up to full postage cost of .32 (.238 + .082=.32) For those
pieces of mail DeLucia Mail Service will not have any further charge. So the maximum
charge for any mail will be normal full postage. Charge for transporting mail is included
in our service charge. A drop shipment slug has been ordered for your new Pitney Bowes
meter at a one time cost of $60.00. This slug prints an endorsement required by the US
Postal Service for mail processed in another city.

CONTRACT FOR DETENTION SERVICES

In accordance with the Uniform Grant and Contract Management Standards and provisions of the Governor's Office,
Criminal Justice Division,. JA-96-J07-09859 Arazos Valley Development Council, and

Brazos County Juvenile Services , hereinafter called Service Agency, by this Agreement, and in consideration of
the mutual promises set forth below, agree that:
L PROVISIONS OF SERVICES
A. The Service Agency agrees to provide the following services, which shall be limited to allege or adjudicated juvenile
offenders in certified detention facilities which meet applicable standards:
B. For and inconsideration of the above-mentioned services, the Brazos Valley 'agrees to pay the

Service Agency and amount not to exceed S 91.00 per client per day. This fee does not exceed the actual cost of care in
the Service Agency, which is S per day, and does not exceed the amount allowed in the current CID Maximum
Rate Schedule. (NOTE: If the contract provides for reimbursement for reserved bed space, substitute the following
language for this paragraph: "The agrees to $ per day per juvenile during
actual days in placement at the Service Agency's facility. The combined fee for reserved bed space and actual days in
placement does not exceed the amount allowed in the current CJD Maximum Rate Schedule.") Total reimbursement under
this contract shall not exceed S
C. The Service Agency is under no obligation to retain space for the client in unauthorized departure situations.
D. Payment is to be made monthly. Claim for payment will be submitted no later than ten days from the last day of the
month for which payment is being requested.
E. Each billing should contain the name of the client or clients for whom payment is being requested along with the
number of days (stated consecutively) for which payment is being requested.
F. The Service Agency is under no obligation to accept a client who is deemed inappropriate for placement in the program
by the Service Agency.
Ti. OTHER PROVISIONS
A. THE GRANTEE SHALL (check one):

of the grant and shall periodically inspect such records to ensure that they are properly kept. Records shall be
preserved for three (3) years for inspection by CJD, or any state or federal agency authorized to inspect the same.
B. In the event of a default of the service provider, the grantee agency may cancel or suspend the contract and the service
provider shall be entitled to recovery for all serviced provided cr materials delivered prior to the cancellation date (or
unused materials may be returned) or shall repay any funds advanced for services not yet rendered.
C. All licenses, legal certifications, or inspections required for the services, facilities, equipment, or materials, and all
applicable state and federal laws and local ordinances must be complied with by the service provider. Failure to comply with
this requirement shall be treated as a default

4. CJD will not approve any salary1from year to year unless the grantee provides adequate
justification in the grant application. CJD will determine whether the justification provided is
sufficient.
5. Overtime pay for any personnel cannot be paid from grant funds.
6. Staff positions that existed prior to the grant are ineligible for CJD funds. (Nonprofit
corporations are exempt from this rule under the VOCA program.)
7. If the grantee agency transfers an existing employee to a grant position, then the agency must
fill that person's original position within 120 days. The grantee's number of non-grant staff
members, therefore, cannot decrease because of the grant award.
8. If a grant-paid position becomes vacant, the grantee must fill the position within 60 days. If
the grantee is unable to fill the position within 60 days, the grantee must request an extension
from CJD in writing.
9. The minimum contribution of in-kind personnel for funds that allow in-kind contributions is
520 volunteer hours per year. See Grantee Contributions, Match Policy, on page 11.
10. Under the Victims of Crime Act Fund, no more than 25% of personnel or personnel time (both
paid and volunteer) can be spent on tasks other than direct-service delivery. These tasks
include administration and support.
11. Personnel is not an eligible category under the Crime Stoppers Assistance Fund.
Professional and Contractual Services
Contracts for services requirements are as follows:
1. An individual may not receive dual compensation from a regular employer and the retaining
grantee for work performed during the same period of time even if the services performed
benefit both.
2. The contractual arrangement must be written, formal, and consistent with the grantee's usual
practices for obtaining such services.
3. The grantee must provide adequate documentation to support time and services and the rates
of compensation.
4. Transportation and subsistence costs for travel by consultants must be at an identified rate
consistent with the grantee's general travel reimbursement practices.
5. Contracts must ensure that the work or services claimed for reimbursement are directly and
exclusively devoted to the grant.
6. The grantee must advertise any ongoing contract to purchase services annually through a
competitive procurement process. The grantee must also document in project records the
procurement process and the criteria used to select contractors. The grantee may extend
existing contracts temporarily to continue services already underway.
7. All contracts in excess of $15,000 require CJD approval. The grantee may submit such
contracts, including sole-source justification, if applicable, with the grant application or, at the

4. For-profit and private nonprofit corporations-The grantee must procure consultants
employed by these organizations through competitive bidding. These costs art not subject to
any maximum rate. Eligible under Fund 421, TTDP, Title V, VOCA, TNCP, CSAF, and SDFSC.
Counseling and Psychological Services
Full battery psychological evaluation-includes (1) diagnostic interview and history; (2)
individual intelligence test; (3) organicity-perceptual test; (4) wide-range achievement test; (5)
projective and objective test; (6) vocational test; (7) aptitude test; or (8) review and evaluation
with written narrative report by a licensed psychologist. Maximum cost per evaluation is
$175. Eligible under Fund 421, TTDP, Title V only, and SDFSC.
2. Individual or family psychological counseling-a licensed psychologist, licensed counselor,
or licensed social worker (advanced clinical practitioner) must directly perform these services.
Administrative expenses and communications with family or other agencies are part of the
cost per counseling hour. The provider may not bill as a separate and additional cost.
Maximum cost per hour is $66. Eligible under Fund 421, TTDP, Title V. VOCA, and SDFSC.
3. Group psychological counseling for children (maximum of eight membtsrs in group, 1.5
hours per session)-a licensed psychologist, licensed counselor, or licensed social worker
(advanced clinical practitioner) must directly perform these services. Administrative expenses
and communication with family, referral source, or other agencies are part of the cost per
counseling hour. The provider may bill as a separate and additional cost. Maximum cost per
individual per session is $28. Eligible under Fund 421, TTDP, Title V. VOCA, and SDFSC.
4. Individual or family chemical dependency counseling-a licensed chemical dependency
counselor or a Certified Alcohol and Drug Abuse Counselor (CADAC) must perform these
services. Administrative expenses and communication with family, referral source, or other
agencies are part of the cost per counseling hour. The provider may not bill as a separate and
additional cost. Maximum cost per hour is $47. Eligible under Fund 421, TTDP, Title V, and
DFSC.
5. Group chemical dependency counseling- (maximum of eight persons in group, 1.5 hours
per session) a licensed chemical dependency counselor or a CADAC must directly perform
these services. Administrative expenses and communication with family, referral source, or
other agencies are part of the cost per counseling hour. The provider may not bill as a
separate and additional cost. Maximum cost per individual per session is $16. Eligible under
Fund 421, TTDP, Title V. and SDFSC.
Psychiatry
1. Psychiatric diagnostic interview or examination-including history, mental status, and
recommended disposition The provider must include communications with family, school, or
referral source in the maximum fee. A licensed psychiatrist must directly perform these
services. Maximum cost per hour is $80. Eligible under Fund 421, TTDP, Title V, and SDFSC.
2. Individual medical psychotherapy-must be performed directly by a licensed psychiatrist.

development of normalized social skills. Maximum cost per day is $42. Eligible under Fund
421 and 11DP. '

Level III-intermediate 24-hour care and supervision for juveniles 10 to 17 years old; placed
by a juvenile court, in a licensed or certified therapeutic foster family home; therapeutic foster
group home, basic child care facility, residential treatment center, wilderness camp, halfway
house, or habilitative foster family or foster group home, when the primary reason for
placement is a need for basic care plus structure, educational support, a higher level of
supervision, and the development of normalized social skills. Maximum cost per day is $58.
Eligible under Fund 421 and JJDP.
4.
Level IV-therapeutic 24-hour care and supervision for juveniles 10 to 17 years old; placed by
a juvenile court, in a licensed residential treatment center or in a therapeutic or wilderness
camp when the primary reason for placement is a severe emotional or behavioral problem
resulting in the juvenile's inability to function in the home, school, or community. Juveniles at
this level of care have physical, mental, and emotional needs and behaviors that may present a
low to moderate risk of causing harm to themselves or others. They require physical
environments and treatment programs in which most activities are therapeutically designed to
improve social, emotional, and educational adaptive behavior. The juveniles may require
psychological or psychiatric services that are integrated into the residential program to assess
and monitor admission, discharge, and treatment plans. Maximum cost per day is $83.
Eligible under Fund 421 and TIDP.
5.
Level V-intensive 24-hour care and supervision for juveniles 10 to 17 years old, placed by a
juvenile court, in a licensed basic child care facility, a therapeutic camp, a residential treatment
center, or a substance abuse treatment facility certified by the Texas Commission on Alcohol
and Drug Abuse, when the primary reason for placement is a need for treatment of severe
emotional or behavior disorders or conditions that require a highly structured program to
improve functioning or maintenance. Such juveniles may present a moderate to severe risk of
causing harm to themselves or others. Maximum cost per day is $101. Eligible under Fund
421 and 1TDP.
6.
Level VI-inpatient-psychiatric 24-hour care and supervision for juveniles 10 to 17 years old,
placed by a juvenile court, in an in-patient psychiatric hospital accredited by JCAH and
licensed by Texas Department of Mental Health and Mental Retardation as an in-patient
psychiatric facility, when the primary reason for placement is a need for treatment of an acute
or chronic emotional or behavioral disorder or condition that requires a highly structured
program with 24-hour supervision to improve functioning or maintenance. Such juveniles
may present a severe to critical risk of causing harm to themselves or others. Maximum cost

per day is $188. Eligible under Fund 421 and JJDP.
7.
Level VII-emergency shelter 24-hour care and supervision for juveniles 10 to 17 years old,
placed by a juvenile court or authorized officer of the court, in a licensed emergency shelter, r~
when the primary reason for placement is an emergency. Maximum cost per day is $91.

The Brazos Valley Development Council (BVDC) received a $45,136.00 FY 97 grant
from the Criminal Justice Division (CJD) of the Governor's Office. These rant funds
will be used to purchase juvenile services for the seven counties in the BVDC region:-
Brazos, Burleson, Grimes, Leon, Madison, Robertson, and Washington.

Juvenile Probation officers. To allow BVDC to reimburse you for services rendered,
please complete, sign, and return to the above address one of the enclosed standard CJD
contracts for services. To ensure speedy payments, please return this contract to me by

Please note that you will continue to bill the customer (Brazos, Burleson, Grimes, Leon,
Madison, Robertson, and Washington Counties) as you normally do. The Chief
Probation officer in each county will then submit invoices to me as needed. BVDC will

THIS CONTRACT AND AGREEMENT, made and entered into this 22th day of
October, 1996, by and between the County of Brazos and Brazos County Emergency
Communications District, and possibly any other public entity, each participating
government acting by and through its respective executive office hereunto duly
authorized by resolution of the governing body.
WITNESSETH:
WHEREAS, the respective participating governments are authorized by the
Interlocal Cooperation Act, V.T.C.A. Government Code Chapter 791, to enter into joint
contracts and agreements for the performance of governmental functions. and services
including administrative functions normally associated with the operation of government
such as necessary materials, supplies and services:
WHEREAS, it is the desire of the aforesaid participating governments to comply
and further the policies and purposes of the Interlocal Cooperation Act;
WHEREAS, the participating governments cannot normally obtain the best
passible service for computer aided dispatch equipment and network charges acting
individually and without cooperation; and
WHEREAS, it is deemed in the best interest of all participating governments that
said governments do enter into a mutually satisfactory agreement for purchase of services
for computer aided dispatch equipment maintenance and network charges for the fiscal
year 1997;

The Brazos County Community Supervision and Corrections Department,
hereinafter referred to as the "Department" and Brazos County, hereinafter
referred to as the "County", by this agreement and in consideration of the mutual
promises set forth below, have agreed as follows:
The County agrees to provide personnel and payroll services as directed by the
Department as follows:
• Orientation of all new employees regarding pension plans, health insurance,
optional insurance policies, and the cafeteria plan;
• Calculation and production of payroll checks;
• Calculation, preparation and filing of the 941 Employer's Federal Quarterly
Tax Return;
• Informational reporting required by the U. S. Department of Labor Statistics;
• Preparation and filing of the Texas Employment Commission's informational
report;
• Preparation and filing of the informational report to the Texas County and
District Retirement System;
• Preparation and disbursement of all employee opted deductions;
• Preparation of the biweekly FICA, Medicare and Federal tax deposit;
• Preparation and disbursement of the payment to Texas County and District
Retirement System;
• Computation and recordkeeping of sick, vacation, and floating holiday leave
balances;
• The County will notify the Department of the total amount to transfer to the
County Payroll Fund for each payroll;
• The County will provide the Department with an itemized list of gross wages
paid to each employee and a summary of benefits paid for employees
including FICA, retirement, and health insurance each payroll;

• The County will provide the Department with an itemized list of all
unemployment benefits paid to former employees of the Department upon
receipt of the invoice from the Texas Employment Commission each calendar
quarter. The Department is responsible for remitting this amount to the
County Treasurer's Office upon receipt of the invoice. The County will
prepare and remit the full payment to the Texas Employment Commission;
• The County agrees to furnish to the Department such information as may be
requested which relates to the services described in this contract.
The Department, in consideration of the aforementioned, will provide the
following:
• Pursuant to Title 2, Subtitle F, Chapter 76 of the Texas Government Code
(fomerly titled Article 42.131 section 6 of the Texas Code of Criminal
Procedure) the employees of the Department will participate in, the Brazos
County Group Health Insurance Plan. The Department employees will folrow
the same policies and receive the same benefits accorded County employees
for the same premium per employee per month set by Commissioner's Court
for County employees;
• Pursuant to Title 2, Subtitle F, Chapter 76 of the Texas Government Code
(formerly titled Article 42.131 section 6 of Texas Code of Criminal Procedure)
the employees of the Department will participate in the Texas County and
District Retirement System. The Department employees will comply with the
rules ana procedures prescribed by the Texas County and District Retirement
System and will receive the same benefits accorded County employees. The
Department agrees to pay the same rate established by Commissioner's
Court for County employees as retirement benefits. This amount will be paid
to the County Treasurer's Office for remittance to the Texas County and
District Retirement System; .
• The Department will record hours to be paid on the timesheet provided by the
County Payroll Officer and will present this to the Treasurer's Office at the
time designated by the County Payroll Officer. The Department will be
responsible for all hours reported;
• The Department will also record on the timesheet any hours earned or used
for vacation, sick, compensatory time, or holidays;
• The Department will transfer the amount of gross wages plus benefits,
consisting of FICA, retirement, and health insurance premiums, to the County
Payroll Fund no later than 3:00pm on the day paychecks are distributed;

THE STATE OF TEXAS
COUNTY OF BRAZOS
This is an agreement by and between the County of Brazos
(hereinafter referred to as "COUNTY") and BRAZOS BEAUTIFUL, INC.,
a non-profit association for the improvement of the aesthetic
appearance of Brazos County (hereinafter referred to as "BRAZOS
BEAUTIFUL"). -
WHEREAS, BRAZOS BEAUTIFUL has been created to provide
assistance to the community in litter control and beautification;
WHEREAS, BRAZOS BEAUTIFUL has expanded its efforts into solid
waste management and recycling;
NOW, THEREFORE, FOR AND IN CONSIDERATION of mutual promises
recited herein, the parties agree as follows:
1. BRAZOS BEAUTIFUL shall provide services in litter control
and beautification and will develop programs directed toward solid
waste management and recycling. BRAZOS BEAUTIFUL shall also assist
in conducting a pilot program for the County Citizen Collection and
Recycling Stations for the rural citizens of Brazos County.
2. BRAZOS BEAUTIFUL will be funded by the COUNTY in the
amount of Twelve Thousand Dollars ($12,000.00), from the County
1996-97 Fiscal Year Funds.
3. BRAZOS BEAUTIFUL shall maintain fiscal records and
supporting documentation in the form of canceled checks, payroll

7. Either of the parties shall have the right to terminate
this agreement in whole or in part at any time. Notice to
terminate this agreement will be given in writing at least thirty
(30) days prior to the date of termination. The notice shall
include the reasons for such termination, the effective date of the
termination, and in the case of partial termination, the portion of
the agreement to be terminated.

LEASE AGREEMENT
This lease Agreement is made and entered into this ~ day of October, 1996
by, and between MIKE HENSARLING of Brazos County, herein called "Lessor", and
BRAZOS COUNTY, TEXAS herein called "Lessee".
In consideration of the mutual covenants and agreements herein set forth, and
other good and valuable consideration, Lessor does hereby demise and lease to
Lessee, and Lessee does hereby lease from Lessor, the following described premises
located in Brazos County, Texas:
Office space (approximately 940 sq. ft.) in the building located at 14821
FM 2154 which is on the corner of FM 2154 and Church Street in Wellborn to
include water and sewer along with restroom. It will also provide handicap

access.
TERM
The term of this lease shall be for a period of one year commencing on October
1, 1996 and ending on September 30, 1997.
RENT
Lessee agrees to pay to Lessor as rent for the leased premises the sum of
FOUR HUNDRED SIXTY DOLLARS (;460.00) per month on the first of each month.
. USE OF PREMISES
The leased premise shall be used only as an office and Lessee shall not permit
the leased premises or any part thereof to be use for: (a) the conduct of any
offensive, noisy, or dangerous activity that would increase the premiums for fire
insurance on the leased premises; (b) the creation or maintenance of a public
nuisance; (c) anything which is against public regulations or rule of any public
authority at any time applicable to the leased premises; or (d) any purpose or in
any manner which will obstruct, interfere with, or infringe on the rights of other

tenants or adjoining property owned by Lessor, nor shall the leased premises be
occupied by any person or persons other than the person or persons authorized by
Lessee.
INDEMNITY AGREEMENT
Lessee agrees to indemnify and hold Lessor and the property of Lessor,
including the leased premises, fee and harmless, from any and all liability for injury
to, or death of, any person, including employees of Lessee or for damage to property
arising from the use and occupancy of the leased premises by Lessee or from the act
or omission of any person, or persons, including employees of Lessee, in or about
the leased premises with the express or implied consent of lessee; provided that
nothing in this agreement shall expand or enlarge the liability of lessee greater than
that of Lessee under the Texas Tort Claims Act.
ALTERATIONS AND WROVEMENTS
Lessee shall make no alterations to the building on the leased premises nor
construct any buildings or other improvements on the leased premises without first
having obtained the written consent of Lessor.
LESSOR REPAIRS
Lessor shall, at his expense, change, clean, or replace all air conditioning
filters as he deems necessary for the proper maintenance of the air conditioning
equipment. Lessor shall, after notice and at his expense, make all roof, floor (other
than surface material), pavement, electrical, plumbing, air condition, heating,
structural repairs and replacements, including but not limited to those required by
public authorities, all repairs and replacements to and painting of the exterior walls,
(outside doors and overhead doors are considered as outside walls). Lessor shall
replace all broken window and plate glass except damage resulting from negligence
of Lessee. If Lessor fails or neglects within a reasonable time to make repairs or

corrections which, under the terms hereof Lessor is required to make after written
notice to Lessor by Lessee, or having started such repairs or corrections, Lessor
fails to complete them within a reasonable time, Lessee may cause such repairs or
corrections to be made or completed at Lessor's cost and expense and may deduct
from subsequent installments of rent an amount sufficient to reimburse itself for
costs and expenses incurred. Unless otherwise herein provided, all normal repairs,
painting and replacements to the inside of buildings shall be made at the expense of
Lessee which shall surrender the same at the end of the Lease term or any extension
thereof in substantially as good condition as when received, ordinary wear and tear,
damage by fire or the elements and unavoidable casualties excepted.
DESTRUCTION OF PREMISES
Should any building or improvements on the leased premises be damaged or
destroyed by fire, the elements, acts of God, or other causes not the fault of Lessee
or any person in or about the leased premises with the express or implied consent
of Lessee, they shall be repaired or replaced by Lessor at his own cost and expense
and the rent payable by Lessee pursuant to this lease shall be abated to the extent
such damage or destruction renders the leased premises uninhabitable by Lessee.
Provided however, should the cost of repairing or restoring any buildings or
improvements so damaged or destroyed exceed twenty-five percent (25%) of the
j replacement cost of all buildings and improvements now located on the leased
premises, or if more than fifty percent (50%) of the total floor space of the leased

CONDITION OF PREMISES
Lessee stipulates that the leased premises, as well as all building and
improvements located thereon, are at the date of this lease in good order, repair and
a safe and clean condition.
UTILITIES
All charges for electricity, shall be paid by Lessee. All charges for water and
other utility services shall be paid by Lessor.
IMPROVEMENTS PROPERTY OF LESSOR ,
All alterations, changes, and improvements built constructed, or placed in the
leased premises by Lessee, other than movable personal property shall, unless
otherwise provided by written agreement between Lessor and Lessee, be the
property of Lessor and remain in the leased premises at the expiration or sooner
termination of this lease. Lessee at the termination of the lease shall not be required
to restore the improvements to their original condition. Nothing contained in this
paragraph, however, shall authorize Lessee to make or place any such alteration,
change, or improvements on the leased premises without having first obtained the
written consent of Lessor.
ASSIGNMENT AND SUBLETTING
Lessee shall not assign this lease nor sublet the leased premises or any
interest therein without first obtaining the written consent of Lessor, which consent
shall not be unreasonably withheld. A consent by Lessor to one assignment or
subletting shall not be deemed to be a consent to any subsequent assignment or
subletting. An assignment or subletting without the written consent of Lessor, shall
be void and shall, at the option of the Lessor, terminate the lease.

At the expiration of this lease, should Lessee hold over for any reason
whatsoever, it is hereby agreed that in the absence of a written agreement to the
contrary, such tenancy shall be from month to month only under the same conditions
and at the same monthly rental as provided herein.
SUBORDINATION OF LEASE
This lease and Lessee's leasehold interest under this lease are and shall be
subject, subordinate, and inferior to any lien or encumbrance now on the leased
premises by Lessor.

RIGHT OF INSPECTION
Lessor and his agents have the right at all reasonable times during the terms
of this lease to enter the leased premises for the purpose of inspecting them and all

In the event Lessor violates or fails to perform any provisions or agreements
of the lease to be performed or complied with by Lessor, and such violation or failure
continues for fifteen days after written notice thereof to Lessor, Lessee may, in

deduct all such payments from the rent.
DEFAULT BE LESSEE
Should Lessee be in default for a period of more than ten (10) days in the
payment of any rent payable under this lease or in the performance of any other
provision of this lease and such default continues for thirty (30) days after written
notice, Lessor may terminate this lease and regain possession of the leased premises
in the manner provided by the laws of the State of Texas in effect at the date of such
default.

Either party hereto may change his address for the purpose of this paragraph by
giving written notice of such change to the other party in the manner provided for

USE OF OFFICES
The leased premises are to be used as office space for the Justice of the Peace
for Precinct Two (2) of Brazos County.
LOCATION FOR RENT PAYMENT
Unless changed by written notice pursuant to the provisions in the above
heading under Notices, all rent payable under this lease shall be paid to Lessor at
P. O. Box 126, Wellborn, Texas, 77881.
ATTORNEY'S FEES
Should any litigation be commenced between the parties hereto concerning the
leased premises, this lease, or the rights and duties of either party in relation

unenforceable provision had never been contained herein.
PRIOR AGREEMENTS SUPERSEDED
This agreement constitutes the sole and only agreement of the parties hereto

No amendment, modification, or alteration of the terms hereof shall be binding

services to the victims of sexual assault; and
WHEREAS, the Provider shares this common goal with the County; and
WHEREAS, the County desires to assist the Provider in providing
support services to victims of sexual assault through funds provided
by the County.
NOW THEREFORE the parties above stated agree to the'following
terms and conditions to provide such support services.
TERM
This contract shall continue in force and effect for a term of
twelve (12) months commencing on the 1st day of October, 1996, and
terminating 30th day of September 1997.
CANCELLATION
This contract may be canceled by any parties hereto upon sixty
(60) days written notice as provided herein.
SERVICES TO BE PERFORMED BY PROVIDER
The Provider will provide services to victims of sexual assault
and their families. These services will include: a 24-hour hotline
and 24-hour escort service; one-on-one counseling; group counseling;
community awareness programs; Speaker's Bureau; training and
supervision of volunteers; training for law enforcement agency
personnel, the medical community, clergy, staff of the District
Attorney's office and psychologists.
USE OF COUNTY FUNDS

Funds to be furnished to Provider as stated herein below shall be
used to pay operational expenses of the Provider, including rent,
telephone expenses, and office supplies, as described in Exhibit A -
Budget, attached hereto and made a part hereof for all purposes.

COUNTY'S LIABILITY FOR PAYMENT
The County agrees to reimburse the Provider a maximum amount of
money totaling $13,000 for the term of this Contract.
This sum shall be paid upon the following date and in the
following amount:
December 1, 1996 $13,000.00
RESPONSIBILITIES OF PROVIDER
Provider will be responsible for providing the following services
pursuant to this Contract:
1. Maintaining this Contract;
2. Providing of the Provider's Services;
3. Maintaining data files on clients and the Services provided
thereto;
4. Respond to all and any inquiries by the County regarding the
Center and its Services;
5. Assist the County with information needed for audit purposes;
6. Provide the County with quarterly financial statements;
7. Provide the County with any and all certified audits of
Provider and the management letter prepared in connection
therewith;
8. Provide the Court with statistics evidencing the number of
Brazos County residents using the Provider's Services and the
percentage Brazos County residents comprise of the total
population using the Provider's Services.
RESPONSIBILITY OF COUNTY
The County shall be responsible for the following duties and
requirements:
1. Provide County funds for the payment of the consideration
stated herein.
2. Conduct a review of the Provider's performance in providing
the Services to be provided hereunder in order to assess
County's continued participation in the funding of the
Provider.

RECORD RETENTION
The Provider shall be responsible for record keeping on all
Services provided to those individuals using its services and all
financial records of the Center. The Provider agrees to maintain and
make available for inspection by the County upon request consistent
with personal privacy and subject to the limitation of state law, any
and all records the County determines, in its sole discretion, to be
necessary for the Court to justify its continued participation in
supporting the Provider with funding. Such records shall be retained
for at least four (4) years from the date the service was provided.
These records shall be made available for inspection and audit by the
County, if it so desires.
DISCRIMINATION
The Provider shall not discriminate against any employee or
applicant for employment because of race, color, religion, sex, or
national origin. The Provider shall take affirmative action to ensure
that applicants who are employed are treated during employment,
without regard to their race, color, religion, sex, or national
origin. Such action shall include, but not limited to, the following:
employment, upgrading, demotion, or transfer; recruitment or
recruitment advertising; layoff or termination; rated of pay or other
forms of compensation; and selection for training, including
apprenticeship. The Provider agrees to post in conspicuous places,
available to employees and applicants for employment, notices setting
forth the provisions of this nondiscrimination clause.
INDEMNITY
The parties hereto agree-to indemnify one another for and hold one
another harmless from and against all suits, claims, demands,
liabilities or actions resulting or alleged to result form the breach,
violation or non-performance of the services stated herein and for any
damage to any person resulting form any action or omission or
negligence on the part of each party hereto.
INSURANCE
The parties hereto agree that the Provider shall be an independent
contractor and not any employee or agent of the County and that each
shall maintain at its own expense, adequate liability insurance to
insure against damages and liabilities which may arise due to the
duties and obligations contracted for herein.

COUNTY INVOLVEMENT
The County and Provider state that to the best of their knowledge,
no officer, agent or employee of the County who exercises any function
or responsibility in connection with the carrying out of this Contract
or the services to which it relates has personal interest direct or
indirect, in this Contract.
GOVERNING LAW
This Agreement shall be executed in and shall be governed by the
laws of the State of Texas.
NOTICES
All notices required to be given hereunder shall be deemed to be
duly given by delivering such notice or by mailing it, registered mail
to the other party at the following addresses:

SEVERABILITY
In the event that any of the provisions or portions thereof, of
this Agreement, are held to be unenforceable or invalid by any court
of competent jurisdiction, the validity and enforceability of the
remaining provisions or portions thereof shall not be affected
thereby.
ENTIRE AGREEMENT
This Agreement contains the entire understanding between the
parties hereto concerning the subject matter contained herein. There
are no representations, agreements, arrangements, or understanding,
oral or written, between or among the parties hereto, relating to the
subject matter of the Agreements, which are not fully expressed
herein.

VUL
ASSIGNABILITY
Provider shall have the right to assign this Contract and any of
its rights hereunder to a wholly owned subsidiary or to a corporation
with which it may be merged without prior written consent of the
County; otherwise, this Contract is not assignable by the Provider
without the prior written consent of the County.

communication line within the right-of-way of County Road in Brazos
County, Texas as follows:
Beginning at a point 1474' west of the junction of
Batts Ferry Rd. and Koppe Bridge Rd., a bore will
be made northeast across Koppe Bridge Rd. and 6-0'
of buried cable will cross the road; then 2981' of
buried cable will be placed northwest at 5' within
the northeast R.O.W. of Koppe Bridge Road. The
proposed cable will be buried to a minimum depth of
30".

attached to this notice. The line will be constructed and
