THE COMMISSIONERS COURT WILL MEET IN REGULAR SESSION ON TUESDAY,
OCTOBER 8, 1996 AT 9:00 A.M. IN THE COMMISSIONERS COURTROOM OF THE
BRAZOS COUNTY COURTHOUSE, 300 EAST 26TH STREET, SUITE 115, BRYAN,
TEXAS.

A regular meeting of the Commissioners' Court of Brazos
County, Texas was held in the Commissioners' Courtroom in the
Courthouse in Bryan, Brazos County, Texas, beginning at 9:00
a.m. on Tuesday, October 8, 1996, with the following members
of the Court present:
Alvin W. Jones, County Judge, Absent;
Gary Norton, Commissioner of Precinct 1;
Sandie Walker, Commissioner of Precinct 2, Presiding;
Randy Sims, Commissioner of Precinct 3;
Carey Cauley, Jr., Commissioner of Precinct 4;
Mary Ann Ward, County Clerk.
Attached is a list of citizens and officials in
attendance.
Commissioner Sims gave the invocation and led the pledge
of allegiance.
There was no citizen input and/or concerns.
The Court proceeded to consider the change of status of
the following employees.

On motion by Commissioner Cauley, seconded by Commissioner
Sims, the Court voted unanimously to approve the Claims as
submitted.

on motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to approve the
County payroll in the amount of $522,000.00 for October 10,
1996.
The Court next considered Budget Amendment ##96/97-02,
which would correct clerical errors in the personnel budgets
of the Sheriff's office, Jail Administration, County Treasurer
and Purchasing Department; adjust the Grants of the
Metropolitan Planning Organization and the Brazos Valley
Narcotics Trafficking Task Force and transfer funds from
Contingency to the Extension Service. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to approve the budget amendment as
submitted, a copy of which is attached hereto.
The next matter for consideration by the Court was a
written request submitted by Steve Smith, Judge of County
Court at Law I, requesting approval for out of state travel
for himself. Judge Smith would be traveling to Reno, Nevada
to attend the "Advanced Evidence" seminar during the week of
November 3 through the 8, 1996. On motion by the Commissioner
Cauley, seconded by Commissioner Sims, the Court voted
unanimously to grant the request from Judge Smith and approved
payment of out of state travel expense for him. The County
will pay for three of the five nights he will be staying in
Reno.
The Court next considered a contract for lease of
cellular telephones with AT&T for Juvenile Services. AT&T
will lease a Mortorola Ultra Classic II cellular phone for a
period of one year at a cost of $16.66 per month. Total
annual cost will be $199.99. On motion by Commissioner
Walker, seconded by Commissioner Norton, the Court voted
unanimously to table consideration until such time as
additional information can be obtained.
The Court next considered renewal of a lease agreement
between Brazos County and Fred Keller of Brazos County for
rental of office space in the building located on 8991 East

Highway 21, in Bryan, Texas, for the Justice of the Peace for
Precinct 3. Term of the lease is for the period of one year
commencing on October 1, 1996 and ending on September 30,
1997. The County agrees to pay to Mr. Fred Keller the amount
of seven hundred fifty dollars ($750.00) per month. On motion
by Commissioner Sims, seconded by Commissioner Norton, the
Court voted unanimously to renew the lease agreement between
Brazos County and Mr. Keller for the period stated above. A
copy of the lease agreement is attached.
The Court next considered a lease agreement between
Brazos County and Janie Moore of Brazos County for rental of
a parcel of land located on FM 2038 in Brazos County, Texas,
for the purpose of operating a Citizens' Collection Station.
Term of the lease is for the period of one year commencing on
October 1, 1996 and ending on September 30, 1997. The County
agrees to pay to Mrs. Moore one thousand two hundred dollars
($1,200.00) in one annual payment in advance. On motion by
Commissioner Sims, seconded by Commissioner Norton, the Court
voted unanimously to renew the lease agreement between Brazos
County and Mrs. Moore.for the period stated above. A copy of
the lease agreement is attached.
The next matter for consideration was the renewal of the
lease between the College Station School District and Brazos
County for the lease of office space for Justices of the
Peace, Precinct 7. The property is located at 100 Anderson in
College Station. Term of the lease is on an annual basis and
that all other conditions of the lease will remain the same as
the original lease executed in 1991. On motion by Commis-
sioner Sims, seconded by Commissioner Norton, the Court voted
unanimously to renew the lease with the College Station
Independent School District. A copy is attached hereto.
The next matter before the Court was the renewal of the
Child Welfare Board Contract between the Texas Department of
Protective and Regulatory Services and Brazos County. This
is a non-financial agreement in which the Texas Department of
Protective and Regulatory Services *and the County agree to

continue the child welfare board and revise the contract to
change the contract number and update terminology. On motion
by Commissioner Walker, seconded by Commissioner Sims, the
Court voted unanimously to renew the Child Welfare Board
Contract between the Texas Department of Protective and
Regulatory Services and Brazos County. A copy of the contract
is attached hereto.
On motion by Commissioner Cauley, seconded by
Commissioner Sims, the Court voted unanimously to appoint the
following persons as presiding judge and alternate judge for
the current voting year at the following voting precincts:

The Court next considered approval of the Preliminary
Plat of Timbercreek at Steep Hollow Phase II Subdivision in
Precinct 3. Richard Vance, County Engineer, noted the
fallowing exceptions:
1) The road needs to be moved away from the
pipeline easement so utility easement along the
road does not share the same space along Planters
Drive, Block One, Lots 8, 9,& 10.
2) The boundary line between the cemetery and Lot
15, Block One needs to be clarified.
3) The utility easements behind the lots in Bock
Two should show 20 feet instead of the 16 feet
shown on the plat.
4) Show pond spillway or overflow route and pipe
(sized correctly) under the road to carry pond
overflow on Lot 7, Block 2.
5) Define right-of-way dedications more clearly
along FM 1179 and Steep Hollow Road (maybe with a
detail).
6) The 15 foot easements along FM 1179 and Steep
Hollow Road need to be labeled "Wickson Water".
7) Need cross section with data stating proof that
roadbed build-up of Planters Drive in f loodplain
will not adversely impact surrounding properties in
floodplain.
8) 9-1-1 requests another name for Paden Drive.

Norton, the Court voted unanimously to approve the Preliminary
Plat of Timbercreek at Steep Hollow Phase II Subdivision in
Precinct 3 subject to the developer addressing the previously
stated exceptions.
The Court next considered awarding the following bids:

Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Young Materials as Primary
and Paveway Contractors, Inc. as
Secondary. On motion by Commissioner
Norton, seconded by Commissioner Sims,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Young Materials
as Primary and Paveway Contractors, Inc.
as Secondary. A copy of the bid
tabulation is attached hereto.
Bid No. 96-041 - Aggregate for Surface Treatments
Cheryl Turney, Purchasing Agent,
recommended acceptance of the bid
submitted by Young Materials for "Loaded
Only" as Primary and Colorado Materials,
as Alternate and the bid submitted by
Austin Crushed Stone for "Loaded and
Hauled" as Primary and Young Contractors,
as Alternate. On motion by Commissioner
Sims, seconded by Commissioner Cauley,
the Court voted unanimously to accept the
recommendation of the Purchasing Agent
and award the contract to Young Materials
for "Loaded Only" as Primary and Colorado
Materials, as Alternate and the bid
submitted by Austin Crushed Stone for
"Loaded and Hauled" as Primary and Young
Contractors, as Alternate. A copy of the

On motion by Commissioner Norton, seconded by Commissioner
Cauley, the Court voted unanimously to authorize the
Purchasing Agent to advertise for bids for the previously
named items.
The Court next considered the renewal of Bid No. 96-005 -
Annual Contract for Operator and Equipment for the Road and
Bridge department. In a letter received from Texcon, General

Contractors, Mr. Carey D. Smith, President, proposed a
continuance of the existing contract to be renewed at the same
prices without any escalation for the period beginning
November 15, 1996 through November 15, 1997. On motion by
Commissioner Norton, seconded by Commissioner Cauley, the
Court voted unanimously to renew the Annual Contract for
Operator and Equipment for the Road and Bridge department
under the conditions specified above. A copy is attached
hereto.

Commissioners' Court meetings held in October 1995, on the

2, 1995. On motion by Commissioner Norton, seconded by
Commissioner Cauley, the Court voted unanimously to approve
the minutes as submitted.
Under citizen input and/or concerns the following comment
was made:
Mike Mahoney - said he had an interest in some
property on FM 2038 and that the road through Fawn
Lake to his property had been worked to deny him
access to his property. Wants that road restored
to allow access to his property because he has
plans for it.
Demetrio Basdekas - asked about the County Judge's
health.
On motion by Commissioner Walker, seconded by
Commissioner Cauley, the Court voted unanimously to delay the
Executive Session until a later date.
Action on the Executive Session was unnecessary since the
Executive Session had been delayed until a later date.
There being no further business to come before the Court,
the meeting was adjourned.

BUDGET AMENDMENT(S) FOR THE 1995-1996 BUDGET YEAR

on this the 8th day of October 1996 at a regular meeting of the
Commissioners' Court, the following members were present:

The following proceedings were held:
THAT WHEREAS, on October 8, 1996, the Court heard and approved
a budget amendment for the 1996-1997 budget year for Brazos County,
Texas.
WHEREAS, an expenditure is necessary due to the necessity to
meet unusual and unforeseen conditions which could not be
reasonably included in the original budget adopted August 8, 1996
the following amendment(s) to the original are hereby authorized,
as described on the attached page(s).

During the budget hearings Agricultural Extension requested $3,000 for "Temporary"
employment. It was noted that this has been annual recurring request. The request
was ranted. However, during the personnel discussions on August 8th it was noted

LEASE AGREEMENT
This lease Agreement is made and entered into this First day of October, 1996,
by and between FRED KELLER of Brazos County, herein called "Lessor", and
BRAZOS COUNTY, TEXAS herein called "Lessee".
In consideration of the mutual covenants and agreements herein set forth, and
other good and valuable consideration, Lessor does hereby demise and lease to
Lessee, and Lessee does hereby lease from Lessor, the following described premises
located in Brazos County, Texas:
Office space (approximately 1760 sq. ft.) in the building located on 8991 East
Highway 21, Bryan, Texas 77803, to include water and sewer along with
restrooms. It will also provide handicap access.
TERM
The term of this lease shall be for a period of one year, commencing October
1, 1996 and ending on September 30, 1997.
RENT
Lessee agrees to pay to Lessor as rent for the leased premises the sum of
$750.00 (Seven Hundred Fifty Dollars) per month on the first of each month.
USE OF PREMISES
The leased premise shall be used only as an office and Lessee shall not permit
the leased premises or any part thereof to be use for: (a) the conduct of any
offensive, noisy, or dangerous activity that would increase the premiums for fire
insurance on the leased premises; (b) the creation or maintenance of a public
nuisance; (c) anything which is against public regulations or rule of any public
authority at any time applicable to the leased premises; or (d) any purpose or in
any manner which will obstruct, interfere with, or infringe on the rights of other
tenants or adjoining property owned by Lessor, nor shall the leased premises be

occupied by any person or persons other than the person or persons authorized by
Lessee.
INDEMNITY AGREE6IENT
Lessee agrees to indemnify and hold Lessor and the property of Lessor,
including the leased premises, fee and harmless, from any and all liability for injury
to, or death of, any person, including employees of Lessee or for damage to property
arising from the use and occupancy of the leased premises by Lessee or from the act
or omission of any person, or persons, including employees of Lessee, in or about
the leased premises with the express or implied consent of lessee; provided that
nothing in this agreement shall expand or enlarge the liability of lessee greater than
that of Lessee under the Texas Tort Claims Act.
ALTERATIONS AND WROVEMENTS
Lessee shall make no alterations to the building on the leased premises nor
construct any buildings or other improvements on the leased premises without first
having obtained the written consent of Lessor.
LESSOR REPAIRS
Lessor shall, at his expense, be responsible for fresh water lines to the
building. Unless otherwise herein provided, all normal repairs, painting and
replacements to the inside of buildings shall be made at the expense of Lessee which
shall surrender the same at the end of the Lease term or any extension thereof in
substantially as good condition as when received, ordinary wear and tear, damage
by fire or the elements and unavoidable casualties excepted. Lessee shall keep the
grass mowed and trimmed around the building.
DESTRUCTION OF PREMISES
Should any building or improvements on the leased premises be damaged or
destroyed by fire, the elements, acts of God, or other causes not the fault of Lessee

of Lessee, they shall be repaired or replaced by Lessor at his own cost and expense
and the rent payable by Lessee pursuant to this lease shall be abated to the extent
such damage or destruction renders the leased premises uninhabitable by Lessee.
Provided however, should the cost of repairing or restoring any buildings or
improvements so damaged or destroyed exceed twenty-five percent (25%) of the
replacement cost of all buildings and improvements now located on the leased
premises, or if more than fifty percent (50%) of the total floor space of the leased
premises shall be rendered unfit for Lessee's occupancy this lease may be terminated
by either party by ten (10) days written notice. If less than fifty percent (50%) of
the total floor space of leased premises shall be uninhabitable and repair and
restoration can be accomplished within ninety (90) days, Lessor may, at his option,
either repair and restore the damaged buildings and improvements or cancel this
lease and return any unearned rent previously paid by Lessee under this lease.
CONDITION OF PREMISES
Lessee stipulates that the leased premises, as well as all building and
improvements located thereon, are at the date of this lease in good order, repair and
a safe and clean conditian.
UTILITIES
All charges for electricity, water and other utility services shall be paid by
Lessee.
IMPROVEMENTS PROPERTY OF LESSOR
All alterations, changes, and improvements built constructed, or placed in the
leased premises by Lessee, other than movable personal property shall, unless
otherwise provided by written agreement between Lessor and Lessee, be the
property of Lessor and remain in the leased premises at the expiration or sooner

termination of this lease. Lessee at the termination of the lease shall not be required
to restore the improvements to their original condition. Nothing contained in this
paragraph, however, shall authorize Lessee to make or place any such alteration,
change, or improvements on the leased premises without having first obtained the
written consent of Lessor.
ASSIGNMENT AND SUBLETTING 01
Lessee shall not assign this lease nor sublet the leased premises or any
interest therein without first obtaining the written consent of Lessor, which consent
shall not be unreasonably withheld. A consent by Lessor to one assignment or
subletting shall not be deemed to be a consent to any subsequent assignment or
subletting. An assignment or subletting without the written consent of Lessor, shall
be void and shall, at the option of the Lessor, terminate the lease.
LESSEE'S RIGHT TO PERFORM
In the event Lessor violates or fails to perform any provisions or agreements
of the lease to be performed or complies with by Lessor, and such violation or failure
continues for fifteen (15) days after written notice thereof to Lessor, Lessee may,
in addition to all remedies available to it, be entitled to perform on behalf of Lessor
and deduct all such payments from the rent.
DEFAULT BY LESSEE
Should Lessee be in default for a period of more than ten (10) days in the
payment of any rent payable under this lease or in the performance of any other
provision of this lease and such default continues for thirty (30) days after written
notice, Lessor may terminate this lease and regain possession of the leased premises
in the manner provided by the laws of the State of Texas in effect at the date of such
default.

HOLD OVER
At the expiration of this lease, should Lessee hold over for any reason
whatsoever, it is hereby agreed that in the absence of a written agreement to the
contrary, such tenancy shall be from month to month only under the same conditions
and at the same monthly rental as provided herein.
SUBORDINATION OF LEASE
This lease and Lessee's leasehold interest under this lease are and shall be
subject, subordinate, and inferior to any lien or encumbrance now on the leased
premises by Lessor.
RIGHT OF INSPECTION
Lessor and his agents have the right at all reasonable times during the terms
of this lease to enter the leased premises for the purpose of inspecting them and all
building and improvements thereon; provided however that the right of inspection
shall riot extend to any record, the disclosure of which is prohibited by law.
PARKING
Ample space will be provided for parking vehicles.
NOTICES
Any and all notices or other communication required or permitted by this lease
to be served on or given to either party to this lease by the other party hereto shall
be in writing and shall be deemed duly served and given when personally delivered
to the party to whom it is directed, or in lieu of such personal service, when
deposited in the United States Mail, postage prepaid, addressed to Lessor, Fred
Keller, at 8032 East State Highway 21, Bryan, Texas 77803, addressed to Lessee,
Brazos County, 300 East 26th Street, Bryan, Texas 77803-5317 until otherwise
notified. Either party hereto may change his address for the purpose of this
paragraph by giving written notice of such change to the other party in the manner

provided for in this paragraph.
USE OF OFFICES
The leased premises are to be used as office space for the Justice of the Peace
for Precinct Three (3) of Brazos County.
LOCATION FOR RENT PAYMENT
Unless changed by written notice pursuant to the provisions in the above
heading under Notices, all rent payable under this lease shall be paid to Lessor at
8032 East State Highway 21, Bryan, Texas 77806.
ATTORNEY'S FEES
Should any litigation be commenced between the parties hereto concerning the
leased premises, this lease, or the rights and duties of either party in relation
thereof, the party prevailing in such litigation shall be entitled, in addition to such
relief as may be granted, to a reasonable sum as and for his attorney's fees in such
litigation.
TEXAS LAW TO APPLY
This agreement shall be construed under and in accordance with the laws of
the State of Texas, and all obligations of the parties created hereunder are

LEGAL CONSTRUCTION
In case any one or more of the provisions contained in the agreement shall for
+ any reason be held to be invalid, illegal or unenforceable it shall not affect any other
provision thereof and this agreement shall be construed as if such invalid, illegal or

AGREEMENT of Lease, made this the - day of October, 1996, by and
between JANIE MOORE, (called "Lessor"), and BRAZOS COUNTY, TEXAS, acting
by and through it duly elected Commissioners Court (called "Lessee").
1. DEMISED PREMISES: LESSOR, for and in consideration of the covenants
and considerations hereinafter contained on the part of the Lessee to be performed,
and in consideration of the rental hereinafter reserved, does hereby grant, lease
demise, and let unto LESSEE, and LESSEE does hereby rent and take from LESSOR,
a parcel of land in Brazos County, Texas described as follows, to wit:
Being a one (1) acre tract or parcel of land lying and being situated in
the E. Seale Survey, Abstract No. 224, Tract 8 Brazos County, Texas
located approximately 300 feet in an easterly direction along the
southwest right-of-way line of FM 2038 from the most southerly right-
of-way line of Dilly Shaw Tap Road.
2. USE: LESSOR agrees that LESSEE may use the premises for the purpose
of operating a Citizens' Collection Station for the collection of non-hazardous waste .
material, plastic, glass, aluminum, appliances, yard waste, household waste and
such other items as LESSEE deems proper and consistent with its recycling program.
The waste shall be collected and stored on the premises in compliance with all federal
and state laws and regulations until such time as it can be hauled off the premises
by the LESSEE, its agent, employees or subcontractor for ultimate disposal off site
(said disposal to comply will all federal and state laws and regulations.
3. TERMS: This Lease shall be effective from the date first above set forth.
It is agreed and understood that this lease may be terminated by either party by the
giving to either party written notice of intention to do so, in which event the term
of this lease shall end.
4. RENT: Rent shall accrue during the original term from and after the
commencement date of this Lease and shall be payable by LESSEE to LESSOR at

CHILD WELFARE BOARD CONTRACT
Contract No.

The Texas Department of Protective and Regulatory Services, formerly known as the Texas Department of Public
Welfare and/or the Texas Department of Human Resources and/or the Texas Department of Human Services,
hereinafter referred to as the Department, and the Commissio r ' Court of Brazos County, hereinafter referred to
as the County, initiated a contract effective September to establish a child welfare board contract to
administer a county wide, jointly financed, state administered and regionally operated child welfare program to
meet the need of children in the county in need of protectiv services. This contract has continued without a break
until present. ;
With this document, the Texas Department of Protective and Regulatory Services and the County agree to continue
the child welfare board and revise the contract to change the contract number and update terminology. This contract
is entered into under the authority of §40.058 of the Human Resources Code and is not an agreement under Ch. 771
of the Government Code.

The County agrees:
A. To continue a Child Welfare Board, hereinafter referred to as the Board, as set out by statute in The Texas
Family Code §264.005
B. That the Board will consist of not less than seven nor more than fifteen persons appointed by the County
Commissioners' Court. Each member will serve a three-year term on a rotating basis. Initially, the appointees
will be designated to serve the following terms: 1/3 of the members appointed to three-year terms; 1/3 of the
members to a two-year term; and 113 of the members to a one-year term. In successive years, from two to five
new members will be appointed. Members shall serve at the pleasure of the Commissioners' Court. Members
serve without compensation.
C. To continue to provide adequate funding for the care of any child in need of protective placement who is under
the conservatorship of the Department, and who is ineligible for Title IV-E foster care or state-paid foster care
and/or Medicaid.
D. To provide adequate funds for medical care not covered by Title XIX (Medicaid) and for children not Medicaid
eligible.
III.
The Board required under Article 11, Section A, of this contract shall have and exercise such lawful authority, duties
and responsibilities as conferred upon it by statute, the Department and the County. The Department and the
County agree that the Board will have the following duties:
A. Serve in an advisory capacity to the county in the development of local policy to mat the needs of the children
in Brazos County covered under this contract.

IV.
A. To seek Title XIX Medicaid coverage within the amount, duration, and scope of the Medicaid program as
defined by the state agency responsible for administration of these funds, for any child eligible for Title IV-E
foster care or state-paid foster care and who is eligible for Medicaid benefits.
B. To receive and expend children's personal funds (SSI, SSA, child support, etc.), in accordance with the needs
of each child and state and federal laws and reprlations. for children in the Department's conservatorship.
V.
The Parties mutually agree-
A. That this mutually undertaken child welfare program must meet state licensing and/or certification standards for
child-caring and child-placing activities as a condition to continuation of this contract.
B. To comply with Title VI of the Civil Rights Act of 1964 (Public Law 88-352), Section 504 of the Rehabilitation
Act of 1973 (Public Law 93-112), The Americans with Disabilities Act of 1990 (Public Law 101-336), and all
amendments to each, and all requirements imposed by the regulations issued pursuant to these acts. In addition,
the County agrees to comply with Title 40, Chapter 738, of the Texas Administrative Code. These provide in
part that no persons in the United States shall, on the grounds of race, color, national origin, sex, age, disability,
political beliefs or religion be excluded from participation in, or denied, any aid, care, service or other benefits
provided by federal and/or state funding, or otherwise be subjected to discrimination. The County further
agrees to comply with Texas Health and Safety Code Section 85.113 (relating to work place and confidentiality
guidelines regarding AIDS and HIV).
C. That there shall be an annual review of this contract conducted to consider any appropriate changes.
D. That the term of this contract shall be for a period beginning on the effective date of this contract and it shall
terminate at such time as the federal, state, or county governments cease to participate in the program, by
mutual consent of all parties hereto, or upon breach of the contract by one of the parties hereto. If mutual
consent cannot be attained, either party to this contract may consider it canceled by giving thirty (30) days
notice in writing to the other party, and this contract shall thereupon be canceled upon the expiration of such
thirty (30) day period. It is further agreed and understood that in the event the federal or state laws or other
requirements should be amended or judicially interpreted so as to render fulfillment of this contract on the part
of either party unfeasible or impossible or if the Department and the County should be unable to agree upon
modifying amendments which would be needed to enable substantial continuation of the program as a result of
such amendments or judicial interpretations, then, and in that event, the Department and the County shall be
discharged from further obligation created under the terms of this contract, except for the equitable settlement
of the respective accrued interests or obligations incurred up to the date of termination.
